Res 2015- 66 Vacating Easement 1450 Northland DrCITY t�F MENI)OTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2015-66 RESOLUTION VACATNG (PORTION OF) AN EASEMENT AT 1450 NORTHLAND DRIVE UPON REQUEST BY THE PROPERTY OWNER WHEREAS, a request by the property owner of 1450 Northland Drive in Mendota Heights was received by the City clerlc on the 20t�' day of July 2015; and WHERIEAS, the request is that the City Council pursuant to Minnesota Statute §412.851 vacate a drainage and utility easement (a portion thereo� located at the southwest corner of the property legally described as: The north-westernmost 240 feet of the 30-foot wide Drainage and Utility Easement identified by Document Number 371255, located at Lot 2, Blocic l, part of the Inland Industrial Parlc plat in Mendota Heights; � WHEREAS, the City Cleric has reviewed and examined the request and determined that the requestor is the valid property owner; and WHEREAS, City staff has reviewed the easement for current and future potential uses by the City and determined that there are no current uses and no apparent future uses of the easement by the City; and WHEREAS, a pubiic hearing to consider the vacation of such easement was held on the lst day of September,�2015, before the City Council in the City Hall located at 1101 Victoria Curve at 7:00 pm after due published and posted notice had been given, as well as personal mailed notice to all affected property owners by the City Clerlc on the l Ot�' day of August, 2014 and all interested and affected persons were given proper notice and an opportunity to voice their concerns and be heard; and WHEREAS, any person, coiporation or public body owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace or otherwise attend thereto; and WHEREAS, the City Council in its discretion has determined that the vacation wiii benefit the public interest because it is not detrimental to the llealth, safety and welfare of the community. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MENDOTA I�EIGHTS, COUNTY OF DAKOTA, NJINNESO'Y'A, that such petition for vacation is hereby granted and the (portion o� easement described as follows is hereby vacated: The north-westernmost 240 feet of the 30-foot wide Drainage and Utility Easement identified by Document Number 371255, located at Lot 2, Blocic 1, part of the Inland Industrial Parlc plat in Mendota Heights BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized to sign all documents necessary to effectuate the intent of this resolution.
