ORD 364 Amend Zoning Town Center RedvlpCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 364 AN ORDINANCE AMENDING ORDINANCE NO. 401 The City Council of the City of Mendota Heights does hereby ordain as follows: SECTION 1 Ordinance No. 401 known and referred to as "Mendota Heights Zoning Ordinance" is hereby amended in the following respects: The following land is to be rezoned to MU -PUD and subject to the same restrictions pertaining to all other MU -PUD zones: All properties within the boundaries of the City of Mendota Heights Town Center Redevelopment Area, located northeast of the intersection of Dodd Road and Highway 110, and described in City of Mendota Heights City Council Resolution No. 01 -38, Exhibit A, dated July 10, 2001, including the following: 1. Parcel 1-A Legal Description: Lot 2, Block 1, Birch Addition (PIN: 27-13900-020-01) 2. Parcel Legal Description: That part of new State Trunk Highway No. 49 lying between the easterly extension of the north line and the easterly extension of the south line of the described tract: That part of the Northwest Quarter (NW 1/4) of Section 25, Township 28 North, Range 23 West, lying West of the Westerly Right of Way line of the new State Trunk Highway No. 49, South of Freeway Road, North of the Northerly Right of Way line of State Trunk Highway No. 110 and Easterly of the Easterly line of Eisness Addition, all in said N W 1/4 of Section 25, Township 28, Range 23. 3. Parcel 2x Location Description: That portion of land generally lying between the northern boundary of Lots 6 and 5, Block 3, Mortenson's Addition and the southern boundary of Lots 2 and 3, Block 1, Eisness Addition. 4. Parcel 3 Legal Description: Lots 1, 2, 3, 4, 5 and 6, Block 5, Jefferson Heights, except that part of Lot 4, Block 5, Jefferson Heights, which lies southeasterly of the following described line: Beginning at the Northeast comer of said Lot 4; thence run southwesterly to a point on the south line of said Lot 4, distant 30 feet West of the southeast comer thereof, and there terminating. Parcel 3x Location Description: That portion of land lying between the northern boundary of Parcel 3, described above and the south line of Rolling Woods Second Addition as platted and monumented, said gap being approximately 3.8 feet wide. 6. Parcel 5B Legal Description: Lots 10 and 11, Block 2, Mortensen's Addition (PIN: 27-49250-100-02 and 27-49250-110-02) 7. Parcel 5C Legal Description: Lots 12 and 13, Block 2, Mortensen's Addition (PIN: 27-49250-120-02 and 27-49250-130-02) 8. Parcel 5x Location Description: Area located between Lot 1, Block 3 and Lot 13, Block 2, Mortensen's Addition as depicted on plat of Mortensen's Addition. 9. Parcel 5D Legal Description: Lots I through 6, inclusive, Block 3, Mortensen's Addition (PIN: 27-49250-010-03, 27-49250-020-03, 27-49250-030-03, 27-49250-040-03, 27-49250-050-03, 27-49250-060-03) 10. Parcel 6 Legal Description: Lot 2, Block 1, Eisness Addition (PIN: 27-23370-020-01) 11. Parcel? Legal Description: Lot 3, Block 1, Eisness Addition (PIN: 27-23370-030-01) 12. Parcel 8 Legal Description: That part of the Southwest Quarter of the Northwest Quarter of Section 25, Township 28, Range 23, described as follows: Commencing at the intersection of the center line of Dodd Road with the east and west quarter line in said Section 25; thence east along said east and west quarter line in Section 25, 442.19 feet; thence north 240 feet; thence west 298.19 feet to center line of Dodd Road; thence southwesterly along said center line 280 feet to place of beginning; less the following described tract: Beginning at a point on the center line of Dodd Road 208.3 feet northeasterly from where said center line intersects the east and west quarter line of Section 25; thence east parallel to said east and west quarter line and 180 feet distant from it, 198.96 feet; thence north at right angles 60 feet; thence west and parallel to the east and west quarter line, 164.04 feet to center line of Dodd Road; thence southwesterly along said center line 69.42 feet to place of beginning. Parcels 3-A, 4, 9 and 10 Properties owned by the City of Mendota Heights located within the City of Mendota Heights Town Center Redevelopment Area and identified as Parcels 3- A, 4, 9, and 10 in City of Mendota Heights City Council Resolution 01 -38, Exhibit A, dated July 10, 2001. More commonly, these properties are collectively known as the City of Mendota Heights Town Center Redevelopment Area, located northeast of the intersection of Dodd Road and Highway 110. SECTION 2 This Ordinance shall be in ftill force and effect from after its publication according to law. Enacted and ordained into an Ordinance this Seventh day of August, 2001.
