Res 2011- 67 CUP 2242 Lexington AveRESOLUTION 2011 -67 t 1 DI 1 �1 WHEREAS, Paul Elias has applied for a conditional use peps t to construct a detached garage at 2242 Lexington Avenue (PID 27- 16400 -00 -054, S 70 FT OF N 440 FT OF LOT 5) as proposed in planning case 2011 -11; and WHEREAS, the Mendota Heights Planning Commission held a public hearing on this application at their regular meeting on May 24 and tabled that hearing until June 28, 2011; and WHEREAS, the commission recommended that the council approve the conditional use permit as shown in planning case 2011 -11. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use permit as proposed in planning case 2011 -11 is hereby approved with the following finding of fact: 1. The proposed structure is consistent with the intent of the conditional use permit clause allowing detached garages. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the approval is subject to the following conditions: 1. The garage shall not exceed 15 feet in height. 2. The garage matches the principal building in color and show compatibility in materials. 3. The applicant consider matching the garage's roof style and roof pitch with that of the principal building. 4. The existing detached accessory structure on the site be removed and re- established in turf and/or pavement as a part of this project. 5. Nothing shall extend beyond the footprint of the building. 6. The structure shall not be used as an occupied dwelling primarily for human habitation.
