ORD 412 Amend Liquor CodeCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 412 AN ORDINANCE AMENDING TITLE 3 CHAPTER 1 OF THE CITY CODE The City Council of the City of Mendota Heights, Minnesota ordains as follows: SECTION 1 City Code Title 3 Chapter 1, Alcoholic Beverages, is hereby amended in the following respects: A. Section 3 -1 -3 is hereby amended so that as amended it shall read as follows with respect to the definitions of Exclusive Liquor Store and Minor: 3 -1 -3: DEFINITIONS: EXCLUSIVE LIQUOR STORE: An establishment used exclusively for the sale of intoxicating liquor, except for the incidental sale of 3.2 percent malt liquor, ice, and tobacco products, subject to the provisions of applicable city licensing ordinances, beverages, either liquid or powder, specifically designated for mixing with intoxicating liquor, soft drinks, liqueur filled candies; food products that contain more than one -half of one percent (0.5 %) alcohol by volume; cork extraction devices; books and videos on the use of alcoholic beverages; magazines and other publications published primarily for information and education on alcoholic beverages; and home brewing equipment. MINOR: Any person who has not attained the age of twenty one (21) years. With respect to purchasing, possessing, consuming, selling, furnishing, and serving alcoholic beverages, a person is not 21 years of age until 8:00 a.m. on the day of that person's 21st birthday. B. Section 3 -1 -5 is hereby amended so that as amended it shall read as follows: 3 -1 -5: TYPES OF LICENSES; EXEMPTIONS: 2. On -Sale Wine Licenses: On -sale wine licenses shall be issued only to restaurants having facilities for seating not fewer than fifty (50) guests at one time, and shall permit only the sale of wine and shall not permit the sale of any other intoxicating liquor, for consumption on the licensed premises only, in conjunction with the sale of food. A holder of an on -sale wine license issued pursuant to this ordinance who is also licensed to sell 3.2 percent malt liquors at on -sale and whose gross receipts are at least 60 percent attributable to the sale of food shall be permitted to sell intoxicating malt liquors at on -sale without an additional license. c. Section 3 -1 -14 is hereby amended so that as amended it shall read as follows: 3 -1 -14: CONDITIONS OF LICENSE: F. Consumption On Approved Licensed Premises: Consumption of on sale alcoholic beverages is allowed only in the approved licensed premises. A restaurant licensed to sell intoxicating liquor or wine at on -sale under this section may permit a person purchasing a full bottle of wine in conjunction with the purchase of a meal to remove the bottle on leaving the licensed premises provided that the bottle has been opened and the contents partially consumed. A removal of a bottle under the conditions described in this subdivision is not an off -sale of intoxicating liquor and may be permitted without additional license. C.
