Res 2011- 18 CUP for 2155 Delaware AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2011 -18 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR AN ACCESSORY STRUCTURE GREATER THAN 425 SQUARE FEET AT 2155 DELAWARE AVE s' WHEREAS, Michael and Julie Gerend have applied for a conditional use permit for an accessory structure greater than 425 square feet at 2155 Delaware Ave (PID 27- 30202- 020 -01; Lot 2 Block 1 Glen Toro Third Addition) as proposed in planning case 11 -03; and WHEREAS, the Mendota Heights Planning Commission held a public hearing on this application at their regular meeting on February 22, 2011; and WHEREAS, the commission recommended that the council approve the conditional use permit as shown in planning case #11 -03. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use permit for an accessory structure greater than 425 square feet at 2155 Delaware Ave as proposed in planning case 11 -03 is hereby approved with the following finding of fact: 1. The conversion of the structure from resident to accessory building leaves the property more closely conforming to the zoning regulations of the R -lA zoning district be leaving one single family resident on the property. 2. The accessory building is an existing structure and will not result in new visual impacts on the adjacent public streets. 3. The conversion of the structure to accessory building will result in a reduction of traffic on the adjacent public streets. 4. The conversion of the structure to accessory building will not increase any other non - conforming conditions on the property. 5. Granting the conditional use permit is in conformance with the land use plans for the area as identified in the city's comprehensive plan. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that a conditional use permit for an accessory structure greater than 425 square feet at 2155 Delaware Ave as proposed in planning case 11 -03 is hereby approved subject to the following conditions: 1.
