Held Tuesday, March 17, 2015
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. Other members present included
Councilmembers Povolny, Petschel, and Norton. Councilmember Duggan was absent.

F) RECOGNIZE FIREFIGHTER RETIREMENT
Mayor Krebsbach recognized Firefighter Michelle Parker on her retirement after 12.5 years of service.
Besides being a certified Firefighter II, trained to the Haz-Mat operational level and a medical first
responder, she has done an excellent job being the coordinator of the Fire Prevention Week.
Councilmember Petschel moved to accept the retirement of Firefighter Michelle Parker.

Ms. Lisa Brandt has successfully completed her one-year probationary period as part time Police
Support Specialist. She has done an excellent job and is a great addition to the City.

Support Specialist effective March 7, 2015.

PUBLIC HEARING
A) RESOLUTION 2015-23, CRITICAL AREA PERMIT, CONDITIONAL USE PERMIT,
VARIANCE AT 731 WOODRIDGE DRIVE, PLANNING CASE 2015-06
Planner Nolan Wall explained the applicant was requesting approval to conduct slope repair at 731
Woodridge Drive, which is within the Mississippi River Corridor Critical Area. Due to the scope of the
project, Critical Area Permit, Conditional Use Permit, and Variance requests are required.

The proposed project includes construction of a concrete retaining wall, associated soil stabilization
activities, and vegetation removal within the approximately 75 -foot by 45 -foot impacted area above
Highway 13, on the applicant's property. The Council granted a request at their earlier meeting to
conduct a public hearing tonight instead of before the Planning Commission so consideration of the
proposed project could be expedited and construction could begin as soon as possible.
Agency review is required for a Critical Area Permit application. MnDOT, the DNR, and the Cities of
St. Paul and Lilydale did not have any objections to the proposed project.
Mayor Krebsbach opened the public hearing and invited the public to come forward to make comments.
No one from the public wished to be heard on this item.

Councilmember Petschel moved to adopt RESOLUTION 2015-23 APPROVING CRITICAL AREA

WOODRIDGE DRIVE based on the Findings of Fact and Conditions as presented in the resolution.

NEW AND UNFINISHED BUSINESS
A) TRAFFIC SAFETY COMMITTEE UPDATE
Public Works Director John Mazzitello explained that the Traffic Safety Committee met on March 3,
2015 and he provided an update from that meeting.
Speed on Marie Avenue - In cooperation with the West St. Paul Police Department, there will be some
targeted speed enforcement along Marie Avenue, between Delaware and Charlton.
Crosswalks on Wachtler Avenue - Wachtler Avenue runs south from Highway 13 to Wentworth. The
residents on the east side of Wachtler requested a crosswalk to access the trail on the west side. Since
Wachtler Avenue is a county road, this request was forwarded to the County.
Request to Change Yield Signs to Stop Signs — Lilac Lane - The Police Department has looked at the
intersections of Lilac Lane/Douglas Road and Lilac Lane/Caren Road. They did some targeted
monitoring and do not believe the intersections warrant a change at this time. The Traffic Safety
Committee is recommending the yield signs remain in place with continued monitoring.
Warrior Drive Parking - A group of residents came before the Council in September 2013 citing
concerns relating to the students parking on the east side of Warrior Drive. Since that time, the Traffic
Safety Committee has looked at this issue, Henry Sibley High School administration has opened more

permit parking spots in their main lot, and they have made parking available at the southeast corner of
their campus. A school assembly was held where Police Officer Jenny Fordham spoke to the students
about traffic safety issues and the residents' concerns about the parking on Warrior.
In 2014, Dakota County constructed a new trail on the east side of Warrior Drive. Parking spaces were
reduced on the east side due to trail access. The Police Department has also monitored the activities in
the area with the parking and traffic movements. The Committee reviewed the statistics gathered by the
police department and recommended no change to the existing parking. The area will continue to be
monitored through the end of the 2015-2016 school year, School Administration will continue to have
assemblies with the students to talk about traffic safety and parking issues, and potential solutions may
be incorporated into the Warrior Drive street rehabilitation project scheduled for the summer of 2016.
Councilmembers asked questions regarding the issue of U-turns and the loss of the temporary no
parking signs.
Chief of Police Michael Aschenbrener confirmed the statistics his department provided.
Mayor Krebsbach opened the floor for comments from the public on this matter.
Stuart Simek, 577 High Ridge Circle - referenced the May 20, 2014 City Council minutes where staff
was directed to put together a working group which was to include the area residents. He noted that this
meeting has not taken place. He stated he is encouraged on what he heard tonight, on the potential
rebuilding of Warrior Drive. He encouraged the Council to consider `No Parking' signs in the area
neighborhoods, or a 2 -hour parking limit.
Frank Pilney, 1867 Warrior Drive - commended the Police Department because the student driving has
dramatically improved. U-turns continue to be a problem. He requested that parking spaces be made
available for residents only. If no parking were allowed on the east side and limited parking on the west
side was opened up, that would still allow two lanes to be open for emergency vehicles.
Councilmembers asked questions regarding the enforcement of residential parking permits and 2 -hour
parking limits.
Kevin Bormann, 1875 Warrior Drive — there is now less trash in this area, believes the statistics are
skewed due to police presence.
Area resident - expressed her appreciation for the work that has been completed by city staff, hope the
city can come up with a way to restrict parking along Warrior Drive.
The City Council directed the Traffic Safety Committee to discuss these concerns sometime in late
March or early April, specifically the request to allow parking spaces for residents only. Mayor
Krebsbach will also meet with the School Superintendent to discuss this issue.

B) APPROVE 2015 CONTRACT FOR PILOT KNOB MANAGEMENT
Assistant to the City Administrator Tamara Schutta introduced Mr. Wiley Buck, representing Great
River Greening. Ms. Schutta explained what was done at Pilot Knob last year and the proposal for
2015. She noted that the contract for $5,200 included control of invasive species organized by Great
River Greening, care of the trail and overlook and the maintenance of Pilot Knob, and the pasturing of
goats and sheep.
Mr. Buck explained that Great River Greening is a local non-profit organization that is committed to
doing ecological restoration and engaging the community in the process. This year the milestones they
hit were 30,000 volunteers, 100,000 trees and shrubs planted, 10,000 acres restored, and their 20th
anniversary.
The main focus of the contract is invasive species management, private volunteer event(s), conservation
grazing, pollinator studies at the site, and restoration of the Highway 55 portion of the roadside (in
cooperation with MnDOT).
Councilmember Povolny moved to authorize staff to execute a contract with Great River Greening for
Pilot Knob Hill Restoration.

C) APPOINTMENTS FOR NOISE OVERSIGHT COMMITTEE
Assistant to the City Administrator Tamara Schutta explained that there is an open position on the Noise
Oversight Committee. Councilmember Petschel is the primary contact with the alternate being
Councilmember Duggan and Airport Commissioner David Sloan. Their 2 -year terms end June 25th
Councilmember Petschel and Commissioner Sloan have expressed an interest in being reappointed.
Councilmember Duggan wishes to step down at this time.
Mayor Krebsbach noted that Councilmember Petschel has done a fantastic job as the NOC
representative as well has Commissioner Sloan. She expressed her appreciation for their service.
Councilmember Povolny moved to appoint Councilmember Petschel as representative, and David Sloan
as alternate to the Noise Oversight Committee for a term through June 25, 2017.

D) SET MAY GOAL SETTING WORKSHOP
Assistant to the City Administrator Tamara Schutta explained that the Council met in February 2015 and
identified a number of goals. At that time, Council directed staff to set a follow-up meeting date in May.

E) ORDINANCE 473 AMEND CITY CODE SECTION 12-1L-10
CONCERNING AFTER -THE -FACT PERMIT FEES
Planner Nolan Wall explained the City was considering amendments to Title 12 Chapter 1 Article L of
the City Code concerning fees and deposits. Staff identified these potential amendments concerning
After -the -Fact Permit Fees. In 2014 the City processed two after -the -fact permits, which involved non -
permitted vegetation removal activities. In order to charge additional fees for after -the -fact zoning
permits — which would include critical area, conditional use, wetlands, and variance permits — the code
must be amended to grant that authority. If approved, the language would then be added to the fee
schedule. Actions that do require after -the -fact permit fees are also subject to the general penalty
provision that is already in the code.
Councilmember Petschel moved to adopt ORDINANCE 473 AMENDING SECTION 12-1L-10 OF
THE CITY CODE CONCERNING AFTER -THE -FACT PERMIT APPLICATION FEES.

F) RESOLUTION 2015-19 APPROVING AMENDMENTS TO FEE SCHEDULE
City Clerk Lorri Smith explained that with the passage of Ordinance 473 regarding After -the -Fact
Permit Fees, staff is proposing to add that permit fee to the fee schedule. Along with that, staff proposed
a few clarifications to the fee schedule.
She then summarized the proposed revisions which are clarifications to fees already in the schedule or
corrections to the software formula for setting the building permit fees in Exhibit A.
Councilmember Norton moved to adopt RESOLUTION 2015-19 REVISING SCHEDULE OF FEES.

G) ORDINANCE 471 AMEND CITY CODE SECTION 12-1
CONCERNING WETLANDS PERMIT REQUIREMENTS
Planner Nolan Wall explained that staff identified potential amendments to the Code concerning the
wetlands permitted administrative approval process to accommodate additional eligible activities.

12-2-10 OF THE CITY CODE CONCERNING WETLANDS PERMIT REQUIREMENTS.

H) DISCUSSION OF MEMORIAL OPTIONS FOR OFFICER SCOTT PATRICK
Chief of Police Michael Aschenbrener explained there were several options for formalizing a way to
honor Officer Scott Patrick. The police officers elected three fellow officers to represent them on a
committee to sort through the different suggestions as ways to recognize and honor Officer Patrick.
The Peer Officer Committee requested that Council representatives join them and form a joint
committee to sort through and make recommendations to bring back to the full City Council for
consideration. The joint committee would be looking at how this would impact the community, the
Patrick family, and the Police Department and getting the list down to a few options that the City
Council could consider as ways to honor Officer Patrick.
City Attorney Tom Lehmann commented that it is important that the Council is involved in the
Committee. The location of the memorial would be somewhere within the City, so there is a vested
interest on behalf of the City to be involved. It also provides an opportunity to keep the communication
open with the Council. It would be prudent to have two Councilmembers on the committee.
City Administrator McNeill relayed to the Council that Councilmember Duggan has indicated he would
be honored to be one of the Council representatives. Councilmember Petschel also indicated her desire
to serve.
Mayor Krebsbach asked for clarification that, in terms of funding the memorial, it would be a
combination of fundraising activities and the City budget. City Administrator Mark McNeill replied that
there are probably three components of funding — city funding, the Mendota Heights Police Officers
Benevolence Association, and the Mendota Heights Community Criminal Apprehensive Fund. The
important thing would be to have the joint committee research funding options and come back with a
recommendation.
Police Officers John Larrive, Bobby Lambert, and Mike Shepard were present to discuss with the
Council the possible designation of a highway in Mendota Heights in memory of Officer Patrick. The
suggestion, which was brought forward from State Representative Joe Atkins, was to designate a portion
of either Highway 110 or Dodd Road as "Officer Scott Patrick Memorial Highway".
Mayor Krebsbach explained that she heard from Rep. Joe Atkins office and that if the City wishes to
designate a road in 2015, a decision would need to be made tonight so the state legislature could hold a
hearing on March 201h. If no decision by the Council is made tonight, the request could be brought back
to the next legislative session, allowing the City time to research and consider the request.
Officers Larrive, Lambert, and Shepard stated that after they received the request from Representative
Atkins, they discussed it with Michelle Patrick and she expressed her desire that the designated road be

Dodd Road, from the south end of Mendota Heights through Smith Avenue in West St. Paul. The
Officer Committee replied back to Representative Atkins' office with her wishes. Since that time, they
received notice that the City Council wanted to be heard and involved on this.
The officers explained that the road designation is something that could be done quickly and in time for
unveiling on the anniversary of Officer Patrick's death.
In response to a question from Mayor Krebsbach, Administrator McNeill explained that Representative
Atkins would need to be notified as soon as possible so he could schedule a committee hearing.
Councilmember Petschel expressed her support since she has now heard confirmation of the family's
wishes. She is in support of forming a joint committee so there is continued communication.
Councilmember Norton echoed Councilmember Petschel's comments.
Councilmember Povolny stated that he has no problem with either road choice; however, if the family
wishes it be Dodd Road then that is what should be done.
Councilmember Petschel moved to send a formal resolution (Resolution 2015-24 Designate TH149 as
Officer Patrick Memorial Hwy) to Rep. Joe Atkins stating that the City Council is in support of
designating Dodd Road as "Officer Scott Patrick Memorial Highway".
Councilmember Norton seconded the motion.
Ms. Michelle Patrick came forward and expressed her appreciation for the hard work the Police Officer
Committee has done and is still doing.

Assistant to the City Administrator Tamara Schutta made the following announcements:
• Grading has started at Lemay Lake Shores. Infrastructure utilities and street installation will
begin in late April.
• Registration is open for the summer park programs.
• Clean-up day is scheduled for Saturday, May 2 from 8:00 a.m. — 12:00 p.m.
• 2nd Annual Blazing Wing Eating Contest at Moose Country is March 21 from 1:00 — 4:00.
• Officer Patrick Fundraiser on Saturday, April 11.

COUNCIL COMMENTS
Councilmember Norton stated that it was really nice to see a lot of people out walking, jogging, and
biking over the last two weeks.
Councilmember Petschel acknowledged the St. Paul Pioneer Press for pointing out that Mendota
Heights is per capita the most Irish city in the State of Minnesota.
Councilmember Povolny wished his son a Happy Birthday.
Mayor Krebsbach noted that The Olive Grove in The Village has cooking and sampling classes.
She noted the passing of Mr. Dick Bjorklund Sr. He was a city building permit inspector and a long-time
contractor in the City. He was also active with the Chamber of Commerce and will be missed.

The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, March
24, 2015 in the Council Chambers at City Hall, 1101 Victoria Curve at 7:00 P.M.
The following Commissioners were present: Chair Litton Field, Jr., Commissioners Howard
Roston, Michael Noonan, Doug Hennes, Mary Magnuson, and Christine Costello. Those absent:
Commissioner Ansis Viksnins. Others present were City Planner Nolan Wall and Public Works
Director/City Engineer John Mazzitello.

PLANNING CASE 92015-05
Alltech Engineering/Mendota Management, LLC, 2515 Pilot Knob Road
Variance Request
Chair Litton Field, Jr. recused himself from this case, due to the fact that his employer does
business with Alltech Engineering and wished to avoid any perceptions of conflict. Vice -chair
Doug Hennes lead the discussion of this case.
City Planner Nolan Wall explained that Alltech Engineering/Mendota Management, LLC was
seeking a variance from the side yard setback standard to construct an approximate 2,363 square
foot addition to the existing office/warehouse building located at 2515 Pilot Knob Road. The
subject parcel is 4.3 acres, located at the southwest corner of the Pilot Knob and Mendota Heights
Road intersection. The property is zoned and guided as Industrial. The same variance request for
a similar project was approved in 2008 as part of Planning Case 2008-12. According to the Code,
a variance is voided after one year if no action is taken. Therefore, since it was never constructed,
the Planning Commission and City Council must consider a new variance request.
Planner Wall stated that the side yard setback for a structure abutting the street in the Industrial
District is 40 feet. The building setback along Mendota Heights Road varies from 22.8 feet to 21

feet 3518 inches, which is caused by the buildings angle in relation to the right-of-way across the
250 feet of frontage. The angle creates an inconsistent setback from Mendota Heights Road.
The proposed addition would extend the northeast corner of the building an additional 40.5 feet to
the east along the existing north wall, which creates a setback of approximately 21 feet. As a result,
the variance request was for approximately 19 feet from the side yard, abutting Mendota Heights
Road. The proposed addition does meet all of other setback, lot coverage, and landscaping
requirements for the industrial district.
Planner Wall then explained the requirements for a variance request approval and shared images
of the lot.
Staff recommended approval of this variance request with conditions.
Commissioners asked questions regarding the location of the alternative that was considered.
Mr. Chris Lawrence, Operations Manager of Alltech Engineering, recognized Mr. Bob Lawrence,
CEO/Founder/Owner of Alltech Engineering and General Manager of Mendota Management who
owns the building, and Mr. Greg Merz, CFO of Alltech Engineering, and indicated they were all
present to answer any additional questions from the Commission. He explained how this
expansion would grow their business and discussed plans for expansion of the warehouse portion
of the building.
Vice -chair Hennes opened the public hearing.
Seeing no one coming forward wishing to speak, Vice -chair Hennes asked for a motion to close
the public hearing.

COMMISSIONER NOONAN MOVED, SECONDED BY COMMISSIONER MAGNUSON, TO
RECOMMEND APPROVAL OF PLANNING CASE 2015-05: SIDE YARD SETBACK
VARIANCE REQUEST FOR BUILDING ADDITION AT 2515 PILOT KNOB ROAD, based on
the following Findings of Fact:
1. The proposed addition is a reasonable use of the property, meets the purpose and intent of
the City Code, and is consistent with the Comprehensive Plan.
2. The improvements to Mendota Heights Road created a unique circumstance upon the
property not created by the applicant.
3. The building's location on a corner lot with an existing encroachment is a unique
circumstance not created by the applicant.
4. The proposed addition represents a small increased encroachment into the side yard while

121 City Planner Nolan Wall explained that the application, on behalf of the property owners,
122 requested a lot split for the existing subject parcel located at 747 Willow Lane. They are also
123 requesting a wetlands permit for construction activity within a wetlands and water resource -related
124 area. Planner Wall shared an image showing the location of the proposed split, the 100 -foot buffer
125 area for the wetlands area, and the 25 -foot non -disturb area. The subject parcel is 1.12 acres and
126 contains an existing single-family dwelling which is zoned R-1 and guided for low-density
127 residential development on the Comprehensive Plan. The applicant intends to demolish the
128 existing home and construct two new single-family homes on the newly -created lots.

130 The subdivision would create two lots, both of which are in excess of the 15,000 square foot
131 minimum lot size requirement for the R-1 zoning district. Parcel A, the westerly parcel, would be
132 approximately 25,903 square feet and Parcel B, the easterly parcel, would include the area that has
133 the existing single family home and would be approximately 26,533 square feet. Both parcels do
134 have the required 100 feet of frontage on Willow Lane, are compliant with the R -I lot standards,
135 and consistent with the Comprehensive Plan.

137 Specific to the wetlands permit itself, the 100 -foot buffer area around Marie Creek encompasses
138 both parcels. Therefore, based on the proposed new pads, construction of the new dwellings will
139 require grading and vegetation removal within that buffer area, which does require a wetlands
140 permit. According to the applicant, up to seven healthy trees would be removed within the buffer
141 area and associated grading would also disturb ground vegetation on both parcels.

143 Staff did walk the site with the applicant and identified within that area that there are numerous
144 dead and dying trees. Those could potentially be removed through an administrative wetlands

permit. However, because they would be disrupting that area and taking out some healthy trees,
staff required them to request a wetlands permit.
It was also noted that vegetation would be replanted on both parcels within the disturbed area post -
construction. Staff proposed a condition that a landscape plan be submitted for further review at a
later date. Also, erosion control measures are required and no disturbance would be occurring
within the 25 -foot buffer area.
Staff recommended approval of the subdivision and wetlands permit request subject to conditions.
Commissioners asked if by approving this wetlands permit if they were also approving the location
of the home construction sites. Additional questions were asked regarding alternative locations of
the house pad on Parcel A and on Parcel B.
Commissioner Roston, being associated with Streeter and Associates, Inc. (construction company
serving this property), recused himself from voting on this case.
Mr. Nate Wissink of Elevation Homes was present to answer additional questions from the
Commission regarding the construction footprint.
Chair Field opened the public hearing.
Mr. David Burns, currently living in Lilydale but will be residing at 738 Willow Lane, requested
that the Commission deny this application. He views lot splits by outside builders as a detriment
to a way of life that should be preserved in Mendota Heights — property sizes, beauty, and
preserving what is had. He has no problem with the building of the homes, just to the lot split.
Ms. Joy Cacicia, 724 Spring Creek Circle, lives on the other side of the proposed Parcel B. She
understands progress and building of homes, but as she understands, there is no guarantee of where
the proposed new home will be located on Parcel B. If the builder decides to move the home further
back on the lot, then sunset view that she has been able to look at every single day for 17 years
will be gone. She does not want to stop change, but she does not want to start feeling closed -in
either.
The applicant returned to address the comments made by the public.
Commissioner Magnuson commented that she understands that this lot split is in compliance with
the City Code and that the applicant is doing everything they need to do to be in compliance with
that Code. She requested that they understand that these are very difficult circumstances for people
who currently live in the neighborhood. While the Commission does not have the authority to tell
them where to site the home, how to build the home, or what it should look like — she requested
that they consider what impact their building will have on the existing neighborhood and to the
extent that they can, integrate it nicely into that neighborhood so that there are fewer disruptive
things that occur to the other neighbors who currently live there.
Mr. Wissink acknowledged the Commission's concerns and noted that they have reached out to
some of the neighbors in the area to discuss the proposed construction in an attempt to address
their concerns.

256 District with conditions. The Industrial District is located in the far southwest corner of the City.

258 The Industrial District contains a mix of office, warehouse, and hotel uses. Most notably, it lacks
259 certain amenities, especially food service options. As a result, staff does get frequent inquiries to
260 allow mobile food trucks in this area. Some of them have been approved administratively for

264 a licensing procedure and would be easier to deal with at the staff level. It's easier to verify that

Rogers Lake Water Quality Report Presentation
Planner Nolan Wall summarized the water quality report completed by Saint Thomas Academy
Environmental Science Class. The students have been monitoring the water quality of Rogers
Lake since 2001.
Mr. Wall explained the overall purpose of their testing, what kind of tests they performed with
an explanation of each, the results of the tests, and a comparison of those test results to last
year. An overall rating was then extrapolated into a composite score of all nine chemical tests.
The overall rating for Rogers Lake improved from 78.6 in 2013 to 80.8 in 2014. The water
quality at Rogers Lake has continued to improve each year.
Commissioner Paper asked how Rogers Lake compares to other lakes in the metro area. Mr.
Wall stated that staff will check that out and follow up.
River to River Greenway Draft Master Plan
Mr. Wall presented the River to River Greenway Draft Master Plan complete by Dakota
County. It is an eight mile trail that starts in Lilydale, and goes through Mendota Heights,
West St. Paul, and South St. Paul. The purpose of this plan is to provide a strategic guidance
for future greenway development. It is anticipated this plan will be adopted by the Dakota
County Board of Commissioner in the summer of 2015.

Dog Park Update
Chair Hinderscheid provided a brief update on the Dog Park.
Meeting Attendance
The commission discussed how many meetings should be attended by the commissioners each
year. The city council suggests that commissioner members attend 2/3 of their appointed
commission meetings. The commission recognized that this is a voluntary position, but
encourage attendance at the meetings to help keep the continuity of the commission.
Announcements
Mr. Wall announced that summer 2015 Park & Recreation Program registration will begin on
March 17, 2015.
Mr. Wall also announced that the Mendota Heights Athletic Association is now accepting
registration for summer youth sports.
Finally, Mr. Wall reminded the commission that they have invited residents to the April 12,
2015 meeting to hear their thoughts and ideas about the possibility of building an archery range
in the city of Mendota Heights.
Commission Comments
Commissioner Kipp reminded residents that Rogers Lake is a shallow lake so please do not dive
into the lake, swimming is ok. He also thought it was a nice meeting and thanked the city council
for all their work to make our city a great place to live.
Commissioner Paper thanked St. Thomas Academy for their reports. He also thanked Mr. Wall
for his work and was very happy that the ice rinks were heavily used this winter.
Commissioner Toth also thanked Mr. Wall and St. Thomas Academy.
Commissioner Evans thanked Mr. Wall and thought that the River to River Greenway was a great
project for our community.
Chair Hinderscheid also thanked Mr. Wall and St. Thomas Academy. Chair Hinderscheid is
excited that Ivy Hills Park tennis courts would be upgraded this spring and that the golf course
would soon we open.

The city needs to contract with a street sweeping firm for the spring street sweeping.
Requests for bids were sent to contractors that have been interested in bidding in the past. We
received three bids and they are follows:
Pearson Bros., Inc. $76.00/hour for an estimated total of $18,240.00
Allied Blacktop Company $81.00/hour for an estimated total of $19,440.00
Mike McPhillips, Inc. $83.00/hour for an estimated total of $19,920.00
BUDGET IMPACT
There is $32,000.00 in the 2015 budget for street sweeping and striping. The estimated
cost to do the spring street sweeping is $18,240.00. The bill for the spring sweeping in 2014 was
$11,100.00.
The remaining money for this line item in the 2015 budget will be used for the fall street
sweeping and the striping of city streets.
RECOMMENDATION
Staff recommends that the street sweeping contract be awarded to the lower bidder,
Pearson Bros., Inc. for their low bid of $76.00 an hour. Pearson Bros., Inc. has swept the city's
streets for the last 12 years and has always done an excellent job.

the national APWA Conference in Phoenix, Arizona later this summer.
The Public Works Director's memo focuses on the experience to be gained by observing the
planning and operations at the Phoenix Conference, in preparation for the conference coming to
the Twin Cities the following year. However, I also believe John's overall professional
development will be benefitted by his attendance of the sessions at the Conference this year,
regardless of whether he is part of the planning process for the 2016 Minneapolis conference.
John has been employed by the City for seven years; this would be his first attendance at a
national conference.
RECOMMENDATION
I believe he and the City would benefit from his being approved to go, and therefore make that
recommendation.

The Minnesota Chapter of the American Public Works Association (APWA) is hosting the 2016
APWA National Congress at the Minneapolis Convention Center. The Minnesota Chapter has
asked that Public Works Director/City Engineer John R. Mazzitello serve on the planning
committee for the 2016 National Congress. As part of the planning committee, members are
encouraged to attend the 2015 APWA National Congress in Phoenix, Arizona; to meet with the
Arizona Chapter planning committee and to see, first hand, what will need to go into our own
hosting of the National Congress in a little over one year from now.
This event will bring over 6,000 public works and engineering professionals to the Twin Cities.
This will be the third time the Twin Cities has hosted the National Congress event.
BUDGET IMPACT
Cost of attending the 2015 APWA National Congress is estimated as follows:
Conference Registration: $785.00
Lodging (5 nights): $695.00
Approximate Airfare: $300.00
Per Diem: meals included in conference registration
Total Estimated Cost: $1,780.00
Funds for attending the 2015 APWA National Congress can be derived from several different
departmental budgets benefitting from attending the event. Staff proposes paying $200.00 out of
each of the following departments: streets, parks, sanitary sewer utility, storm sewer utility,
building official, and planning. The balance of attendance costs would be paid for out of the
Engineering budget. There are sufficient funds to cover these expenses in the 2015 budget.
RECOMMENDATION
Staff recommends Council authorize the Public Works Director/City Engineer to attend the 2015

The City of Mendota Heights has contracted with GM Management for maintenance of the
grounds and equipment of the Par 3 Golf Course since 2008. Previous contracts have included
maintenance labor as well as supervision of course maintenance.
For the 2015 season, the city will be hiring two part time seasonal Par 3 maintenance workers.
The course is still in need of a maintenance supervisor, with knowledge of turf and golf course
practices. Staff is recommending a contract with GM Management to continue overseeing
maintenance activities on a consultant basis.
The attached agreement would retain GM Management for the 2015 golf season as a consultant
golf course superintendent, providing insight and suggested activities to city staff. Staff views this
agreement as a means to maintain the healthy turf and good playing conditions that have been
developed since 2008, while allowing for continued control over the work direction of
maintenance staff.
BUDGET IMPACT
The attached Par 3 Maintenance Consulting Contract is for $6,000 and is included in the 2015
budget.
RECOMMENDATION
Staff recommends entering into a Par 3 Maintenance Consulting Contract. If council wishes to
implement this recommendation, pass a motion authorizing staff to enter into an agreement with

vendors: MTI Distributing, Turf Werks, LESCO mfg, Gertens and Menards. All other
purchases must be coordinated through the City of Mendota Heights.
3. Payment: The City will pay GM Management a management fee of $6,000 for Golf
Course Superintendent services.
4. Insurance, Indemnity, Limitation of Liability, Release:
a. Workers' Compensation Insurance: Contractor shall provide a certificate of
insurance showing evidence of workers' compensation coverage or provide
evidence of qualification as a self -insurer of workers' compensation
b. At all times during the term of this contract, GM Management shall maintain
insurance commercial general liability (CGL), and if necessary commercial
umbrella insurance, with a limit of not les than $1,000,000 each occurrence. The
City shall be named as an additional insured under the CGL.

c. Indemnity: the parties hereby agree to mutually indemnify and hold harmless the
other party for claims arising out of its negligent acts and omissions or willful
misconduct or the acts of its employees or independent contractors, agents or
assigns in connection with or relating to the performance of each party's
obligations under this agreement.
i. Notwithstanding the foregoing, nothing in this section is intended, nor
should it be construed as a waiver of any municipal tort liability limits,
governmental immunities or defenses which otherwise protect the City of
Mendota Heights.
d. After a period of 12 months from acceptance of the final payment due to GM
Management, GM Management agrees that it shall be deemed to have released
the City from any and all claims, causes of action and liability in connection with
this contract or the performance of services.
5. Termination: Either party may terminate the contract for any reason with thirty (30)
days written notice. Within thirty (30) days of termination, GM Management will be
entitled to a pro rata compensation for all work completed as of the date of termination to
the extent that such services were completed to the satisfaction of the City.
6. Amendment: This Agreement may only be amended by a written agreement, signed by
both parties.
7. Independent Contractors: GM Management and the City are deemed to be
independent contractors, and GM Management shall not be deemed to be an agent,
officer or employee of the City, in connection with the matters contemplated by this
Agreement. The City will not provide GM Management with any employee -type
benefits, including but not limited to health insurance, a pension plan, vacation pay, or
sick pay. Neither party has the right, power or authority, express or implied, to bind the
other party or otherwise create any duty or obligation on the part of the other party,
express or implied, nor shall either party hold out GM Management as having any such
status, right, power or authority. The City acknowledges that GM Management, as an
independent contractor, may perform services to other unrelated parties during the term
of this Agreement.
8. Representations of GM Management. GM Management acknowledges that the City is
hiring GM Management because of its expertise in this area and that the City has not
provided any training for GM Management, its employees or agents. GM Management
represents that it has sufficient knowledge and capacity to provide the Services for the
City.
9. Compliance with Laws. GM Management agrees that it will comply with all applicable
laws, rules and regulations in the performance of the Services.
10. Entire Agreement: This Agreement represents the entire agreement and understanding
of the parties hereto with respect to the subject matter of this Agreement, and it
supersedes all prior and concurrent agreements, understandings, promises or
representations, whether written or oral, made by either party to the other concerning
such subject matter.

11. Waiver: The failure of either parry to insist in any one or more instances upon strict
performance of any of the provisions of this Agreement shall not be construed as a
waiver or relinquishment of the right to enforce or require compliance with such
provision.
12. Applicable Law: This Agreement shall be governed by and construed in accordance with
the laws of the State of Minnesota.
13. Term: The term of this Agreement is to be from date of signing through December 31,
2015.

SUBJECT: Approval of Plans and Specifications and Authorization to Advertise for Bids for
2015 Sanitary Sewer Rehabilitation Project
BACKGROUND
Our sanitary sewer system is aging. Many of our pipes are 60 years old and will soon be in need of repair.
Cleaning our sewer system on a regular cycle will help extend the life of the pipes. Televising of the
system will show where immediate repairs are needed. Lining pipes in need of repair with cured -in -place -
pipe will extend the life of our system and minimize inflow from ground water.
The 2015 Sanitary Sewer Rehabilitation Project consists of lining approximately 4000 feet of sanitary
sewer. The locations were determined from the report provided with the 2013 sanitary sewer cleaning
and televising project. Staff anticipates lining as many sanitary sewer pipes as possible without exceeding
the budgeted amounts with the following priority:
1) Huber Drive from Bent Tree Lane to Cheyenne Lane.
2) Mendota Heights Road from Pilot Knob to Main lift station.
3) Mendota Heights Road from Highway 55 to RJ Ryan site.
4) Rogers Park
The completion date for the project is September 30, 2015. Staff expects higher per unit costs for this
project due to the repair of larger diameter pipes and high flow rates for the interceptor line. A 2014
Rehabilitation project was also deferred to 2015.
BUDGETIMPACT
The project costs will be funded through the Sanitary Sewer Utility Fund which has sufficient funds to
cover the project costs. The 2014 & 2015 city budget includes $110,000 per year for sanitary sewer
lining. The city has also received a grant from the metropolitan council of $27,138.31. Staff has
estimated the costs of the 2015 project at $245,460.00.
RECOMMENDATION
Staff recommends that the council approve the final plans and specifications and authorize staff to
advertise for bids.
If city council wishes to implement the staff recommendations, pass a motion adopting A
RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS, AND AUTHORIZING
ADVERTISEMENT FOR BIDS FOR THE 2015 SANITARY SEWER REHABILITATION
PROJECT (PROJECT #201505). This action requires a simple majority vote.

WHEREAS, the City Engineer reported that the proposed improvements and
construction thereof were feasible, desirable, necessary, and cost effective, and further reported
on the proposed costs of said improvements and construction thereof, and
WHEREAS, the City Council has heretofore directed the City Engineer to proceed with
the preparation of plans and specifications thereof, and
WHEREAS, the City Engineer has prepared plans and specifications for said
improvements and have presented such plans and specifications to the City Council for approval.
NOW THEREFORE BE IT RESOLVED; by the Mendota Heights City Council as
follows:
1. That the plans and specifications for said improvements be and they are hereby in all
respects approved by the City.
2. That the Clerk with the aid and assistance of the City Engineer be and is hereby,
authorized and directed to advertise for bids for said improvements all in accordance with
the applicable Minnesota Statutes.

Item 1: Successful Completion of Probationary Period, Mechanic Nick Courteau
Effective March 29, 2015, Nick Courteau has successfully completed his six month probationary
period as a Mechanic. Nick is doing an excellent job in all categories of the Mechanic position.
His work ethic has made him a perfect fit for the City of Mendota Heights and being part of our
team.
City staff recommends that the City Council officially appoint Nick Courteau to the position of
regular, full-time Mechanic, effective March 29, 2015.
Item 2: Par 3 Temporary Seasonal Hires 2015
At a recent meeting, City Council gave approval for staff to begin the hiring and recruitment
process for the 2015 Par 3 golf season. Several employees from the 2014 golf season have re-
applied for Par 3 positions. Applicants were offered their position contingent upon a successful
completion of a criminal background check and council approval. Staff is recommending the

WHAT
A 10,000 square foot native wildflower garden/meadow at the corner of Dodd and Marie that will (with time)
mature into an aesthetically pleasing and environmentally functional demonstration garden.
WHY
1) Dodd and Marie is a great location: A high profile corner that will be noticed and appreciated by the
community (an average of 10,000 vehicles per day pass by on Dodd Road). Some of us will have the pleasure
of driving past this wildflower garden 2-4 times per day!
2) Native wildflowers and grasses offer both beauty and unparalleled functionality: beauty for the community
and functionality for water amelioration, food for pollinators and other wildlife. Native plants are best suited
for this challenging location—a location that can be both extremely dry and extremely wet from the water
that flows through the runoff pond after a heavy rainfall.
3) Beauty + high profile corner = inspiration to residents to plant native wildflowers within and in addition to
traditional landscapes.
4) Why to try to inspire such plantings? This is an idea worth spreading.
Native plants are the gold standard for providing habitat and sustenance for wildlife. Once established, they
are resilient, require little water, and never need fertilizing. Deep roots (some as long as 14 feet) absorb
stormwater runoff extremely well. Interpretive signage at the site will explain these benefits.
The garden will serve as a showcase for sustainable landscape practices.
WHAT's NEXT?
1) Authorize this initiative to move forward at the next council meeting (site prep needs to begin in June).
2) Sign a fiscal agent agreement with Great River Greening.
3) Allow a private fundraiser to take place at the home of Leslie Pilgrim and Ned Rukavina on May 26.
Contributions would go to a designated fund at Great River Greening.
4) Agree that the restoration will not be dismantled or disturbed for reasons other than those deemed
necessary for water management, public safety, or lack of upkeep. If the restoration is disturbed by the city for
management or public safety purposes, the city will agree to restore the wildflower garden to what it was. The
city would commit to keeping this garden intact for at least 15 years, with best efforts to keep the restoration
intact in perpetuity.
5) Consider the possibility of financing ongoing professional stewardship of the wildflower garden after the 3-5
year establishment period (estimated in today's dollars at $1,000 per year per Prairie Restorations, Inc.).

Greetings City of Mendota Heights,
Introduction
Over the past several months, discussions have taken place with the city's Public Works
Director, John Mazzatillo, and Mendota Heights resident, Leslie Pilgrim (and occasionally
others, including Mendota Heights resident, Cindy Johnson, and city Project &4onager,Rvan
Ruaek)regarding the city -owned parcel located atthe intersection ofDodd Road and Marie
Avenue West. The 1.48 acre parcel is the site of the city's storm water runoff rate control pond.
Installed in2O12,the pond is designed to help control the downstream velocity ofMarie Creek.
From this location, the managed water runs along Marie Avenue, through Valley Park, and then
ultimately flows directly into the Mississippi River.
The 1.48 acre parcel is mostly wooded, with approximately 18,500 square feet comprising open
field and the rote control pond. Of this 18.5OOsquare feet, approximately 10,000 square feet is
an open field of mixed vegetation dominated by non-native plants ("weeds") with some
scattered native plants that remain from an earlier seeding. A variety of native and non-
native/invasive plants border the pond, with cattails (presumed tobenon-native\atthe water's
edge. The city periodically mows the open field to keep weed seed from invading neighbors'
property in the vicinity. The city's Publics Work Director has indicated that all engineering work
on the runoff rate control pond is complete and there are no plans to further configure this site.
He has also indicated that any re-engineering of Dodd Road by the state at this intersection will
not encroach onthe restoration (this will beconfirmed within the next few weeks byJohn
Benefits of a Restoration at Marie and Dodd
The purpose ofthis correspondence istopropose aplan totransform 1O.O0Osquare feet ofthis
1.48 acne city -owned parcel (referred to as the "open field" in this proposal) to g professionally
installed and managed prairie restoration. The parcel's location is particularly appealing for
such arestoration for several reasons:
eMarie Avenue and Dodd Road is a high-profile, highly visible corner. At this heavily traveled
intersection, an average of 9,600 vehicles travel on Dodd Road per day; approximately 3,100
vehicles travel per day on Marie Avenue (Source: Department of Transportation). Considering
that the population of Mendota Heights is 11,172 people, the intersection represents a heavily
used corridor in the community. A prairie restoration on this particular corner would be
noticed and appreciated by the community.
eA well managed native planting with good stewardship practices at this site will take the
property "off line." Noxious weeds and repeated mowings would be replaced with functional
and aesthetic vegetation. A deep-rooted prairie flower/grass planting in the open field space
would help in water amelioration and help absorb runoff. Native vegetation on the hillside
sloping down to the pond and a wetlands planting around the pond would provide a buffer
zone to slow down (and absorb) runoff and a filter strip to help remove contaminants.
Considering water from this site flows directly into the Mississippi River, any efforts to absorb
storm water or improve water quality is a benefit to both community and the environment. In
addition to benefits to water, a prairie restoration would transform a marginal habitat into a
robust habitat for endangered pollinators as well as many types of wildlife. As the prairie area
would abut approximately an acre of woods, birds would have a "new found appreciation" for
existing sheltering trees due to nearby sustenance from native vegetation.
eResidents would experience first-hand what a native habitat looks like and its importance in
an urban ecosystem. Interpretive signage will help educate community about the benefits of
native plantings and their purpose at this site. It is hoped that the restoration would inspire
others to install crucial native habitat/rain gardens in their own yards (people do things when
they see others doing the same things). As Mendota Heights is a bluff city with much water
making its way to the Mississippi River, the cumulative impact of individual homeowners'
actions could result in a meaningful improvement in city storm water quality.
elt is hoped that this restoration will add to residents' sense of community and community
pride. In future years, once the planting is established, community members and groups may
coalesce into a "green team" to participate in organized stewardship of the restoration.
Estimated Costs
In early November, 2014, John Pauley from Prairie Restorations visited the Dodd and Marie site
with Leslie Pilgrim. Prairie Restorations is a 37 -year-old business dedicated to the restoration
and management of native plant communities. From this visit, a proposal was prepared that
describes the restoration process as well as the specific grass and wildflower mixes that would
be used in the project. The proposal was prepared with a sensitivity to the types of vegetation
that would work best in an urban environment (e.g., grasses and flowers that are of acceptable
height and slightly more showy than a traditional native planting). Costs outlined in the
proposal (which is included in its entirety at the end of this proposal) are as follows:
Site preparation, seeding, erosion control: $4,185
Management*, year one: $300
Year two: $600
Year three: $600
Total for three years: $5,685
*Management fees are estimates. Management includes site monitoring, prescribed burnings,
mowing, spot spraying and spot mowing, and hand weeding as needed.
Stewardship
Initial elimination of the weed seed bank will be crucial to the success of the restoration. And
intense front-end stewardship will help ensure weeds are kept at bay. [Note: In particular, the
site has attracted invasive, non-native thistle which are particularly challenging to permanently
remove.]
Prairie restorations require three to five years of intense, knowledgeable stewardship. Ongoing
stewardship of this site, however, beyond the initial three to five years, is imperative as there is
no such thing as a "maintenance free" garden of any type. The more professional the
installation, the less intense the maintenance in future years, and the greater the chance of
success of the planting. Therefore, any funds raised (fundraising will be addressed later in this
proposal) in support of the Marie and Dodd restoration that exceed the initial $5,685 cost
suggested by Prairie Restorations, would be used to fund additional professional stewardship of
this site.
It should be noted that although it is proposed Prairie Restorations be responsible for
installation and initial stewardship of approximately 10,000 square feet of the Dodd and Marie
parcel, the city of Mendota Heights will be involved and in control of this city -owned property.
Proposal
The city of Mendota Heights has indicated it has no funds to support this proposal. However,
the location of this city -owned land and its potential environmental and community benefit
make it a compelling resource, despite the lack of (or minimal) city financial support (although
support may come in other forms as detailed later in this proposal). Therefore, Mendota
Heights residents and long-time community members, Leslie Pilgrim and Ned Rukavina,
propose a grass-roots, community-based fundraising effort to pay for Prairie Resotrations'
services. The fundraiser would take place in late February 2015 and would be held at the home
of Leslie Pilgrim and Ned Rukavina (referred to as "Fund Raisers" later in this proposal).
Mendota Heights resident and professional development director, Lisa Lane, would assist in the
planning of the fundraiser (without charging for her services). It is hoped that this one
fundraiser, alone, would raise enough funds to support Prairie Restorations' proposal. The
fundraiser would not be widely advertised nor widely promoted, but would be based on
networking, word-of-mouth, and the grassroots efforts of Lisa Lane, Ned Rukavina, and Leslie
Pilgrim. Although the fundraising event will be kept to a manageable size, it is hoped that the
city of Mendota Heights would encourage community financial support on its
Facebook page and in several of its seasonal newsletters.
Responsibilities of Fund Raisers
1) Conduct a February, 2O1S.fund raiser intheir home. Fund Raisers will pay for food
and beverage for the event aowell aSmaterials used inopresentation.
2) Volunteer their time as necessary in the coordination of the contract between the
city ofMendota Heights and Prairie Restorations, Inc.
3\ Provide best efforts to coordinate a volunteer "Green Squad" or "Green Teams" that
would take over stewardship ofthe Dodd and Marie restoration if/when Prairie
Restorations iyno longer contracted to do so.
4\ Donate time onanongoing basis toensure the Dodd and Marie restoration isa
success.
Responsibilities of the City of Mendota Heights
I\ Sign a contract with Prairie Restorations in the amount of the funds specifically raised
for the Dodd and Marie restoration. At a bare minimum, this contract would beinthe
amount of$4,}85.Funds raised inexcess ofthe $4,185 would beitemized inthe
contract as man agern ent/stewardsh ip costs reserved for subsequent years.
Z\ Provide a city employee to attend the fundraiser and to answer city -related
questions. This individual will tally contributions with the Fund Raisers at the end of
the event to determine additional amounts to raise in subsequent efforts, if
necessary.
3\ Set up a specific account/fund in the city's record keeping which tracks all inflows and
outflows ofthis project, /ncludingonyfundsreceivec/fhon7otherogencies.Any
contributions tothis project vvou|d beguaranteed tonever beconming|edwith other
city funds.
4) Provide o city -produced receipt to any individual/business that contributes any
amount to the Dodd and Marie fund. This receipt would be mandated to be provided
even ifthe contributor does not request one.
5) Provide onannual accounting ofthe Dodd and Marie fund tothe Fund Raisers. Fund
Raisers do not request access to the identity of contributors, but require access to
inflow and outflow information. This accounting will beprovided for the first five
years ofthis project.
G\ After Prairie Restorations' maintenance agreement ends, the city will offer
reasonable support of the Dodd and Marie property, such as future burns (conducted
by the Fire Department once approximately every two years, guided by an informed
volunteer) and/or periodic mowing as recommended byPrairie Restorations. /Note:
city mowing would take place at this site even ifthere was no restoration so
additional cost 10the city should benminimng|\.Watering ofthe site bythe city may be
necessary ifthe restoration becomes imperiled due tmlack ofrainfall.
7\ Offer assurances that the restoration will not be "dismantled" or disturbed for
reasons other than those deemed tobenecessary for water management orpublic
safety. |fthe restoration isdisturbed, the city will agree tobe financially responsible
for restoring habitat to what it was. The city will guarantee that the Dodd and Marie
10,000 square foot prairie restoration will remain intact as a community resource
(with best efforts to keep habitat in the surrounding 1.48 acre parcel intact, as well)
for at least 15 years, with best efforts to keep the restoration intact in perpetuity.
8) Cover the costs of interpretive signage (somewhat similar to the signage at Rogers
Lake Park) and install such signage. Donors contributing $500 or more toward the
restoration will have their names mentioned in special section of the signage.
9) Consider a financial contribution to this project.
10) Help seek out other funding for this project, such as may be available through sources
like the Soil and Water Conservation District's retrofit fund, etc.
[Note: Update April 6, 2015. The city has not agreed to any of the above items except it has
indicated #7 above is reasonable as well as possibly #9 for funding of future stewardship once
the site is established]
[Note: The rate control pond itself would remain the responsibility of the city. Any cattails that
accumulate in the pond (from upstream seed), would need to be monitored by the city and
removed as necessary to prevent sediment accumulation—a situation that exists for the city
regardless of the outcome of this proposal.]
We look forward to this unique city -community collaboration. It is our belief that there is ample
community interest in a project such as this one and that fundraising goals have a good chance

B. Project Overview:
1. Establishing a native landscape (httn://www.prairieresto.com/establish landscape.shtml) in this area will
provide a long term, ecologically sound landscape that is adapted to the existing
conditions of the site. This native landscape will not require irrigation, black dirt or
other soil amendments. It will add a distinctive look to the site as well as provide
valuable habitat for songbirds and butterflies.
2. To establish this planting, the site will be treated with herbicide to kill existing weeds,
tilled and harrowed to provide a smooth seedbed, seeded with native grasses and
wildflowers, and mulched with straw to protect the seeding and enhance germination.
3. An estimate for 3 years of Establishment Period Vegetation Management is included
in this proposal.

1. Any grading that needs to be done to reshape banks or otherwise alter the existing
grades should be done before the project commences (to be done by others).

1. Management (maintenance) plays a vital role in the eventual success of any native
landscape installation, especially during the establishment period.
2. During the first growing season the project area may need to be mowed to control
annual weed development. If a "closed" canopy of weed cover develops, it should be
mowed to aid in the growth of the prairie seedlings by reducing competition. Mowing
may also be necessary if the weeds are about to set seed. Optimum cutting height,
depending on the wildflower species present, is typically 4 to 6 inches. Mowings done
by PRI will be billed separately unless they are included as part of the installation

contract.
3. In years following the first growing season, management services could include site
monitoring, prescribed burning, mowing, spot spraying, spot mowing, herbicide
wicking or hand weeding. PRI provides estimates for management services on an
annual basis prior to the growing season. Most of these services are billed on a time
and materials basis and the annual estimates are not exceeded without client
approval. Some services such prescribed burning are provided as a lump sum cost. A
summary of billing rates and materials costs will be provided with the estimate.

INTRODUCTION:
In 2014 the Reserve Unit volunteered a total of 2,279 hours in support of the Police Department.
This impressive donation of time was accomplished by Volunteer Reserve Captain Jerry Murphy,
Reserve Sergeant Randy Pentel, Reserve Officers George Castillo, Jim Knox, Jeffrey Parker, and
Volunteer Coordinator Becky Pentel.
In November of 2014 Reserve Officer George Castillo accepted a full time job as a Deputy with
the Dakota County Sheriff's Department. George became a Mendota Heights Reserve Officer in
2011. He has been a great asset to the Reserve program. He represented the department on
numerous occasions at city events and details. George earned the Presidential volunteer service
bronze award each of the 4 years he served.
BACKGROUND:
All Mendota Heights Reserve Officer are non -licensed and volunteer members of the Police
Department. They perform non -precarious Police functions in support of the full time staff. They
primarily assist at city events, with crime prevention efforts and in support of the patrol division
as extra eyes and ears on the street. The unit has performed dozens of transports to jail and detox
allowing full time Officers to stay back in the city available to respond to emergencies. They
participate in ongoing training within the department as well as jointly with other Reserve units
from northern Dakota County. Reserve Officers are not trained or authorized to do the majority
of the functions of a full time Officer, however they are invaluable because they allow the full
time Officers more time to focus on protecting the lives and property of the citizens of the
communities we patrol.
In reviewing the great accomplishments of the unit and its dedicated members we wanted to
recognize their efforts formally in front of the Mayor, Council and the citizens who benefit from
the services they provide. Again this year we would like to honor our members who donated a
very large amount of their personal time to the city by presenting them with the Presidents
Volunteer Service Award. The President's Volunteer Service Award recognizes individuals and

groups that have achieved a certain standard — measured by the number of hours of service over
a 12 -month period. The award consists of:
1. An official President's Volunteer Service award lapel pin
2. A personalized certificate of achievement
3. A congratulatory letter from President Obama
The Bronze award is presented to a volunteer who donates between 100 and 249 hours. The
silver award is presented to volunteers who donate between 250 and 499 hours and the gold
award is given to those who donate 500 or more hours in a calendar year. The lifetime award
goes to a volunteer that donates in excess of 4000 hours in a lifetime.
RECOMMENDATION:
If the Council agrees with the recommendations the following Reserve Officers should be
presented by the Mayor with the aforementioned awards for their service to the city of Mendota
Heights.
Based on the hours volunteered during 2014 the Police Department will be presenting the
following Reserve Officers with the following awards;

by the City Council; therefore a new variance request must be considered.
The proposed addition would extend the northeast corner of the building an additional 40.5 feet to the east
along the existing north wall, which creates a side yard setback of approximately 21'-0518". Asa result, the
variance request is for approximately 19 feet for the side yard abutting Mendota Heights Road. According
to the applicant, the proposed addition is necessary to accommodate additional office space in alignment
with the existing building.
The Planning Commission conducted a public hearing at the March 24 meeting; there were no public
comments.

RECOMMENDATION
The Planning Commission recommended approval of the variance request, with conditions, as described in
Planning Case 2015-05. If the City Council desires to implement the recommendation, pass a motion

WHEREAS, Alltech Engineering Corporation, on behalf of Mendota Management, LLC, has
applied for an approximately nineteen -foot (19) variance from the side yard setback standards in order
to construct an addition to the existing office/warehouse building at 2515 Pilot Knob Road as proposed
in Planning Case 2015-05 and described in Exhibit A; and
WHEREAS, the Mendota Heights Planning Commission held a public hearing on this matter
at their regular meeting on March 24, 2015.
NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the
variance request as proposed in Planning Case 2015-05 is hereby approved with the following findings
of fact:
1. The proposed addition is a reasonable use of the property, meets the purpose and intent of the
City Code, and is consistent with the Comprehensive Plan.
2. The improvements to Mendota Heights Road created a unique circumstance upon the property
not created by the applicant.
3. The building's location on a corner lot with an existing encroachment is a unique circumstance
not created by the applicant.
4. The proposed addition represents a small increased encroachment into the side yard while still
maintaining a large front yard setback.
5. The applicant has considered alternatives to the proposed addition.
6. The proposed addition will not alter the essential character of the neighborhood.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the variance
request as proposed in Planning Case 2015-05 is hereby approved with the following conditions:
1. A building permit be obtained prior to construction of the addition.
2. The applicant shall submit grading plans and a dimensioned site plan with associated
easements, subject to review and approval by the City Engineering Department as part of any
building permit application.
3. Any land disturbance activities must be in compliance with the City's Land Disturbance
Guidance document.

DESCRIPTION OF THE REQUEST
The applicant is seeking a variance from the side yard setback standards to construct an addition to the
office/warehouse building at 2515 Pilot Knob Road.
BACKGROUND
The subject parcel is 4.34 acres (189,067 square feet) and contains an existing office/warehouse building
on the southwest corner of the Pilot Knob Road/Mendota Heights Road intersection. The parcel is zoned
and guided as I -Industrial. The applicants intend to construct an approximately 2,363 -square foot (40'-6"
by 59'-4") addition to the northeast corner of the building. The north side of the addition would encroach
into the side yard setback along Mendota Heights Road.
A variance request for a similar project was approved in 2008, as part of Planning Case 2008-12. According
to Title 12 -1L -5(F) of the City Code, a variance becomes void one year after approval unless made use of

ANALYSIS
Comprehensive Plan
The subject parcel is guided I -Industrial in the 2030 Comprehensive Plan. The applicant's request to
construct an addition to the existing building is consistent with the continued use as an office/warehouse.
Side Yard Setback Variance
Title 12 -1G -17(G) of the City Code requires a 40 -foot side yard setback abutting a street in the Industrial
District. The existing building's side yard setback along Mendota Heights Road ranges from 22.8' to 21'-
35 8'. Due to the building's angle in relation to the right-of-way, the setback is inconsistent along the 250
feet of existing frontage (see Site Plan).

The proposed addition would extend the northeast corner of the building an additional 40.5 feet to the east
along the existing north wall, which creates a side yard setback of approximately 21'-0518". Asa result, the
variance request is for approximately 19 feet for the side yard abutting Mendota Heights Road. As shown
in the table above, the proposed addition meets the Industrial District's other setback requirements.
According to the applicant, the proposed addition is necessary to accommodate additional office space in
alignment with the existing building. As shown in the attached floor plans, the proposed addition would
expand the existing office area and better serve the needs of the company and employees.
When considering a variance for the proposed addition, the City is required to find that:
1. The request is in harmony with the general purposes and intent of the ordinance and comprehensive
plan and the applicant proposes to use the property in a reasonable manner.
An expansion of the existing office/warehouse building in the Industrial District is a reasonable use of the
property and consistent with the Comprehensive Plan. The existing building is non -conforming from the
required side yard setback along Mendota Heights Road and the proposed addition would encroach only
three inches further than the existing condition.
2. The applicant establishes there are practical difficulties with complying with the ordinance due to
circumstances that are unique to the property which are not created by the applicant or based on
economic considerations;
The building was purchased by the applicant in 1995 and the north building wall has remained in its existing
location along Mendota Heights Road. It is unknown what the Industrial District's side yard setback
standards were when the building was originally constructed in 1965. Therefore, the building's location on
a corner lot with an existing encroachment is a unique circumstance not created by the applicant.
The applicant has established that practical difficulties exist in expanding the building to fit their current
needs in compliance with the Code's side yard setback standards. As noted in the applicant's letter of
intent, other design alternatives were considered as part of the 2008 application review process. An
alternate addition constructed on the east end of the building, in compliance with the side yard setback
standards, would require the existing entrance to be relocated, mature trees to be removed, and be disruptive
to the business operations. However, the potential cost of a compliant expansion project cannot be
considered as a finding for approval of the variance request in this case.
3. The request will not alter the essential character of the locality.
The proposed project to extend the existing north building wall along Mendota Heights Road, with an
insignificant increase in encroachment from the existing condition, will not negatively impact the
surrounding properties. In addition, the property will still maintain a front yard setback of nearly 100 feet
from Pilot Knob Road with a maintained lawn and mature trees to offset the extended encroachment along
Mendota Heights Road.

ALTERNATIVES
Following a public hearing, the Planning Commission may consider the following actions:
1. Recommend approval of the variance request for construction of an addition within the required
side yard setback area based on the attached findings of fact, with conditions.

yard setback area based on the findings of fact that a practical difficulty is not established and
expansion alternatives exist that do not require a side yard setback variance.

Mendota Management LLC is requesting a variance to the side yard setback requirement of 40'-0" to enable
expansion of its building located at 2515 Pilot Knob Road. The building currently has a setback of 2 F- 3 5/8"
or greater on its north side along a length of 250' of Mendota Heights Road. The proposed expansion would
extend the length of the building no more than 40'6" at the existing setback. At the northeast corner of the
addition the setback would be 2 F- 0 5/8". The building was constructed prior to an extension of Mendota
Heights Road which created the current setback requirement.
This same variance request was granted in 2008 by Mendota Heights City Council, but because of the recession
Alltech Engineering Corp did not move forward with the addition at that time. Instead, other less costly
improvements were made within the existing structure that expanded office space. Once again, due to growth,
Alltech must expand its office. This location is Alltech Engineering's corporate headquarters. It is Alltech's
goal to continue to grow in this location, if expansion is feasible.
The request for variance is based on practical difficulties for Mendota Management and its sole tenant, Alltech
Engineering Corp. These difficulties include:
1) We have reviewed a variety of options for expanding the building using the open space at the East end
of the property. It is our assessment that all other options beside the proposed expansion would create
significant disruption to Alltech's operations and/or substantial additional construction cost. Disruption
to Alltech's operations would be most severe during the construction process, and might require the
company's temporary relocation.
2) The zoning change limits Mendota Managements ability to expand the building in accordance with
original expansion plans for the property. These limitations include moving the building's entrance,
potential encroachment on the sidewalk and parking surface, and changes to the property's landscaping
that will both result in additional cost and degrade the property's appearance.
Because of our desire to protect our property value, we have also considered the issue of preserving the
neighborhood's character. The expanded building will still have a 94'6" setback from Pilot Knob Road with a
maintained lawn and mature trees. Other plans we explored do not allow preservation of either a contiguous
lawn near the building's entrance or preservation of mature trees of similar type and age as those on adjacent
properties.

WHEREAS, The Planning Commission held a public hearing on this application

deny the Variance as presented to the Planning Commission on the evening of May 27,
2008 and as shown in Planning Case #08-12 for a lack of demonstrated hardship.
WHEREAS, the applicant has provided staff additional material defining the
hardship and identifying alternative options which were considered,

Yes, the addition adds eight offices. This will allow Alltech Engineering Corp to continue to grow
its corporate headquarters at its current location. Currently, Alltech has no room to add additional
office staff, because all cubicles and offices are being used. The addition follows the existing
building wall on the north side of the property and preserves the character of the lot. Finally, this
proposal was deemed reasonable by Mendota Heights City Council in 2008, when they approved
this same variance request.

The building was built in 1965, 30 years before Alltech took possession of the building in 1995.
The existing building walls have not changed. Furthermore, Mendota Heights Road was widened
and a sidewalk added to create the current 21' 3 5/8" setback. An addition has been considered
on the other side of the front of the building, but it doesn't flow with the current entrance or
walkway, and would cause the removal of mature trees from the lot. Furthermore, a front addition
on the south side of the building would be so disruptive to our operations during construction,
that we would have to consider moving. Many other addition plans have been considered, but
because of practical difficulties, this plan is the least disruptive to our existing front office space.

BACKGROUND
The applicant, on behalf of the property owner, is seeking approval to subdivide the subject parcel located at
747 Willow Lane. In addition, construction of single-family dwellings on the newly -created parcels will cause
soil disturbance and vegetation removal within a wetland/water resource -related area, which requires a
wetlands permit.
The proposed parcels meet the R -I Zoning District's lot size and width requirements. The applicant has also
provided information regarding the proposed location of the new dwellings, which would comply with the
required setback standards.
Marie Creek runs through the northwest corner of the subject parcel. As a result, much of the rear yards of the
newly -created parcels are located within the 100 -foot wetland/water resource -related buffer area. Based on
the proposed building pads, construction of the new dwellings on both parcels will require grading and
vegetation removal within this area; therefore a wetlands permit is required. After construction, vegetation is
proposed to be replanted within the disturbed area and adequate erosion control measures will be installed
during construction.
The Planning Commission conducted a public hearing at the March 24 meeting. Neighboring property owners
commented on the implications of lot splits in the city and the location of the proposed dwellings on the lots.

conditions, as described in Planning Case 2015-07. If the City

at their regular meeting on March 24, 2015.
NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the lot
split and wetlands permit requests as proposed in Planning Case 2015-07 are hereby approved with the
following findings of fact:
1. The proposed lot split and construction activities meet the purpose and intent of the City Code
and are consistent with the Comprehensive Plan.
2. No grading or vegetation removal within the required 25 -foot non -disturb buffer area will
occur as part of the proposed construction projects.
3. Adequate erosion control measures will be observed during construction.
4. Vegetation will be replanted in the disturbed areas after construction is completed.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the lot split and
wetlands permit requests as proposed in Planning Case 2015-07 are hereby approved with the
following conditions:
1. The existing single family dwelling is demolished prior to the subdivision being recorded by
Dakota County.
2. Park dedication fee in the amount of $2,700, in lieu of land, is collected after City Council
approval and before being recorded by Dakota County or issuance of any additional permits by
the City.
3. Street reconstruction assessment fee in the amount of $3,900, as part of Bunker Hills Street
Reconstruction 95-14/Improvement 96-3, is collected after City Council approval and before
being recorded by Dakota County or issuance of any additional permits by the City.
4. The applicant shall dedicate the following drainage and utility easements on both newly -
created parcels to be denoted on the Certificate of Survey submitted to Dakota County: 10 -foot
wide along the front property lines; 5 -foot wide along the rear property lines; and across the
entire 25 -foot non -disturb buffer area from the edge of Marie Creek.
5. Connection charges for sanitary sewer and water main shall be paid prior to issuance of a
building permit.
6. The applicant shall submit grading and utility plans and a dimensioned site plan with
associated easements, subject to review and approval by the City Engineering Department as
part of any building permit application.
7. No disturbance, besides installation of erosion control measures during construction, shall
occur within 25 feet of the edge of Marie Creek.

DESCRIPTION OF THE REQUEST
The applicant, on behalf of the property owner, is seeking approval to subdivide the subject parcel located
at 747 Willow Lane. The request requires City approval before being recorded with Dakota County. In
addition, construction of single-family dwellings on the newly -created parcels will cause soil disturbance
and vegetation removal within a wetland/water resource -related area, which requires a wetlands permit.
BACKGROUND
The subject parcel is approximately 1.21 acres (52,708 square feet) and contains an existing single-family
residential dwelling. In addition, the northwest corner of the subject parcel is traversed by Marie Creek
(see attached Aerial Map). The parcel is zoned R-1 and is guided for low density residential development.
If the requests are approved, the existing dwelling would be demolished and two new single-family homes
would be constructed within the building pads shown on the proposed Building Exhibit.
ANALYSIS
Comprehensive Plan
The subject parcel is guided LR, Low Density Residential in the 2030 Comprehensive Plan. The applicant's
request to subdivide the subject parcel into two parcels, consisting of approximately 0.60 acres each, is
consistent with the LR maximum density of 2.9 units per acre.
Lot Split
Title 11-3-2 of the City Code (Subdivision Ordinance) allows the subdivision of parcels, provided that the
resulting lots are compliant with the requirements of the applicable zoning district. According to the
Certificate of Survey included as part of the application submittal, and shown in the table below, both
proposed parcels meet the R-1 lot standards.

The proposed Building Exhibit includes the required setbacks for future principal structures on the newly -
created parcels; actual compliance will be verified upon submission of building permit applications based
on the proposed dwellings' design.
Wetlands Permit
The purpose of the Wetlands Systems Chapter of the City Code is to (Title 12-2-1):
• Provide for protection, preservation, maintenance, and use wetlands and water resource -related
areas;
• Maintain the natural drainage system;
• Minimize disturbance which may result from alteration by earthwork, loss of vegetation, loss of
wildlife and aquatic organisms as a result of the disturbance of the natural environment or from
excessive sedimentation;
• Provide for protection of potable fresh water supplies; and
• Ensure safety from floods.
As shown in the attached maps, the 100 -foot wetland/water resource -related area encompasses the
northwest portion of the subject parcel. Based on the proposed building pads, construction of the new
dwellings on Parcels A and B will require grading and vegetation removal within this area; therefore a
wetlands permit is required.
According to the applicant, up to seven substantial, healthy trees will be removed. Associated grading will
disturb other insignificant ground vegetation on both parcels, much of which is dead or dying (see attached
photos). In addition, the following is the proposed scope of further disturbance in the impacted area:
"The area is currently a combination of overgrown woods and yard. We anticipate some
re -grading on our sites that would mitigate the topography change currently on the lots
(especially on Parcel A) and allow the yard to be more usable. We would grade into the
100 foot buffer to clean up the vegetation and allow the woods to grow healthier (clean up
brush, noxious weeds, etc). The hope is that at the end of the project the yards would
be more usable, but the trees and woods would be healthier based on us cleaning up
the overgrowth. "
After construction, vegetation is proposed to be replanted within the disturbed area. Proposed erosion
control measures are shown on the Building Exhibit, which will be reviewed in greater detail by the
Engineering Department as part of the building permit applications.
Stream bank erosion has taken place along Marie Creek in the past. The 25 -foot non -disturb buffer area
that is now part of the wetlands permit review process helps to protect stream banks from surface runoff
caused by impervious surfaces. With the non -disturb area in place, erosion is more likely to be caused by
the velocity of water moving within the creek itself than is likely from surface runoff.
ALTERNATIVES
1. Recommend approval of the subdivision and wetlands permit requests, based on the attached
findings of fact that, with conditions.

2. Recommend denial of the subdivision and wetlands permit request, based on the finding of fact that
the proposed subdivision and associated construction activities are not consistent with the City
Code or Comprehensive Plan.

STAFF RECOMMENDATION
Staff recommends approval of the subdivision and wetlands permit requests based on the attached findings
of fact (Alternative 1), with the following conditions:
The existing single family dwelling is demolished prior to the subdivision being recorded by
Dakota County.
2. Park dedication fee in the amount of $2,700, in lieu of land, is collected after City Council approval
and before being recorded by Dakota County or issuance of any additional permits by the City.
3. Street reconstruction assessment fee in the amount of $3,900, as part of Bunker Hills Street
Reconstruction 95-14/Improvement 96-3, is collected after City Council approval and before being
recorded by Dakota County or issuance of any additional permits by the City.
4. The applicant shall dedicate the following drainage and utility easements on both newly -created
parcels to be denoted on the Certificate of Survey submitted to Dakota County: 10 -foot wide along
the front property lines; 5 -foot wide along the rear property lines; and across the entire 25 -foot non -
disturb buffer area from the edge of Marie Creek.
Connection charges for sanitary sewer and water main shall be paid prior to issuance of a building
permit.
The applicant shall submit grading and utility plans and a dimensioned site plan with associated
easements, subject to review and approval by the City Engineering Department as part of any
building permit application.
7. No disturbance, besides installation of erosion control measures during construction, shall occur
within 25 feet of the edge of Marie Creek.
8. Any land disturbance activities shall be in compliance with the City's Land Disturbance Guidance
document.
9. A Landscape Plan is submitted for review by the Planning Department showing vegetation to be
re -planted within the 100 -foot wetland/water resource -related area after construction.

businesses in our city. Food trucks are not currently addressed in our City Code. Last summer, staff
administratively -approved food trucks on a case-by-case basis to allow them to be located on private
property. We had no issues with the food trucks.
At the 2014 Council Goal Setting session, the Council discussed revisions to the Code regarding peddlers,
solicitors and transient merchants and directed staff to bring back some revisions. The current language is
very confusing for staff and the public to interpret. Staff has been working with City Attorney Tom
Lehmann to revise the language so that it better reflects and clearly states the intent of the Council.
Food Trucks
A new section of Code being proposed would allow for food trucks to be located on private property in
the Industrial Zoning District. It is proposed that the food truck owner be required to register with the
city, along with submitting a copy of their current state food truck license and proof of liability insurance.
This would allow city staff to provide them with the city's regulations that are included in this proposed
ordinance. No fee for registering a food truck would be required.
The Planning Commission conducted a public hearing to discuss the proposed mobile food truck
amendments, as included in Section 7 of DRAFT Ordinance 475, at the March 24 meeting; there were no
public comments. The Planning Commission recommended the following revisions, which are
underlined in the DRAFT:
• Section 2 and Section 7: Revised the mobile food truck definition and purpose to specifically
reference the Industrial District — not the entire City, as originally written.
• Section 7(A): Clarified that registration is required annually for each site the vendor operates.
• Section 7(13)(2): Revised "proper" licenses to "required" licenses.
• Section 7(B)(6): Exempted existing tables and chairs and further defined areas where
tables/chairs are not permitted.
In addition, after consultation with the City Attorney, staff is proposing an additional amendment that
would allow mobile food trucks on private properties outside of the Industrial District for special events
once per year. Registration and compliance with the operational requirements would still be
required.

Soliciting
The proposed ordinance would repeal Section 3.3 of the Code and replace it with language that more
clearly states that the City does not allow peddlers or transient merchants. This is not a change from the
previous ordinance which was adopted in November of 2011. This new ordinance would not allow
solicitors who are engaged in any commercial type of activity.
The ordinance would still allow non-commercial door-to-door advocates who are exercising their Federal
constitutional rights such as freedom of speech, press, or religion. Also still allowed would be
fundraising activity for a school, religious organization, or a service organization. Also, any utility
service provider who has a franchise agreement with the city would still be allowed to go door-to-door to
sell or inform residents of their services.
As proposed in Section 6, the proposed time to allow non-commercial soliciting is proposed to be from
9:00 am to one half hour before sunset. The previous ordinance did not specify the hours allowed.
RECOMMENDATION
City staff is recommending the Council adopt Ordinance 475 Amending Section 3-3 of the City Code
Concerning Peddlers, Solicitors, Transient Merchants, and Food Trucks, and approve the summary
publication. The summary publication requires a 4/5t1 vote of the Council.

AN ORDINANCE AMENDING SECTION 3-3 OF THE CITY CODE OF THE
CITY OF MENDOTA HEIGHTS, MINNESOTA, DAKOTA COUNTY, CONCERNING
PEDDLERS, SOLICITORS, TRANSIENT MERCHANTS, and FOOD TRUCKS
The City Council of the City of Mendota Heights, Minnesota, does hereby ordain:
Section 1.
Title 3, Chapter 3 is hereby repealed and replaced.
Section 2.
3-3-1: DEFINITIONS:
Except as may otherwise be provided or clearly implied by context, all terms shall be given their
commonly accepted definitions. For the purpose of this ordinance, the following definitions shall apply
unless the context clearly indicates or requires a different meaning.
PERSON: Any natural individual, group, organization, corporation, partnership, or similar association.
PEDDLER: Any person, whether a resident of the City of Mendota Heights or not, who goes from house-
to-house, door-to-door, business -to -business, street -to -street, or any other type of place -to -place
movement, for the purpose of offering for sale, displaying for exposing for sale, selling or attempting to
sell, and delivering immediately upon sale, the goods, wares, products, merchandise, or other personal
property that the person is carrying or otherwise transporting. For purpose of this chapter, the term
"Peddler" shall have the same common meaning as the term "Hawker."
SOLICITOR: Any person, whether a resident of the City of Mendota Heights or not who goes from
house-to-house, door-to-door, business -to -business, street -to -street, or any other type of place -to -place
movement, for the purpose of obtaining or attempting to obtain orders for goods, wares, products,
merchandise, other personal property, or services of which he or she may be carrying or transporting
samples, or that may be described in a catalog or by other means, and for which delivery or performance
shall occur at a later time. The absence of samples or catalogs shall not remove a person from the scope of
this provision if the actual purpose of the person's activity is to obtain or attempt to obtain orders as
discussed above. For purposes of this ordinance, the term "Solicitor" shall have the same meaning as the
term "Canvasser." For purpose of this ordinance, the term "Door -to -Door Advocate" shall also fall under
the term "Solicitor."
TRANSIENT MERCHANT: Any person, firm or corporation, who temporarily sets up business out of a
vehicle, trailer, boxcar, tent, other portable shelter, or empty store front for the purpose of exposing or
displaying for sale, selling or attempting to sell, and delivering goods, wares, products, merchandise, or
other personal property and who does not remain in any one location for more than fourteen (14)
consecutive days.
NON-COMMERCIAL DOOR-TO-DOOR ADVOCATE: Any person who goes door-to-door for the
primary purpose of disseminating religious, political, social, or other ideological beliefs. For purposes of
this Ordinance, the term door-to-door advocate shall fall under the term solicitor and include door-to-door
canvassing and pamphleting intended for non-commercial purposes.

PROFESSIONAL FUNDRAISER: Any person, including a corporation or other entity, who, for
compensation, performs any solicitations or other services for a religious, political, social, or other
charitable organization.
MOBILE FOOD TRUCK: A motorized vehicle or pushcart that is designed and operated for the purpose
of preparing and or selling food and non-alcoholic beverages to the general public within the Industrial
Zoning District or as set forth in 3-3-6(D) of this Chapter.^epere*e eil-y limits.
VENDOR: A person who hawks, peddles, sells or offers food for sale.
Section 3.
3-3-2: EXCEPTIONS TO DEFINITIONS:
For the purpose of this chapter, the terms Peddler, Solicitor and Transient Merchant shall not apply to:
A. Non-commercial Door -to -Door Advocates. Nothing within this ordinance shall be interpreted to
prohibit or restrict Non -Commercial Door -to -Door Advocates.
B. Any person who makes initial contacts with other people for the purpose of establishing or trying to
establish a regular customer delivery route for the delivery of perishable food and dairy products,
such as baked goods or milk.
C. Any person making deliveries of perishable food and dairy products to the customers on his or her
established delivery route.
D. Any person making deliveries of newspapers, newsletters, or other similar publications on an
established customer delivery route, when attempting to establish a regular delivery route, or when
publications are delivered to the community at large.
E. Any person conducting the type of sale commonly known as garage sales, rummage sales, or estate
sales.
F. Any person participating in an organized, multi -person bazaar or flea market.
G. Any person conducting an auction as a properly licensed auctioneer.
H. Any officer of the court conducting a court-ordered sale.
Exemption from these definitions shall not, for the scope of this chapter, excuse any person from
complying with any other applicable statutory provision or requirement provided by another city
ordinance.
Section 4.
3-3-3: PROHIBITION OF PEDDLERS, SOLICITORS AND TRANSIENT MERCHANTS:
A. Prohibition of Peddlers, Solicitors and Transient Merchants. The practice of going in and upon
private residences in the City of Mendota Heights, by Peddlers, Solicitors and Transient Merchants,
not having been requested or invited to do so by the owner or owners of said private residences for
the purpose of sale, displaying for exposing for sale, selling or attempting to sell, and delivering
immediately upon sale, the goods, wares, products, merchandise, or other personal property that the
person is carrying or otherwise transporting or that may be described in a catalog or by other means,
and for which delivery or performance shall occur at a later time, is hereby declared to be a nuisance
and punishable as a misdemeanor.
B. Authority of Law Enforcement to Enforce this Ordinance. Law Enforcement for the City of Mendota
Heights are hereby required and directed to suppress the activities of Peddlers, Solicitors and
Transient Merchants and to cite any such nuisance as is described in Section 3-3-3(A).

Section 5.
3-3-4: EXCEPTIONS TO PROHIBITION OF PEDDLERS, SOLICITORS AND TRANSIENT
MERCHANTS:
For the purpose of this chapter, persons engaging in the following activities shall be exempt from the
prohibitory activities in Section 3:
A. Any person selling, or attempting to sell, or to take or attempt to take orders for, any product grown,
produced, cultivated, or raised on any farm.
B. Any person going from house-to-house, door-to-door, business -to -business, street -to -street, or any
other type of place -to -place movement for the primary purpose of exercising that person's state or
federal constitutional rights such as freedom of speech, freedom of the press, freedom of religion, and
the like. This exemption will not apply if the person's exercise of constitutional rights is merely
incidental to what would properly be considered a commercial activity.
C. Any person going from house-to-house, door-to-door, business -to -business, street -to -street, or any
other type of place -to -place movement for the primary purpose of fundraising for a school or religious
function or activity or related service organization for example the Girl Scouts of America or Boy
Scouts of America.
D. Any utility provider licensed or franchised through the City of Mendota Heights attempting to
increase their customer base by attempting to sell to or inform residents or businesses of utility
services and/or promotions.
Section 6.
3-3-5: PROHIBITED ACTIVITIES FOR NON-COMMERCIAL DOOR-TO-DOOR ADVOCATES
AND PROFESSIONAL FUNDRAISERS:
Non -Commercial Door -to -Door Advocates excluded under 3-3-2 of this chapter shall be prohibited from
conducting business in any of the following manner:
A. Calling attention to his or her business or the items to be sold by means of blowing any horn or
whistle, ringing any bell, crying out, or by any other noise, so as to be unreasonably audible within an
enclosed structure.
B. Obstructing the free flow of traffic, either vehicular or pedestrian, on any street, sidewalk, alleyway,
or other public right-of-way.
C. Conducting business in a way as to create a threat to the health, safety, and welfare of any specific
individual or the general public.
D. Conducting business before 9:00 a.m. or after one-half hour before sunset.
E. Alleging false or misleading statements including untrue statements of endorsement.
F. Remaining on the property of another when requested to leave.
G. Otherwise operating their business in any matter that a reasonable person would find obscene,
threatening, intimidating or abusive.
Section 7.
3-3-6: MOBILE FOOD TRUCKS
For purpose of this Chapter, the intent is to regulate how mobile food truck vendors sell food and or non-
alcoholic beverages to the general public within the Industrial Zoning District^afpffa'e ,.:,-, liffli s.
A. Registration Required. Annual registration shall be required for each separate property on which the
mobile food truck vendor operates.
1. It shall be unlawful for any mobile food truck vendor to sell, or offer for sale, any food or
beverage without first registering with the City Clerk, or his/her designee.

2. Not later than thirty (30) days after filing of a completed application, the applicant shall be
notified of acceptance or denial of registration.
3. The application shall be accompanied by proof of insurance and approval of any and all
health department requirements whether from Dakota County or the State of Minnesota.
4. Mobile food truck vendors shall carry $1,000,000 of combined single limit Bodily Injury and
Property Damage Auto liability, $1,000,000 of General Liability coverage including Products
and Completed Operations. A certificate of insurance shall be provided to the city prior to
the issuance of a permit.
B. Operations requirements. Mobile food truck vendors shall operate under the following conditions:
1. Hours of operation are limited to between 9:00 AM and 2:00 PM.
2. All requir Apfopef licenses must be valid.
3. Vendors shall be parked on private property with the property owner's permission and shall
not be parked within any public street, right-of-way or sidewalk unless said street has been
closed for a special event, as approved by the City Council.
4. Vendors shall be responsible for the proper disposal of waste and trash associated with the
operation. City trash receptacles are not to be used for this purpose. Vendors shall remove
all waste and trash from their location at the end of each day or as needed to maintain the
health and safety of the public. The vendor shall keep all areas within ten (10) feet of the
truck clean of grease, trash, paper, cups or cans associated with their operation. No liquid
waste or grease is to be disposed into tree pits, storm sewer drains or onto sidewalks, streets
or other public space. Under no circumstances shall grease be released into or disposed of
into the City's sanitary sewer system.
5. There shall be no audio amplifier or similar device to attract the attention of the public.
6. No tables, chairs or other structures, except those to hold/display condiments, shall be
allowed outside of the food truck within public right-of-way, designated off-street parking
spaces, fire lanes, or driveways. This shall not preclude any existing structures that are on the
propeM.
7. Advertising consisting of business name, logo, and items available for sale may be displayed
on the food truck. No other form of on-site advertising shall be permitted.
8. The mobile food truck owner or his/her designee shall be present at all times except in an
emergency.
C. Location. Mobile food truck vendors may operate within the following zoning district(s): I -Industrial.
49-D. Special Events. Special events proposed to be located in non -industrial zones of the City may
use mobile food trucks upon registration with the City. Said events shall occur no more frequently
than one time per year. These events must be in compliance with all criteria outlined in Sections A
and B above, but changes in the hours of operation may be considered. Any permission for special
event mobile food trucks may be granted by the City Administrator.
Section 8.
This Ordinance shall be in effect from and after the date of its passage and publication.
Adopted and ordained into an Ordinance this seventh day of April, 2015.
