ORD 388 Establish Fees and Escrow Acct RequirementsCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 388 AN ORDINANCE ESTABLISHING FEES AND ESCROW ACCOUNT REQUIREMENTS The City Council of the City of Mendota Heights hereby ordains as follows: SECTION 1. FEES Except as otherwise stated in this code, the fees for the various licenses, permits, services and functions rendered shall be as set forth in an appendix to this chapter. SECTION 2. ESCROW ACCOUNTS (A) When it is determined by the city that the complexity or size of a project, subdivision, rezoning, conditional use permit or plat will necessitate the outside review or involvement of consultants to the city, a cash escrow may be required. (B) An escrow agreement will be prepared stating the amount required to be deposited, the maruzer in which fiinds will be disbursed, the manner in which exhausted funds will be replenished and the manner in which unexpended finds will be refiinded. The initial deposit of funds shall be based on the type or magnitude of the project as follows: (1) Privately installed municipal improvements. The cash escrow shall represent 17% of the City Engineer's estimate of project cost. (2) Privately installed or privately owned improvements. The cash escrow shall represent 6% of the City Engineer's estimate of project cost. (3) Legal Work. The cash escrow shall represent at least the equivalent of three hours of legal work, at the then current rate charged by the city's attorneys. SECTION 3. MUNICIPAL PLANNING FEES The city may prescribe fees sufficient to defray the costs incurred by it in reviewing, investigating and administering an application for an amendment to an official control or an application for a permit or other approval required under an official control established pursuant to M.S. Chapter 462. All fees shall be as set forth in a rate schedule duly adopted by the City Council. The term "official control" has the meaning as set forth in M.S. Chapter 462. SECTION 4 This ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an ordinance this 6th day of January, 2004. The building official may authorize refunding of not more than 80 percent of the plan review fee paid when an application for a permit for which a plan review has been paid is withdrawn or canceled before any plan reviewing is done. The building official shall not authorize refunding of any fee paid except on written application filed by the original permittee not later than 180 days after the date of fee payment. * *$15 or 1% of cost of improvement, whichever is greater, if it does not require modification to electric or gas service, has a total cost of $500 or less, excluding fixture or appliance cost, and if it is improved, installed or replaced by the home owner or a licensed contractor. CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 387a AN ORDINANCE AMENDING TITLE 6, CHAPTER 3, SECTION 3 OF THE CITY CODE The City Council of the City of Mendota Heights, Minnesota ordains as follows: The following streets are hereby added to paragraph C of the City Code: Parking prohibited on Certain Streets: No person shall park or leave standing any motor vehicle on the following streets or portions thereof in the City: Street Side Location Mendota Heights Road North Beginning at the east line of 1031 Mendota Heights Road's driveway and extending to the east 150 feet Adopted and ordained into an Ordinance this 0' day of November 2003.
