Ayes: 5 Nays: 0 PULLED CONSENT AGENDA ITEM H) APPROVAL OF FIREFIGHTER RETIREMENT Mayor Krebsbach announced that Firefighter Tracy Wilcziek retired effective March 17, 2015. Firefighter Wilcziek became a firefighter on September 22, 1997 and served with the department for 17 years. He was certified as a Firefighter II, First Responder, and trained to the Haz-Mat Operational Level. Councilmember Norton moved to accept the retirement of Firefighter Tracy Wilcziek retroactive to March 17, 2015. Councilmember Petschel seconded the motion. Ayes: 5 Nays: 0 K) APPROVAL RESOLUTION 2015-38 MNDOT LANDSCAPE PARTNERSHIP AGREEMENT FOR PILOT KNOB RESTORATION PHASE III In this agreement, Councilmember Duggan requested that Section 2.1. E. Restore Right -of -Way, be revised to read "on that which was disturbed do to this project". At the request of Mayor Krebsbach, Assistant to the City Administrator Tamara Schutta came forward to explain the agreement. She explained that the agreement is a boilerplate template from MnDOT, however, she will check to see if they would agree to the removal of the word "all" in section 2.1.E. There is no financial exposure to the City on this project. Mayor Krebsbach requested that confirmation be received that Great River Greening, the organization responsible for the volunteers, provides insurance coverage for them. page 5 Councilmember Duggan moved to adopt RESOLUTION 2015-38 MNDOT LANDSCAPE PARTNERSHIP AGREEMENT FOR PILOT KNOB RESTORATION with the requested revision to Section 2.1.E. Councilmember Petschel seconded the motion. Mayor Krebsbach offered a friendly amendment to the motion to include `and based on the fact that the City of Mendota Heights is not providing indemnification for the work.' Councilmember Povolny seconded the friendly amendment. Ayes: 5 Nays: 0 M) APPROVAL OF THE ADDITION OF A CANOE RACK AT ROGERS LAKE PARK Councilmember Petschel requested that Recreation Program Coordinator Sloan Wallgren explain the addition of a canoe rack at Rogers Lake Park. She also asked if the City would assume any liability. Recreation Coordinator Wallgren explained that the Parks and Recreation Commission approved recommending to the City Council to consider installing a canoe rack at Rogers Lake Park. Funds for the construction would come from the Special Parks Fund and the rack would be built by city staff. The Parks and Rec Commission suggested a rental fee of $50 per year. City Attorney Tom Lehmann indicated that staff would need to install appropriate signage so that residents understand that the City would assume no liability or responsibility for their canoe or kayak and that acceptance of the fee does not put liability upon the City. Councilmember Petschel moved to approve the addition of a canoe rack at Rogers Lake Park with appropriate signage indicating no liability or responsibility on the City of Mendota Heights. Councilmember Povolny seconded the motion Ayes: 5 Nays: 0 N) APPROVAL OF THE ADDITION OF PICKLEBALL COURTS AND FULL BASKETBALL COURT AT MARIE PARK Councilmember Duggan acknowledged the Parks and Recreation Commission and staff for putting together this proposal for pickleball courts at Marie Park. Recreation Program Coordinator Sloan Wallgren explained what pickleball is and where the courts would be located at Marie Park. Councilmember Duggan moved to approve the addition of pickleball courts and a full basketball court at Marie Park. Councilmember Povolny seconded the motion. Ayes: 5 Nays: 0 page 6 P) APPROVAL OF CLAIMS LIST Councilmember Duggan asked if the claim identified as Urban Companies is for work on the Sibley Memorial Trail and was this additional on top of the amount paid in January. Public Works Director John Mazzitello replied that this is the latest pay request that falls under the amended budget for the project. The project is virtually completed as the trail has been paved and tolerance checked. All that remains to be done is the landscaping along the edge of the pavement. Councilmember Duggan requested that the Councilmembers be informed on the total dollar amount spent on this project. Councilmember Duggan moved to approve the list of claims as presented. PRESENTATIONS A) SWEARING IN CEREMONY OF POLICE OFFICER PHILIP MCCARTY Chief of Police Michael Aschenbrener introduced Police Officer Philip McCarty and provided information about his background and experience. Police Officer Philip McCarty read the Police Officer Code of Ethics and was sworn in by Mayor Krebsbach. Ayes: 5 Nays: 0 NEW AND UNFINISHED BUSINESS A) RESOLUTION 2015-37 BID AWARD FOR VICTORIA ROAD PHASE H CONSTRUCTION PROJECT Public Works Director John Mazzitello explained this resolution is to accept bids and award the contract for the Victoria Road improvements, the second phase of the reconstruction of Victoria Road. A bid opening was held on May 27, 2015 with four bidders. Valley Paving Inc. was the low bidder. They are an experienced contractor who has done work in Mendota Heights in the past. In addition to the base bid for the Victoria Road project, staff asked for an alternate bid for the City Hall parking lot. That bid came in at $172,306.75 and staff recommended that the alternate bid not be accepted. It was hoped that a better price would be obtained by tying the two projects together. Construction would be scheduled to begin in June and completed before Labor Day. Councilmembers asked questions regarding staff's estimate of cost compared to the bid from Valley Paving. Councilmember Povolny moved to adopt RESOLUTION 2015-37 AWARDING CONTRACT FOR THE VICTORIA ROAD SOUTH NEIGHBORHOOD IMPROVEMENTS (PROJECT #201308a) TO VALLEY PAVING INC. AND REJECTING ALL ALTERNATE BIDS FOR CITY HALL -UPPER PARKING LOT RECONSTRUCTION. Councilmember Duggan seconded the motion. Ayes: 5 Nays: 0 B) ITEM PULLED FROM AGENDA C) PUBLIC HEARING REQUEST FOR CRITICAL AREA PERMIT / VARIANCE AT 1104 SIBLEY MEMORIAL HIGHWAY Planner Nolan Wall explained that the applicant was requesting a public hearing before the City Council to consider approval of an after -the -fact critical area permit and variance request for construction of a retaining wall. Planner Wall shared an image of the subject parcel highlighting the retaining wall, which was constructed in 2011. Staff was made aware that critical area and building permits were not obtained and contacted the property owner accordingly. Due to the after -the -fact nature of this application and the page 9 fairly straight -forward review process that a project like this would require, staff recommended that the application be considered directly by the City Council. The variance request portion of this request pertains to the height of the retaining wall. In the critical area ordinance, it limits a wall to five feet. Staff was seeking recommendation from the City Council to consider conducting a public hearing for the after -the -fact permit and variance applications either on June 16 or July 7 Council meetings. Ms. Jennifer Foley, 1104 Sibley Memorial Highway, who is the applicant, was present to answer questions from the Council. Councilmembers asked questions regarding the condition of the wall in relation to it being replaced five years ago, the height of the current wall in comparison with the old wall. Councilmember Povolny moved to set the public hearing date for Tuesday, July 7, 2015, and direct staff to provide the required public notice. Councilmember Norton seconded the motion. Ayes: 5 Nays: 0 D) PUBLIC HEARING REQUEST FOR AMENDMENTS TO FINAL PLANNED UNIT DEVELOPMENT PLAN, FINAL PLAT, AND DEVELOPMENT AGREEMENT BY RYLAND HOMES Planner Nolan Wall explained that Ryland Homes, the developer of LeMay Shores housing project, is requesting a public hearing to consider approvals of amendments to the Final Planned Unit Development Plan, Final Plat, and Development Agreement. The current proposed amendments are required to create an additional outlot, which requires a Conditional Use Permit and a public hearing. Planner Wall shared an image of the LeMay Shores project highlighting the proposed outlot area location. The proposed outlot would be owned and maintained by the homeowners association. Staff feels that the proposed outlot would have very few negative impacts, if any, on the surrounding residential properties. As a result, the developer is requesting that a public hearing be held before the City Council on June 16 in order to expedite the approval process. Councilmembers asked questions regarding the creation of the outlot and when Ryland Homes would be present to explain what they are going to do in regards to airport noise extenuation for these homes. Councilmember Duggan moved to set the public hearing date for Tuesday, June 16, 2015, to consider approvals of the amendments to the final PUD, Final Plat, and Development Agreement, and to add a second agenda item to hear Ryland Homes' plan for noise abatement and construction standards for the housing project. Councilmember Povolny seconded the motion. Ayes: 5 Nays: 0 page 10 E) ORDINANCE 478 CONCERNING MINIMUM REQUIREMENTS FOR SINGLE-FAMILY RESIDENTIAL DISTRICTS, PLANNING CASE 2015-15 Planner Nolan Wall explained that the City was considering amendments to Title 12, Chapter 1, Article E of the City Code concerning minimum requirements for single-family residential districts. In response to the recent infill development and the increasing number of tear -downs in the area, the City Council directed staff to research potential ordinance amendments to address several issues that were discussed at the February and May workshops. The issues discussed relating to this development pattern included structure size and footprint, minimum lot sizes, building height, the character of the neighborhood, and construction impacts. After discussion by the Council, staff was directed to proceed with certain amendments, which were provided in Ordinance 478. Planner Wall briefly highlighted the sections contained in the draft ordinance. Councilmembers asked questions regarding input by the Planning Commission, a review of the items not in the proposed Ordinance per Council request, and the inclusion of width clarification. Councilmember Duggan moved to adopt ORDINANCE 478 CONCERNING MINIMUM REQUIREMENTS FOR SINGLE-FAMILY RESIDENTIAL DISTRICTS. Councilmember Povolny seconded the motion. Ayes: 5 Nays: 0 COMMUNITY ANNOUNCEMENTS Assistant to the City Administrator Tamara Schutta made the following announcements: • Parks Celebration scheduled for Friday, June 5 with "Steve Clark and the Working Stiffs". On Saturday, June 6, will be the 10th annual 5K and events at Mendakota Park. • CenturyLink has submitted a franchise application to NDC4. A public hearing is scheduled for June 3. • Truck & Travel Show at Henry Sibley on Wednesday, June 10. • Link available on the City's website to MnDOT regarding the Highway 13 project update. • Over 250 kids have registered for the Mendota Heights golf programs this summer. • Over 200 kids have registered for the Mendota Heights summer programs. • The Fishing Derby is scheduled for June 25. Fire Chief John Maczko provided an update on the recent fire events. page II COUNCIL COMMENTS Councilmember Duggan expressed appreciation to Fire Chief John Maczko and to Chief of Police Michael Aschenbrener and their staff for all of the work they do. All Councilmembers agreed. Councilmember Petschel noted that the Federal Aviation Administration (FAA) is starting a two-year study on the concept of day/night levels of noise, averaging them, coming up with a 65 DNL system to determine if it is the best metric. She will keep everyone up-to-date on this. She also mentioned that she spent time at the Scott Patrick Memorial Little League Tournament at Mendakota Park. It was a wonderful tournament. She has learned that the Dodge Nature Center is contracting with Great River Greening to work on the southern piece of the Lily property. Mayor Krebsbach mentioned an email received from a group called NerdWallet indicating that Mendota Heights has been ranked 9th out of 123 cities in the State of Minnesota as one of the best places to start a business in Minnesota. She also congratulated all of the seniors graduating from high school this year; including Councilmember Povolny's son. ADJOURN Councilmember Duggan moved to adjourn. BACKGROUND I am seeking your approval to attend the International City /County Management Association (ICMA) annual conference which with be held in Seattle, Washington from September 26 to 30, 2015. This is the premier annual conference for administrator and manager in the field of local government, and provides the opportunity to learn new skills and sharpen existing ones. City policy requires that the City Council approve any out of State travel by city employees. Further, the Employment Agreement with the City Administrator states that the City "will annually consider paying for the cost of registration, travel and subsistence for attendance at national, state, and local meetings of the International City Management Association..." BUDGET IMPACT The estimated expenses including conference registration, lodging, and meals are $2100. The funds to provide for attendance at this conference are included in the City's 2015 budget, in the Administration Department's Training and Conferences line item. RECOMMENDATION The Council is asked to pass a motion to approve the City Administrator's attendance at the 2015 International City/County Management Association annual conference in Seattle, Washington, from September 26-30, 2015. We have in the past rented this piece of equipment to cut the road side weeds and city owned lots. BUDGET IMPACT In the 2015 Streets Budget under rental and leases there is $5,500.00 budgeted for renting this piece of equipment this year. Staff has received a quote off the state contract for a new 80" brush cat high flow mower attachment for our existing Bobcat. The Tri State rental lease agreement terms and conditions states that 100% of the rent applies to the purchase price of $4,800.00 which would be paid in 2015, over the year we would make two payments of $2,400.00. RECOMMENDATION Staff recommends that the City Council authorize the signing of the Tri State Bobcat lease agreement to purchase a new 80" high flow brush cat mower attachment for our Bobcat for the purchase price of $4,800.00 which would be paid with the money budgeted in 2015. The majority of calls were classified as false alarms or good intent calls. Eight were residential in nature and four were commercial alarms. There were four utility checks (gas leaks or power lines), one Mutual Aid call, one car fire, one EMS call, and one structure fire (see attached incident of interest). Monthly and Squad and Department Training The monthly department and squad trainings were held at the vacant home in Sunfish Lake. All of the trainings incorporated basic fire ground skills such as interior fire attack, ventilation, and search and rescue. On May 30th, the department had a live fire training exercise on the vacant home that we had been using for training the previous months. Fires were lit in various areas of the home and allowed to grow until they resembled a typical room and contents fire. When the fires reached that point, a crew of firefighters entered the building to extinguish the fire. This type of training is the most realistic training that firefighters can receive. During the course of the training, eight different fires were set and then extinguished by the attack teams. Eventually the house was allowed to burn down. Chief 1 (Maczko) and Chief 2 (Dreelan) arrived, reported a working fire on the back of the home involving the three season porch and extending into the attic. Chief 1 assumed command and Chief 2 assumed C division. First arriving Engine 10 (Stein, Bogg, Belmares, Goldenstein, Henning and Ober) pulled a 2.5" attack line to the side C line and attacked the exterior fire. Once the exterior fire was knocked down, they entered the porch and extinguished the interior fire. Ladder 10 arrived (Heidelberg, Madland, Mendez, Willems, and Taylor) laid a supply line to Engine 10 and advanced a second line to the second floor and assisted Engine 10. The fire was placed under control 20 minutes after the department's arrival. RESPONSE TIME: 11 minutes FIRE ORIGIN/CAUSE: Under investigation. Shortly thereafter, a scoping committee was convened to provide feedback and comments on the project scope to staff and the City's planning consultant. As a result of those discussions, and the initial scope included as part of the approved grant application, the attached project scope is being presented to the Council for review and approval. The goal of the study is to create a redevelopment plan that is both visionary and realistic. In summary, the proposed project scope includes: 1. Planning analysis 2. Market overview 3. Idea generation 4. Workshop(s) 5. Plan preparation Stantec is proposing to complete this project as an addendum for a special project under the existing Professional Services Agreement as the City's planning consultant. The project schedule is 6-9 months and, if approved by the Council, staff would begin to coordinate the required work as soon as possible. BUDGETIMPACT The City's required $10,000 match as part of the grant agreement would be paid out of the Industrial Development Fund. RECOMMENDATION Staff recommends that the City Council pass a motion approving the Professional Services Agreement Task Order with Stantec Consulting Services for the work proposed in the Industrial District Redevelopment Plan Scope. Stantec 2335 Highway 36 West, St. Paul MN 55113-3819 PROFESSIONAL SERVICES AGREEMENT TASK ORDER Mendota Heights Industrial District Redevelopment Area Plan June 10, 2015 TASK ORDER This task order is an addendum for a special project under the Professional Services Agreement dated January 1, 2015 between the City of Mendota Heights and Stantec Consulting Services. Special projects are referenced in Attachment B, item 4 of that agreement. BACKGROUND Mendota Heights has received a grant from the Dakota County Community Development Agency (CDA) for an Industrial District Redevelopment Area Plan. Stantec will partner with the City to prepare this plan. The study area for the plan encompasses the approximately 500 acres of the City's Industrial Zoning District located in the southwestern corner of the City, bounded generally by 1-494, and State Highways 13 and 55. The grant would be used to develop a redevelopment plan for the area, which includes a number of properties which are either vacant or underutilized and ripe for potential redevelopment. SCOPE OF WORK The City's initial scope described in the grant application includes: • Analysis of existing zoning • Analysis of existing site conditions and potential constraints • Review of the market factors that may influence future development of the properties • Preparing a redevelopment plan • Identifying potential funding for property acquisition and remediation if necessary • Land use plan and zoning amendments that may be necessary to implement the plan. Goal The goal for the study is to create a redevelopment plan for the area that is both visionary and realistic. To accomplish this goal we will undertake the study in five steps: Design with community in mind June 10, 2015 Nolan Wall, City of Mendota Heights page 20 Page 2 of 3 Task 1. Planning analysis. Stantec and City staff will conduct basic analysis of the area; current conditions, parcel size, existing land uses, existing zoning, building condition, vacancy, access, transportation, MSP airport noise and safety zones, visibility, and other issues for the whole Industrial District. This task will involve creating base maps of the area, researching available property and building data, and reviewing previous reports and studies relevant to the area. Task 2. Market overview. Interviews and analysis to determine the market for the properties in the study area as a business park. We will engage a subconsultant real estate expert to assist in gathering information, statistics and opinions on activity and potential in the area, given its location relative to Mendota Heights and surrounding communities, MSP airport, Bloomington 1-494 strip, Downtown St. Paul and other regional drivers of economic activity. Task 3. Idea generation. We will gather a technical group or groups of real estate and development people to brainstorm ideas for what could be, given the study area's location and characteristics. We will look particularly at the southwest portion of the study area as a potential focus area for more intense consideration. Stantec and City staff will then refine the ideas for presentation to the Planning Commission and City Council. Task 4. PC/CC Workshop. Present ideas to the Planning Commission and City Council in a workshop setting to gauge support for various ideas and develop a preferred plan. Task 5. Prepare plan, Stantec and City staff will refine likely scenarios and develop implementation steps to make one or more of them a reality. This would likely involve identifying future studies on key implantation steps, plus potential amendments to the Land Use Plan and zoning code. Mazzitello, PE, PMP MBA Public Works Director/City Engineer SUBJECT: Sub -Licensing of a Right -of -Way License Agreement BACKGROUND In 2013, the City granted a License Agreement to the owner of 963 Wagon Wheel Trail for the use of an undeveloped, City -owned Right -of -Way as a private driveway to their residence. 963 Wagon Wheel Trail was developed after the original lot was split into two separate parcels. The second parcel, located at 953 Wagon Wheel Trail has now developed, and the owner wishes to have the driveway of the new home connect to the driveway in the Right -of Way granted by the original 2013 License Agreement. Included in the 2013 License Agreement is a provision for sub -licensing the Right -of -Way at the request of the original License holder. This provision was included in the original agreement for this specific purpose. In 2013, it was not known how the 953 Wagon Wheel Trail lot would be developed or if the new owners would want the home to access the driveway, or access directly onto Wagon Wheel Trail. The developer of the new home would like to utilize the Right -of - Way for driveway access; and under the terms of the original agreement, the current License holder needs to request a sub -license be issued. This request is attached. Included with the 2013 License Agreement Approval was a Shared Driveway Maintenance Agreement between the owner of 963 Wagon Wheel Trail and the owner of 945 Wagon Wheel Trail. This agreement outlines the responsibilities for maintaining the driveway within the City - owned Right -of -Way. The City is not a party to this agreement, although the City did require it be agreed to as a condition of approving the original License Agreement. All three parties (963, 953, and 945 Wagon Wheel Trail) have agreed to a new Shared Driveway Maintenance Agreement, and the new agreement will be recorded against all three properties at Dakota County if the sub -license is approved. BUDGET IMPACT Other than the staff time to complete the amended License Agreement, no expense is anticipated for this action. RECOMMENDATION Staff recommends that the City Council authorize staff to execute an amendment to the 2013 License Agreement establishing a sub -license to the owner of 953 Wagon Wheel Trail. page 23 John R. We will need a copy of that in the near future. Mr. Quehl received a License Agreement to utilize the City Right -of -Way as part of his development approval. A condition of this License Agreement was that that he establish the Shared Driveway Maintenance Agreement with the Pinces. The cleanest way to handle the City approval for your property is going to be to have Mr. Quehl ask for a sub- license to his License Agreement for use of the Right -of -Way. There is a provision in the License Agreement that allows for this, and that sub -license would need City Council approval. The kicker is that since Mr. Quehl is the holder of the License Agreement, he has to request the sub -license. I am available this week and next (until noon on Friday, 6/12) to discuss. I would need the request for sub -license by noon on 6/10 to be able to put an item together for the 6/16 Council meeting. SECTION TWO If it becomes necessary or desirable to repair or rebuild the southerly 35 feet of driveway, the repairing or rebuilding expense shall be borne equally by the parties, or by their heirs and assigns who shall at the time of the repair or rebuilding be using it, in proportion to the extent of their use. Any repairing or rebuilding of the driveway shall be on the same location, and of the same size, as the original driveway or part of the original driveway, and of the same or similar material of the same quality as that used in the original driveway or part of the original driveway. SECTION THREE The benefits and obligations of the covenants in this agreement shall run with the land described above so long as the driveway or any extension of the driveway continues to exist, and shall bind the respective parties to this agreement, their heirs, legal representatives, and assigns. SECTION FOUR This agreement between the above pal -ties does not bind the City of Mendota Heights in any way, including the City's right to improve the right of way to City street standards and assess those costs to the above parties, or to abandon or vacate the right of way in the future. Note: The City does not currently have any plans to improve or vacate the right of way. Item 2: Successful Completion of Probationary Period, Public Works Superintendent Terry Blum Effective June 4, 2015, Terry Blum successfully completed his probationary period as the Public Works Superintendent. Terry's 30+ years of experience and extensive knowledge of the public works operations has provided for a seamless transition into his role as Public Works Superintendent. Terry Blum's position is a Grade Level 34 in the City's position and pay classification plan. On June 4, 2015 Mr. Blum is at Grade Level 34, Step D. City staff recommends that the city council officially appoint Terry Blum to the position of regular, full-time Public Works Superintendent, effective June 4, 2015. Item 3: 2015 Parks and Recreation Temporary Seasonal Hires Staff continue to recruit for the 2015 summer season. Staff recently interviewed for the Tennis Lead position. This position will assist our Tennis Instructor in providing tennis instruction for youth group lessons. The following applicant was offered their position contingent upon a successful completion of a criminal background check and council approval. City staff recommends that city council approve the hiring of Brandon Goldirsh as Engineering Intern effective June 8, 2015, at the authorized wage of $12.00 per hour. Item 5: Forestry Interns Hires At the June 2, 2015 meeting, the city council authorized staff to begin the recruitment process for two Forestry Intern positions. The interns will take an inventory of the ash trees located in our city parks and on our boulevards. Staff recently interviewed two candidates. Ms. Jessica Donoian is a studying Environmental Science and Forest Ecosystem Management at the University of Minnesota. Ahnika Hesbjerg is studying Environmental Sustainability at the University of Minnesota Duluth. Both Jessica and Ahnika will be able to start on a part-time basis at the end of June and work through August. The two intern positions will each be limited to 240 hours at an hourly rate of $10.00. Staff recommends that the city council approve the hiring of Jessia Donoian and Ahnika Hesbj erg as Forestry Interns pending a background check, at the authorized wage of $10.00 per hour. The necessary parts are on order, and the cars will soon be transitioned into fully equipped squad cars. BACKGROUND: The marked squad cars are obtained through a lease through the State of Minnesota. The cost varies slightly by vehicle; our average vehicle cost for 2014 was $8995.42. This is $2,000 less than the purchase price of 2015 with no changes on the State of MN Contract. The lease requires the city to pay for gas, oil, tires and brakes during the term of the lease; all other costs are covered by the State. In April, the State contract vendor for the conversion was here at MHPD and assessed the vehicles for parts that would not last 3 more years. The only major part needing to be replaced in both squads is the computer docking station. The State Contract vendor highly recommends the installation of the molded back seats. This will be an additional cost item. BUDGET IMPACT: The removal and placement with the parts is estimated at $4379.15 per car. We will be adding amplified antennas for wireless connectivity to the squad computers at $2054.00 for each vehicle. The exterior graphics are $375 per car. The radars in each car will be replaced at a cost of $2186.21. One of the two squads will have a new in -squad camera system installed at a cost of approximately $4500. Earlier in 2015 Sgt. Petersen was successful in writing a grant to replace the squad computers. These will be added when the grant money is made available by the State. The cost of a squad computer is approximately $4500. All other equipment and wiring will move from the old squad to the new squad. The transition from old to new takes approximately one week. These are all budgeted costs in the 2015 budget. Finance has confirmed the money is available for the approved usage. RECOMMENDATION: No action required --for informational purposes only. According to Title 12 -1K -6-G(2) of the Code: All other changes in use, or rearrangements of lots, blocks and building tracts, any changes in the provision of common open spaces, and all other changes in the approved final plan must be made by the council under the procedures authorized by this chapter for the approval of a conditional use permit. No amendments may be required by the council because of changes in conditions that have occurred since the final plan was approved or by changes in the development policy of the community. According to the applicant, during mass -grading of the site earlier this year a large debris field was uncovered in the rear yards of ten lots abutting the Resurrection Cemetery property (see site map). The debris consisted mainly of concrete, asphalt, flower pots, and miscellaneous trash; no contaminants were found. Formerly known as the NURT (North Urban Regional Trail), the 8 -mile regional trail utilizes existing and newly -constructed trail segments through Lilydale, Mendota Heights, West St. Paul, and South St. Paul to connect important regional destinations. The Master Plan will be a long-term policy guide for improvements, acquisitions, management, and operations and is being funded through the Statewide Health Improvement Program (SHIP). Staff participated in the process of developing the plan as part of a technical advisory group. As segments of the Greenway are improved as designated within the Master Plan, it is intended for Dakota County to assume maintenance responsibility to the entire facility, which will traverse Mendota Heights from Lilydale Road, south through Valley Park, east along Highway 110, north along Warrior Drive and east along Marie Avenue. The timeframe for the assumption of maintenance responsibility will depend upon timing of any projects deemed necessary as part of the Master Plan. Attached is an Executive Summary of the DRAFT Master Plan; representatives from Dakota County will be in attendance to answer any questions. Today, the surrounding landscape is fully developed and consists of a mix of land uses, including residential neighborhoods, parks, schools, and commercial corridors. 1 River to River Greenway DRAFT MASTER PLAN Executive Summary 2015 EXISTING CONDITIONS The River to River Greenway's route travels from the Lilydale trailhead of the Big Rivers Regional Trail (part of the Minnesota River Greenway) to Kaposia Landing and the Mississippi River Regional Trail through parks, residential, and commercial areas in the communities of Mendota Heights, West St. Paul, and South St. Paul. The greenway links destinations including: Valley Park, Village at Mendota Heights, Henry Sibley High School, Dodge Nature Center, Garlough Park and Elementary School, Marthaler Park, West St. Paul City Hall, Robert Street commercial corridor, Wentworth Library, West St. Paul YMCA, Thompson Oaks Golf Course, Thompson County Park, and Kaposia Park. The River to River Greenway connects the Mississippi River - just downstream of its confluence with the Minnesota River - to the Mississippi River in South St. Paul - after it has traveled through downtown St. Paul. Between these spans of river is a rich, urban and suburban landscape full of residential neighborhoods, retail districts, parks, and open spaces. Cultural Resources Within the greenway corridor there are parks, historical and cultural features, and many recreational resources, both old and new, that have provided people with access to nature for generations. Though few of these resources are considered historic by state or federal definitions, or have simply not yet been evaluated, they are an important part of the landscape to the people along the greenway corridor. There are other cultural resources recognized by the State Historic Preservation Office within and around the River to River Greenway. Of note is the G.W. Wentworth House. There does not appear to have been many architectural/ historical evaluations within the corridor, but much of the housing stock is of a sufficient age to be evaluated and the possibility remains that further investigations could uncover some additionally intriguing resources. Natural Resources The River to River Greenway corridor connects several forested parks and open spaces through urban and suburban development patterns. The overall quality of plant communities within the corridor is moderate to high quality, as identified by the Minnesota County Biological Survey (MCBS) and the Minnesota Land Cover Classification System (MLCCS). The corridor is flanked by two large natural ares -- Valley Park and Kaposia Park -- that consist of moderate to high quality plant communities. The fully realized greenway trail will be a continuous, paved trail for nature -based recreation and non -motorized transportation. The trail is a connective feature linking recreation destinations (places people go for outdoor recreation), activity centers (gathering places along the trail), and trail connections. The plan recommends that the theme and subthemes be integrated into the greenway design and interpretation concentrated at trailheads and neighborhood gateways. The greenway area contains a rich cultural history with stories of key historical figures, movement corridors, and open space preservation areas. Cultural sites that can be highlighted along the greenway include Dodd Road, Dodge Nature Center, Kaposia Park, the historic Wentworth house, and other parks and schools. This rich cultural history offers opportunities to integrate interpretation into The Greenway. The plan recommends restoration and protection efforts be focused at the trailhead locations, where there is the greatest opportunity for greenway users to see the results of activities. Stewardship activities in the larger greenway corridor will need to be in cooperation with public and private landowners. All stewardship actions should be evaluated through the lens of sustainability — is the stewardship effort sustainable over the long-term, from both an ecological and economic perspective. IMPLEMENTATION &MANAGEMENT Implementation will depend on multi jurisdictional collaboration. Without continued coordination between the communities and agencies that the greenway travels through it is unlikely the greenway, as it is envisioned, will be fully realized. While the 30' regional trail corridor will be the jurisdictional and operational responsibility of Dakota County, the larger greenway corridor will be governed in many ways depending on the situation and land ownership. As greenway segments are reconstructed or enhanced to regional trail standards, formal joint powers agreements between Dakota County and collaborating agencies will need to be established to outline specific agency responsibilities. These agreements will outline who has control over the trail right-of-way, as well as who will operate and maintain the trail and how they will do it. Similarly, responsibilities for land acquisition, construction, stewardship, operations, and maintenance will depend on the particularities of each segment. River to River Greenway Habitat Investment Areas MISSISSIPPI iNATIONAL RIVER & RECREATION AREA 7 River to River Greenway DRAFT MASTER PLAN Executive Summary 2015 Land Protection and Stewardship Dakota County's greenway concept expands the traditional concept of a corridor to include recreation, transportation, ecology, and water quality components in a 100' - 300' corridor. Because securing the entire width of the corridor is not feasible, a dual approach to securing greenway lands is recommended. ► Land Protection is essential to make the greenway usable to the public. For the River to River Greenway, having existed as the North Urban Regional Trail for several years, the majority of the land is already in public ownership or under a trail easement. For land owned by other public agencies, Dakota County will need to permanently protect the trail corridor and trailheads for greenway trail use with easements or joint powers agreements. For land that is currently privately owned, the County will need to protect the trail corridor for public use. Land protection strategies include: park dedication, direct purchase with resale of land not required for the trail, permanent easements, land donation, bargain sale, life estate, and negotiations with cities and developers. ► Land Stewardship refers to the care of native landscapes and habitat within the wider greenway. Generally, Dakota County will not be the lead agency in stewardship activities outside of the 30' trail corridor, but will work as a steward partner with local jurisdictions, agencies, and private landowners by providing funding and expertise whenever possible. Phasing and Priorities Greenway segments have been prioritized as either first priority, second priority, or long-term projects. It is anticipated that first priority projects will be built in advance of second priority projects but the Master Plan remains flexible so that any project can be implemented as partnership or funding opportunities arise. ► First priority projects are those that are needed to create a continuous, functional greenway experience. It is intended that recreation, water quality, and natural resource elements be integrated into the greenway at the time of initial construction. ► Second priority projects will enhance the greenway experience. These are more expensive trail reconstruction segments, trailhead development, and enhancements to existing trail segments. ► Long-term projects will be installed as funding, partnerships, or construction opportunities arise. RAVA Creek at Big Rivers Regional Trailhead Garlough Park is an environmental learning site for Garlough Elementary students. Kaposia Park in South St. Paul contains the only MLCCS-identified high quality plant communities along the corridor. Cost share roles will be determined based on the strengths of each agency and circumstances of each project. In-kind contributions of land, easements, design, engineering, construction, maintenance, and operations are encouraged and will be outlined in individual joint powers agreements between agencies. It is anticipated that most future capital projects will be positioned to secure regional, state, and federal funds for recreation, water, and habitat, and that these sources will account for the majority of capital construction costs. In many cases, but not all, Dakota County, as the regional agency, will be in the best position to pursue outside funding. Examples of outside funding sources include: ► NPS Rivers, Trails, and Conservation Assistance Program ► Federal Transportation Grants (Map 21) ► Minnesota Department of Transportation ► Minnesota Department of Natural Resources ► Minnesota Pollution Control Agency ► Metropolitan Council ► The Environment and Natural Resources Trust Fund ► Clean Water, Land, and Legacy Amendment ► Watershed Management Organizations ► Foundations and Nonprofits ► Statewide Health Improvement Program (SHIP) Funding for annual operating and maintenance costs for the 30' regional trail corridor and trailheads will primarily be the responsibility of Dakota County. Annual operating costs are funded though the Dakota County General Fund Budget and from regional park allocations from the Metropolitan Council. In situations where there are efficiencies in local jurisdictions performing maintenance and operations, Dakota County will enter into a joint powers agreement outlining responsibilities and cost sharing. To maintain a fresh look and provide useful information to our residents, it is recommended that a website is updated and redesigned every five years. The city's webmaster team is responsible for maintaining the content of the site. The team members include Nancy Bauer, Bobby Crane, Sue Donovan, Trista Miller and Tamara Schutta. Our current website is six years old and it is very limiting as what we can do with it. Over the past year, staff has had the opportunity to review other options for updating and maintain our website. We have had the opportunity to see demonstrations from CivicPlus. If the City Council gives staff direction to move forward with a website redesign, we have several options available to us. We can continue to use GovOffice Web Solutions for our website platform. The cost to complete a complete navigation restructure and section rebuild is $4,850 for up to 300 pages. The past six years, GovOffice Web Solutions has met our basic needs. However, it can be cumbersome and inflexible for managing the site. If the city were to consider CivicPlus, it would provide a new platform for community engagement, secured online payments, creation of an intranet, and more flexibility managing web content (i.e. images, video, agendas, etc...). CivicPlus offers a four-year payment plan to lower the one-time project development and start-up costs of launching a new website. The four year partnership would include a redesign in the fourth year. Annual recurring fees would be the following: 1St Year 2 nd Year 3r Year 4th Year $10,819 $10,819 $10,819 $5,115 The city's purchasing policy allows for the city to purchase through a Cooperative Purchasing Agreement for items or services less than $50,000. This allows the city to enter into a service agreement with CivicPlus through the GSA Contract #GS -35F -0124U. Another option for the city would be to obtain additional quotes through an RFP process. page 85 Staff would like to provide a ten minute overview of the city's website and provide a few examples of other local government websites. If the city were to redesign the website, it would take approximately 5 months from start to finish to have a new site up and running. BUDGETIMPACT There is $11,000 available in the 2015 budget for a full website redesign. RECOMMENDATION Staff will provide a ten minute overview of the city's current website and show a couple of examples of other local government sites. Staff is also seeking direction from council if they desire to move forward.
