RESOLUTION 2011 -31
1. The proposed deck falls within the exemptions in the Critical Area Ordinance,
specifically providing for such construction on slopes greater than 18 %.
2. The proposed deck will not have any visual impact on views to or from the river.
3. The construction will not jeopardize the aesthetic integrity and natural
environment of the Mississippi Critical Area.
4. The construction will not impact the soils or vegetation on the property.
5. The approval standards for the Critical Area Overlay District are being met.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the
approval is subject to the following conditions:
1. Development is not to increase the rate of runoff. The applicants should verify
the construction of the deck to demonstrate the deck permits rainwater to flow
through to the existing ground.
2. Applicants shall obtain a building pen-nit prior to commencing construction, and
all construction activities must follow the Land Disturbance Guidance document.

A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR A DECK
ADDITION AT 1230 CULLIGAN LANE
WHEREAS, Norbert and Sandra Krebsbach have applied for a critical area
permit for a deck addition at 1230 Culligan Lane (PlD 27- 81250 -01 -150; Lot 15 Block 1
Valley View Oak) as proposed in planning case 2011 -08; and
WHEREAS, the Mendota Heights Planning Commission held a public hearing
on this application at their regular meeting on April 26, 2011; and
WHEREAS, the commission recommended that the council approve the critical
in 2011
area permit as shown planning case -08.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City
Council that a critical area permit for a deck addition at 1230 Culligan Lane as proposed
in planning case 2011 -08 is hereby approved with the following findings of fact:
