Res 2011- 50 Vacate a Utility Easement L6 Bl1 Mendota Plaza ExpansionCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2011 -50 A RESOLUTION VACATING A UTILITY EASEMENT AT LOT 6 BLOCK 1, MENDOTA PLAZA EXPANSION WHEREAS, a Planned Unit Development for the Mendota Plaza Expansion, located between Trunk Highway 110, Trunk Highway 149 (Dodd Road), South Plaza Drive, and the Dodge Nature Center, was approved by City Council; and WHEREAS, the plans of the Planned Unit Development for the Mendota Plaza Expansion identified the relocation of utility lined running north from South Plaza Drive; and WHEREAS, the specified utilities have been relocated as part of the initial phase of the Mendota plaza Expansion construction; and WHEREAS, a public hearing to consider the vacation of such street was held on the 21St day of June, 2011, before the City Council in the City Hall located at 1101 Victoria Curve at 7:00 p.m. after due published and posted notice had been given, and all interested and affected persons were given an opportunity to voice their concerns and be heard; and WHEREAS, pursuant to Minnesota Statute Section 412.851, the City of Mendota Heights sees no foreseeable use for the original utility easement area as recorded at Dakota County under. Easement Document Numbers 374891, 374892, and 432907. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, that vacation is hereby granted and the portion of utility easement described as follows is hereby vacated: A 30.00 foot wide easement over that part of Lot 6, Block 1, MENDOTA PLAZA EXPANSION, Dakota County, Minnesota, the centerline being described as follows: Commencing at the southwest corner of said Lot 6; thence North 89 degrees 51 nimutes,28 seconds East, assumed bearing along the south line of said Lot6, a distance of 103.29 feet; thence 18.21 feet northeasterly along a tangential curve concave to the north with a radius of 3 75. 00 feet and a central angle of 02 degree 46 minutes 54 seconds to the point of beginning of the centerline to be described; thence North 02 degrees 44 minutes 48 seconds West, a distance of 275.64 feet to the northwesterly line and there terminating. The sidelines of said easement are extended or shortened to terminate on the south and northwesterly lines of said lot. BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized to sign all documents necessary to effectuate the intent of this resolution.
