Held Tuesday, July 21, 2015
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Acting Mayor Petschel called the meeting to order at 7:00 p.m. Other Councilmembers present included
Duggan, Povolny, and Norton. Mayor Krebsbach was absent.

PULLED CONSENT AGENDA ITEM
G) APPROVE RESOLUTION 2015-54 DAKOTA CO ELECTRONIC CRIMES TASK FORCE JPA
Chief of Police Michael Aschenbrener explained that the Dakota County Electronic Crimes Task Force
was formed in 2014. It involves all of the law enforcement agencies in Dakota County in partnership.
Three agencies are not actively signing onto this joint powers agreement as they have their own
electronic crime units. The remainder have been up and running since January 1, 2015.
The reason this agreement is again before the Council is that one of the agencies had a change to their
funding process and will not able to join until next year, thus voiding the original agreement. The Task
Force is working diligently and operating out of the Dakota County Sheriff's Office.
They have opened 54 case files in the last month, examined over 115 metal hard drives and over 50
regular hard drives. They are on their third major felony stalking investigation. They have been very
busy.
Councilmember Duggan shared some non -substantive edits to the agreement.
Councilmember Norton moved to adopt RESOLUTION 2015-54 FORMALLY AUTHORIZING
PARTICIPATION IN A JOINT POWERS AGREEMENT (JPA) "DAKOTA COUNTY ELECTRONIC
CRIMES TASK FORCE."

H) PURCHASE OF PROPERTY — 1189 BOURN LANE
City Administrator Mark McNeill explained that over the past years, the City has been purchasing
properties as they have become available on Bourn Lane. Several weeks ago, staff was approached by

the owner of 1189 Bourn Lane, the last piece of a 14.8 -acre parcel of land currently owned by the City.
The lot itself is 0.43 acres and the owner is willing to sell it. An appraisal was done and a purchase price
of $247,000 was negotiated. Staff anticipates that there will be additional costs for cleanup of the site,
legal fees, and environmental remediation that will total approximately $25,000.
The funding for this would come from the City's Fund 13, which is projected to have a $281,000
balance by the end of this year. The fund could be reimbursed when the larger parcel is sold for
redevelopment.
Councilmembers asked questions regarding the recouping of the cleanup costs and demolition of the
existing structure. The Fire Department is interested in using the existing structure for training
purposes.
Councilmember Duggan moved to approve the purchase agreement for 1189 Bourn Lane.

I) APPROVE DATES FOR COUNCIL BUDGET WORKSHOP MEETINGS
City Administrator Mark McNeill stated that staff is proposing the budget workshop meetings be held
before the regular Council meetings on August 18, 2015 and September 1, 2015, starting at 5:00 p.m.
Councilmember Duggan moved to set workshops for August 18 and September 1, 2015, at 5:00 p.m., to
discuss the 2016 budget.

PUBLIC COMMENTS
PRESENTATIONS
A) CITIZENS AWARDS OF MERIT
Chief of Police Michael Aschenbrener shared the details of a selfless potential life-saving act provided
to Ms. Jane Lonergrin by Mr. Greg Hilding on January 26, 2015. Ms. Lonergrin had been out walking
her dog in the early morning hours when she slipped on some ice, fell, and hit her head. She was
unconscious and unable to help herself up. Mr. Hilding was driving to work when he saw her light and

realized something was wrong. He helped her into his car and took her to a hospital. Fortunately she was
not seriously hurt but the situation could have turned out very differently.
For this selfless act, Mr. Hilding was awarded the Mendota Heights' Police Department's Citizen's
Award of Merit.
NEW AND UNFINISHED BUSINESS
A) RESOLUTION 2015-56 AMENDMENTS TO EDUCATIONAL FACILITIES REVENUE
REFUNDING NOTE FOR ST. THOMAS ACADEMY
City Administrator Mark McNeill explained that the City was approached a few weeks ago regarding a
desire by St. Thomas Academy to make certain amendments to the Note and Loan Agreement for the
1999 issuance of Variable Rate Demand Purchase Revenue Bonds, Series 1999. The City served as a
conduit in the issuance of these bonds, and city approval is needed for these proposed amendments. Mr.
McNeill introduced Ms. Mary Ippel from Briggs & Morgan, the City's bond counsel.
Ms. Ippel gave a brief background on the Conduit Revenue Bonds that were issued in 1999 for the
middle school expansion of St. Thomas Academy. These bonds were refunded [refinanced] in 2010 with
US Bank. The amendments to this agreement would have no impact on the City.
Councilmembers asked questions regarding the review process of the document by the bond counsel.
Councilmember Duggan moved to adopt RESOLUTION 2015-56 PROVIDING FOR THE FIRST
AMENDMENT TO EDUCATIONAL FACILITIES REVENUE REFUNDING NOTE (ST. THOMAS
ACADEMY PROJECT), SERIES 2010 AND AUTHORIZING THE EXECUTION OF DOCUMENTS
RELATED THERETO.

COMMUNITY ANNOUNCEMENTS
Assistant to the City Administrator Tamara Schutta made the following announcements:
• A Day to Remember the Life of Police Officer Scott Patrick will be held on July 30, 2015. A
highway dedication ceremony (Dodd Road) will begin at 11:45 a.m. at 1010 Dodd Rd, West St.
Paul. A candlelight vigil will begin at 8:00 p.m. Market Square, 720 Main Street.
• Night to Unite is scheduled for Tuesday, August 4. Register your neighborhood party by July 24.
• July 22 Performances in the Park will feature Pat Donohue at 6:30 p.m.
• The Fire Department is accepting applications for volunteer firefighters through August 21.

COUNCIL COMMENTS
Councilmember Norton mentioned that "The King & I Thai" has opened for business.
Councilmember Povolny mentioned that he is still seeing a lot of walkers and bikers off the bike path
and wearing dark clothing. He encouraged residents to be safety conscience and wear bright or reflective
clothing that can be seen in the dusk and dark of the evenings.
Councilmember Duggan mentioned that he has read in the police reports that the number of robberies
and invasions of cars and homes is increasing. Residents are leaving their cars unlocked with garage
door openers in them. Residents should remember that garage door openers can be keys to your house.
He also expressed appreciation to the staff and the police officers for helping with the proclamation and
celebration of St. Peter's 175th anniversary. It was a huge success.
There were four letters to the editor in the Pioneer Press having to do with the nuclear agreement wth
Iran. He expressed his appreciation that there are citizens who pay attention to the news and respond to
the news.
Councilmember Petschel recognized Annie Heck, a junior at Convent of the Visitation School, for
winning the Women's Junior LPGA at Giants Ridge. She will be competing in the National LPGA
Tournament in Texas.
She also made note that Councilmembers will be receiving a copy of a resolution that was passed by the
City Council in Sunfish Lake, acknowledging the City of Mendota Heights' award winning fire
department.
She acknowledged the City's Public Works Department, the Engineers, and the City of West St. Paul for
the rapid resolution of what could have been a devastating incident at Dodd and Decorah. Public Works
Director John Mazzitello explained that on the morning of July 15, two city employees reported that
water was coming out of a manhole on Decorah. The manhole accesses the 24 -inch concrete pipe
interceptor line. A blockage or some other obstruction could cause a backup that would be catastrophic.
When the jet was put into the pipe to clear it, the road collapsed. The concrete sewer pipe collapsed and
blocked the flow of the sewer. Public works staff reacted immediately and mobilized their response
equipment, called the City of West St. Paul for help, and a bypass was up that prevented sewage from
backing up. Staff also started checking manholes and service access points to verify the backup did not
make it into homes. Calling an emergency contractor in to make the repair, fixing the pipe, backfilling
the hole, and paving the street where the repair was made — six days after the blockage was detected,
Decorah was open for traffic again.
Upon being requested, Public Works Director Mazzitello shared details and the importance of the
sanitary sewer cleaning and televising contract that was approved on the Consent Agenda earlier this
evening.

PARKS AND RECREATION MEETING
July 14, 2015
The July meeting of the Mendota Heights Parks and Recreation Commission was held on
Tuesday, July 14, 2015 at Mendota Heights City Hall, 1101 Victoria Curve.
Chair Hinderscheid called to order the parks and recreation commission meeting at 6:30 p.m.
The following commissioners were present: Chair Hinderscheid, Commissioners: Ira Kip,
Stephanie Levine, Michael Toth, and Joel Paper and Student Representatives Joe Quehl.
Absent: Commissioner Evans and Commissioner Miller. Staff present: Recreation
Programmer Sloan Wallgren.
Approval of Agenda
COMMISSIONER TOTH MADE A MOTION TO APPROVE THE AGENDA;
COMMISSIONER LEVINE SECONDED THE MOTION.

Recreation Programs Update
Mr. Wallgren updated the commission on all of the programs that have been taking place so far
this summer. He also updated the commission on the remaining programs that are schedule for
the summer. The remaining programs include: Summer Playground Program, Thursday Field
Trips, Adult Softball Tournament, Traveling Parks Program, Monday Puppet Wagon Show,
Tuesday Theatre Shows and live Music at Market Square on Wednesday nights.
2016 Budget Planning
Mr. Wallgren informed the commission that staff has been working on the budget for 2016
programs and events. One area that staff is looking to expand is hosting a few Movie in the
Park events for next year.
Par 3 Report
Mr. Wallgren informed the commission that the golf course is doing great so far this year. The
great weather and the addition of Footgolf have really increased the revenue for the year.
There are still many small group outing planned of the months of July and August.
Mr. Wallgren informed that commission that staff has made several improvements to the golf
course and clubhouse such as new ball washers and new umbrellas for the patio. Improvements
to the maintenance operations include a new 30 gallon gas tank for diesel fuel and the purchase
of a used mower.
Announcements
Mr. Wallgren announced that the Mendota Heights Athletic Association is new taking
registrations for basketball. He also relayed some positive comments about Mendakota Park
made by the Dakota County Assistant Attorney. Finally, Mr. Wallgren encouraged people to
enjoy our remaining musical entertainment at Market Square Park Wednesday nights starting
at 6:30PM.

Commission Comments
Commissioner Kipp thought it was a good meeting.
Commissioner Levine was happy to see all of the great programs this summer and encouraged
people to get out and enjoy our great trails.
Commissioner Paper thanked staff for all the work, his family had a blast at the Fishing Derby and
he was glad that the golf course was doing so well.
Commissioner Toth announced that he had a great time at the Fishing Derby and was glad to see
so many families out at Rogers Lake.
Chair Hinderscheid had a great time at the Fishing Derby and was glad to see that the city is
making progress with an off -leash dog area.

45 City Planner Nolan Wall explained that the applicant was seeking a Wetlands Permit for vegetation
46 removal and construction on the subject parcel. The proposed construction activities are within
47 100 feet of a wetland and do not meet the requirements for administrative approval.

49 The subject parcel is 48,630 square feet, zoned R-1, and guided for rural residential development
50 in the Comprehensive Plan. The property is currently undeveloped and the applicant has been
51 contracted to construct a new single family dwelling on the property.

53 Planner Wall shared an image of a site plan that was included as part of the Planned Unit
54 Development approval in 1998. At that time the City approved the PUD agreement, Preliminary
55 Plat, and Development Agreement for the Glen Toro 2nd Addition development. That development
56 consists of nine lots of which five have been developed. The original approval and subsequent
57 amendments did not address the incorporation of the City -issued wetlands permits. Staff identified
58 this wetlands permit issue upon the applicant's submission of a building permit and subsequent
59 review of the previously -approved project files.

61 Due to the location of the building pads, the majority of the construction activities would take
62 place outside of the 100 -foot buffer area. As part of the PUD, the setbacks were approved to be
63 flexible based on the lot layouts and proposed structures. As a result of the proposed building pad
64 being located outside of the 100 -foot buffer area, the applicant and architect did request
65 commencement of certain construction activities without having obtained the appropriate wetlands
66 permit. Staff brought that request forward to the City Council for consideration at a special meeting
67 held on July 15, 2015. The Council did authorize staff to issue the building permit for the proposed
68 dwelling on the subject parcel upon completion of the plan review by the Building Official.

70 Planner Wall reiterated that this request is limited to those proposed activities that would occur
71 within the 100 -foot buffer area, which only includes vegetation removal and construction and
72 grading of a portion of the driveway. According to the applicant, no mature trees will be removed;
73 only brush and overgrowth.

116 a Critical Area Permit, Conditional Use Permit, Wetlands Permit, and Variance Requests for
117 demolition of the existing structures and construction of a new single-family dwelling on the
118 subject parcel. That site is currently under construction.

120 Preliminary construction plans included in the previous application did not include the proposed
121 driveway turnaround area and retaining wall. Therefore, a Critical Area Permit for the construction
122 and a Variance for the height of the retaining wall are required.

125 proposed construction was in compliance with City standards. Engineering staff have reviewed the
126 proposed retaining wall and found the plans to be reasonable given the constraints of the site.

162 wall height standard cause a practical difficulty in constructing the proposed project to the
163 height required to structurally -support the proposed turn-around/driveway expansion.
164 4. The proposed construction activities will not remove any additional vegetation and the
165 proposed design will not direct headlights into the adjacent dwelling to the north; the
166 character of the neighborhood will not be altered.
167 AND WITH THE CONDITION that the applicant obtains a building permit

169 Commissioner Roston expressed that he had concerns and was not prepared to recommend
170 approval. He would like to know what alternatives were considered and what can be done to avoid
171 needing a variance; such as going the other direction, moving it further down the driveway, or
172 recognizing that the neighborhood does not always have turnarounds. He recommended tabling
173 the application and that the applicant work with staff to demonstrate why the other approaches do
174 not work.

282 21,000 square feet and contains an existing single-family dwelling. The applicant intends to
283 construct a deck wrapping around the west and northwest corners. As proposed, a portion of the
284 deck within the rear yard would require a variance. The existing dwelling was constructed in 2006.
285 Between 2004 and 2005 the Planning Commission and City Council did discuss a number of
286 different planning applications regarding potential building pads in the subject parcel and a series
287 of planning applications including various requests. Ultimately no variances were granted and the
288 existing dwelling was issued a building permit for construction in its current location.

290 The R-1 district's rear -yard setback standard is 30 feet or 20% of the average lot depth whichever
291 is greater. In this case, due to the orientation of the existing dwelling which fronts Ivy Hill Drive,
292 the required rear -yard setback is 30 feet. Attached decks are considered to be part of the principal
293 structure; therefore, the same setback standards apply_ As proposed, the deck would encroach nine
294 feet into the required 30 -foot rear yard setback area.

296 Commissioners asked questions regarding the length of the nine -foot encroachment.

298 Based on the scope of the proposed project, staff recommended denial of the nine -foot variance
299 request as they feel it does not meet the requirements for approval of a variance. Staff feels that
300 there are other design options that would allow for a reasonable use of the property, which would
301 reduce the encroachment or no variance at all.

306 A. Consider a three-foot variance to allow construction of a landing/walkway from the patio

311 case. According to the building code, three feet is the minimum width of a landing required
312 for a walkway. In this scenario, staff would further recommend the three-foot
313 encroachment extend no further than three feet from the northwest corner of the existing
314 dwelling.

316 B. Consider a three-foot variance to allow construction of a landing/steps to the existing patio
317 door and eliminate the portion of the proposed deck encroaching into the rear .

318 This option addresses the safety concern raised by the applicant regarding access to the
319 existing patio door. A compliant landing at least three long and steps could be constructed
320 to provide safe access to the rear yard from the existing dwelling. However, it would not
321 provide access from the dwelling to the compliant portion of the proposed deck extending
322 into the side yard.

324 C. Eliminate the portion of the proposed deck encroaching into the rear yard and construct
325 steps to access the compliant portion from the side yard.

327 This option does not require a variance and, in staff's opinion, still allows for reasonable
328 use of the property by providing access to the compliant portion of the deck extending into
329 the side yard. As with Option B, it would not provide access from the dwelling to the
330 portion of the proposed deck extending into the side yard or address the potential safety
331 issue.

423 a temporary facility while the City undergoes the upcoming redevelopment and comprehensive

467 requirements and discuss other operational issues as this moves forward. If approved it is intended
468 to be open this year.

477 1. If a dog park were to be put into the field it should be as least intrusive in the area as
478 possible; a fence would be too intrusive on the wildlife; she would have no problem with
479 a dog straying into her yard — monies set aside for fencing should be used for improvements
480 to the dog park; she would fight the installation of a fence.
481 2. She would recommend lighting be installed and added to the ordinance for safety issues
482 and liability.
483 3. It would be very important to have water available in the park — water playground.
484 4. Property value if the dog park is not done well.
485 5. On -street parking on Acacia Boulevard would be all right; she would also be fine with
486 parking on Pilot Knob Road in front of her home; she does not want parking restricted on
487 Pilot Knob Road.

BACKGROUND
Pursuant to State Statutes and our City Code, no person shall sell or give away liquor without first
having received a license. Temporary On -Sale Liquor licenses shall be granted only to clubs and
charitable, religious or nonprofit organizations for the sale of intoxicating liquor. The licenses are
subject to final approval by the Director of Alcohol and Gambling Enforcement.
Holy Family Maronite Church, located at 1960 Lexington Avenue South, is planning to hold their
annual church festival on Sunday, September 13, 2015, on the church property. They have submitted
an application for a Temporary On -Sale Liquor license to allow for the sale of beer during the hours
of 11:00 am - 6:00 pm. Security will be present during the event and liability insurance has been
obtained.
The festival will include outdoor music, ethnic dance demonstrations, food booths, booths for kid's
games, a heritage booth, etc. The church is also requesting the use of the city hall parking lot for
their overflow parking.
It should be noted that Temporary On -Sale Liquor licenses have been issued in the past to charitable,
nonprofit and religious organizations within the city with no incidents or negative reports.
RECOMMENDED ACTION
Staff recommends the City Council approve the Temporary On -Sale Liquor license for Holy Family
Maronite Catholic Church, and also the use of the City Hall parking lot for their overflow parking.

BACKGROUND
The applicant, on behalf of the property owners, is seeking a wetlands permit to remove vegetation and
construct a driveway on the subject parcel within the 100 -foot wetland/water resource -related buffer area.
The subject parcel is currently undeveloped and was included as part of a Planned Unit Development, which
was approved by the City Council in 1998. However, the original approval, and subsequent amendments,
did not address the incorporation of city -issued wetlands permits. Staff identified the permitting issue upon
the applicant's submission of a building permit. Since the majority of the construction activity for the new
dwelling and associated site improvements are outside of the buffer area, the Council authorized staff to
issue the building permit for the proposed dwelling upon completion of plan review by the Building Official
at the July 15 Special Meeting. The building permit has since been issued.
The Planning Commission conducted a public hearing at the July 28 meeting; there were no public
comments.

RECOMMENDATION
The Planning Commission recommended approval of the wetlands permit request, with conditions, as
described in Planning Case 2015-27. If the City Council desires to implement the recommendation, pass a

ROAD.

construct a driveway on the subject parcel. The proposed activities are within 100 feet of a wetland and do
not meet the conditions for an administrative approval.
BACKGROUND
The subject parcel is 48,630 square feet (1.12 acres) and is currently undeveloped. The property is zoned
R -IA One Family Residential and guided for rural residential development. The applicant has been
contracted to construct a new single-family dwelling on the property.
The City approved a Planned Unit Development (PUD), Preliminary Plat, and Developers Agreement for
the Glen Toro Second Addition Development in 1998, as part of Planning Case 1998-12. The development
consists of nine lots; five of which have been developed. The original approval, and subsequent
amendments, did not address the incorporation of city -issued wetlands permits. According to the official
Wetlands Systems Map, which was updated in 2006, a wetland is identified within 100 feet of the subject
parcel. According to Title 12-2-6-A of the Code, a wetlands permit is required for the removal of vegetation
and grading within 100 feet of a wetland or water resource -related area.
Staff identified the wetlands permit issue upon the applicant's submission of a building permit and
subsequent review of the previously -approved project files. Due to the location of the proposed building
pad, the vast majority of the construction activity will be outside of the 100 -foot buffer area (see attached
map). As a result, the applicant and architect requested commencement of certain construction activities
without having obtained the appropriate wetlands permit. Staff brought forward the request to the City
Council for consideration at the July 15 special meeting. The Council authorized staff to issue the building
permit for the proposed dwelling on the subject parcel upon completion of plan review by the Building
Official.

ANALYSIS
Comprehensive Plan
The subject parcel is guided RR Rural Residential in the 2030 Comprehensive Plan. The applicant's request
to remove vegetation and construct the proposed project on the property is consistent with the Plan.
Wetlands Permit
According to Title 12-2-1 of the City Code:
The purpose of this chapter shall be to provide for the protection, preservation, maintenance, and use of
Mendota Heights wetlands and water resource related areas, to maintain the natural drainage system, to
minimize the disturbance which may result from alteration by earthwork, loss of vegetation, loss of wildlife
and aquatic organisms as a result of the disturbance of the natural environment, or from excessive
sedimentation; to provide forprotection ofprobable fresh water supplies; and to ensure safety from floods.
The request in this case is limited to the proposed activities within the 100 -foot buffer area, which only
includes vegetation removal and construction/grading of a portion of the driveway. As shown in the
attached aerial map, the subject parcel is separated from the wetland by Glen Toro Road. According to the
applicant, no mature trees will be removed to construct the driveway, only brush and overgrowth. Based
on the proposed scope of the project within the buffer area, staff does not feel there will be any negative
impacts to the wetland.

1. Recommend approval of the wetlands permit request, based on the findings of fact that the proposed
scope of the project within the buffer area will not have any negative impacts on the wetland, with
conditions.

SUBJECT: Call for a Public Hearing — Vacation of Part of a Drainage and Utility Easement
BACKGROUND
A Mendota Heights business owner that owns property at 1450 Northland Drive has
requested the vacation of a portion of a Drainage and Utility Easement located along the southern
boundary of the property, recorded as Document Number 371255, and part of the Inland Industrial
Park plat of 1974. The property owner is requesting that 240 feet of the easement be vacated.
The request is being made in order for the property owner to re -purpose the building for their
own use. The new use will require larger trucks that the current loading dock configuration can
accommodate. In order to accommodate the larger trucks, the paved lot needs to be expanded, and
that expansion will encroach on the easement being requested for vacation. A diagram of the
conceptual expansion and the easement is attached for your reference.
Staff has researched the Drainage and Utility Easement referenced and located on the subject
property. This portion of the easement is not being utilized by the City or any other utility we have
located or identified in our Geographic Information System (GIS) database.
In order for the City to vacate a Right -of -Way or Easement, a public hearing must be
conducted. The attached Resolution calls for a public hearing to be held on September 1St, 2015 for
the vacation of the north -westernmost 240 feet of the 30-ffot wide Drainage and Utility Easement
identified by Document Number 371255, located at Lot 2, Block 1, part of the Inland Industrial Park
plat in Mendota Heights. Calling for the public hearing does not obligate Council to ultimately
vacate the Easement.
All impacted property owners, and all property owners party to the associated subdivision
plat will be contacted about the public hearing by published and mailed notice.
BUDGET IMPACT
Other than the staff time to process the vacation, there is no impact to the city budget.
The application fee, per the City Fee Schedule, has been paid.
RECOMMENDATION
Staff recommends that the City Council pass a motion adopting Resolution No. 2015-62,
RESOLUTION CALLING FOR A PUBLIC HEARING ON AN EASEMENT
VACATION STARTED BY A REQUEST OF THE PORPERTY OWNER. This action

SUBJECT: Marie Park Warming House Replacement
BACKGROUND
The Parks Department would like to replace the warming house in Marie Park. The warming house is 45
years old. It is old, the wooden floor has settled and it requires a lot of up keep.
BUDGET IMPACT
In the 2015 Special Park Fund, there is $35,000 to replace the old warming house. Three quotes
were obtained and they are: Joe Becker Construction $35,000, Kirchner Contracting, Inc.
$41,120, and Paper Brothers Construction, Inc. $45,800. The quotes also include the removal
and disposal of the existing warming house.
RECOMMENDATION
Staff recommends that the City Council authorize the issuance of a purchase order to Joe Becker
Construction for their low bid of $35,000 to replace the warming house in Marie Park.
If the City Council concurs with the recommendation, they should pass a motion authorizing a
purchase order to Joe Becker Construction for their low bid of $35,000 to replace the warming
house at Marie Park. This action requires a simple majority vote.

Update
The golf course remained very busy during the months of May and June. We were only closed a
few days due to rain and cold weather. Our Women's League and Junior Leagues are all up and
running. We have over 150 in our Junior Golf Leagues, over 200 in our Golf Camps and 60
participants in our Women's League.
Our Footgolf remains very popular. We saw a very nice increase in revenue for the month of
June. Footgolf has brought many new people to the golf course and community. We have
received many great reviews about the course layout, and only a handful of complaints from
golfers. Most customers are happy to see kids and families out supporting the course and getting
physical activity.
Maintenance Update
The golf course is in great shape and we have received many compliments about the conditions
of the golf course. We have made several purchases over the last 2 months: we bought a new 30
gallon gas tank for diesel fuel ($450), new umbrellas for the patio ($300), new ball washers for
the course ($1,000) and a new mower ($650) for the golf course which will be used to verticut
the greens and tees and will serve as a backup greens mower in case ours goes down.
Budget
Total sales for the month of June were $33,527 and total expenses were $18,424. Total sales for
the year through June are $78,598 and expenses are $55,608 resulting in a net profit of $22,990
year to date.

BACKGROUND
On August 1, 2012, the City Council adopted a new Emergency Operations Plan (EOP). In
2013, the city agreed to contract with the Dakota County Emergency Manager to work on
compliance issues for Emergency Management. At that time work was done and completed on a
new EOP. This past week Dakota County has begun training city staff on their parts of the EOP.
The 2015 EOP has been approved by the Dakota County Emergency Manager and has been
reviewed for compliance by the State of Minnesota Department of Homeland Security and
Emergency Management (HSEM).
Staff is training on each emergency support function and will be training on the plan in August.
Work is well underway to ensure compliance with the 2016 standards.
The document is not public information and is not attached to this memo. Council may view or
sign out a copy of the document by contacting the Emergency Manager.
Changes will be made to the 2015 plan by staff to ensure HSEM compliance and a new plan will
be brought to council when directed by HSEM.
BUDGET IMPACT
Upon completion of the June, 2014 rain storms or Minnesota HSEM Disaster 92 the City will
have recouped approximately $500,000 in disaster money from the Federal Emergency
Management Assistance (FEMA) and HSEM.
This is a contracted and budgeted service provide to the City under the direction of the
Emergency Manager.
RECOMMENDATION
If Council desires to implement the recommendation, pass a motion authorizing the Mayor to
sign Resolution No. 2015-61; "ADOPTING 2015 MENDOTA HEIGHTS EMERGENCY

INTRODUCTION:
The police department accepted the delivery of two new, leased, black and white squads. These
new squads, along with one of the old black and white squads, are at Emergency Automotive
Technologies Incorporated (EATI) where equipment will be removed and replaced (R&R). We
learned from EATI that the light bars and control heads on the old squads are obsolete.
BACKGROUND:
The squads were inspected in April to estimate which parts needed to be ordered for the R&R as
we only replace parts that will not be serviceable for the next three years. At that time,
information about parts availability for the Whelen light bars and Blink control heads was not
available. We learned about the issue when the new squads were delivered.
The light bars and control heads could be replaced at a later date, however, the cost to R&R just
those parts would be nearly equal having them installed now during the full R& R.
The price to replace the light bar and control head is estimated $3425 per car using the MN State
Cooperative Purchasing agreement pricing contract #L-336(5). The parts will need to be ordered
immediately.
In reviewing the budget there is approximately $6800 in unused capital expenses due to leasing
instead of purchasing the copy machine. The finance director advised that with council approval
this could occur. By doing this the overall budget for the copy machine will be over the $9000
line item by $50.
RECOMMENDATION:
Authorize staff to move the money from the capital line to repair and maintenance. Authorize
staff to sign a purchase for two light bars and control head for an amount not to exceed $6800.

WHEREAS, Mendakota Country Club, has applied for variances for construction of an

WHEREAS, the Mendota Heights Planning Commission held a public hearing on this matter
at their regular meeting on July 28, 2015.
NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the

findings of fact:

6. The unique nature of the property justifying the variances includes the fact that the property is
more than 100 acres in the R-1 District.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the variance
requests as proposed in Planning Case 2015-25 are hereby approved with the following conditions:
1. The applicant obtains a building permit.
2. The storage pods are removed after construction of the proposed accessory structure is

3. All grading and construction activity will be in compliance with applicable federal, state, and

The structure would have three levels; a basement drive-in level with an overhead garage door, a main
level, and an attic storage space. Due to lack of adequate storage space within the clubhouse, temporary
storage pods are located within the proposed construction area (see attached photos). According to the
applicant, the proposed structure would address the storage needs and fire code issues.
ANALYSIS
Comprehensive Plan
The subject parcel is guided GC Golf Course in the 2030 Comprehensive Plan. The applicant's request to
construct an accessory structure for additional storage on the property is consistent with the continued use
as a country club/golf course.
Accessory Structure
Title 12 -1D -3-B and C of the City Code contain the following accessory structure standards for all
residential districts:

The proposed accessory structure meets the applicable setback standards; as shown in the table above, it
exceeds the height, number, area, and size standards for the R-1 District. According to the preliminary
building plans, the proposed accessory structure will be constructed of similar materials and colors to match
the clubhouse building.
Variances
When considering the variance requests for the proposed accessory structure, the City is required to find
that:
1. The request is in harmony with the general purposes and intent of the ordinance and comprehensive
plan and the applicant proposes to use the property in a reasonable manner.
The use of the property as a country club/golf course is permitted as a conditional use in the R-1 District
and its continued use is consistent with the Comprehensive Plan. The applicant's desire to construct an
additional accessory structure on the property to perpetuate and support the existing use is reasonable.
2. The applicant establishes there are practical difficulties with complying with the ordinance due to
circumstances that are unique to the property which are not created by the applicant or based on
economic considerations.
The use of the property as a country club/golf course requires numerous accessory structures for storage of
equipment and materials. Applying the existing height, number, area, and size standards for accessory
structures in residential districts creates a practical difficulty in complying with the Code when new
structures are required for additional storage in order to meet fire code requirements. According to the
applicant, an addition cannot be constructed onto the southwest side of the existing clubhouse building due
to the presence of air handling equipment in the existing attic space.
3. The request will not alter the essential character of the locality.
The property already contains numerous accessory structures and the proposed structure will be constructed
of similar materials and colors to match the clubhouse building. Construction of the proposed accessory

Mendakota Country Club would like to propose the construction of a storage facility to satisfy the needs of the
club. Adequate storage space was overlooked when the clubhouse was built and has created safety concerns.
The Fire Marshal has noted areas where improvements must be made in meeting fire codes. Hallways that would
be used as fire escape routes are becoming clogged with glassware, tables and chairs. The two 8' x 16' storage pods
we currently use cost us $392.48 per month, are unsightly, and have proved to be inadequate for our storage
needs.
The best and only site for this storage building is on the southwest side of our clubhouse where the current storage
pods are located. The proposed structure will measure 50' in length and 38' in width. It will have three levels; a
basement drive-in level, a main level, and an attic storage level. This storage building should provide close to 4875
sq. ft. of storage space vs. the current pod storage of 256 sq. ft.
® We will use construction materials on the exterior of the building that will closely match the clubhouse
exterior.
® Main Floor storage components will consist of tables, chairs, boxes of decorations, glassware, plates, etc.
® Basement storage will consist of electric golf cars and a work -shop area.
® Attic storage will consist of once a year type decorations, office files, etc.
® Main floor will be kept at a temperature of approximately 50° during the winter months with a unit type
heater.
® Exterior lighting will consist of 60 watt motion sensitive flood lights above each overhead door.
We would like to begin the construction process in September of 2015.

Ordinance 483 Adopting Standards for Video/Electronic Display Scoreboards
BACKGROUND
The City is considering amendments to Title 12 -1E -3-C of the City Code concerning video/electronic
display scoreboards. Representatives from Saint Thomas Academy appeared before the City Council on
July 7 to discuss plans for a new scoreboard for the main athletic field/track on campus. As a result of the
discussion, staff drafted a proposed code amendment to establish standards for the proposed use.
As proposed, a video/electronic display scoreboard would be considered a permitted accessory use for
public and parochial schools in a residential zoning district, therefore no additional approval is necessary
as long as the conditions are met. DRAFT Ordinance 483 includes nine proposed conditions, including
the following:
• Use restrictions
• Brightness and security requirements
• Setbacks from surrounding residential uses
• Area
• Height
• On -premise advertising
• Number of displays
• Hours of operation
The Planning Commission conducted a public hearing at the July 28 meeting. Representatives from Saint
Thomas Academy provided testimony on how they intend to use the scoreboard and commented on the
proposed language. The proposed ordinance was revised based on the Planning Commission discussion;
revisions are shown as tracked changes in the packet. The Commission also requested staff send the
proposed ordinance to ISD 197 and Convent of the Visitation School for their review and comment. Any
additional comments received will be provided to the City Council for consideration.

RECOMMENDATION
The Planning Commission recommended approval of DRAFT Ordinance 483, as described in Planning
Case 2015-28. If the City Council desires to implement the recommendation, pass a motion adopting
ORDINANCE 483 CONCERNING VIDEO/ELECTRONIC DISPLAY SCOREBOARDS.
This matter requires a simple majority vote.

AN ORDINANCE AMENDING TITLE 12, CHAPTER 1, ARTICLE E OF THE CITY CODE OF
THE CITY OF MENDOTA HEIGHTS, MINNESOTA, DAKOTA COUNTY, CONCERNING
VIDEO DISPLAY SCOREBOARDS FOR PUBLIC AND PARIOCHIAL
SCHOOLSINSTITUTIONA-L USES
The City Council of the City of Mendota Heights, Minnesota, does hereby ordain:
Section 1.
Title 12 -1E -3-C is hereby amended to as follows to add the proposed language:
Video/electronic display scoreboard for public and parochial schools„ ins44-ti6ena use, provided that:
1. The scoreboard shall only be used for organized events in which the permitted ins4itid4i0ffal use is
participating in or hosting.
2. The video/electronic display portion(s) of the scoreboard shall only be used when an event is
occurring at the athletic field.
3. The scoreboard shall be equipped with industry -standard security and brightness control features.
4. The video/electronic display portion(s) of the scoreboard shall not be located closer than three
hundred (300) feet to any surrounding residential property boundary line.
5. The scoreboard shall not exceed eight hundred (800) square feet in area per surface and the
video/electronic display portion(s) shall not exceed six hundred (600) square feet of the total area.
6. The scoreboard shall not exceed forty-five feet (45) in height from the average natural grade at
the base of the scoreboard.

DESCRIPTION OF THE REQUEST
The City is considering amendments to Title 12 -1E -3-C of the City Code concerning video/electronic
display scoreboards.
BACKGROUND
Representatives from Saint Thomas Academy appeared before the City Council on July 7 to discuss plans
for a new scoreboard for the main athletic field/track on campus (see attached letter with revised rendering).
As a result of the discussion, staff was directed to bring forward a code amendment to establish standards
for the proposed use.
In April 2014, the Council adopted Ordinance 460 allowing electronic display signs for institutional uses
in residential zoning districts. The definition of such a sign is as follows:
SIGN, ELECTRONIC DISPLAY: A sign or portion thereof that displays electronic, nonpictorial, text
information in which each alphanumeric character is defined by a small number of matrix elements using
different combinations of light emitting diodes (LEDs), fiber optics, light bulbs, or other illumination
devices within the display area. Electronic display signs include computer programmable, microprocessor
controlled electronic displays. A scoreboard being used during an organized sporting event shall not be
considered a sign. [12-1B-2]
While scoreboards were intentionally excluded from the definition, video/electronic display components
encompassing an entire scoreboard were not discussed as part of the code amendment process.
ANALYSIS
The City is the applicant in this case, however the application was initiated by a request from Saint Thomas
Academy to utilize this technology and feedback from the City Council that it should be considered as a
scoreboard, not as a sign. As proposed, a video/electronic display scoreboard would be considered a
permitted accessory use for an institutional use in a residential zoning district, therefore no additional
approval is necessary as long as the conditions are met.

School representatives have already been before the City Council and will be present at the subsequent
Planning Commission and City Council meetings to discuss the proposed code amendment and their
proposed scoreboard plans. In order to allow for a compliant video/electronic display scoreboard to be
erected as soon as possible after approval of the code amendment, based on a public hearing and thorough
discussion before the Planning Commission and City Council, staff feels that adequate public comment
opportunities will have been provided concerning this issue. Therefore, consideration of the proposed use
as a conditional use, which requires an additional permit and application review process, may be
unnecessary. In addition, all property owners within 350 feet of the campus were provided public hearing
notices on this request, which is the same requirement as for a conditional use permit. If and when the City
pursues an institutional/public use zoning district, the standards can be reviewed and revised accordingly.
DRAFT Ordinance 483 includes the following proposed amendment, including the rationale for each
condition:
Video%lectronic display scoreboard for an institutional use, provided that:
1. The scoreboard shall only be used for organized events in which the permitted institutional use is
participating in or hosting.
2. The video%lectronic display portion(s) of the scoreboard shall only be used when an event is
occurring at the athletic field.
Both conditions would limit the use of the scoreboard to during events related to the institutional use.
3. The scoreboard shall be equipped with industry -standard security and brightness control features.
Security and brightness need to be appropriately controlled to prevent the scoreboard from being
distracting or misused.
4. The video%lectronic display portion(s) of the scoreboard shall not be located closer than three
hundred (300) feet to any surrounding residential property boundary line.
The distance would only apply to properties which face the video/electronic display portion of the
scoreboard.
5. The scoreboard shall not exceed eight hundred (800) square feet in area per surface and the
video%lectronic display portion(s) shall not exceed six hundred (600) square feet of the total area.
The video/electronic display portion would be limited to a percentage of the overall size of the
scoreboard. Currently, there are no size limitations in the Code regarding scoreboards. The proposed
total area standard is less than both example ordinances reviewed by staff.
6. The scoreboard shall not exceed forty-five feet (45) in height from the average natural grade at the
base of the scoreboard.
The scoreboard needs to be high enough to see from the athletic field stands. The proposed standard is
consistent with the example ordinances reviewed by staff.
7. Advertising of products, events, persons, institutions, activities, businesses, services or subjects not
related to the event taking place on the premises or sponsored by the permitted institutional use are
prohibited. Organizations sponsoring the scoreboard may include identifying information within the
area allowed for the scoreboard in a combined amount not to exceed thirty (30%) percent of the total
scoreboard area.
The intent in allowing institutional uses the opportunity to utilize this technology is for use during an event
at the athletic field and for promotions and announcements specific to the use and visitors to the property.

Existing scoreboards in the city already contain sponsor/advertising space, therefore the proposed condition
would limit the amount of space in relation to the overall area of the scoreboard.
8. No permitted institutional use shall have more than one(]) scoreboard structure equipped with
video%lectronic display(s) and no video%lectronic display(s) or signage shall be affixed to the back
of the scoreboard.
Existing scoreboards with electronic time/scorekeeping capabilities are not meant to be included in this
condition.
9. The hours of operation for the video%lectronic display portion(s) of the scoreboard shall be limited
to between eight o'clock (8: 00) A.M. and eleven o'clock (I1: 00) P.M. with an allowance of up to
thirty (30) minutes before or after a permitted event.

Re: Athletic Field Scoreboard Replacement at Saint Thomas Academy
Saint Thomas Academy desires to replace the 1994 scoreboard on our main athletic field. When
installed it was the current technology in scoreboards, today it is antiquated and at the end of its service life. On
numerous occasions it has become an issue due to failures during events. Additionally the 1994 scoreboard
was designed primarily as a Football scoreboard, and while we make it work for Soccer and Lacrosse it does
not have the capability to sere as a Track & Field scoreboard.
The proposed scoreboard represents the current technology in scoreboards. After contacting several
scoreboard manufacturers, I can say with confidence that any current technology digital scoreboard is made up
of various components. The obsolete fixed -digit scoreboards dike our 94' scoreboard} come in essentially one
piece, but are limited in the functions they can perform. The proposed scoreboard would give Saint Thomas
Academy one scoreboard that could function for all of the current athletic events we hold on the field: Football,
Soccer, Lacrosse, and Track & Field.
After reviewing several mockups of our proposed replacement scoreboard with Mendota Heights City
Staff, we are invited to attend the 717 Council meeting to discuss the proposed replacement scoreboard. City
staff informed us that potential issues regarding scoreboards were discussed when the code was amended to
allow electronic display signage — and they were purposely excluded, "A scoreboard being used during an
organized sporting event shall not be considered a sign." Staff also noted that the video message board
component of a scoreboard was not discussed and wanted to have Council feedback on this aspect before
making a determination on any variance or permitting.
After Laving read the signage section of the City Code numerous times, I believe all scoreboards
including those with a video message board component should not be considered a sign. All of the currently in
place scoreboards within Mendota Heights would require a variance if they lost the scoreboard exemption.
We very much want to replace the scoreboard ASAP but if we go through the Variance review process,
we will be forced to use the existing system until next summer.

COMMENT:
INTRODUCTION
The Council is asked to take actions which would allow for the establishment of an off -leash dog
area at the Pilot Knob site. The first step is to approve actions resulting from the
recommendations of the Planning Commission to allow for an off -leash dog area to be an interim
use in the I -Zone, and to approve the actual permit (see accompanying memo from Planner
Nolan Wall).
The second requested action is to give direction to staff regarding operational issues, should the
Council choose to proceed with the off -leash dog area at this location.
BACKGROUND
On June 29th, the Council discussed the possible funding of a dog park to be located on a parcel
of City -owned land, located south and west of the intersection of Pilot Knob Road and Acacia
Blvd (see attached memo). As shown, when the development included a chain-link fence around
the perimeter of the approximately 3 acre site, the cost would have been in the $30,000 range,
with $24,000 of that being for a 6 foot high fence.
Staff did meet with one of the two immediate residential neighbors of the proposed off -leash
area. If an off -leash dog area is to go there, she feels the City should make the following other
improvements to help assure that it is successful:
• Benches for patrons
• Restroom Facilities
• Water (if not for all users, at least for the dogs)
• Lighting
• Signage

• Disposal receptacle for dog waste
Because this is an interim use, restrooms could be handled by a portable toilet (used seasonally
from March to the end of October). Permanent water would be more costly, in that a line would
have to be bored under the either Pilot Knob Road or Acacia Blvd, which are the closest sources
of city water. A lesser cost alternative would be for portable watering tanks, but those would
require more maintenance from Public Works—the filling of the tanks might be able to be done
at the same maintenance visit as when the dog waste is emptied.
Staff has also been made aware that an abandoned well does exist in the wooded area adjacent to
the proposed site, but if it was properly abandoned and capped, it would be unusable for re -use
now.
The neighbor also suggested security lighting for the area. In her research, she found that a street
light could be placed on an existing pole at the intersection of Acacia and Pilot Knob, and be
made to shine towards the dog park area. She felt that that would also discourage other problem
users in the area. If a light is able to be placed on an existing pole, Xcel would charge only for
the cost of the power.
COST ESTIMATES:
The June 29th memo outlines possible sources of funding for the off leash dog area, with a
$30,000 budget. Upon further review, the breakdown would be:

Adding large dog/small dog separations, black coating for the fence fabric, or a taller
fence increases the cost.
There would be the added costs of maintenance and upkeep (water, receptacle waste removal)
primarily from the Public Works Department. Mowing is currently performed twice a year.
Depending on what is chosen for funding, there may be additional operational costs for such
things as Police Officers checking dog licenses or use permits.
It is not anticipated that the City will patrol the use site for the removal of dog waste from the
grounds. It is expected that the owners of the dogs will be responsible for their own dog's waste

removal. If that does not happen, the owners could be ticketed; if it gets to be a significant
problem, the park could be closed.
BUDGET IMPACT:
As discussed in the June 29th memo, the city could sell dog park passes (suggested $20 for
residents, and $25 for non-residents). The best estimate is that this might generate $2000
additional revenue per year.
The Special Parks Fund could not be used for this sort of development. Minnesota Statute
462.358 subd. 2b (g) states,
"Cash payments received must be used only for the acquisition and development or improvement
of parks, recreation facilities, playgrounds, trails, wetlands, or open space based upon the
approved park system plan. Cash payments must not be used for ongoing operation or
maintenance of pars recreational facilities, playgrounds, trails, wetlands, or open space".
An off -leash dog area was not anticipated in the park system plan. Therefore, the only other
source of funding for this --if the dog park is to be constructed this year --would be the General
Fund. Based on mid -year projections, there should be funding available, based on typical
expenditure patterns, and that revenues received for FYI seem healthy to date.
RECOMMENDATION
I recommend that the Council approve the recommendations of the Planning Commission to
allow for an off -leash dog area to be an interim use in the I -Zone, and to furthermore approve the
permit application of the City for an off -leash dog area at this location, for a period of time not to
exceed 5 years.
In addition, if the Council concurs, it should direct staff to
1. Bring back an ordinance to establish No Parking on the north side of Acacia Boulevard
between the TH 55 bridge and Pilot Knob Road, and the south side of Acacia Boulevard
from its intersection with Pilot Knob Road, easterly for 100 feet.
2. Have the staff research and recommend dog park use rules, and use permit fees.
ACTION REQUIRED;
If the Council concurs, it should by motion:
1. Approve off -leash dog areas to be an interim use in the Industrial zone
2. Approve an interim use off -leash dog area for the Pilot Knob location, to expire
December 31, 2020.
3. Direct staff to make provide for improvements to allow for the off -leash park at the above
location, with funding to come from the 2016 General Fund.

Introduction:
As a follow-up to the Council's directives at the May 12th workshop, on June 23rd, the Planning
Commission will consider action to allow for an interim use (anticipated five years) of the Pilot
Knob site for a dog park. One other directive was to determine a source of funding for its
development.
Background:
Knowing the significance of Pilot Knob to the Dakota peoples, we did contact both the Chair of the
Mendota Mdewakanton tribe, and the Pilot Knob Preservation Association. We explained that
there has been discussion of the City -owned site for an interim dog park use. If that use should it
proceed, a fence would have to be installed, which would involve some digging for fence post
holes.
While there are longer term issues to be resolved regarding the ultimate use of that site
(development, versus preservation or an interpretive center), a use as a dog park for at least the
short term—with a suggested time frame of five years --was acceptable to them.
Funding:
Assuming that a dog park use is to be pursued, the estimated cost to build a temporary park at
Pilot Knob is going to be roughly $30,000. The largest part of this is for fencing, which is required
by code for the dogs to be off -leash. While not typically used for non -permanent park
expenditures, the Special Parks Fund is a possibility for funding. Another possible source of
funding for this project would be from the General Fund reserves.
There would be an opportunity to recover a small portion of the costs associated with building a
dog park through dog license fees. Staff has included a list of fees that nearby cities are charging
for dog license fees and dog park license fees.

Note that the City of Mendota Heights does charge $10 to license unsprayed/unneutered dogs, but
there are only a handful of these issued. However, there were only 186 dog licenses issued in
2014, which generated $1115.
Options: Staff has identified three possible options regarding licensing for the dog park.
Option #1: Increase all dog license fees from $5 to $10. If all current licenses are renewed, this
would produce and additional $1115 from license fees per year for an additional $5575 over the
next five years. We could mandate nonresidents to purchase a dog park license for $25, but that
would require dog park monitoring.
Option #2: Keep the dog license fees at $5, and sell a separate license for the dog park for $20. If
half of our licensed dog owners purchase a dog park license, this would produce approximately
$2000 in additional revenue per year. The City could also require all nonresidents to purchase a
dog park license for $25. This would, however, require monitoring for compliance by either the
Police Department, or by the City's contracted animal control company. To do the latter, however,
would likely be at an additional cost, thus reducing the net additional income.
Option #3: Do not charge any additional fees for the dog park.
Recommendation:
Option 1 would be the easiest to implement if we are to generate additional funds, but this will
mean that other funds will end up subsidizing the costs, short and long term.
Action Required
Council should select one of the above options by motion.

BACKGROUND
The City is considering amendments to Title 12-1G of the City Code concerning off -leash dog areas. The
Council directed staff to amend the City Code to allow interim uses, which was adopted by Ordinance 479
in Planning Case 2015-22, and off -leash dog area as an interim use in the Industrial District, as proposed in
this case. The interim use designation provides for a temporary facility while the City undergoes the
upcoming redevelopment and comprehensive planning processes.
DRAFT Ordinance 484 includes the conditions that are required for approval of an interim use permit for
the proposed use. Any additional revisions made the City Council may also influence the subsequent
interim use permit application, which is also included on the agenda for consideration, as in Planning Case
2015-30.
The Planning Commission conducted a public hearing at the July 28 meeting; there were no public
comments. The proposed ordinance was revised based on the Planning Commission discussion; revisions
are shown as tracked changes in the packet.
BUDGETIMPACT

RECOMMENDATION
The Planning Commission recommended approval of DRAFT Ordinance 484, as described in Planning
Case 2015-29. If the City Council desires to implement the recommendation, pass a motion adopting

The City Council of the City of Mendota Heights, Minnesota, does hereby ordain:
Section 1.
Title 12-1G-2-1 is hereby added as follows:
INTERIM USES:
Within the I industrial district, no structure or land shall be used for the following uses except by interim
use permit:
Off -leash dog area, provided that:
A. The minimum parcel size shall be five (5) acres, which may include a combination of adjoining
lots under control by the c
B. No principal or accessory structures shall located on the lot(s).
C. Proper fencing is installed around the entire off -leash area with height and materials approved by
the City Council.
D. Adequate off-street and/or on -street parking shall be supplied, as determined by the City Council.
E. Hours of operation shall be limited to between seven o'clock (7:00) A.M. and ten o'clock (10:00)
P.M.
F. Fixed lighting structures are prohibited.
G. All dogs shall be appropriately licensed.
H. All dogs shall be kept on -leash at all times except within the designated off -leash area.
I. No dog(s) shall be left unattended within the off -leash area.
J. Dog waste receptacles shall be provided and all dog waste shall be properly disposed of on-site
by the user or removed immediately.
Section 2.
This Ordinance shall be in effect from and after the date of its passage and publication.

and appropriate buffer space from surrounding properties, if necessary.

Due to the temporary nature of an interim use, no principal or accessory structures should exist on the lot(s).
C. Proper fencing is installed around the entire off -leash area with height and materials approved by the
City Council.
The City Council has discretion to approve fencing height and materials.
Staff is aware of other surrounding off -leash dog areas that do not have fencing. If the Council does not
feel that fencing is required around the entire proposed off -leash dog area, this condition could be revised.
D. Adequate off-street and/or on -street parking shall be supplied, as determined by the City Council.
The City Council has discretion to determine if off-street parking is necessary or if adequate on -street
parking is available.
E. Hours of operation shall be limited to between seven o'clock (7:00) A.M. and ten o'clock (10:00) P.M.
The hours of operation for public parks in the City are 6:00 A.M. to 10:00 P.M., as in Title 8-4-2 of the
Code. The City recently adopted weekday hours of operation for exterior construction activities from 7:00
A.M. to 8:00 P.M.
Staff is proposing hours of operation for the proposed use starting at 7:00 A.M., which is consistent with
weekday exterior construction hours of operation and later than for public parks. The closing time would
be consistent with public park hours of operation. Another option to consider could be to limit the hours
of operation from sunrise to sunset.
F. Fixed lighting structures are prohibited.
Fixed lighting structures may have negative impacts on surrounding properties.
G. All dogs shall be appropriately licensed.
According to Title 5-3-2 of the City Code: "...no person shall own, keep, or harbor any dog within the city
limits unless such dog is licensed..." Dogs found not to be in compliance with this provision would not be
allowed in the off -leash dog area and may be cited for violating the City Code. It is assumed that dogs
appropriately licensed in other cities would not require a license from the City of Mendota Heights.
H. All dogs shall be kept on -leash at all times except within the designated off -leash area.
According to Title 5-3-3-A of the City Code: "No owner of a dog shall permit his/her dog to beat large in
the city but shall keep such dog under restraint at all times."
If the Council determines fencing is not required around the entire proposed off -leash dog area, this section
of the Code may also require an amendment.
I. No dog(s) shall be left unattended within the off -leash area.
Unattended dogs may present a danger to themselves, other dogs, and the public.
J. Dog waste receptacles shall be provided and all dog waste shall be properly disposed of on-site by the
user or removed immediately.
According to Title 5-3-3-D-2 of the City Code: "It is unlawful for any person in control of, causing or
permitting any dog to be on any property, public or private, not owned or possessed by such person, to fail
to remove excrement left by such dog to a proper receptacle."

BACKGROUND
The City is seeking to construct an off -leash dog area on city -owned property within the Industrial Zoning
District. The request requires an interim use permit, based on adoption of Ordinance 484 by the City
Council, as proposed in Planning Case 2015-29, that allows the proposed use.
The city owns approximately 13 acres of undeveloped land south of Acacia Boulevard, east of Pilot Knob
Road, and west of Highway 55. The properties are bordered by two single-family residential uses to the
west and Acacia Park Cemetery across Pilot Knob Road; the historic Pilot Knob site to the north across
Acacia Boulevard; and an industrial/office building to the south.
As included in the attached staff report, if approved, the following conditions are proposed:
1. The interim use shall be terminated by December 31, 2020 or upon the properties being sold by the
City, whichever comes first, but may be renewed as provided for by the City Code.
2. The interim use permit is periodically reviewed to ensure compliance with the applicable codes and
policies and, if necessary, amended accordingly.
3. A fence permit is obtained.
The Planning Commission conducted a public hearing at the July 28 meeting. A neighboring resident
voiced concerns regarding fencing, lighting, safety/liability issues, water, impact on surrounding property
values, and parking.
BUDGETIMPACT
The City Administrator's memo to the Council addresses the budgetary issues regarding the proposed use.
RECOMMENDATION
The Planning Commission recommended approval of the interim use permit request, with conditions, as
described in Planning Case 2015-30. If the City Council desires to implement the recommendation, pass a
motion adopting RESOLUTION 2015-60 APPROVING AN INTERIM USE PERMIT FOR
UNADDRESSED CITY -OWNED PROPERTY.
This matter requires a simple majority vote.

The City is seeking to construct an off -leash dog area on city -owned property within the Industrial Zoning District.
The request requires an interim use permit, based on subsequent adoption of Ordinance 484 by the City Council,
as proposed in Planning Case 2015-29.
BACKGROUND
The city owns approximately 13 acres of undeveloped land south of Acacia Boulevard, east of Pilot Knob Road,
and west of Highway 55 (see attached Site Plan). The area consists of several parcels which are zoned I -Industrial
and guided for industrial development. Historically, the properties contained various residential and commercial
uses. The properties are bordered by two single-family residential uses to the west and Acacia Park Cemetery
across Pilot Knob Road; the historic Pilot Knob site to the north across Acacia Boulevard; and an industrial/office
building to the south.
In 2014, the City Council began exploring potential sites for an off -leash dog area and it was determined that the
proposed site was the best option. The Council then directed staff to amend the City Code to allow interim uses,
which were adopted as part of Ordinance 479 in Planning Case 2015-22, and off -leash dog areas as an interim use
in the Industrial District, as in proposed Ordinance 484 in Planning Case 2015-29. The interim use designation
provides for a temporary facility while the City undergoes the upcoming redevelopment and comprehensive
planning processes. The proposed use does not require any site improvements, other than fencing, and will not
remove any existing vegetation. As included in the staff recommendation, the proposed use as an off -leash dog
area shall terminate after five years, or at the time of sale of the property, whichever comes first.
ANALYSIS
Comprehensive Plan
The subject parcel is guided I -Industrial in the 2030 Comprehensive Plan. The city's request to establish a
temporary off -leash dog area, in compliance with the City Code requirements, allows for a temporary use of
undeveloped property while potentially reconsidering the future land use designation in upcoming planning
processes.

The newly adopted Title 12-1L-6-1 of the City Code includes the following standards for consideration of an
interim use; staff feels the proposed use is compliant:
A. The proposed use will not be detrimental to the health, safety or general welfare of the community, nor will
cause serious traffic congestion nor hazards, nor will seriously depreciate surrounding property value.
B. The proposed use conforms to the general purpose and intent of the city code and comprehensive plan,
including all applicable performance standards, so as not to be in conflict on an on-going basis.
C. The date or event that will terminate the use can be identified with certainty.
D. Permission of the use will not impose, by agreement, additional costs on the public if it is necessary for the
public to take the property in the future.
E. The user agrees to any conditions that the city deems appropriate for permission of the use, including a
condition that the owner will provide an appropriate financial surety to cover the cost of removing an
interim use and any structures upon expiration or revocation of the interim use permit.
F. The use will not delay anticipated development or redevelopment of the site.
G. The property on which the use will be located is currently in compliance with all applicable city code
standards.
H. The use is allowed as an interim use in the applicable zoning district.
As proposed in Ordinance 484, as part of Planning Case 2015-29, the proposed use would be permitted as an
interim use subject to compliance with the following conditions:
A. The minimum parcel size shall be five (S) acres, which may include a combination of adjoining lots under
control by the same property owner.
The City currently owns approximately 13 acres of land amongst several combined adjoining lots. The fenced -in
portion of the proposed off -leash dog area would encompass approximately three acres.
B. No principal or accessory structures shall located on the lot(s).
There are no structures located on any of the city -owned parcels.
C. Proper fencing is installed around the entire off -leash area with height and materials approved by the City
Council.
Staff is proposing a six-foot high, black chain-link fence around the entire proposed off -leash dog area. The City
Council, based on any recommendations from the Planning Commission and/or testimony received during the
public hearing, can determine alternate fencing materials and height to be erected.
Staff is aware of other surrounding off -leash dog areas that do not have fencing. If the Council does not feel that
fencing is required around the entire proposed off -leash dog area, this condition could be revised.
D. Adequate off-street and/or on -street parking shall be supplied, as determined by the City Council.
No off-street parking facility is included in the proposed project budget for this use. Staff is proposing to utilize
available on -street parking along Acacia Boulevard and estimates that approximately 20 on -street spaces exist
along a 500 -foot stretch on the south side of Acacia Boulevard (see Site Plan).
Due to the existing truck traffic serving the industrial areas to the south of the proposed site, and as a courtesy to
the adjacent residential use at 2170 Pilot Knob Road, staff is also recommending that the City Council consider
establishing the following no parking regulations (see Site Plan):
• North side of Acacia Boulevard between the Highway 55 bridge and Pilot Knob Road
• South side of Acacia Boulevard for the first 175 feet adjacent to 2170 Pilot Knob Road
E. Hours of operation shall be limited to between seven o'clock (TOO) A.M. and ten o'clock (YmbpaM
Starting hours are consistent with the hours of operation for exterior construction activities in residential zones,
which is meant to limit noise disruption, or barking dogs in this case, and closing hours are consistent with the
hours of operation for public parks.
F. Fixed lighting structures are prohibited.
No lighting is proposed for this use as part of the project.
G. All dogs shall be appropriately licensed.

SUBJECT: Workshop Date—Water / Fire Station Discussion
COMMENT:
INTRODUCTION
At its meeting of August 4th, the City Council will be asked to establish a date and time to
discuss two items:
1. Updated St. Paul Regional Water Contract discussion
2. Report on the Fire Station Feasibility and Programming Study
BACKGROUND
At its June 29 workshop, the Council asked questions and gave feedback on the proposed
contract revisions with the SPRWA. Staff has new information based on that discussion, and
would like to provide that to Council so that a decision on the contract may be scheduled.
In addition, last year the Council hired the firm of Buetow 2 Architects to perform a study of the
existing fire station building, and to make recommendations for its future. A study committee
made up of fire department personnel, Health East, and Councilors Povolny and Norton met
several times to discuss. The Study Report is now ready for discussion with the City Council.
It is anticipated that available times for the architect, the Fire Chief, and fire personnel will be
able to be reported at the August 4th City Council meeting.
If it is ready to discuss these issues, the Council will be asked to establish a date to do that. A
calendar of available dates is attached.
ACTION REQUIRED
Based on information available at the August 4th meeting, the Council should, by motion, set a
date and time for a workshop to discuss the SPRWA contract, and the Fire Station Feasibility
and Programming Study.
