ORD 361 Amend Zoning DesignationsAttachment A - Staff Option CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA ORDINANCE NUMBER 361 AN ORDINANCE AMENDING ORDINANCE NO. 401 The City Council of the City of Mendota Heights does hereby ordain as follows: SECTION 1 Municipal Ordinance No. 401, commonly known as the City Zoning Ordinance, is hereby amended to amend Section 13.1(2) to read as attached: 13.1(2) The Planned Unit Development District will be comprised of four types of zoning designations: SECTION 2 Municipal Ordinance No. 401, commonly known as the City Zoning Ordinance, is hereby amended to add Section 13.1(2)d to read as attached: 13.1(2)d MU-PUD, Mixed-Use, Planned Unit Development District: This district is intended to provide the opportunity to develop a Planned Unit Development with mixing of residential and non-residential uses. All of the permitted, conditional, and accessory uses contained in the R-2, R-3, B-1, and B-2 Zoning Districts shall be treated as potentially allowable uses within the MU-PUD District, provided they would be allowable on the site under the Comprehensive Plan. The City Council shall have the authority to approve other uses in the MU-PUD District by special permit. SECTION 3 Municipal Ordinance No. 401, commonly known as the City Zoning Ordinance, is hereby amended to amend Section 13.2(2) to read as attached: 13.2(2) In a residential Planned Unit Development District the number of dwelling units proposed for the entire site shall not exceed the total number permitted under the density control provisions of the equivalent standard Zoning District. The HR-PUD District will use the standards of the R-3 Zoning District as a guide; the MR-PUD District will use the standards of the R-2 District as a guide. If the residential Planned Unit Development is in more than one (1) zoning district, the number of allowable dwelling units must be calculated separately for each portion of the Planned Unit Development that is in a separate zone, and must then be combined to determine the number of dwelling units allowable in the entire Planned Unit Development. The density of individual uses in the MU-PUD District may be guided by the standard Zoning District for each use. The City Council shall have the authority to determine the allowed density based on the quality and components of the Planned Unit Development. Said density may be lesser or greater than that prescribed by the standard Zoning District(s) at the discretion of the Council.
