ORD 362 Amend Zoning Residential ProgramsCITY OF MENDOTA HEIGHTS
DAKOTA COUNTY, MINNESOTA
ORDINANCE NUMBER 362
AN ORDINANCE AMENDING ORDINANCE NO. 401
The City Council of the City of Mendota Heights does hereby ordain as follows:
SECTION I Municipal Ordinance No. 401, commonly known as the City Zoning
Ordinance, is hereby amended to add Section 14.2(13) and 14.2(14) to
read as follows:
14.2(13) Residential programs for treatment of chemically dependent adults. In
reviewing a conditional use pen-nit for such a facility the City Council
shall consider the following:
1. the program shall at all times hold and be entitled to a valid license
from the Minnesota Department of Human Services
2. no more than ten (10) adults shall reside at the facility;
3. all residents shall be of the same gender;
4. twenty-four (24) hour supervision shall be provided for all
residents;
5. no person whose residency is imposed by court order shall be
allowed to reside at the facility;
6. no resident's stay shall exceed thirty (30) days within one year
commencing with the resident's first day of admission, and no more
than 3 such admissions shall be permitted during said year;
7. adequate water, sanitary sewer, and parking shall be as necessary
for the facility and
8. any additional conditions the City Council shall determine to be
necessary to assess the specific impact of a proposed facility.
9. those admitted shall have the primary diagnosis of chemical
dependency
10. residential treatment facilities shall be housed in buildings that
serve no other purpose
14.2(14) Violation: Failure to comply with any condition imposed in granting
the Conditional Use Permit shall be a default provision for which the
City Council may, upon proper notice and hearing, terminate the
Conditional Use Permit.
