Res 2011- 77 Variance 667 First AveA RESOLUTION APPROVING A TWO FOOT VARIANCE TO THE FRONT
YARD SETBACK FOR A COVERED FRONT PORCH AT 667 FIRST AVENUE
WHEREAS, Robert and Dianne Sullwold have applied for a variance to the front
yard setback for a covered front porch at 667 First Avenue (PID: 27- 69702 - 131 -05, Lot
12 and W 20 feet of Lot 13, Block 5, T.T. Smith Subdivision No. 3) as proposed in
planning case 2011 -23; and
WHEREAS, the Mendota Heights Planning Commission held a public hearing
on the matter on August 23, 2011; and
WHEREAS, the commission, at their August 23, 2011 meeting, recommended
that the city council deny the variance to the front yard setback for a front porch at 667
First Avenue South; and
WHEREAS, the applicant has revised the site plan in response to planning
commission feedback; and
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City
Council that a two foot variance to the front yard setback as requested in planning case
2011 -23 is hereby approved with the following findings of fact:
1. Covered front entry is allowed by code as a conditional use permit
2. The revised project meets all requirements of the conditional use permit and is
a reasonable use of property.
3. The revised project fits with the character of the neighborhood and the single
family zoning district.
Adopted by the City Council of the City of Mendota Heights this sixth day of September
2011.
