Res 2011- 44 CAP 1040 Sibley Memorial HwyRESOLUTION 2011 -44 WHEREAS, Beverly Sargent has applied for a critical area permit for a privacy fence at 1040 Sibley Memorial Highway (PID 27- 47500 -00 -010; Lot 1 Mayfield Heights) as proposed in planning case 2011 -10; and WHEREAS, the Mendota Heights Planning Commission held a public hearing on this application at their regular meeting on May 24, 2011; and WHEREAS, the commission recommended that the council approve the critical area permit as shown in planning case 2011 -10. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a critical area permit for a privacy fence as proposed in planning case 2011- 10 is hereby approved with the following findings of fact: 1. The proposed fence will have little or no visual impact on the critical area or surrounding property. 2. The fence will create no issues for grading or erosion. 3. The fence is proposed to have minimal impact on the land as it does not involve landscaping, paving, grade changes, soil loss, or altering of slopes. 4. The proposed fence is to be constructed of natural wood material, consistent the requirements of the Critical Area Ordinance and guiding documents. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the approval is subject to the following conditions: 1. The applicant confirms that the fence project shall not involve landscaping, paving, grade changes, soil loss, or slope alteration. 2. The applicant shall receive a fence permit. 3. The fence shall meet the regulations established in Section 12 -1D -6, including the 30% open design requirement. 4. The applicant shall pay all code enforcement and permit fees associated with the project. Adopted by the City Council of the City of Mendota Heights this seventh day of June 2011.
