ORDINANCE NO. 414
AN ORDINANCE AMENDING TITLE 7 CHAPTER 2
OF THE CITY CODE
The City Council of the City of Mendota Heights, Minnesota ordains as follows:
SECTION 1 City Code Title 7, Chapter 2, Fire Code, is hereby amended in the following
respects:
A. Section 7 -2 -1 is hereby amended in its entirety so that as amended it shall read as follows:
7 -2 -1: CODE ADOPTED: A certain document, three (3) copies of which are on file
in the office of the City Clerk of Mendota Heights, being marked and designated as
the International Fire Code, 2006 edition as amended by Minnesota Rules
7511.0010 though and including 7511.3800 as published by the International Code
Council, be and is hereby adopted as the Code of the City of Mendota Heights in the
State of Minnesota regulating and governing the safeguarding of life and property
from fire and explosion hazards arising from the storage, handling, and use of
hazardous substances materials and devices, and from conditions hazardous to life
or property in the occupancy of buildings and premises in the City of Mendota
Heights as herein provided; and each and all of the regulations, provisions,
conditions and terns of said International Fire Code on file in the office of the City
Clerk are hereby referred to, and adopted, and made part hereof, as fully set out in
this ordinance, with the additions, insertions, deletions, and changes in the following
sections of this ordinance.
B. Section 7 -2 -2 is hereby amended in its entirety, so that as amended it reads as follows:
7 -2 -2: AMENDMENTS:
A. Section 105 (permits) is hereby deleted.
B. Chapter 9 of the Minnesota State Fire Code is amended to read: Fire
extinguishers are required at the following locations: MULTIPLE
DWELLINGS- located so that no person shall travel in excess of fifty(50)feet to
reach a fire extinguisher of a 2A -1OBC rating. ABC extinguishers shall also be
provided for boiler, furnace, or electrical rooms. RETAIL AND COMMERCIAL
ESTABLISHMENTS• an ABC extinguisher with a minimum size of 2A -20BC
rating shall protect all boiler rooms, furnace, and electrical rooms.
C. Section 907.15 of the International Fire Code, 2006 edition, is amended by
adding a new subsection which shall read as follows: When a fire system is
required to be monitored by the International Fire Code, it shall be monitored by
an Underwriters Laboratory (UL) listed central monitoring station.
D. Section 3308 of the International Fire Code, 2006 addition, is amended by adding
a new section 3308.12 to read as follows: Indoor sales of fireworks shall be
restricted to buildings or structures with an approved, fully automatic fire -
sprinkler system. Outdoor sales of fireworks is prohibited.
C. Section 7 -2 -4 is hereby amended in its entirety, so that as amended it reads as follows:
7 -2 -4: INTERPRETATION: In the event of a conflict between the provisions of the
Minnesota State Fire Code, 2006 edition, and the provisions of this code, the more
stringent shall apply. Provided, however, that no provision of this code shall be
interpreted to exceed the provisions of the Minnesota State Building Code, 2006
edition, as amended.
D. Section 7 -2 -513 is hereby amended in its entirety, so that as amended it reads as follows:
B. Any person aggrieved by a written order pursuant to Section 108.1 of the State
Fire Code may, within 15 days after service of said notice, appeal therefrom to
the Board of Appeals by filing a written notice of appeal with the City Clerk. The
appeal shall be heard at such time as may be established by the board, The City
Council of the City of Mendota Heights shall serve as and constitute the Board of
Appeals. The Board may, upon the hearing, affirm in whole or in part or deny the
existence of a violation. Pending decision of the Board of Appeals, the order of
the Code Official shall be stayed unless there is an immediate fire hazard to life
or property.
E. Section 7 -5 -10 is hereby added to read as follows:
7 -5 -10: FIRES OR BARBECUES ON BALCONIES OR PATIOS.
A. In any structure containing two or more vertically stacked residential units, no
person shall kindle, maintain, or cause any fire or open flame on any balcony
above ground level, or on any ground floor patio immediately adjacent to or
within fifteen (15) feet of any unit.
B. No person shall store any fuel, barbecue, torch or similar heating or lighting
chemicals or devices in either of the places cited in 9.1.
C. Use of Liquefied petroleum gas on balconies or patios as described in 9.1 or
storage in basement shall be prohibited.
D. Exception: Listed electric or gas -fired barbecue grills that are permanently
mounted and wired or plumbed to the building's gas supply or electrical system
and that maintains a minimum clearance as required by the Manufacturer and
when approved by the Code Authority.
SECTION 2 This Ordinance shall be in full force and effect from and after its
publication according to law.
