RESOLUTION NO. 86- 13
RESOLUTION APPROVING CONDITIONAL USE PERMIT
WHEREAS, St. Paul's United Methodist Church has requested a conditional
use permit to construct a church on the east side of Dodd Road, approximately
one-half mile north of TH 110; and
WHEREAS, the required public hearing was conducted with no objections
to the facility being raised.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Mendota
Heights that a conditional use permit be granted to.St. Paul's United Methodist•
Church to allow construction of a church on the above described property on
condition that:

1. The church be constructed in accordance with drawing #SD -1, dated
February 19, 1986.
2. That the landscaping plan be reviewed and approved by City staff.
BE IT FURTHER RESOLVED, that an 18 foot -setback.variance be granted on
the north and south property lines and a five foot variance to the height of
the church spire also be granted.
Adopted by the City Council of the City of Mendota Heights this 4th day of
March, 1986.

Minutes of the Regular Meeting
Held 'Tuesday, February 18, 1986
Pursuant to due call and notice thereof, the regular meeting of the City Council,
( City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 7:36 o'clock P.M. The following
members were present: Mayor. Lockwood, Councilmember.s Blesener, Cummins, Hartmann,
and Witt.
AGENDA ADOPTION Councilmember. Blesener moved adoption of the agenda for the
meeting including additional items contained in the add-on
agenda.

APPROVAL OF MINUTES Councilmember. Hartmann moved approval of the minutes of the
February 4th meeting with correction.

PARK STUDY Mr. Barry Warner from Barton-Aschman Associates was present
to answer any questions Council had regarding the Park Study his
firm is conducting.
Councilmember Witt stated that she would like to see general
information, not detailed schematics of park facility improve-
ments. She was not comfortable with the $8,500 price, and
wanted to try to reduce that figure.
Mr.. Warner apologized for not being present at the February
4th Council meeting when the Park Study was considered. He too,
felt that Council expectations had not been met. He noted that.
Phase II of the contract responds to 'the -'general direction of
the Park and Recreation Commission and that meeting attendance
was a serious concern of the Commission. He said that meeting
Alf attendance was included under Task 5, which had not been
approved on February 4th. The two tasks approved on February
4th were memo formats and a consultant recommendation.
Mr. Robert Leffert of the Park and Recreation Commission sr
for the Commission members and referred to the Park and Rec
minutes of their last meeting. He said the ultimate goal of
the Commission is leading to a bond issue and they felt a need
from the consultant on a referendum.

BOARD OF REVIEW
The Council discussed a memo from City Clerk Swanson regard.g
a date for the 1986 Board of Review. It was the concensus
of the Council to set the date for. the 1986 Board of Review.
for Wednesday, May 21, 1986 at 7:30 P.M.
MISCELLANEOUS
The Council was advised that the precinct caucuses will be
conducted on March 18th, the same night as a regularly
scheduled Council meeting. Under state statutes, no meetings -m-!
be conducted on precinct caucus day after'6:00 P.M.
It was the concensus of the Council that the regular March 18th
City Council meeting be rescheduled to Monday, March 24th, at
7:30 P.M.
CASE #86 02,
Dietrich Investments, Inc. had applied for
a rezoning, sub -
HAMPTON INN
division, conditional use permit, ordinance amendment, and
HEARING
variances to allow construction of a Hampton Inn hotel on the
southeast corner.of TH 55 and Mendota Heights Road. This
matter was to have been considered by the Planning Commission
at a special meeting on February 10, and considered by the
City Council at a public hearing on February 18, but the
applicant withdrew his application. Because the hearing notice
had been previously published in the City's legal newspaper,
Mayor Lockwood called the meeting to order for the purpose of
that public hearing, and the hearing was opened.
Councilmember Cummins moved to close the public hearing at 7:46.
Councilmember Witt seconded the motion.

Mr.. Leffert had two requests for the Council:
1. To have the consultant's services, in person, all through
�irocess.
2. To have the actual dollar amounts with specific items
that these :dollars will produce that will go into the.bond
issue.
Mayor. Lockwood stated that he felt the $8,500 for Phase II is
too high for improvements. He thought the main concern should
be to acquire new land for an athletic complex.
Mr.. Leffert stated that the major issue of the bond referendum
is to acquire one of two sites and also, to satisfy all
segments of the population. He asked if the Council would
prefer to have this project done in three phases instead of two.
Mr. Leffert also stated that he did not know when the bond
referendum would be held. It could be as early as May, or in
June or September. He discussed the pros and cons on when the
referendum should be held. There was also discussion on who
would pick the final site for the athletic complex, the Park
and Recreation Commission or the City Council.
After further discussion, Councilmember Hartmann moved to
authorize approval of Task 5 - Requested Meeting Attendance,
and approval of a modified Task 2 - Improvements to Existing
Park Facilities, with a $4,000 maximum cost.
Councilmember Cummins seconded the motion.
"-Task 4 - Bond Issue Information Dispersion, will come to pass
upon satisfactory completion of the other tasks.
Mr. Warner invited the Council to phone him at his firm if
they have any questions regarding the study.
WHOLESALE WATER -,Mr:~-Wil L'iebenow,.of Short, Elliott, Hendrickson, was present
for discussion on the merits of Mendota Heights selling whole-
sale water. He noted that the original study was to convert
St. Paul Water retail to St. Paul Water wholesale in a simple
manner. He noted that the City would have to negotiate with
St. Paul Water on the price of.water and the price of meters.
Mr. Liebenow noted that the revenue generated through retail
sales would be slightly in excess of expenses. He then went
on to note possible advantages and disadvantages of retail
water sale.
Councilmember Blesener felt that the risks -would be greater
than the rewards.
Councilmember Cummins moved to authorize staff to attempt
to negotiate with St. Paul Water on reducing the 20% surcharge.
Councilmember. Blesener seconded the motion.

YORKTON CENTRE POINTE Mr. Larry Lee was present to request Council approval of
SOUTH, AMENDED PLAT
the amended final plat for Yorkton Centre Pointe South._
Mr.. Lee indicated that the original plat had not been
recorded yet, due to negotiation problems with GNB. The
amended plat deletes the GNB parcelfromthe plat.
After discussion, Councilmember. Witt moved adoption of
Resolution No. 86-10, "RESOLUTION APPROVING AMENDED FINAL
PLAT FOR YORKTON CENTRE POINTE SOUTH."
Councilmember Hartmann seconded the motion.

SOUTHEAST AREA PLAN
City Administrator Frazell briefed the Council on the
AMENDMENT
action taken by the Metropolitan Council Community Develop-
ment Committee regarding the Southeast Area Plan amendment.
GUN CLUB LAKE WMO
The Council acknowledged a memo from Public Works Director
REPRESENTATIVES
Danielson regarding the appointment of two members to the
Gun Club Lake Watershed Management Organization. It was the
concensus of the Council that Public Works Director Danielson
should be a permanent member of the WMO and Mr. Danielson
was directed to contact Mr. Miles Bredvold to see if he
would also be interested in serving as.a City representative.
In the event Mr. Bredvold declines, Civil Engineer I Klayton
Eckles would be the other staff member serving as a repres
entative.
SPECIAL SERVICE Councilmember. Hartmann moved adoption of Resolution No.
DISTRICT LEGISLATION 86-11, "RESOLUTION SUPPORTING LEGISLATION TO CREATE SPECIAL
SERVICE DISTRICTS."
Councilmember Witt seconded the motion.

FISCHER PROPERTY Councilmember Hartmann moved to authorize staff to order an
APPRAISAL appraisal of the Harry Kirchner property on Dodd Road.

MTC BUS ROUTE #19 The Council acknowledged a 'letter from Mr. Scott Thompson,
MTC Planner, requesting approval of a proposed change in
MTC Route #19 as it moves through Mendota Heights.
Councilmember Hartmann moved approval of the amendment to
MTC Route #19, as requested in Mr. Thompson's letter of
February 4, 1986.

MISCELLANEOUS The Council acknowledged and briefly discussed a memo from
Public Works Director Danielson regarding the traffic

noted that she would be coordinating lobbying.

PLANNING COMMISSION
MINUTES
FEBRUARY 25, 1986
The regular meeting of the Mendota Heights.Planning Commission was'called
to order by Vice -Chairperson Morson at 8:00 P.M. The following members were
present: Morson, Henning and McMonigal. Members absent were: Frank and Burke.
Also present were Planning Consultant Howard Dahlgren and Public Works Director
Jim Danielson.
Vice -Chairperson Morson introduced the two new Planning Commissioners,
Sandra Krebsbach and Ultan Duggan.
APPROVAL OF Minutes of the January 28 meeting had been submitted
MINUTES previously.
Commissioner McMonigal move& that the minutes be approved
as submitted.
Commissioner Henning seconded the motion.

HEARING, CASE #86-01; Vice -Chairperson Morson called the meeting to order for the
ST. PAUL'S UNITED purpose of continuing a public hearing on an application from
METHODIST CHURCH,, St. Paul's United Methodist Church for a conditional use
CONDITIONAL USE permit and variances to allow construction of a church on
PERMIT & VARIANCES the east side of Dodd Road, approximately one-half mile
north of TH 110.
Mr. Richard Haluptzok, architect from Buetow & Associates,
was present for the discussion. He presented a new drawing
showing a 60 foot right-of-way, all from the church property,
and stated the the proposed new road will be constructed
along the north side of the property. He noted that the
.proposed road placement was preferred by Mn/DOT.
Mr. Haluptzok stated that the setbacks they needed were even
less than what was asked for at the January 28 public hearing.
He"requested 32 foot setbacks on both the north and south
property lines, rather than 50 feet as requested previously.
He noted that the church location has been moved 34 feet
easterly due to a possible need for future right-of-way by
Mn/DOT. .He indicated that the church will still be set back
50 feet from the new right-of-way property line if Mn/DOT
takes any land. He also added that the new drawing shows
heavier screening on the south property line.
The applicant will petition the City for installation of
public utilities and street only as far east as the parking
lot, not all the way easterly to the end of the property.
There are about 120 members of the congregation now, and this
could double and there still would be ample room in the church
to accommodate the increase. He noted that there is only
one service on Sunday, that staff will be there most of

the week, and the pastor will not live iii the building. He
also said that a 5 foot variance is also needed due to t1-
height
rheight of the church spire.
Ms. Maureen Jensen, from Mn/DOT was present and showed
several different options for. Dodd Road alignment between
TH 110 and Marie Avenue. She said that the proposed church
location will preclude radical changes for. Dodd Road, but
will still leave several options open.
Commissioner Henning asked what will happen with the proposed
road and Mr. Jules Herman's driveway alignment now that the
right-of-way.is to be 60 feet wide. Mr. Herman responded
that the roadway will be across from his driveway now.
Vice -Chairperson Morson read a letter received from Mrs.
Lorraine Hohenstein, 1898 Dodd Road, property owner adjacent
to the southern property line of the church. She indicated
that she is not against the church, she is against 'losing
some of her land to allow the church to locate there.
Public Works Director Danielson pointed out that she will
not lose any of her land under the proposal.
Vice -Chairperson Morson opened the hearing for questions
and comments from the audience.
Mrs. Phyllis Stueve, 642 Callahan Place, asked who would b.-
assessed
Passessed for the public improvements and also questioned
length of the cul-de-sac.
CASE #86-04, ..-Mr. Garrold Murphy from Somerset Country Club was present
SOMERSET COUNTRY to request a 2,840 square foot variance.to allow construction
CLUB, VARIANCE of a 30'x8O'foot addition to an existing 30'x48' building.
He advised the members that an existing 27'x21' concrete block
building will be demolished to make room for the new addit
Planner Dahlgren indicated that he saw no problem with the
proposal, and noted that the new building will house
maintenance equipment.
There being no further questions or comments, Commissioner
Henning moved to close the public hearing at 8:33 P.M.

A gentleman in the audience expressed concern over drainage
across Dodd Road around the curve, and suggested that staff
take a close look at the problem.

SUBJECT: S.P. 1917 (T.H. 149) at Mendota Heights Road

I am writing in response to your December 20, 1985 letter concerning traffic safety at the
T.H. 149/Mendota Heights Road intersection. We have had an opportunity to observe and
analyze traffic operation on numerous occasions during the last few months. The State
Patrol has also been closely monitoring this area at our request. Our conclusion is that
no change in the present traffic control or intersection design is warranted at this time.
As a point of clarification. I believe the serious accident you referred to in your letter
actually occurred when one of the vehicles ran a red light. Drivers running red lights are
very rare, isolated, and unpredictable events. Unfortunately, when they do occur, serious
accidents may be the result. We asked the State Patrol to closely monitor this intersection
for violations.' They, have reported to us that no violations have been observed.
We have also given extensive study to the intersection at Mendota Heights Road. During
the morning and afternoon rush hours. there_ are brief periods of times when traffic on
Mendota Heights Road must wait for gaps in T.H. 149 traffic before entering the highway.
The delays that were repeatedly observed were not at all unusual for intersections in the
Metropolitan Area and would not warrant any change in traffic control. In fact, if a signal
were installed. delays to all vehicles would significantly increase.
Subsequent to this intersection being opened to ,traffic in the fall of 1984, four accidents
have been reported to the State Department of Public Safety. As you know, one of these
was a fatal accident involving a member of the Visitation Convent School community. This
accident was certainly tragic, and as with any fatal or serious injury accident, precipitates
a feeling that something must be done so it does not occur again. The facts we must deal
with, however, indicate that the number of accidents and accident rate are not unusual
for this type of intersection. As with delay, accidents would be expected to increase if
a . signal were installed because many additional vehicles would be forced to stop that
presently are not required to do so. Also. very serious accidents may still occur when a
vehicle inadvertently runs a red light such as the recent serious accident at the 1-494 north
ramp intersection involving a car carrying St. Thomas students. Traffic signals are not
necessarily safety devices, rather they are devices intended to control the assignment of
right of way when congestion becomes significant for long periods of any average day.

As part of our study of this intersection, we reviewed the sight distances available to drivers:
in al.l directions. There are not restrictions -to sight except those caused by other vehicles;
using the roads. Care must be exercised by drivers when one vehicle is blocking the view
of :tither approaching traffic.
Prior to the reconstruction of T.H. 149 and the opening of 1-494 to T.H. 149. our planning
studies indicated that traffic volumes at the Mendota Heights Road intersection wpulff
not be high enough for a long enough period of time during the day to meet the minimum
requirements for traffic signal installation. Recent counts taken verify those findings_
In fact, the counts are not close to meeting minimum thresholds, which is one of the
requirements of installing signals.
As you pointed out there are many inexperienced drivers using this intersection. Fromm
the observations we have made, we do not consider this location to be any more difficult
to drive through than hundreds of other intersections in the Metropolitan Area. Of the
accidents we are aware of in this vicinity, none were caused by school-age drivers.
When 1-494 is completed across Dakota County, either in late 1986 or 1987, traffic volumes
on T.H. 149 are expected ,to decrease somewhat. Of course as development in the area
occurs, additional traffic will also be generated. As with all of the intersections on the
Trunk Highway System, Mn/DOT will continue to monitor traffic operations and will take
steps to provide the safest traffic control that is feasible.
I appreciate you expressing your concerns about safety at this intersection. At the present
time, we believe the intersection is as safe as we can make it.

SUBJECT: Case No. 86-01, St. Paul's United Methodist Church, Request for
Conditional Use Permit and Variances

The Planning Commission conducted a public hearing on January 28 to
consider a conditional use permit for a new church,to be located approximately
one-half mile north of TH 110 on the east side of Dodd Road (Arnie Siebell's
property). There were many residents at the hearing and many questions and
concerns were -raised. The Commission narrowed the concerns to four and
continued the public hearing to their February 25 meeting,'allowing staff
and the applicant to address these concerns.
The four concerns were addressed at the February 25 meeting, and even
though the room was still full of interested residents, only one new question
was raised concerning possible future assessments.
RECOMMENDATION
The Planning Commission unanimously recommended that the City Council
approve the requested conditional use permit and two variances - those being
approval of an 18 foot setback variance on the north and south property lines
and approval of a 5 foot height variance for the church spire. These approvals
were recommended on the following condition:
1. The plan be accomplished as shown on drawing # SD -1, dated
February 19, 1986 (see attached drawing), to include the
platting at a future date.
2. That the landscaping plan be reviewed and approved by staff.
Staff recommends that Council add to the conditions a requirement for
the dedication of the 60 foot right-of-way. Staff further recommends that

WHEREAS, St. Paul's United Methodist Church has requested a conditional
use permit to construct a church on the east side of Dodd Road, approximately
one-half mile north of TH 110; and
WHEREAS, the required public hearing was conducted with no objections
to the facility being raised.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Mendota
Heights that a conditional use permit be granted to St, Paul's United Methodist
Church to allow construction of a church on the above described property on
condition that:

St. Paul's United Methodist Church is proposing to construct a church on•
the east side of -Dodd Road, approximately one-half mile north of TH 110. The
lot contains approximately seven acres and the configuration is a long, narrow
lot extending from Dodd Road easterly to'the Warrior Pond school site. The .
school site presently has only one access point from the south.- Staff feels very
strongly that accommodations should be made with the lot development to allow
sewer, water and streets to be extended easterly to*the Warrior Pond site.
The Church is amenable to allowing the City to construct, the street and install
the utilities adjacent to their north property line. They have spoken to the
adjacent neighbor to the north and he has stated that he is totally against any
development whatsoever on this piece of property. Knowing his feelings, and
desiring to expedite the project, the Church is willing to dedicate 50 feet of the
required 60 foot right-of-way. This will allow the City to construct the street
now in its entirety and obtain the remaining 10 feet from the reluctant property
owner to the north, at such time as he would subdivide his property.
Churches -are permitted in R-1 zoning by a conditional use permit, with a pro-
vision providing that no building shall be located within 50 feet of any lot line
of an abutting lot in an R district. Upon reviewing the site plan, a variance to
the 50 foot setback will have to be considered along the south property line. Staff
feels that this variance could be granted for the following reasons:
1. The building had to be pushed further south because theapplicant has
dedicated 20 feet more right-of-way than normal along the north property
line.
2. There is only one point of the building which violates the 50 foot setback
requirement.
3. The closest residence to the south appears to be set back 100 feet from
the Church's property line.
The applicant will need a variance to the height restriction on the church
spire, which is proposed to be 42.6 ft. The City's allowable height,for a spire
is 37.5 feet.
The Church proposes to install a ground sign at the intersection of Dodd and
the new proposed street.- The allowable sign area in an R-1 district is 12 square
feet with a maximum height of 10 feet. The proposed sign is 27 square feet.
The minimum -setback -is 30 feet (building setback). The Church desires to set their
sign back 20 feet.

Staff Is aware that subsequent to the approval of the conditional use permit
and building permit, the Church intends to subdivide the remainder of their
property into six single family lots.

DISCUSSION:
The Planning Commission conducted a public hearing at its January
meeting to consider a Conditional Use Permit to allow St. Paul's United
Methodist Church to construct a church on the east side of Dodd Road ap-
proximately 1/2 mile north of Trunk Highway 110. The hearing was continued
to the February meeting to allow the applicant time to address the following
Commission concerns:
1. The location of the new road.
2. The building setback from Dodd Road.
3. The orientation of the church, causing the need for setback vari-
ances.
4. The fact that only 50 feet of street right-of-way is being dedi-
cated when 60 feet is needed.
I sentwa-copy of the Church's plan to Mn/DOT and requested them to
review and comment on the first two concerns. On February 18th City staff
and the applicant met with Bob Benke and Maureen Jensen of Mn/DOT to discuss
Mn/DOT's findings.
At that meeting Mr. Benke presented a plan that showed a "worst case"
upgrading proposal for Dodd Road. He explained that if Mn/DOT would use
this plan they -.:would need-up.to 120 more feet of right-of-way from the
Church's property. After some discussion, it was concluded that a satis-
factory alignment of Dodd Road could be built with Mn/DOT acquiring only 34
more feet of right-of-way.from the church property. The Church's architect,
Dick Haluptzok is now preparing new plans that will move the church far
enough back to allow for Mn/DOT's acquisition of this 34 feet. Mr. Benke
stated that if a hardship could be shown Mn/DOT could acquire this right-of-
way immediately otherwise it would be acquired in the 1987-88 time frame.
Construction is programmed for 1990 subject to funding staying in place and
environmental studies being completed.
Mr. Benke stated that the new road's intersection with Dodd Road is on
a curve and a grade which is not ideal, however Mn/DOT has concluded that
the north property line is the best point on the property to make the access
with Dodd Road. The access problem will be improved with the upgrading of
Dodd Road in 1990. Maureen Jensen will attend the February public hearing
to answer any further questions the Commission may have.

rotated so that the requested variance on the south property line is reduced
to 18 feet.
The church has also indicated that it will dedicate the full 60 feet of .
right-of-way along the north property line.

able to be prepared before the meeting. Mr. Haluptozok will hand them out
the night of the hearing.

Now that we have completed our meetings regarding the new street right-of-way
and the future right-of-way needs for Dodd Road, I thought I would give you a
summary of the decisions we collectively arrived at:
1. The 60'-0" right-of-way for the new street will be totally on the church
property. The City will extend utilities and build the street during the
summer of 1986.
2. The street location will be along the north edge of the church property.
This location works better for the neighbors adjacent to the church and
is preferred by Minnesota Department of Transportation.
3. The church building has been re -oriented to minimize the requested variances
for building setbacks. The original plan requested a variance from
50'-0" to 20'-0" on the north and south sides. We now will be requesting
a variance from 50'-0" to 32'-0" at those sides.
4. The building has been moved + 35'-0" east to accommodate a possible
future widening of Dodd Road, to keep open the design options for that
work, and to maintain the required 50'-0" setback to the building
expansion line.
As we discussed, I will have colored drawings at the meeting on February 25, 1986.

1. Saint Paul's United. Methodist Church, now located on George
Street in the west side.:of Saint Paul; has sold their church
to the Hmong Methodist Church and propose now to construct a
new church in•Mendota Heights on the Arnold Siebell site,
consisting of 6.75 acres,• with approximately 260 feet of
frontage on the east side of Dodd Road. The property is
zoned R-1 and churches area conditional use, thus requiring
the processing of a conditional use permit prior to
construction approval.
2. The site, as you know, is long and narrow, being 503.26 feet
in depth (as 'Measured along the north property line) and a
north=south perpendicular width of 257.4 feet. The church
proposes -to use only 2.42 acres of the 6.75 acre site and
proposes to plat the remainder of the property into single
family lots.
3. We met with the applicants and their architect (Buetow and
Associates) -on January 13 to review this development
proposal. The initial design, reviewed at that time, did
not make provision for a public right-of-way to serve as
frontage for the proposed single family lots to the east.
We suggested therefore that an east -west street be platted
along the north side of the property. The architects and
representatives of the congregation informed us that the
property owner to the north does not desire to develop his
land and would prefer that no development occur to the south
as well. Thus, this owner will not likely be willing to
dedicate a 30 foot right-of-way constituting one-half of the
normally required 60 foot right-of-way width for a
residential street.

The applicants have therefore shown a 50 foot right-of-way
to be dedicated in the future. Mr. Danielson suggests that
perhaps an additional ten.(10) feet can be acquired from the
property to the north at such time as that land may be
developed.
The dedication of an east -west street in the vicinity of
this property will also contribute to providing more
adequate access to the so-called Warrior Pond property now
being offered for sale for development by the school board.
This property' is contiguous to the property *in question on
the east side and fronts on Warrior Road.
4. Though the applicant has not applied for a land division at
.this point, the submission of a Preliminary Plat would be
the appropriate means of providing for the required
right-of-way establishing a lot for the church site, and
providing for, the division of the six (6) lots to be sold
for residential purposes to the east. We would anticipate,
as reviewed. with representatives of the Church, that the
congregation would petition the City to construct the public
street which could be done in two phases. The street could
be built to the east property of the church at this time,
and extended later to provide frontage for the single family
lots and access to the property to the east.
5. Attached are copies of the site plan, landscape plan, floor
plan, and elevations of the proposed structure. The seating
capacity of the sanctuary is proposed to be 170 seats
.(including 30 seats in the choir). Expansion is provided
for an additional 100 seats. Attendance -of the current
congregation we understand is approximately 120 as of today.
We are somewhat concerned about the capacity for growth in
this overall design, inasmuch as the rule of thumb for the
establishment of new suburban churches is approximately five
(5) acres. The plans for the church include the expansion
of the northwesterly wing by an additional: 15 feet. The
congregation may wish to consider holding one or two of the
lots they propose to plat until such time -as expansion plans
may be more definitive.
6. The site plan indicates a 32 car expansion to the existing
101 car capacity of the parking lot. The ordinance requires
one parking space for each 3.5 seats. This is a minimum
requirement and in some cases is not adequate for suburban
congregations. Assuming 101 parking spaces as initially
proposed, and a seating capacity of 170, there will be one
parking space for each 1.68 seats. At a 270 seat capacity,
and a parking capacity of 133, the ratio will be 2.3 seats
for each parking space. Both are well within range of the
minimum required.

7. The conditional use of a church in the R-1 Zone requires
that the structure be located not less than 50 feet from any
property line. The initial design (without a public street
provided) places the- building 61 feet from Dodd Road,
approximately 73 feet on the north, and 60 feet from the
south property line. The current proposal proposes 61 feet
contiguous to Dodd Road (the front yard) with a 31 foot
setback from the proposed east -west street on the north and
31 feet from the southerly property line on the south.
Thus, a variance to the side yard setbacks will be required
in this case,, in addition to the approval of the conditional
use permit.
Obviously, the hardship in this case is the fact that the
property is extremely long and narrow,'.and the necessity of
a 50 foot right-of-way, substantially reduces the lot width.
The design of the entrance is such that the canopy extending
over the entrance drive, is substantially back from the
street and located so as to provide an excellent
relationship between the street and the parking area serving
the entrance to the east.
The location of the building is such that it would not
impair line of sight visibility at the intersection with
Dodd Road and the new east -west proposed street. The
southerly setback is as you will note from the site plan,
dimensioned from the corner of the building.' The dimension
isn't actuallyon the site plan, but the architect informs
us that it is 31 feet.
8. The higher element of the church structure_ is in, the
center, and the southeasterly wing (as you will not from
the elevations) has a hip roof oriented to' the southeast.
Thus, the impact of the structure should be minimal upon
the contiguous properties to the south.
9. The landscape plan submitted, we suggest is a preliminary
plan, and any approval of *the Conditional Use Permit could
be conditional upon a more detailed and ;expanded plan.
There are a number of coniferous trees planted - in the
westerly portion of the site. We suggest these could be
moved to the easterly side of the future parking lot so as
to make a transition to the single family lots to the east.
There should also be more adequate screening' of the parking
lot from the contiguous single family lots to the south.
The landscape plan indicates species and 'size, but not
quantities.
10. It would appear that the basic design will integrate well
with the residential neighborhood, with the combination of
hoop and gable roofs tending to "hug the ground". The
combination of brick and stained wood siding should augment
the residential character of the structure.

The applicants are holding a meeting with the Public Works
Direction on Tuesday, January 22, to discuss timing and
costs of the proposed public streets. The applicants have
informed us that they will prepare a statement from the
congregation outlining their objectives, more details of the
construction proposal, more specific proposals regarding the
construction of the public street and timing of the lot
development, and larger -scaled, dimensioned plans and site
drawings. We are aware that the congregation and their
consultants are trying to proceed as quickly as possible to
meet their development schedule.
12.
It would appear the most 'difficult aspect of the proposal
is that of the provisions for public right-of-way for the
lots and access to the property to the east. Such as
access, though it may. not be desired by all in the
immediate area 'will provide an important second means `of
access to the school district property to the east. The
problem with that property is that it will be very
difficult to build a road around either end of the pond to
serve the westerly half of the site.
13.
If aconditional use permit is granted, it should be
conditioned upon the provisions -for filing of a preliminary
plat and appropriate public right-of-way subject to
engineering staff approval of provisions for -utilities,
grading, and drainage, and -subject to final revisions of a
landscape plan to include emphasis for appropriate screening
to contiguous single family,residential,lots.�

PLANNING CONSIDERATIONS:
1. The applicants and their representatives appeared at the last meeting of
the Planning Commission with a proposal requesting approval of a
conditional use permit for the construction of a new church on the
Arnold Siebell property. At that time, a 50 foot right-of-way was
proposed on the north side of the property to provide access to the
north side of the church site, as well as to a series of 100 foot wide
lots on the easterly end of the property. `
2. The proposal has now been adjusted to provide for a 60 foot
right-of-way which does not require a future dedication of an additional
10 feet off of the north property. The current proposal suggests a 2.75
acre site for the church and the platting of five 100 foot lots to the
east.
3. The current plan calls for a parking capacity for 99 cars with an
expansion for an additional 30 cars. Based on the seating capacity of
the church -,as , discussed at the last meeting, this parking capability will
conform to ordinance requirements. One space per each 3-1/2 seats of
capacity, in the main assembly hall.
4. The ordinance requires that the principal structure be setback a distance
of 50 feet from any property line. The congregation, in this case, is
requesting that this distance be reduced to 32 feet on the south, 32
feet on the north, and 30 feet on the west. The hardship here, of
course, is the fact that the -property is long and narrow, being 1,103
feet in length (on the north side) and 257 feet in width. You will
notice that in all cases,.a corner of the church is located at the
minimum distance and, thus, the impact of the reduced setback is
significantly less than if a lengthy wall were placed at the reduced "
setback distance.
5. We- have some concern with respect to the provision for some additional
right-of-way on the west side of the site contiguous to Dodd Road. ', We
do not feel that it is necessary to extend the full 225 foot width of
UNITED METHODIST CHURCH, CASE 8601 Page 2
right-of-way once planned for in the 1950s for the re-routing of Dodd
Road. The extension of a local thoroughfare across Highway 110 on
this right-of-way is, however, an -ingredient of the overall plan for
central Mendota Heights approved by a planning study last year. This
may require the dedication of a sliver of land, perhaps squaring off the
west boundary of the property in a straight north/south direction. Such
additional right-of-way would, in our opinion, provide adequate area for
an extension of Dodd Road as a local thoroughfare across Highway 110.
Your Public Works Director will have additional comment regarding the
needs for this right-of-way.
6. The -landscape plan presented is basically adequate, but we suggest that
its approval be made subject to staff .review. Some additional plantings
are necessary for the west side of the structure and the north side of
the parking lot providing additional transition to the residential area to
the north of the proposed street. This application should be followed
with an application for construction of the street : and utilities as a
• public project and a filing of a preliminary plat to establish the site
for the church, dedication of the roadway, and the platting of the five
single family lots proposed to the east. There should also be provision
for a temporary turnaround, which will be necessary until such time as
the street is extended easterly to serve the "Warrior Pond" property.

Mr. Mike Bisanz is selling some 8+ acres of B1 -A zoned property lying
between I -35E and St. Thomas Academy to International Office Systems.
Dallas Development Company will be the developer and will be building a new
corporate headquarters for IOS on the site.
The property presently does not have sewer or water available to it and
Mr. Bisanz has petitioned the city for those facilities. To get sewer to
the property there are two other landowners that will be involved, Mr.
Robert Tousignant and St. Thomas Academy. Staff has recently met with Mr.
Tousignant to find out his reaction to the proposed project. His property
is presently green acres (farm land that cannot be assessed) and he does
not intend to take the land out of that status for the next few years. He
does not object to the project.
Mr. Pat Casey, St. Thomas Academy Superintendent, indicated that he or
a school representative would be at the public hearing. It did not sound
<_ like they would be opposed to the project if the City would defer making the
assessments to the school.
Staff will be prepared to make an oral presentation of the project the
night of the Council meeting. Please bring your feasibility reports.
RECOMMENDATION:
The project is a feasible one and staff recommends that Council order
it to go ahead and .allow staff to prepare the plans and specifications.

Staff sent the property owners of the Lake LeMay area a copy of the
attached public hearing notice and letter. As a result the Engineering
staff has received calls regarding the Lake LeMay public hearing. In addi—
tion to the concerns raised over the storm sewer project, some residents are
dismayed that an extension of the sanitary sewer and watermains to serve the
Furlong Addition is not part of the proposed project. These residents
indicated they will attend the public hearing to voice their positions.
The extension of the sanitary sewer and water utilities to serve the
Furlong Addition was not specifically addressed in the LeMay feasibility
report. The Engineering Staff previously recommended that installation take
place in the.,future when the upgrading of Trunk Highway 55 begins, so staff
did not recommend that the Council order it's inclusion in the study. This
proposal has been studied in the past; a feasibility report for the Garron
property included cost estimates to serve the Furlong Addition. Converting
these 1984 figures to the present gives a rough idea of the approximate cost
to install sewer and water and restore the streets in the Furlong Addition,
about $750,000. This amounts to about $13,000 on the average lot, but there
are some large lots that could be three times this amount. These figures do
not take into account the Tax Increment Financing that could be used in the
future to cover a portion of the.costs to bring the assessments in line with
typical utility costs. Currently there is no Tax Increment Financing bud—
geted in 1986 for a project of this size. Therefore to fund a project to
serve the Furlong area would require,budge ting Tax Increment Financing for
1987 or 1988. Although the LeMay storm project in its present form does not
directly benefit the Furlong Addition with sewer and water, it does include
the extension of sewer and water from Transport Drive to Trunk Highway 55,
which will indirectly help in the future.
As far as the storm sewer project itself is concerned there have been
several arguments against the storm sewer assessments. In particular the
residents on Rogers Court plan to be in attendance at the Council meeting to
protest the storm sewer project. They argue that the problem did not sur—
face until Trunk Highway 55 was upgraded near Mendota Heights Road. It is
true that Mn/DOT increased the quantity of hard surface and improved the
ditches so the Trunk Highway 55 runoff surely has increased to some extent,
but the increased flow is not sufficient to be the major cause of the
problem. As stated in the feasibility report the problem is most likely
caused by the excessive rainfall in the past years and possibly reduced
perculation. Other arguments that might be raised at the hearing include
the lack of benefit received, or that a greater benefit is received by the
Bredvolds.
Staff will be prepared to make an oral presentation of the project the
night of the Council meeting. Please bring your feasibility reports.
RECOMMENDATION:
Staff recommends that storm sewer be installed to control the Lake
LeMay water level and that sanitary sewer and water utilities be extended
from Transport Drive to Trunk Highway 55 in order to serve the Brooks
property. The results of the hearing may indicate that staff should con-
sider sewer and water extensions to serve the Furlong Addition in a feasi-
bility study.
ACTION REQUIRED:
Conduct a public hearing and if the Council agrees with staff's recom-
mendation then the Council should pass a motion adopting Resolution No. 86-

Over the past several years there has been higher than normal precipi-
tation and Lake LeMay has been rising. The water is now at such a high
level that it is on the verge of flooding homes. The City has investigated
the alternative solutions and we have determined that there is only one
reasonable one, to construct a storm sewer that will control the lake level.
We have worked with the Minnesota Department of Transportation and
because some of the water comes from their highway they are willing to
share in the costs of the construction, but the remaining costs will have to
be assessed to the area property owners whose lands either drain into the
lake or the adjoining land west of Trunk Highway 55. Our estimates for the
costs of these assessments are $925 per acre or 2.15 cents per square foot
of contributing land. Attached is the official notice informing you of the
public hearing to be held by the City Council on March 4, 1986. This
hearing is being conducted to determine if the project is to go ahead.

couple of days with the flu so they are not quite complete however a com-

weather permitting. They will then begin construction a model home as soon
as the mass grading is completed. We have a 66 working day completion on
the City project so that public facilities will be available to the project
about August 1st_

8a. Planning Case #86-02, Dietrich Investments, Inc. Request for
Rezoning, Subdivision, Conditional Use Permit, Ordinance Amendment
and Variances.
As I have informed Council in the past, Dietrich Investments
and Langer Construction proposed a replatting of the property at
the southeast corner of TH SS and Mendota Heights Road, with the
anchor development to be a Hampton Inn hotel. That planning case
was to be the subject of a special Planning Commission meeting on
February 10, and referred to the City Council for a public hearing
and final action this evening.
Prior to the Planning Commission meeting on February 10th,
the application was withdrawn. However, the notice ofup blic
hearing has already been placed in the official City newspaper, so
that to meet legal requirements, Council should open and close
thatup blic hearing at 7:45 P.M.

9c. Discussion of Metropolitan Council Action on Southeast Area
Plan Amendment.
In the Friday News of February 14th, I described in some
length the action of the Community Development Committee on
Thursday the 13th. In anticipation that some may not have brought
that section of the Friday News to the meeting, an additional copy
is attached.

Once again, no formal Council action is required this
evening, this is simply an opportunity to discuss the status of
this project.
9i. Approval for MTC to Change Route #19.
Attached is a letter from Scott Thompson, planner with the
MTC, describing a proposed change in Route 19 as it moves through
Mendota Heights. As noted in the letter, City staff -had suggested
to the MTC planners that there should be some bus route serving
our growing industrial park in the southwest corner of the City.
Mr. Thompson notes in the letter that MTC regulations require
that the City approve operation of Route 19 on Mendota Heights Road
west of Highway 55 to Pilot Knob Road, then south to the Mendota
Heights border.
ACTION REQUIRED
Motion to approve the amendment to MTC route 19 as requested
in the letter of February 4.

Final Plat
Case No. 85-24
DISCUSSION:
The City Council approved the Yorkton Centre Pointe South final plat for
Larry Lee on December 17, 1985. When the plat was approved Mr. Lee was still
dealing with GNB to acquire some of their property for right-of-way for his
project. The County let him file the plat in 1985 subject to those negotiations
being finalized. Mr. Lee and GNB have been unable to come to terms.
Mr -.,Lee states that every day the plat goes unsigned it is costing him a
large sum of money. He therefore requestes that the City allow him to make
a small change to the plat and remove the GNB parcel.
Staff has no problems with Mr. Lee's request. Staff will acquire the
right-of-way from GNB as part of the public improvement project and assess the
costs to that project.
RECOMMENDATION:
Staff recommends that Council approve the amended Yorkton Centre Pointe
South plat.
ACTION REQUIRED:
If Council wishes to implement the staff recommendation, they should pass
a motion adopting Resolution No. 86- RESOLUTION APPROVING AMENDED FINAL

WHEREAS, an amended final plat for Yorkton Centre Pointe South has been
submitted to the City Council; and
WHEREAS, the City Council has reviewed said amended final plat and
finds the same to be in order.
NOW THEREFORE IT IS HEREBY RESOLVED by the:City Council of the City
of Mendota Heights, Minnesota, as follows:
1. That the amended final plat of Yorkton Centre Pointe South submitted
at this meeting be and the same is hereby approved.
2. That the appropriate City officials be and they are hereby authorized
to execute the final plat on behalf of the City of Mendota Heights.

METROPOLITAN COUNCIL COMMITTEE REVIEW OF SOUTHEAST AREA PLAN AMENDMENT
Consideration of our Southeast Area plan amendment was before the Metro Council
Community Development Committee on Thursday afternoon. Some of you may have seen the
report on the result of that meeting in today's Pioneer Press Metro Section, Page 2.
In case you didn't, I am attaching a copy. The reporting is generally accurate, if
not complete, although I do not know where they got the figure of a 120 acre site.
As you will recall, the Met Council staff report had recommended the plan amendment
not be approved without the City:
a. Implementing an ordinance to ensure appropriate levels of sound attenuation
in structures within the aircraft noise exposure zones;
b. Preparing an implementation plan to notify occupants of proposed developments
of the potential for aircraft noise;
c. Agreeing to submit plans for new developments classified as conditional land
uses to the Metropolitan Council for review and comment prior to implementation.
In last week's Friday News, Council received a copy of my letter to the Committee members
taking exception to those recommendations.
While the outcome of the Committee meeting was somewhat vague in my mind, I generally
felt it was positive for us. The Committee members were fairly firm in their assertion
that it would expect all cities to eventually implement the Guidelines for Land Use
Compatibility with Aircraft Noise in their comprehensive plan, and would want to see that
done in -our plan amendment at this point. However., they conceded (and frankly, in some
cases I think learned for the first time) that the Metropolitan Council had never com-
pleted its obligation to develop a model ordinance. They conceded that it was hardly
realistic to ask Mendota Heights or any other city to implement the noise attenuation
ordinance when they have not done their part. They indicated that they would not hold
up our plan amendment approval pending development of that ordinance, but would be looking
fbr some commitment from the City to implement the o._d_ina.uce when it is completed, and
other cities are doing so. Included in their action was a directive to the Metropolitan
Council staff to complete work on the ordinance.
They also generally concurred with our suggestion that notification of potential
property owners and renters was a responsibility of the private sector, rather than the
City. They suggested that rather than the City coming up with a program to notify
potential occupants, they should esquire developers in the noise contour areas to present
to us eir plan for occupant notification.
There was frankly very little discussion about item C. The final recommendation
adopted unanimously by, the Committee was:
That the Metropolitan Council inform the Clity of Mendota Heights that
it will (emphasis mine) approve this amendment when the amendment has
been modified to ensure satisfactory compliance with the Councils'
Guidelines for Land Use Compatibility with Aircraft Noise.
While this appears a little vague, I think from the tone of discussion I have a fairly
good idea of what they are and are not expecting from us_,so that we can put together an

do, until the full Metropolitan Council has either accepted or rejected the
Committee's recommendation on February 28th.
HOUSING PLAN AMENDMENT APPROVED
The Community Development Committee also acted on our proposed amendment
to.the Housing component of our Comprehensive Plan. The Council passed this
amendment last June but Howard's office did not turn it into the Met Council
until recently. -The Community Development Committee found the proposed amend-
ment consistent with Metropolitan Council goals and recommended approval to
the full Council.
HAMPTON INN APPLICATION WITHDRAWN
The proposal to build a Hampton Inn at the southeast corner of TH 55 and
Mendota Heights Road was originally scheduled for a special Planning Commission
meeting on Monday evening. Late last Friday afternoon, we received a call asking
that that meeting be cancelled. Subsequently, this week we learned that the
principal investors had withdrawn from the project, and that it would not be
going forward, unless resurrected by another group. Therefore it appears that this
property will not be developing in the near future.
PABST MEAT SUPPLY FIRE CODE VARIANCE
Fire Chief John Maczko and Code Enforcement Officer Paul Berg met with Tim
Pabst and his contractor Wednesday morning to look over the situation in the
Pabst basement, and possible solutions thereto. Apparently, this meeting went
much better, since I talked -to Tim later in the morning and he confirmed that he
had gotten some useful help from the City. He better understood the need for
ventilation.
Tim's contractor. will be considering alternative ways that they could make
the opening in the north wall of the basement to satisfy the Fire Code.
MENDOTA PLAZA FOR SALE!
We have learned through a couple of sources -that the Mendota Plaza has.been
placed on the market by the Sheehy family. We understand that there are several
developers who have expressed an interest in acquiring and rehabilitating (or
demolishing and rebuilding) the property.
Howard was also contacted this week by a remodeling architect who had been
retained by the Sheehy's to come up with some ways to rehabilitate the Center.
Apparently they are Looking at their options.
MAYOR/MANAGER'S BREAKFAST WITH STATE REPRESENTATIVES AND SENATORS
As planned, we had our Mayor/Manager's breakfast this morning (hosted by
Mendota Heights) with all of the representatives and senators from the northern
Dakota County area. We discussed the Governor's proposal to cut local government
aid'and homestead tax credits approximately 8% in this fiscal year. Represen-
tative McKasy reported 'that the goal of the Republican caucus is to take the
budget shortfalls from State agencies and welfare programs, and try to make no
cuts in local government aid or homestead tax credits.

Dear Mr. Frazell:
Last October when we met to discuss MTC plans for service changes in Mendota
Heights I indicated to you that the Service Planning Unit was considering a
route change on the St. Paul Route #19.
For your reference, I have enclosed a hand schedule for the St. Paul Route
#19. As I recall, you had indicated interest in the possibility of bus
service on Mendota Road & Pilot Knob Road to serve the rapidly developing
business park. In response to your request, the MTC is planning a route
change on Route #19 that would provide this service. The new Route 19 would
operate on Snelling Avenue as it is presently operating, then via Montreal
Avenue east to I -35E to Hwy. 110 to Lexington Avenue to Mendota Heights Road
to Pilot Knob Road to Corporate Center Drive (old Eagan Industrial Drive) to
Eagandale Blvd. and then back to Lone Oak Road and its present route.
Before this service can be implemented, MTC requires concurrence from the City
of Mendota Heights to operate on Mendota Heights Road west of Hwy. 55 to Pilot
Knob Road and then south to the Mendota Heights border.
Also, the MTC is considering route changes to the Route #72 Express and on the
Route #46 express. A public hearing will be held sometime in late March to
discuss staff's plans to change these routes. I will keep you informed as to
the time and place of this public hearing. Please call me at 349-7774 if you
