RESOLUTION 2011-45
A RESOLUTION APPROVING A CONDITIONAL USE PERM[IT FOR
PARTICIPATIVE ATHLETICS AT 2535 PILOT KNOB ROAD.
WHEREAS, Patrick Costello has applied for a conditional use permit for
participative athletics at 2535 Pilot Knob Road (PID 27-16300-01-040, Lot 4, Block I
Carew Business Center and PID 27-16300-01-030 Lot 3, Block I Carew Business
Center) as proposed in planning case 2011-12; and
WHEREAS, the Mendota Heights Planning Commission held a public hearing
on this application at their regular meeting on May 24, 2011; and
WHEREAS, the commission recommended that the council approve the critical
area permit as shown in planning case 2011-12.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City
Council that a conditional use pen-nit as proposed in planning case 2011-12 is hereby
approved with the following findings of fact:
1. The use will be consistent with current and future land uses in the area.
2. The use complies with zoning ordinance performance standards.
3. The use can be accommodated with existing public services, such as roads,
sewers, water, etc.
4. That the use will not tend to depreciate property values in the area.
5. Hours of operation shall be from 5:00 a.m. to 12:00 p.m. (midnight).
Adopted by the City Council of the City of Mendota Heights this seventh day of June
2011.
