Stringer Midwest Planning: Howard Dahlgren Absent: Tom Libera Continuation of .Fublic Hearing as follows: Hardy Wright B. Genereaux, Secy. Case 67-5, 67-5a Applicant: T. O. Curley -present at hearing Location: Lexington and Highway 110 Request: (Case 67-5a) Conditional use of Lots 1 through 5, Block 1, Curley's Valley View. Area to be used for parking adjacent to Outlots B and C. Case 67-5: Rezone Outlots B and C of Curley's Valley View from B-2 (neighborhood) to B-3 ( general business) for cons- truction of Swenson's Carriage House Furniture Store. A. Tom Curley's description of project. Rolf Ljungkull, Chairman, requested that Tom Curley review his proposal for rezoning. In his review, Mr. Curley discussed the following items. 1. Request rezoning Outlots B and C from B2 to B3 to encourage regional business. 2. He would be willing to change his request for conditional use of residential lots 1 through 5 to conditional use for lots 1 through 3, and to rezoning only the portion of Out - lots B and C needed for the store. 3. Would request at a later date conditional use permit for parking on the remaining lots #4 through #9 as needed. 4. Showed sketch of proposed wall. Would build wall parallel to a line 30 ft north of the right of way for Mary Adele and extending approximately from the apex of lot 1 through lots 1 to 9 to the west side of Patricia. The wall would consist of concrete columns spaced 45 feet apart and joined by precast concrete segments. Electric or gas lights would be mounted on top of each column. The height of the wall would be 4'8" and a space of 6" to 8" would exist between the ground and the bottom wall segment. 5. Construction of the project would begin in the spring of 1968. 6. Said land owner would maintain planting strip until such time as parcels were leased. Thereafter according to agreement the lessee would maintain the planting strip adjacent to his property. B. Howard Dahlgren At the termination of Curley's talk, Howard Dahlgren reviewed the proposal by saying that the furniture store would be a desirable addition to the (2) B. Howard Dahlgren continued village since the business would be a quiet one with low volume traffic. He also approved of the wall construction as described by Mr. Curley. Suggested also was that only the portion of Outlots B and C occupied by the store and the parking lot should be rezoned, thereby providing greater control of future development of the area. However the owner of the land could go to the courts if unreasonable demands were made by the village at a future date. Mr. Dahlgren concluded his talk by reading his report of October 25, 1967, which outlined his recommendations for rezoning. C. Qtestion6 and Answer Period A question and answer period ddveloped the following: 1. Erection of a wall through lots 1 through 9 infers future conditional approval of parking on the remaining lots 4 through 9. 2. Other businesses which could be attracted might be a medical clinic, funeral home, small supermarket, etc. 3. Commission can recommend approval of portion of application but cannot add to it. 4. Mr. Curley evaded the question as to whether or not he would provide a performance bond for maintaining the planting strip adjacent to the wall. However with persistent questioning he reluctantly agreed to a performance bond,. 5. Mr. Curley is in the process of painting the barn white. 6. Mr. Curley,when asked if he was removing the illegal signs on the Imrner9said that he didn't know as if the signs are illegal. 7. Area Residents who replied that they were in favor of oDnditional use permits for lots 1 through 3; partial rezoning of Outlots B and C directly north of lots #1 through #3, erection of the wall, and planting of the adjacent buffer strip are as follows: a Frank Moudry 2090 Theresa, lots 7 and 8 b A. Curley said he would need to investigate if the type wall he planned to build could be made 5 feet high as requested by the commission. 9. Curley asked that the planning commission guarantee that a possible future rezoning of lot 1, block 2 include a wall and buffer strip for protection of lot 2, block 2 Curley's Valley View. 10. Howard Dahlgren said that if the rezoning was approved and a building as proposed failed to materialize, the conditional use permit would be void but the rezoning would be valid. (3) D. RRecommendations of commission members: 1. Hardy Wright Conditional use permit for lots 1 through 3. 2. Len Lustig Recommended performance bond for maintenance of 30 ft. buffer zone. 3. Charles Hebble Recommended conformance to conditions required at September 27, 1967 meeting prior to approval of rezoning. 4. B. Genereaux...,. Recommended landscaping be designed by competant landscaper. Landscape plan should include list of plant materials. 5. George Weed Recommended rezoning be denied since Mr. T. O. Curley had sufficient time to comply with recommendations made at Planning Commission Meeting of September 27, 1967, E. Public Hearing closed. F. Motion made by George Weed, seconded by B. Genereaux as follows: Deny application by T. O. Curley for rezoning outlots B and C from B 2 to B 3 and for conditional use permit for lots 1 through 5, because the applicant had failed to comply with all 8 recommendations which were presented to Mr. Curley verbally at the September 27, meeting of the Planning Commissionaid later presented in writing by Howard Dahlgren. All items discussed at the September 27, 1967 meeting are as follows: 1. Submit complete landscape plan 2. Submit complete plot plan 3. Show wall to be 5 feet high of brick 4. Fourth wall or back of building should be finished same as others. 5. Submit a drainage plan 6. Submit a lighting plan 7. Remove barn behind business buildings 8. Correct existing signs on corner Ayes 4.0.Nayes 2.....Motion approved for denying application for rezoning. 1 Note: Reports and letters presented at hearing: Tom Curley's November 21, 1967 letter Midwest Planning Commission report of October 25, 1967. REGULAR BUSINESS MEETING Harry Peters, a resident of Bloomington, questioned the commission as to the possibility of his raising dogs on a 3 IA acre piece of property, he was planning to buy at 1062 Wagon Wheel Road. He mentioned that he also boards dogs tot as a business but as an accomodation. Cited was Section 7.3 (8) which requires a conditional use permit in an R 1 district for " The keeping of domestic aniamls for non- commercial purposes, including horses for the use of the occupants of the premise, provided that any accessory building used for housing such animals shall be located not less than 100 feet from the nearest residence." Also mentioned was the fact that boarding of dogs constituted a kennel. Since there is no provision in the ordnance for a kennel, the operation of such is prohibited. Mr. Peters was told that the only way he could raise and board dogs was by an (4) amendment to Ordnance #32. The Commission informed him that an amendment could not be initiated for anyone not owning land in Mendota Heights. 2. Howard Dahlgren presented a plan whereby Economics Laboratory proposed an amendment to their existing development plan for the purpose of constructing a parking lot. No application for variance was made, as only a parking lot permit is needed. 3. Motion was made, seconded and approved toedjourn the meeting. Time: 11::30 P. M. Respectfully submitted, B.
