ORDINANCE NO. 424
AN ORDINANCE AMENDING TITLE 12, CHAPTER 1 OF THE
CITY CODE, THE CITY'S ZONING ORDINANCE, TO ALLOW RETAIL SALES AS A
CONDITIONAL USE IN THE I, INDUSTRIAL DISTRICT
The City Council of the City of Mendota Heights, Minnesota ordains as follows:
SECTION 1 Section 12 -1G -1 of the Mendota Heights Zoning Ordinance (I District
Conditional Uses) is hereby amended to add the following:
Accessory, enclosed retail sales, provided that:
1. Accessory Use: The retail sales portion of the business shall be an accessory use to
the existing permitted or conditionally- permitted use in the I- Industrial District.
2. Site Requirements: The retail sales portion of the business shall be conducted
within the same building as the principal use.
3. Building Requirements: The retail sales portion of the business shall not constitute
more than five percent (5 %) of the gross floor area of the principal use.
4. Building Design: The building design shall be in compliance with Section 12- 1D -13-
2C.
5. Parldng• Adequate off - street parlung and off - street loading shall be provided and
shall be in compliance with the provisions of Section 12 -1G -5 and 12 -1J -1 of this
ordinance.
6. Signage: All signage shall be in compliance with the provisions of Section 12 -0-5.
Separate wall signage may be considered at the retail entrance, but no separate
freestanding signage shall be considered.
7. Landscaping: All landscaping shall be in compliance with Section 12- 1D- 13 -2D, 12-
1G -6, and 12 -1I -9.
8. Screening: All screening shall be in compliance with Section 12- lD- 13 -2.E, 12 -1G -6,
and 12 -1I -9.
9. Hours of Operation: The hours of operation of the retail sales portion of the
business shall be limited from 8 AM to 5 PM.
SECTION 2 This Ordinance shall be in full force and effect from and after its publication
according to law.
Adopted and ordained into an Ordinance this 1st day of September, 2009.
