Minutes of the Regular Meeting
Held Tuesday, October 7, 2014
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present:
Councilmembers Duggan, Petschel, and Norton. Councilmember Povolny was absent.

Council, the audience, and staff recited the Pledge of Allegiance.

Mayor Krebsbach presented the agenda for adoption. Councilmember Norton moved adoption of the
agenda with the understanding that item 6m was pulled from the agenda.

SWEARING IN CEREMONY OF POLICE OFFICER ROBIN NELSON
Chief of Police Michael Aschenbrener introduced Ms. Robin Nelson as the newest hire at the Mendota
Heights Police Department. Ms. Nelson read aloud the Code of Ethics to the Council and the public.
Mayor Krebsbach officially swore in Police Officer Robin Nelson.

D) APPROVAL OF CHANGE OF DATE FOR NOVEMBER 4 CITY COUNCIL MEETING
City Administrator Justin Miller explained that Tuesday, November 4th is the regularly scheduled
meeting for the City Council, which is also the night of the General Election. As public meetings cannot
be held between 6:00 p.m. and 8:00 p.m., staff recommended the meeting be moved to Wednesday,
November 5th at 7:00 p.m. The Canvassing Board meeting will be scheduled at a later date.
Councilmember Duggan moved to change the date for November 4th city council meeting to
Wednesday, November 5th at 7:00 p.m.

H) APPROVAL OF WETLAND DELINEATION FOR RATCHYE PROPERTY
AT 2270 WAGON WHEEL COURT
This item was pulled from the consent agenda to allow Councilmember Norton a chance to abstain.
Councilmember Duggan moved to approve and accept the report as submitted by Kjolhaug
Environmental Services Company, Inc. for their determination of wetland boundaries and to direct staff
to issue the Notice of Decision.

K) AUTHORIZATION TO APPLY FOR GRANT TO UPDATE PILOT KNOB NATIONAL
REGISTER OF HISTORIC PLACES APPLICATION
Councilmember Duggan stated that, if obtained, this grant would facilitate updating of the application
for Pilot Knob to be listed in the National Register of Historic Places. A portion of the grant would also
be used to produce more brochures. The City would be the official grant applicant, but PKPA would
conduct all of the work.
Of the $6,000 grant requested, $5,000 would be used to cover the cost of conducting new research,
revising the original application to describe the preservation and restoration activities to date. The
remaining $1,000 would be used for reprinting copies of The Pocket Guide to Pilot Knob.
Councilmember Duggan moved to authorize staff to apply for a grant from the Arts and Cultural
Heritage Fund in the amount of $6,000.

P) APPROVAL OF CLAIMS LIST
Councilmember Petschel noted that under Significant Claims is the Met Council Environmental Services
— SAC & Sewer charges in the amount of $91,130.04. She explained that there was an event in June
with record breaking rainfall. In the area bordering West St. Paul, near Somerset Golf Course, on
Delaware Avenue, West St. Paul was overwhelmed with water flow and Mendota Heights had to take on
some of the stormwater from West St. Paul and send it through our system. This resulted in an increase
in the bill. Mendota Heights has been working with the Met Council to have the bill adjusted.
In the process of working on that issue, Mendota Heights discovered that there may be a meter that we
are being charged for that belongs to West St. Paul. She suggested this needs to be investigated.
The reason Councilmember Petschel raised this issue is that this is a significant bill for Mendota
Heights.
City Administrator Justin Miller replied that this bill necessarily was not impacted by the June storm.
However, going forward bills might be. This is the rate that the Met Council proposed for the City for
2015. Staff has been in discussion with them. The Council will be seeing the rate structure at a future
meeting to approve the utilities rates beginning in 2015.
Mayor Krebsbach asked Administrator Miller to see if the City's Met Council representative can come
to the next Council meeting.
Councilmember Duggan asked Finance Director Kristen Schabacker to share what the previous bills or
estimates were from the Met Council Environmental Services. Director Schabacker replied that the City
has an annual amount that is equal for all 12 months. This year's monthly charge for sewer is
$86,209.74. Next year the monthly bill is projected to be increased by approximately 12%.

PRESENTATIONS
A) DR. NANCY ALLEN-MASTRO, ISD 197 REFERENDUM
Dr. Nancy Allen -Mastro, Superintendent of District 197, made a presentation on the upcoming
November 4th school referendum that is on the General Election ballot.
They have three questions on the ballot.
1. Technology — asking the taxpayers to approve $1.2M annually for a 10 -year period
2. School Security — remodel or relocate the front offices to the schools, $3.2M bond to be paid
back over a 10 -year period
3. Multi -use Athletic Stadium at Henry Sibley High School, $4.5M bond is being proposed
Ms. Allen -Mastro explained that question three is a contingency question, meaning that questions one
and two must pass in order for question three to pass.
Councilmember Duggan asked in regards to the stadium if any of the issues and questions raised by the
Council in previous meetings had been addressed. Ms. Allen -Mastro replied that they were waiting until
after the referendum to address those concerns.
In regards to the stadium location asked by Mayor Krebsbach, it was noted that the school site is
preferred and there really is no interest in researching alternate sites.
The school district is trying to get the word out to all of the residents; there have been a lot of
presentations around the community and avenues such as this meeting to get the word out as well.
Ms. Allen -Mastro continued by sharing the estimated tax impact on an estimated $200,000 value
homestead:
• Question 1 (Technology) = $24/year or $2/month
• Question 2 (Security) = $3/year or $0.25/month
• Question 3 (Stadium) = $5/year or $0.42/month
• Questions 1, 2, & 3 = $32/year or $2.67/month
Ms. Allen -Mastro encouraged residents to go to the school's website and use the calculator there to
figure out the impact on their own home value. The commercial impact is on the website as well. Ms.
Allen -Mastro also shared a graph outlining how this school district stacks up against other similar
districts.

Councilmembers asked questions regarding the technology portion of the levy, how much of their own
money the school district is using to 'get the word out' in regards to the levy, and the total amount of the
referendum [$20.2M].
PUBLIC HEARINGS
A) VICTORIA/ROLLING GREEN NEIGHBORHOOD STREET PROJECT ASSESSMENT
HEARING, RESOLUTION 2014-66
Assistant City Engineer Ryan Ruzek explained that this is the assessment hearing for the
Victoria/Rolling Green Neighborhood Improvements. The project included a reconstruction of Victoria
Road and street rehabilitation of Walsh Lane, Stratford Road, Oxford Court, Coventry Court, Windwood
Court, and Rolling Green Curve.
The total estimated cost for the street reconstruction project was $762,196, the street rehabilitation was
$502,765, curb and gutter replacement was $76,133, trail replacement was $63,002, storm sewer was
$218,224, and the watermain was $196,692 — for a total of $1,819,014.30.
Several funding sources were used for this project:
• $401,000 from special assessments
• $783,000 in municipal bonds
• $500,000 MSA funds due to the higher traffic road for the heavier duty vehicles
• $497,900 from utility funds
The assessable costs for the reconstruction projects were $914,000; 50% of that was $457,000. There
were only 16 units on this section of Victoria Road that were assessable units. Based on the City's
policy the assessments would have been $28,500; however, it was proposed to cap that amount at $8,950
during the public hearing to order the project.
The assessable cost for the street rehabilitation was $603,318; 50% of that was $301,659 to the
residents. There are 67 units in the rehabilitation area and based on the City policy the assessments
would have been $4,502 per unit; however, it was proposed to cap that amount at $3,850 during the
public hearing to order the project.
The reconstruction assessment is payable over an 18 -year period and the rehabilitation assessment is
payable over a 10 -year period.
The assessments can be paid up until November 10th without incurring any interest. The interest rate on
the assessments is proposed at 6%, which would begin as of this meeting date if not paid prior to the
November 10th deadline.
Councilmembers asked how the project looks and if there had been any complaints received from the
residents.
Mayor Krebsbach noted that she did receive a call from a resident close to Marie Park stating it was
dusty. Engineer Ruzek stated that the streets were scheduled to be cleaned tonight.

Mayor Krebsbach opened the public hearing and asked if anyone was in the audience wishing to speak.
Seeing no one coming forward, Councilmember Petschel moved to close the public hearing.

Councilmember Duggan moved to adopt Resolution 2014-66 ADOPTING ASSESSMENTS FOR THE
VICTORIA ROAD & ROLLING GREEN NEIGHBORHOOD IMPROVEMENTS (PROJECT
#201308).

NEW AND UNFINISHED BUSINESS
A) 2014 BOND SALE, RESOLUTIONS 2014-67 AND 2014-68
Finance Director Kristen Schabacker noted that on this date the City held a bond sale for GO
Improvement bonds for the street improvement project and also for GO Refunding bonds. She
introduced Mr. Mark Ruff from Ehlers and Associates to present the results of the sale.
Mr. Mark Ruff from Ehlers and Associates explained that the City's AAA bond rating was confirmed.
Standard & Poor's was very complimentary of the City's budget flexibility and liquidity. They also
highlighted the strong management conditions, including the comprehensive policies and practices, the
long-term planning, and general fund reserve policy. Standard & Poor's does not anticipate a change in
the rating within the 2 -year outlook horizon but they do specifically highlight that the City's available
fund balance should be at least 75% of expenditures.
The good thing about a high bond rating is the attraction of more bids and lower interest rates. This bond
issuance attracted four bids, the low bidder being Northland Securities with an interest rate of 2.6%. The
size of the issuance as reduced from $1,050,000 to $1,030,000 because of the lower cost of issuance and
underwriters discount and because of the premium bid.
Councilmember Duggan moved to adopt Resolution 2014-67 "RESOLUTION PROVIDING FOR THE
ISSUANCE AND SALE OF $1,050,000 GENERAL OBLIGATION IMPROVEMENT BONDS,
SERIES 2014A, PLEDGING SPECIAL ASSESSMENTS FOR THE SECURITY THEREOF AND
LEVING A TAX FOR THE PAYMENT THEREOF".

Mr. Ruff continued by explaining the $900,000 General Obligation Refunding Bonds. Again, four bids
were received and the low bidder was Northland Securities with an interest rate of 2.3%. This saves the
City over $20,000 per year. The size of the issuance was reduced from $900,000 to $885,000 because of
the lower cost of issuance and underwriters discount and because of the premium bid.
Councilmember Petschel moved to adopt Resolution 2014- 68 "RESOLUTION PROVIDING FOR THE
ISSUANCE AND SALE OF $900,000 GENERAL OBLIGATION REFUNDING BONDS, SERIES
2014B AND PLEDGING FOR THE SECURITY THEREOF SPECIAL ASSESSMENTS AND
LEVYING A TAX FOR THE PAYMENT THEREOF".

B) PLANNING CASE 2014-26, AFTER -THE -FACT WETLANDS PERMIT,
2054 ACACIA DRIVE, RESOLUTION 2014-59
Planner Nolan Wall explained that the applicant was seeking an after -the -fact wetlands permit to remove
vegetation at 2054 Acacia Drive. The subject parcel contains an existing single family attached dwelling
along the northwest shore of Lake Augusta in the Augusta Shores Development. A substantial portion of
the rear yard is within a conservation easement.
The applicant stated that buckthorn and five dead elm trees were removed from the rear yard in 2006
and 2007. Those trees ranged in size from six to ten inches in diameter and the stumps were left
undisturbed. The impacted area is now devoid of significant vegetative cover and has been maintained
as a grassy area. Since being contacted by the City, the property owner is no longer maintaining the
impacted area and regrowth is occurring with the natural vegetation.
The conservation easement area does contain a mix of mature trees as well as natural and invasive
ground cover vegetation; the purpose is to provide a buffer between the development and the lake. Had
the applicant known that a wetlands permit was required, action would most likely have been approved
administratively.
In an effort to ensure compliance in the entire Augusta Shores Development, staff is working with the
townhome association to put together a wetlands permit for vegetation removal for the entire
development.
Staff recommended approval of this resolution.
Councilmember Norton moved to adopt RESOLUTION 2014-59 APPROVING A WETLANDS
PERMIT AT 2054 ACACIA DRIVE with conditions as stated in the resolution.

C) PLANNING CASE 2014-27, CRITICAL AREA PERMIT,
744 WOODRIDGE DRIVE, RESOLUTION 2014-60
Planner Nolan Wall explained that the applicant was seeking a critical area permit to construct
improvement within the Mississippi River Corridor Critical Area. The subject parcel is 1.75 acres with a
single family home. The Ivy Falls Creek bluff area is located to the west and south of the site. The
property is zoned R-1 and guided for low density residential development. The single family dwelling
was approved by a critical area permit and was constructed in 2010. The proposed project would include
a swimming pool, retaining wall including replacement and new structures, a patio, fence, and an
expansion to the existing screen porch.
Planner Wall described the purposes of the critical area overlay district. The proposed project is
compliant with the purpose and intent of the code, as well as the applicable development and natural
resource management standards.
Staff recommended approval of this resolution.
Councilmembers asked questions regarding the potential lessening of the run-off with this new
construction, and any potential dangers if a future homeowner removes the pool.
Councilmember Petschel moved to adopt RESOLUTION 2014-60 APPROVING A CRITICAL AREA
PERMIT AT 744 WOODRIDGE DRIVE with conditions as stated in the resolution.

D) PLANNING CASE 2014-28, CODE AMENDMENT REQUEST FOR EXCEPTION TO
SWIMMING POOL FENCING REQUIREMENTS, RESOLUTION 2014-61
Planner Nolan Wall explained that the applicants were requesting a code amendment that would allow
automatic pool covers as an exception to the City's current swimming pool fencing requirements. The
applicant's letter of intent included the rationale for consideration of the amendment.
The current swimming pool fencing requirements include standards for height, vertical spacing, prohibit
foot and hand holds, and requires self-closing and self -latching gates. The proposed amendment would
allow an exception to this fence requirement for covers conforming to ASTMF 1346-91 standards
specifications for safety covers and labeling requirements. The ASTMF International develops voluntary
standards for a variety of projects. Some of the conditions for this specific standard include provisions
that would inhibit children from under 5 -years old from removing or operating the cover (including
keys, combination locks, or other devices), switching devices must be inaccessible and must be at least
five feet above the pool deck, have a weight bearing threshold of 485 pounds (equal to two adults and
one child), prevent test objects from being passed through the cover, standing water must be
substantially drained within 30 minutes after a normal rainfall, must meet labeling requirements, and
must be reversible from a full stop without having to complete the full cycle. This proposed amendment
is similar in nature to the regulations that are currently in place in the City of Inver Grove Heights. In

addition, there are other jurisdictions that do allow exception to the fencing requirement for automatic
covers, including Maplewood, Sunfish Lake, and Rochester.
The City Council did deny a similar amendment request in 2005, which included two additional
conditions. The Planning Commission recommended that those be added to this proposed code
amendment. The proposed code amendment, in addition to what the applicants proposed, contains these
two additional conditions:
• The property owner shall provide proof of liability insurance coverage
• The property owner shall provide proof of inspection of the pool cover by an experienced
installer to the City on an annual basis
The Planning Commission reviewed this application at their September 23rd meeting and recommended
denial.
Councilmembers asked questions regarding there being any record of greater safety with fencing around
a pool versus an automatic electronic cover and any record of comparison of near drownings or
drownings and pools with automatic covers versus pools with fences.
Councilmember Duggan expressed his desire to see this code amendment put into place, as he did in
2005, because the issue is safety. An unlatched fence is just as unsafe as an open pool cover. If the issue
is aesthetics in the critical area, then this would be a way of minimizing obstruction of that beauty.
Mayor Krebsbach moved to adopt RESOLUTION 2014-61 DENYING ORDINANCE NO. 469 TO
AMEND THE CITY CODE TO ALLOW AN EXCEPTION FOR SWIMMING POOL FENCING
REQUIREMENTS based on the Findings of Fact as stated in the resolution.
Councilmember Petschel seconded the motion for purposes of discussion.
Councilmember Petschel commented that she did a bit of research on her own and found that insurance
companies recommended both a fence and a locking pool cover. She also saw that there were several
pages on-line as regards to trouble -shooting a pool cover in the event of mechanical failure. The
question is not is it as safe as a fence, but because it is mechanical what happens when it is not operating
correctly. After reviewing this information, Councilmember Petschel would not be in favor of having a
pool cover replace the fencing requirement.

Councilmember Duggan noted that even locked buildings and camera security can be breached. The
proposal from the Planning Commission was that there be two additional requirements added to the
conditions.
Councilmember Duggan believed that the artificial element, in this case a fence, would take away from
the natural beauty of the critical area. If there is an alternative that is just as safe, an electronic pool
cover, he would be in support of that.

Councilmember Duggan moved to adopt alternate RESOLUTION 2014-61 RESOLUTION
APPROVING ORDINANCE NO. 469 TO AMEND THE CITY CODE TO ALLOW AN EXCEPTION
FOR SWIMMING POOL FENCING REQUIREMENTS based on the Findings of Fact as stated in the
resolution and with the conditions.
Councilmember Norton seconded the motion.
Councilmember Norton stated that he recognized the safety concerns of the fence and the belt &
suspender sort of approach if you have the fence and the cover. He believes that the cover in its entirety
is a safer mechanism for protecting the pool than a fence is. He recognizes that a fence can be left
unlatched and a pool cover can be left open. One of the other things that need to be considered is the
children, animals, and even adults that are not fit for swimming would be saved by a pool cover such as
this. Some pool covers that he has seen can hold in excess of 500 pounds.
One of the things that he sees for this particular property is that it is secluded in nature. He wondered if
there wasn't an opportunity to create some sort of mechanism to the ordinance that would allow the
Council to permit a pool cover as opposed to a fence because they meet a set of requirements — the lot is
large enough, there is not another home within X distance, etc. Planner Wall noted that, as proposed,
this ordinance amendment would apply a broad brush for every property within the City.

E) PLANNING CASE 2014-29, ELECTRONIC SIGNAGE CONDITIONAL USE PERMIT,
2544 VISITATION DRIVE, RESOLUTION 2014-62
Planner Nolan Wall explained that the applicant was seeking a Conditional Use Permit to erect an
electronic display sign on the Visitation Campus, near the school's front entrance. There is an existing
monument on the site currently.
Recently, the City did amend the code to allow for this type of signage for qualifying uses in the
residential district, subject to numerous conditions. The applicant's letter of intent included a detailed
analysis in response to each of those fifteen conditions. Staff has reviewed the application materials and
determined that the proposed sign would be in compliance and recommended approval.
Councilmember Petschel clarified that the sign would not be located at the front entrance to the campus
near the round -about, but located in the interior of the campus at the front entrance to the building.

Planner Wall noted that there was one public comment during the Planning Commission hearing that
was more of a curiosity of just what was being proposed and trying to ensure that it would not increase
brightness or be burdensome to them.
Councilmember Duggan, in regards to Item 6 on Page 186 [Exhibit B — New Signage] described as
"Digital Welcome Display Sign", asked what the distance from that sign to the first or nearest home on
Lake Drive was. He also asked if this sign was going to be facing towards Mendota Heights Road or
Lake Drive. Planner Wall replied that the distance from the external property boundary line on the
Visitation Campus would be approximately 320 feet and 337 feet from the nearest residential property
line. The code requires a 50 foot setback from surrounding property boundary lines.
Mr. Greg Engels, Director of Operations at Visitation School, addressed the question regarding the light
by saying that the brightness level would be well below the brightness allowed in the ordinance. The
amount of light coming from the proposed sign would be less than the existing parking lot lights, school
lights, etc. The sign would be pointing right towards the corner of the parking lot and not towards any
of the residential neighbors.
Councilmember Petschel moved to adopt RESOLUTION 2014-62 APPROVING A CONDITIONAL
PERMIT AT 2455 VISITATION DRIVE.

For point of discussion and so all residents are aware, Mayor Krebsbach stated that this was the code
change that was discussed and applies to all institutional uses. This is the first such application since this
new code implementation.

F) ACCEPT FEASIBILITY REPORT FOR KENSINGTON NEIGHBORHOOD STREET
IMPROVEMENTS AND CONSIDER SETTING DATE OF PUBLIC HEARING,
RESOLUTIONS 2014-50 AND 2014-64
Assistant City Engineer Ryan Ruzek explained that staff has put together a feasibility report for the
Kensington Neighborhood Street Improvements. This would include rehabilitation to Bedford Court,
Claremont Drive, Concord Way, Lockwood Drive, and a portion of Stockbridge Road (from Concord
Way to the point of intersection with the pedestrian trail). The total estimated project cost would be
$740,320, with an assessable cost of $337,393, and a bond amount of $402,927 in 2015 costs.
The Kensington Neighborhood Street Improvements currently is not shown in the 5 -year Capital
Improvement Plan, however, staff has received a number of inquiries as to when the streets would be
rehabilitated. Staff also has two letters from the association boards asking for their streets to be included
in the Capital Improvement Plan at the earliest possible time.
Mayor Krebsbach noted that if Council were to go ahead with the feasibility report, that would not mean
that they would order the project for 2015. Engineer Ruzek confirmed and stated there are two

resolutions before the Council; one is accepting the feasibility report and the other is calling for a public
hearing.
City Administrator Justin Miller interjected that he and City Engineer John Mazzitello have been
working on a revised street improvement plan that they would present to the Council before the end of
the year as part of the larger budget discussion. The revised plan does put this project into 2019.
Councilmembers asked questions regarding the condition of the roads and expressed their desire to see
the proposed revised plan before making a decision on calling for the project.

• The first annual Bike Ride for Breast Cancer Awareness is October 11, starting at 8:30 a.m.
• The Halloween bonfire is scheduled for October 31 from 7:00 — 9:00 p.m. at Mendota Plaza
COUNCIL COMMENTS
Councilmember Norton acknowledged the students from St. Thomas Academy for raising money for
Officer Patrick's family.
He also attended, as many others did, the Officer Patrick Memorial Fund Raiser/Party at Moose Country
in Lilydale and he suspects they raised a good amount of money for the appropriate organizations.
Councilmember Petschel made the observation that she has seen a lot of work being done on roofs,
siding, gutters, windows, kitchens, and bathrooms in our community. It is delightful to see.

She also noted that the sign saying "The State of Minnesota Property — Keep Off' with an upside down
95 has been taken down during the recent fiber optic project. She is hopeful that when the sign is put
back up, the 95 will get put right side up.
She asked Administrator Miller to explain this fiber optic cable installation. Administrator Miller replied
that the school district, in combination with Dakota County, has been installing fiber optic throughout
the community connecting all of the schools. For the most part they are doing directional boring so they
do not have to dig up too much of the roadways. Eventually those lines would go right by the Fire
Station along Dodd Road and then very close to the public works garage; leaving City Hall to be
needing to be connected.
Councilmember Duggan stated that he also saw all of the signs of home improvements going on in our
community.
He also reminded everyone of the decision made recently to spend $555,000 for the West St. Paul
Hockey Arena renovations. He thought about the off -leash dog park and believes this should be
reconsidered.
Mayor Krebsbach noted the passing of two residents of Mendota Heights, giving their names and a brief
background of each:
• Mr. Elliott Karasov Sr. passed away in April. He was a veteran and one of the members who
helped found Beth Jacob Congregation
• Ms. Susan Bozivich was 62 years old, died of breast cancer, and was a Mendota Heights mom
Mayor Krebsbach stated she will be at the Fire Department Open House in the afternoon.

8, 2014 at 7:00 p.m. at Mendota Heights City Hall.

Vice -Chair Lorberbaum called the meeting to order at 7:00 pm.
Approval of Minutes
Neuharth moved, and Dunn seconded that the minutes of the September 10, 2014 Airport Relations
Commission meetings be approved as submitted. All voted in favor.
Unfinished and New Business
There was no new or unfinished business to report.
Reports on Areas of Focus
Neuharth noted that all measurements were within the normal range and below the upper control limits. Portz
updated the commission on the MAC's art initiatives and his visit to the San Francisco airport and their art
displays. Norling noted that the 80dB events at sensors 13 and 23 were above average. Lorberbaum distributed
charts tracking complaints and complainants and noted the increase from the City of Minneapolis.
The commission agreed to invite a representative from Delta to attend the next meeting. Rose Agnew suggested
that the MAC's new sustainability manager be asked to attend a future meeting as well. The commission also
agreed to cancel the December meeting, as has been the historical practice.

Fire Calls
The department responded to 29 calls for the month. The majority of calls were classified as
false alarms or as good intent calls. Seven of the calls were residential in nature, of the other
calls, three were commercial, nine were EMS calls, four calls were utility checks, and one call
was mutual aid to the Inver Grove Heights Fire Department. There were also two car fires, one
call to assist the police, one grass fire and one vehicle accident with injuries.
Monthly Department Training
The monthly department training required each of our firefighters to drive several of our trucks
through a DOT driving course. The training division sets up a cone course in a local parking lot
which has five different DOT skill stations that firefighters must maneuver the apparatus
through.
Monthly Squad Training
The squad training for the month was boat operations. In the eyes of the NFPA the operation of
our boat is considered a technical skill that requires annual training Crews launched the boat on
Rogers Lake where they were trained on boat operations and performing water rescues.

I. INTRODUCTION AND BACKGROUND
A. General Information and Scope of Work
The City of Mendota Heights invites written proposals from qualified law firms interested in
providing labor relations legal services to the City of Mendota Heights. The Labor Attorney is
expected to provide labor related legal services for the City and act in an advisory capacity to the
City Council, City Administrator, staff and appointed committees, as directed. Specifically, the
Labor Attorney can expect to provide the following services:
■ Assist in contract negotiations with city's three bargaining units (LELS for patrol police
officers, MnPEA for police sergeants, and Teamsters for Public Works)
■ Provide assistance in policy formulation relating to personnel matters
■ Review and advise on disciplinary matters, including defense of city during grievance
proceedings
■ Advise city on employer-provided benefits, including legal issues surrounding health care
reform
■ Attend City Council meetings as required
■ Defend the City in litigation as required
As a minimum, the proposal shall include:
■ Provide resumes for your firm and for each attorney who may provide services to the City.
■ Describe special areas of expertise held by members of the applicant firm and describe how
they may be utilized/applied within Mendota Heights.
■ Describe your research capabilities and the references that you utilize. Detail your
capabilities to maintain a proper response time for legal reports and memos.
■ Describe your support staff (knowledge, skills, abilities, expertise).
■ List and describe any previous or current experience in labor related legal services, specify
activities performed and the name of a person who may be contacted at the municipality.
■ List previous or current activities performed for the City of Mendota Heights.
■ Define any potential conflicts of interest the firm may have providing services to the City.
■ Provide a detailed description and explanation of all fees and/or charges that may arise for
provided prosecution and related legal services.
B. Qualifications and Selection Criteria
The City of Mendota Heights intends to select and award a contract to the firm best qualified to
perform the work described in Section A based on cost, extent and quality of firm's resources,
communication and presentation skills, and quality and extent of municipal representation
experience.
C. Review and Recommendation Process
Based upon review of the submitted proposals and potential interview of qualified candidates,
one firm will be recommended for City Council approval. Interviewing, if needed, is preliminarily
scheduled for the week of December 1st at Mendota Heights City Hall.
D. Financial Liability Limitations
The City of Mendota Heights shall not be liable for any expenses incurred by the applicant
associated with the preparation of the proposal, attendance at the interviews, preparation of a
compensation (fees) schedule or final contract negotiations.

E. Rights of Review
The City of Mendota Heights reserves the right to reject any proposal or to request additional
information from any or all applicants.
F. Proposals Considered Public Data
Consistent with Minnesota Statues Chapter 13, proposals submitted may be considered public
data and may be released to those who request copies.

The following material is required to be received by November 14, 2014, for a proposing firm to be
considered:
A. Cover Letter/Title Page
Title page showing the following: The firm's name, address, telephone, and email address of the
contact person; and the date of the proposal.
B. Transmittal Letter
A signed letter of transmittal briefly stating the firm's understanding of the work to be done, the
commitment to perform the work within requested time periods, a statement why the firm
believes that it is best qualified to perform the engagement and a statement that the proposal is
a firm and irrevocable offer.
C. Technical Proposal
The proposal for technical qualifications shall be limited to eight -pages excluding resumes and
references.
The purpose of the technical proposal is to demonstrate the qualifications, competence, and
capacity of the firm seeking to undertake the City Attorney role for the City of Mendota Heights
in conformity with the requirements of this request. As such, the substance of the proposals will
carry more weight than form or manner of presentation. The technical proposal should
demonstrate the qualifications of the firm and of the particular staff to be assigned to this
engagement. Please identify the primary attorney who would be assigned responsibility for
Mendota Heights and his/her primary backups.
1. Firm's Profile
a. A description of the legal services, specifically relating to City government, which the
firm is capable of providing, together with an explanation of how these services might
best assist the City of Mendota Heights.
b. A brief description of the experience of the firm in representing municipalities.
c. Any additional information which might be beneficial to the City of Mendota Heights in
evaluating the firm's qualifications to serve as City Attorney.
2. Personnel Qualifications - Resumes
For each member of the professional staff proposed to be assigned to this engagement,
please provide the following information:
a. A brief resume of the professional experience and qualifications of the individual.
b. An outline of the proposed function of the individual in the proposed engagement.
c. A description of the accessibility and availability of the individual during the course of
the engagement.
d. The office location to which the individual is assigned.
3. References
a. Please include a list of municipal clients where related services were provided by the
professional staff proposed along with the name and telephone number of a person
who may be contacted at the municipality.
b. Include a list of previous or current services provided to the City of Mendota Heights.

4. Compensation Schedule
a. The proposal should clearly set forth the basis for fees to be charged for the work
proposed. Rates should be clearly stated for varying levels of staff expected to perform
support services.
b. Identify any other costs the city will be charged in addition to those noted in 4a.
IV. CONTRACT EXECUTION
The information below is being provided as part of this Request for Proposal to give proposers an
understanding of the City's expectations with respect to contract execution.
A. Negotiations and Contract Execution
The City reserves the right to negotiate the final terms and conditions of the contract to be
executed. Should the City and a firm be unable to agree upon the entire contract, the City
reserves the right to discontinue negotiations, select another firm, or reject all of the statements
of proposal. Upon completion of negotiations agreeable to the City and firm, a contract shall be
executed.
It is anticipated that the City will establish a relationship with a selected firm for a minimum of
three (3) years. A contract for one year with annual renewals is expected. Each party may
terminate the contract with 90 -day notice.
Contracting Ethics
1. No elected official or employee of the City of Mendota Heights who exercises any
responsibilities in the review, approval, or implementation of the proposal shall
participate in any decision which affects his or her direct or indirect financial interests.
2. It is a breach of ethical standards for any person to offer, give, or agree to give any City of
Mendota Heights employee or Council person, or for any City of Mendota Heights
employee or Council person to solicit, demand, accept, or agree to accept from another
person or firm, a gratuity or an offer of employment whenever a reasonable prudent
person would conclude that such consideration was motivated by an individual, group or
corporate desire to obtain special, preferential, or more favorable treatment than is
normally accorded the general public.
3. The firm shall not assign any interest in this contract and shall not transfer any interest in
the same without the prior written consent of the City.
4. The firm shall not accept any private client or project which, by nature, places it in ethical
conflict during its representation of the City of Mendota Heights.

Update
The cities of Mendota Heights and West St. Paul partnered to offer the Thompson Oaks/Mendota
Heights Par 3 event on September 27, 2014. The event was filled with 40 golfers, and everyone
had a great time.
Footgolf has continued to grow in popularity. We have received many phone calls and emails
inquiring about the new sport. We collected $310 in revenue from Footgolf in the month of
September. The Pioneer Press published an article about Footgolf at the Mendota Heights Par on
Saturday October 11, 2014, and we have seen a great response to the new activity. We will also
be promoting the golf course in the next episode of Community Parks Connection on local cable.

The fall maintenance was done to the putting greens on September 30, 2014. Our maintenance
staff will wrap up the end of season activities on or around October 17, 2014. Our irrigation lines
will be blown out for the season at the end of October. Finally, our golf course consultant will
spray for snow mold at the very end of the season.
Budget
Total sales for the month of September were $15,450 are expenses were $14,380. Total sales for
the year through September are $130,834 and expenses are $107,817 resulting in a net revenue of
$23,017. The golf course in on track to have a yearend net revenue of around $5,000 to $8,000.

SUBJECT: Resolution Supporting the Dakota County 2015-2019 Capital Improvement Plan
BACKGROUND
Every year Dakota County updates their five-year Capital Improvement Plan (CIP). In
conjunction with these updates, the County asks for resolutions of support from County cities
and townships to present to the County Board at the public hearing where the CIP is formally
adopted. This year's public hearing before the County Board is scheduled for November, 2014
at the County Administrative Center in Hastings. A copy of the Draft 2015-2019 CIP is attached
for your review.
Mendota Heights has no substantial street projects listed in the Draft 2015-2019 CIP beyond the
recurring markings and signage maintenance items; however, Mendota Heights does have the
following item included in the CIP:
1. The County share of storm water funding contributions to the Highway 13 reconstruction
(requested by the City of Mendota Heights) is included in 2015. The State Department of
Transportation is leading this project with cooperation from the cities of Lilydale and
Mendota Heights.
BUDGET IMPACT
None.
RECOMMENDATION
Staff recommends Council adopt a Resolution in support of the 2015-2019 Dakota County CIP.
If Council wishes to implement the Staff recommended action, pass the attached
RESOLUTION 2014-71, A RESOLUTION SUPPORTING PROJECTS LISTED IN THE
DRAFT 2015-2019 DAKOTA COUNTY CAPITAL IMPROVEMENT PLAN by a simple
majority vote.

RESOLUTION SUPPORTING PROJECTS LISTED IN THE DRAFT
2015-2019 DAKOTA COUNTY CAPITAL IMPROVEMENT PLAN
WHEREAS, the City of Mendota Heights values the cooperative working relationship it
has with Dakota County; and
WHEREAS, the City of Mendota Heights supports the continued improvement of our
regional road network, trails and park system; and is further supportive of the proposed work on
the regional trail network; and
WHEREAS, the City of Mendota Heights is also supportive of vehicular and pedestrian
public safety as well as storm water drainage improvements throughout the public right-of-way
in the city.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Mendota
Heights, Minnesota supports the efforts of Dakota County to improve public safety,
transportation, storm water drainage, parks, trails, and recreational facilities through the Draft
2015-2019 Capital Improvement Plan.

Each year LMCIT requires the city to decide if we wish to purchase additional liability coverage
and a waiver of monetary limits on the claims. The base coverage is $1,500,000 which is the
basic statutory limit. In the past, we have not purchased additional coverage and elected not to
waive the statutory tort limits Our insurance coverage period runs November 1, 2014 to
November 1, 2015.

Way
BACKGROUND
A Mendota Heights resident that lives on Spring Street has requested the vacation of a
portion of Partition Road, an undeveloped City right-of-way, in the Kirchner Addition plat. He
has submitted his petition with the required amount of signatures consisting of a majority of the
abutting property owners. The Kirchner Addition plat was signed and recorded in 1944.
Staff has researched the undeveloped, platted, half -street right-of-way that exists east of
Ivy Hill Drive, southeast of Spring Street and northwest of Dodd Road. This half -street right-of-
way runs between Butler Avenue and Dodd Road. The portion proposed to be vacated is 30 -feet
wide and is currently utilized by two residents as part of their respective yards. The part
proposed for vacation is the northeasterly 30 feet of right-of-way identified as Partition Road,
part of the Kirchner Addition Plat, between Spring Street and Dodd Road. The City has no
utilities located within the right-of-way proposed for vacation.
In order for the City to vacate a right-of-way, a public hearing must be conducted. The
attached Resolution calls for a public hearing to be held on November 18th for the vacation of the
Partition Road half -street right-of-way between Spring Street and Dodd Road. Calling for the
public hearing does not obligate Council to ultimately vacate the right-of-way.
All impacted property owners will be contacted about the public hearing by published
and mailed notice.
BUDGET IMPACT
Other than the staff time to process the vacation, there is no impact to the city budget.
RECOMMENDATION
Staff recommends that the City Council pass a motion adopting Resolution No. 2014-70,
A RESOLUTION CALLING FOR A PUBLIC HEARING ON A RIGHT-OF-WAY

WHEREAS, the City Clerk has reviewed and examined the signatures on said petition

consider the vacation of such street and a public hearing shall be held on such proposed vacation
on the 18th day of November, 2014, before the City Council in the Mendota Heights City Hall
located at 1101 Victoria Curve at 7:00 p.m.
The City Clerk is hereby directed to give published, posted, and mailed notice of such hearing as
required by law.

SUBJECT: Authorize Purchase Order for Storm Sewer Improvements at Dodd Road &
Marie Avenue and 745 Willow Lane
BACKGROUND
In 2014, Minnesota had record rainfall amounts for April and June. These storms have caused
several drainage issues around the city. Staff has been working on repairing and improving areas to
better handle any future storms.
The first project is a culvert under a driveway at 745 Willow Lane. The existing culvert is a 42"
Concrete pipe. The pipe is in good condition but erosion on both ends of the pipe has caused the
aprons to settle and the joints between the pipes to separate. A quote was received to remove and
reinstall the existing pipe, drill holes to "tie" the pipes together and place a grouted rip rap to prevent
further erosion. The driveway and vegetation restoration is also included.
The second project will repair two failed gabion structures in the northeast corner of Dodd Road and
Marie Avenue as well as replacing existing pipes and culverts with properly sized HDPE pipe
running through two back yards. The properties at 1770 &1780 Dodd Road have existing culverts
which are undersized to handle the runoff from the Hidden Creek development. The project will
include removal of the existing pipes, 325 feet of 24" HDPE pipe, rip rap and all restoration.
City staff met with three contractors on-site and has requested quotes from all three. Two contractors
have submitted quotes for this work. Northdale Construction did not bid due to scheduling
constraints.

Staff is recommending that the contract be awarded to Didion Contracting for the bid submitted of
$44,940.00. This is not the low bid for the improvements but Gartzke Construction is not able to
schedule the work in 2014 and staff is worried another Spring similar to 2014 could increase the
scope of the project as well as potential damages to adjacent properties.

Staff recommends the project be awarded to Didion Contracting. The Storm Sewer Utility Fund has
sufficient balance to cover this improvement. It is possible that a portion of this expense will be
reimbursed through an emergency declaration through the State of Minnesota.
RECOMMENDATION
If Council wishes to implement the staff recommendation, pass a motion authorizing staff to issue a
purchase order to Didion Contracting in the amount of $44,940.00. This action requires a simple
majority vote.

BACKGROUND
The largest sanitary sewer lift station in Mendota Heights is located on Mendota Heights Road in the
industrial park. The lift station was constructed in 1969 with a wet well/dry well design. The dry
well was rehabilitated in 2002. The wet well requires periodic maintenance and cleaning but overall
is in good condition. To properly clean and maintain the wet well, sewage flowing into the well
needs to be closed off There is a 20" plug valve on the well to restrict the flow but the valve has
seized and is not operational.
City staff met with three contractors on-site and has requested quotes from all three. Two contractors
have submitted quotes for this work.

Staff is recommending that the contract be awarded to Magney Construction for the bid submitted to
install a new 20" plug valve in the wet well of the lift station.

RECOMMENDATION

Fencing Requirements
BACKGROUND
The applicants are requesting an amendment to Title 9-2-4(C) of the City Code to allow an exception for
swimming pool fencing requirements. The applicants' letter of intent includes the rationale for their request
and proposed language.
The City Council considered a similar amendment in 2005 and ultimately denied the request. Since the
code amendment application in this case was tied to a critical area permit request for the construction of a
private swimming pool and fence, Staff brought both applications before the Planning Commission.
While the Planning Commission recommended denial of the proposed amendment (4-3), there was
consensus to include similar requirements for proof of insurance and annual inspection reports, as were
proposed in the 2005 amendment considered by the Council. In addition, there was discussion that pool
covers in lieu of fencing may work for some properties, but not all. If supported by the Council, Staff can
further research the issue and propose additional code language that may allow an exception to the
swimming pool fencing requirements for properties meeting certain additional conditions. Potential
conditions to consider could include lot size, distance from other residential dwellings, or location in the
critical area and/or wetlands district.
The Planning Commission conducted a public hearing at the September 23 meeting; there were no
comments. The City Council tabled action on the proposed amendment at the October 7 meeting.
BUDGET IMPACT

RECOMMENDATION
The Planning Commission recommended denial of the proposed code amendment, as described in Planning
Case 2014-28. If the City Council desires to implement the recommendation, pass a motion adopting
RESOLUTION 2014-61 DENYING ORDINDANCE NO. 469 TO AMEND THE CITY CODE TO
ALLOW AN EXCEPTION FOR SWIMMING POOL FENCING REQUIREMENTS.
An alternate resolution of approval is also attached for consideration.
This matter requires a simple majority vote.

DESCRIPTION OF THE REQUEST
The applicants are requesting an amendment to Title 9-2-4(C) of the City Code to allow an exception for

BACKGROUND
As part of a separate request, the applicants are seeking a critical area permit to construct a pool and
additional improvements in the rear yard of their property. The applicants' letter of intent includes the
rationale for their request and proposed language.
ANALYSIS
Existing Code Requirements
Title 9, Chapter 2 of the City Code contains swimming pool requirements; the fencing requirements are as
follows:
9-2-4: REQUIREMENTS IN ALL ZONING DISTRICTS:
C. Fences, Gates And Screening:
1. The pool area shall be enclosed with fencing to effectively prevent the entrance of children and be
without handholds or footholds that would enable a child to climb over it or pass through it. The fence
shall be at least five feet (5) in height, but not exceeding six feet (6), to prevent uncontrolled access
from the street or adjacent property. Where horizontal fence members are less than forty five inches
(45') apart, vertical spacing shall not exceed one and three-quarter inches (11/4'). Where horizontal
members are equal to or more than forty five inches (45') apart, vertical spacing shall not exceed four
inches (4'), spaced so that a four inch (4') sphere cannot pass through. The spacing between the bottom
of the fence and grade shall not exceed four inches (4').
2. Fences shall have self-closing and self -latching gates with provisions for locking and shall be
completely installed prior to the filling of the pool. Spacing between the bottom offence gates and grade

shall not exceed four inches (4"). The gate release mechanism shall be placed a minimum of fifty four
inches (54') above the bottom of the gate.
3. Where the fence encloses only the swimming pool area, adequate screening, including, but not limited
to, landscaping, shall be placed between the pool area and adjacent single-family district lot lines.
These requirements are reviewed and approved as part of the building permit application.
Proposed Amendment
The applicants are proposing to amend the City Code to read as follows:
"Exception to the fence requirement for pool covers conforming to ASTM F 1346-91, Standard
Performance Specifications for Safety Covers and Labeling Requirements."
ASTM International develops and delivers voluntary consensus standards for a variety of products. Some
of the conditions for ASTM specification F 1346-91 include:
• Provisions such as keys, combination locks, special tools, devices or inaccessible locations to
inhibit children under 5 years of age from the removing or operating the cover
• Switching devices that are key -operated must be locked away or able to be de -activated or located
in an inaccessible location, at least 5 feet above the pool deck
• Cover should be able to hold a weight of 485 pounds (2 adults and 1 child) to permit rescue
operation
• Demonstration that any opening in the cover is sufficiently small and strong enough to prevent the
test object being passed through
• Standing water must be substantially drained from the cover within a period of 30 minutes after a
normal rainfall
• Meet labeling requirements for all covers for swimming pools, spas and hot tubs
• Cover must be reversible in direction from a full stop at any point in its travel without having to
complete the full open or closed cycle
The proposed Code language would be the same as contained in the Inver Grove Heights City Code. Other
jurisdictions, including the cities of Sunfish Lake, Maplewood and Rochester, and Scott County allow
exceptions to the fence requirements for automatic or manually -controlled pool covers.
STAFF RECOMMENDATION
Safety barrier design requirements for private outdoor swimming pools are intended to provide protection
against potential drownings and near -drownings by restricting access. The City's existing swimming pool
fencing requirements are consistent with safety barrier guidelines from the U.S. Consumer Product Safety
Commission, as well as numerous surrounding communities. The City has discretion to amend the Code if
it determines that an automatic pool cover, when used properly, provides the same protection as the existing
fencing requirements.
Staff recommends denial of the proposed amendment to the City Code to allow an exception for swimming
pool fence requirements. While some residential properties with an automatic pool cover are secluded and
may not need a fence to prevent an unattended child from wandering into the pool area, there are numerous
properties where the current fencing regulations are the best way to ensure the appropriate safety barrier
requirements exist. While a gate can be left unlocked or fencing not properly maintained, it is Staffs
opinion that automatic pool covers do not alone provide adequate safety measures because they can be left
open or unattended without any additional safety barriers in place.
Staff further recommends the Planning Commission discuss the proposed amendment, as in DRAFT
Ordinance 469, and make a recommendation to the City Council.

FOR SWIMMING POOL FENCE REQUIREMENTS
The City Council of the City of Mendota Heights, Minnesota, does hereby ordain:
Section 1.
Section 9-2-4(C) is hereby amended to read as follows:
4. In -ground, private swimming pools may install a pool cover conforming to ASTM F 1346-91,
"Standard Performance Specifications For Safety Covers and Labeling Requirements For All Covers For
Swimming Pools, Spas, And Hot Tubs" in lieu of the required fencing, subject to the following
requirements:
a. The property owner shall provide proof of liability insurance coverage.
b. The property owner shall provide proof of inspection of the pool cover by an experienced
installer to the City on an annual basis.
Section 2.
This Ordinance shall be in effect from and after the date of its passage and publication.

SUBJECT: Resolution Approving a Conditional Use Permit at 645 Sibley Memorial Highway
BACKGROUND
The applicants are seeking approval for an after -the -fact conditional use permit to clear cut vegetation on
their property and within the Mississippi River Corridor Critical Area. Title 12-3-9(F) of the City Code
allows vegetation removal in the Critical Area Overlay District, in compliance with a number of conditions.
The applicants received a critical area permit in October 2013 to demolish the existing structures and
construct a new single-family dwelling on the subject parcel. On July 1, 2014, Staff was made aware of
significant clearcutting activity within the bluff area, which was not included in the landscape plan as part
of the previously -approved application, and investigated the complaint.
The Planning Commission conducted a public hearing at the August 26 meeting; a copy of the minutes are
attached for your review. Staff has the following responses to the Planning Commission and public
comments from the public hearing:
Minnesota Department of Natural Resources
After an initial review of the situation, the DNR's Area Hydrologist recommended that erosion control
measures be put in place, if necessary, to stabilize the slope to prevent destabilization as the vegetation re-
grows. Staff inspected the property shortly after receiving the complaint, and no erosion of the bluff was
observed at that time or during subsequent site visits. It was determined that any additional disturbance to
the slope or impacted area should be avoided.
Additional site visits from the applicants' contracted landscape architect and geotechnical engineer
determined that re -growth was occurring and that no erosion of the slope was visible as a result of the
clearcutting activity (see attached reports dated 9/12/14). The DNR was provided the most recent
information included in the Council packet for review. They indicated they have no further comments and
felt that the City is handling the situation appropriately.
Security Insurance
An adjacent property owner has requested the City issue a bond to protect their property until the potential
for erosion has been taken care of. According to the City Attorney, the City does not have the authority to
require a bond specific to protection from erosion for surrounding properties. The bluff has been gradually
eroding over time and it would be difficult to obtain evidence that would prove any additional erosion was
caused by this specific clearcutting activity on the subject parcel. In addition, it would also be difficult to
determine a bond amount and term.

The Planning Commission did recommend, if the Hillside Vegetation Restoration Plan is implemented, that
a bond is posted guaranteeing the value of the work for a 24 -month period. According to the City Attorney,
this is within the City's authority to require as a condition for approval of the after -the -fact permit. If
Council would like to require this type of performance security of the applicant, staff recommends making
this an additional condition of approval and that the security would cover a period of 24 months from the
date of permit approval. This security could be implemented in the form of a letter of credit from a financial
institution, a cash escrow held by the City, or a formal performance bond. This security insurance would
be for the restoration of vegetation only, and would not cover the cost of any claims from the applicant or
other property owners due to future issues in the disturbed area.
Hillside Vegetation Restoration Plan
As part of the application, the City requested the applicants submit an inventory of the vegetation that was
removed and a restoration plan (see attached plans). A licensed landscape architect completed the plans
and proposed to re-evaluate the vegetation re -growth in the impacted area after September 1. If determined
to be inadequate, the Hillside Vegetation Restoration Plan was to be implemented as soon as possible.
According to the landscape architect, the proposed plantings included in the plan are not meant to replace
the mature trees that were removed by a previous property owner, but are intended to supplement and
support the natural vegetation re -growth within the impacted area if necessary. According to the report,
adequate re -growth is occurring and introducing new plantings within the impacted area that may cause
additional soil disturbance or damage to existing root systems is not recommended. Staff and the DNR
have reviewed the report and are not recommending any further action.
Geotechnical Report
Based on the public comments and Planning Commission discussion, it was recommended that the
applicants hire a licensed geotechnical engineer to analyze the effect of the clearcutting activity on the
stability of the slope. According to the report, no evidence of erosion was observed within the impacted
area and the clearcutting activity did not appear to a have negative impact on the stability of the slope. The
observations were made from the top of the bluff and soil samples were not taken due to unsafe conditions
and to limit any additional disturbance to the soil surface or slope. Staff and the DNR have reviewed the
report and are not recommending any further action.
Citation
As noted in the Staff report, Title 12-1L-11 of the City Code authorizes the City to issue citations for
violations of or refusal to comply with the provisions of the Code. According to Title 1-4-1(A): "Violation
of a provision of this code is a misdemeanor and, upon conviction thereof a person may be punished by a
fine of not more than seven hundred dollars ($700.00), or such other amount set by law, or imprisonment
for a term not to exceed ninety (90) days, or such other term set by law, or both." It is our understanding
that the maximum allowable fine has now been increased to one thousand dollars ($1,000.00).
If the City Council desires to pursue a penalty in this case, a motion authorizing staff to direct the City
Prosecuting Attorney to file a formal criminal complaint can be passed. Criminal fines imposed are either
by plea agreement or set by the court, not to exceed the maximum allowable amount. The direction to issue
a citation does not need to be included as a condition in the Resolution.
Conditional Use Permit
Conditional use permits are land use permits that run with the land, not the land owner or applicant and as
long as the conditions are being met, the permit remains valid. The issue of whether the potential approval
of an after -the -fact conditional use permit would allow future clearcutting on the subject parcel was raised
by the Planning Commission. Resolution 2014-69, as proposed in condition #2, does not allow any
additional trimming, cutting, or alteration of the slope under the after -the -fact conditional use permit.

Should any additional removal activity occur on the subject parcel, regardless of the property owner, a new
conditional use or critical area permit would be required.
According to the City Attorney, the City would not be liable, based upon the circumstances of this case, for
any future slope degradation/erosion issues on the applicants' property or surrounding properties by
approving the proposed after -the -fact conditional use permit. Private property owners are ultimately
responsible for filing or defending claims alleging damage to property as a result of any negative impacts
caused by the clearcutting activity.
BUDGET IMPACT
N/A
RECOMMENDATION
The Planning Commission recommended approval of the after -the -fact conditional use permit, with
conditions, as described in Planning Case 2014-20. In addition to the four conditions recommended by the
Planning Commission, staff is recommending an additional condition be considered regarding future
inspections (see #5). If the City Council desires to implement the recommendation, pass a motion adopting
RESOLUTION 2014-69 APPROVING A CONDITIONAL USE PERMIT AT 645 SIBLEY MEMORIAL
HIGHWAY.
This matter requires a simple majority vote.
In addition, a separate motion could be considered if the City Council desires to pursue penalties against
the property owner.

RESOLUTION APPROVING A CONDITIONAL USE PERMIT AT
645 SIBLEY MEMORIAL HIGHWAY
WHEREAS, Paul and Shannon Burke have applied for an after -the -fact conditional use
permit to clear cut vegetation at 645 Sibley Memorial Highway within the Mississippi River
Corridor Critical Area (PEN 27-03900-15-030) as proposed in Planning Case 2014-20; and
WHEREAS, the Mendota Heights Planning Commission held a public hearing on this
matter at their regular meeting on August 26, 2014.
NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the
after -the -fact conditional use permit request as proposed in Planning Case 2014-20 is hereby
approved with the following conditions:
1. The applicant supplies a report from a licensed landscape architect on the status of the
vegetation re -growth in the impacted area as soon as possible after September 1,
2014. If determined to be inadequate, the Hillside Vegetation Restoration Plan will
be implemented immediately.
2. No trimming, cutting, or any alteration of the slope may occur except in complete
conformity with the provisions of the City Code relating to the Mississippi River
Corridor Critical Area, and all other City Codes.
3. At the expense of the applicant, a geotechnical engineer be retained to conduct a sight
investigation to assess whether clearcutting activity has undermined or impacted the
slope and, if so, to advance corrective and mitigation measures to be implemented
immediately.
4. A performance security in compliance with City Code requirements is posted
guaranteeing the value of the potential landscaping work for a 24 -month period
following approval of the permit.
5. The City can inspect the property to monitor the vegetation re -growth and reserves
the right to require the implementation of the Hillside Vegetation Restoration Plan, or
any other approved vegetation plan, and erosion control measures, as necessary to
protect the bluff.

After -the -Fact Conditional Use Permit for Clearcutting within the Mississippi River Corridor
Critical Area.
Planner Nolan Wall explained that the applicant was requesting an after -the -fact approval of a
Conditional Use Permit to clear cut vegetation in the Mississippi Corridor Critical Area.
The applicant did receive a Critical Area Permit in October 2013 to construct a new single family
dwelling on the subject parcel. On July 1, 2014 staff was made aware of the clearcutting activity
within that impacted area and it was determined that action was not included as part of the
landscape plan of the approved Critical Area Permit. Staff investigated the issue and notified the
property owners of the appropriate course of action.
Planner Wall shared an image of the property with the dwellings and improvements that were on
the property as part of the Critical Area Permit, as well as the impacted area. This After -the -Fact
Conditional Use Permit only addresses the clearcutting activity that took place within the impacted
area this summer; any additional cutting or trimming may need to be considered in an additional
request in the future.
The applicant was required to provide a Hillside Vegetation Restoration Plan and noted that the
impacted area would be re-evaluated in September in order to insure that appropriate regrowth has
occurred. If at that time it is determined by staff or by the landscape architect working with the
property owner that additional plantings are needed, this planting schedule would be implemented
immediately.
Clearcutting is allowed in the critical area by Conditional Use Permit but is subject to compliance
with a number of different conditions. Planner Wall reviewed each of those conditions and related
how the application applies.
Planner Wall further explained that the City is authorized to issue a citation for violations of the
code provisions, which would be a maximum of up to a $1,000 fine in this case. No citation has
been issued at this time. The Planning Commission could consider that as a condition of approval
and forward on to the City Council.
Staff recommended approval of the After -the -Fact Conditional Use Permit with conditions.

Commissioners asked questions regarding the deepness of the area of clearcutting, what would
happen if this application was not approved, the proposed conditions, the Hillside Vegetation
Restoration Plan, and what would be `inadequate' regrowth.
Mr. Paul Burke, 645 Sibley Memorial Highway; and Mr. Jeff Feulner with Keenan & Sveiven,
15119 Minnetonka Boulevard, Minnetonka, were on hand to answer questions from the
Commission. Mr. Burke stated that he hired St. Croix Tree Service, who espoused knowledge of
the regulations for trimming within the bluff zone and they provided a letter in which they claimed
to have contacted the City last fall in anticipation of doing this trimming, and he turned the tree
trimming activities over to them to provide some improvement in the views. However, he certainly
would not characterize their work project as clearcutting.
Commissioners asked the applicant questions regarding the sharing of the current situation with
St. Croix Tree Service and what their reaction was, the purpose of the removal, if St. Croix Tree
Service was involved in the previous cutting, how recent was the previous cutting, and if a permit
had been issued for the previous cutting.
Chair Field opened the public hearing.
Planner Wall read a comment from the Minnesota Department of Natural Resources, which was
received the afternoon of this Planning Commission meeting. Their recommendation is to get
erosion control measures in place, as needed, to stabilize the slope before vegetation takes root to
prevent any destabilization of the slope.
Mr. Marco Scibora, 647 and 649 Sibley Memorial Highway, expressed his opposition to the
granting of this Conditional Use Permit. He stated that the previous clearing had been done by the
previous owner in 2003 and at that time, the mature trees were cut down to four feet from the
ground to allow for growth.
As a next door neighbor, he was very concerned about liability to his property. He has lost
approximately one foot of his property since 1998 to erosion and severely questioned the
consequences of this clearcutting event on his and his neighbors' properties.
Mr. Scibora also questioned the hiring of the landscape architect to evaluate the regrowth. After
speaking with the Department of Natural Resources, he believed that a geotechnical engineer
would be better qualified to evaluate the site.
He wished that he had been given the opportunity to express his opposition before the event took
place. He believed that allowing this violation of the code to pass by without consequences would
be wrong. He also wanted it put on the record that he requested the City issue a bond insurance to
protect his property until this potential for erosion has been taken care of.
Commissioners asked Mr. Scibora to confirm that, according to his experience; the previous
cutting was not as extensive as this one and asked questions regarding his request for denial of the
application.

Mr. Tom Diamond, 2119 Savage Drive, St. Paul addressed the specific regulations in place that
have been established by the state to protect the slope, wildlife habitat, and views along the river.
He stated that clearcutting of the bluff is flat out prohibited in the critical area. He continued by
describing the area in this application as being approximately 80 feet by 80 feet with the grade
being roughly 66% slope. Now that the clearcutting has been done, it is very important that the
natural habitat be restored. The vegetation restoration plan is a landscaping plan — not a bluff
restoration plan and it will not have the root structure necessary to protect the bluff.
Also, the applicant keeps referring to `trimming' when what occurred was `clearcutting'. The
record indicates that this was done without a required permit and that the City is considering using
a Conditional Use Permit to authorize the clearcutting after the fact. He suggested that the permit
specify that the vegetation, including trees, must be allowed to regenerate; and that if the
regeneration of the vegetation does not happen then they must be re-established and restored,
including trees; and the replacement vegetation must be a mix of the species which are native to
that bluff area.
Mr. Burke returned to address concerns and opinions expressed in the public hearing. He stated
that the area that was cut was no different in size than what was cut in the past and, as in the past,
regrowth will occur.
Mr. Fuelner return to address the comments about the Hillside Vegetation Restoration Plan and
the reasons for using the plantings as proposed should the review require that the plan be
implemented.
Commissioners asked questions regarding if and when a geotechnical engineer would be
consulted; the training, background, and experience of the landscape architect that would give
them the ability to make a determination as to whether or not there has been any slope failure.
Ms. Phyllis Dosch, 1028 Brompton Place, expressed her concerns about the bluff. She also
indicated that the cutting done in 2003 was illegal and that the property owner at the time was
either penalized or threatened with penalty. She wondered why this is even being discussed as it
should never had been done in the first place; and what is to prevent someone else from doing it
as well.
Chair Field asked for a motion to close the public hearing.

determined to be inadequate, the Hillside Vegetation Restoration Plan will be implemented
immediately.
2. Any additional trimming or cutting, which is determined to require additional permitting,
will be included in a separate Critical Area Permit application for consideration.
AND WITH THE ADDITION OF THE FOLLOWING CONDITIONS:
3. At the expense of the applicant, a geotechnical engineer be retained to conduct a sight
investigation to assess whether clearcutting activity has undermined or impacted the slope
and if so to advance corrective and mitigation measures to be implemented immediately.
As a discussion item, Commissioner Noonan suggested the immediate implementation of a
restoration plan, approved by the City of Mendota Heights and the DNR. It was determined that
this is covered sufficiently under condition three.
Commissioners discussed the possibility of adding a fine.
Chair Field suggested Condition number two be amended to read:
2. No trimming, cutting, or any alteration of the slope may occur except in complete
conformity with the provisions of the City Code relating to the Mississippi River Corridor
Critical Area, and all other City Codes.

After the question was raised about what would happen if the conditions were not met, the addition

Dear Mr & Mrs. Burke:
In accordance with the Bluff Tree Preservation Plan done by Keenan & Sveiven, Inc., I am submitting
this report of vegetation evaluation regarding the bluff area at 645 Sibley Memorial Highway.
This letter summarizes the observations conducted on September 2, 2014 of the clear cut area of the bluff.
Our goal is to provide an accurate assessment of the state of vegetation growth and re -generation in this
area, and determine if vegetation restoration and replanting must immediately take place within the area.
Background
In conjunction with the construction of their new home at 645 Sibley Memorial Highway, Paul and
Shannon Burke contracted with St. Croix Tree Service to trim trees on the bluff, to enhance their views to
Pickerel Lake. Unbeknownst to the Burkes, the cutting had violated city code for vegetation removal
within a Critical Area Overlay District. This violation triggered the need for an after -the -fact conditional
use permit. Keenan & Sveiven, Inc. was hired as landscape architects to evaluate the impacted area and
establish a plan for preservation and restoration to maintain the integrity of the bluff and protect against
potential erosion activity. As part of this plan, the remaining vegetation was to be re-evaluated
approximately two months after the cutting by the landscape architect to ensure that the existing
vegetation was healthy, viable and growing. If adequate vegetation growth is not taking place at that
time, additional plantings would be required to be installed throughout the impacted hillside to ensure
consistent vegetation coverage and soil protection.
Observations
We observed the clear cut area on September 2, primarily from the top of the slope as close to the edge as
possible. Traversing the entire slope was deemed unfeasible for safety reasons on the steep slope, as well
as to protect and limit any potential disturbance to the soil surface of the bluff. We observed the site from
multiple vantage points along the top of the bluff, while remaining on the subject property.

The disturbed area could be classified in two distinct zones. The vegetation within approximately 20'
from the top of the bluff ("Top Edge" zone) is substantially different than the vegetation in the rest of the
clear cut area. Vegetation in this "Top Edge" zone is quite thick and dense, and contains typical
residential landscape plantings which include Viburnum, Honeysuckle, Daylilies, Englemann Ivy,
Boxelders, as well as a number of other "volunteer" perennial varieties that have come up through the
years. The majority of this zone was untouched during the tree cutting activities, and remains thick and
full. There are two areas that were lightly disturbed in this zone, and appear to have been adequately
stabilized by the homeowners landscape contractor with grass seed and mulch.
The second zone ("Natural Bluff' zone) is where the majority of the clear -cutting took place. Current
species observed growing in this area include Elm, Basswood, Maple and Boxelder, as well as,
Englemann Ivy and Grape vine. In our initial site visit after the cutting on July 9, 2014, we observed that
all cut trees were left to a height of 2-4', and all stumps and root systems were left intact to encourage re-
growth. On September 2, substantial re -growth of the cut trees has taken place throughout the hillside — to
estimated heights up to 4-5'at each of the recently cut stumps. The stumps of the cut trees are effectively
hidden by the new shoots, and growth appears to be taking place throughout the hillside beneath the cut
timber originally left on site.
Summary/Recommendations
While we would never recommend clear cutting activities on a steep slope or bluff, the vegetation at this
site has responded well. Consistent, vigorous new growth was observed throughout the hillside. At this
time, we would not recommend any additional planting activities to take place within the clear cut areas
of the bluff at 645 Sibley Memorial highway. This site was also reviewed by Haugo Geotechnical
Services on September 2, 2014 and their report stated no evidence of fresh sediment or signs of erosion.
Introducing planting activities on a hillside could cause unwanted disturbance to the soil surface or
existing root systems, leading to increased erosion potential until new plantings are established.

Dear Mr. & Mrs. Burke:
We understand the natural trees and brush along the bluff was clear-cut during the recent
reconstruction of the single family home at 645 Sibley Memorial Drive in Mendota Heights,
Minnesota. We further understand that Keenan & Sveiven Inc. were hired as landscape architects to
document the clear cut area and plants disturbed as well as monitor the re -growth of the natural
bluff landscape.
This letter summarizes our observations conducted on September 2, 2014 of the bluff side from a
geotechnical engineering perspective. The scope of our services was generally limited to conducting
one site visit for observations (soil borings on the bluff/hillside were not feasible due to the pitch of
the slope) and preparing a brief summary letter describing site soil information, our observations
and providing an opinion as to the clear cutting activities effect on the stability of the bluff.
Project and Site Description
The site consists of a 1.2 acre residential parcel which is located on the northwest side of Sibley
Memorial Highway (State Highway 13), overlooking Pickerel Lake and the Mississippi River. The
property consists of a newly constructed two-story residence, with an attached garage which is
generally centrally located in the buildable portion of the lot. The remaining ground surface is
generally landscaped with moderate tree cover.
We understand the northwestern half acre is classified as a "Critical Area" of the bluff, which has
special regulations regarding landscaping and grading activates.
Available Soil Information
Soil borings or hand auger probes were not conducted on the hillside (bluff) at the time of our site
visit. Based on a review of the Surficial Geology of the Twin Cities Metropolitan Area, Minnesota
map prepared by the Minnesota Geotechnical Survey and dated 2007 the site generally consists of

glacial till identified as the Twin Cities Member's unsorted sediment. These soil types would consist
of silty sand with gravel which correlate to a USCS classification of SM.
Observations
We observed the clear cut area from the top of the slope, from multiple vantage points near the edge
of the bluff, while remain on the Burke residential property. The hillside was deemed unsafe to
walk at the time of our observations due to steep slopes and the sensitive site conditions.
The clear cut area was approximately 80 feet wide and 90 feet deep, based on estimates. At the time
of our site visit, it appeared there was vegetation growth occurring in the clear cut area. We did not
observe fresh sediment or signs of erosion. We understand the stumps and root structure was
undisturbed at the time of the clear -cutting.
Discussion
Based on current engineering practices, the condition of a slope is evaluated in terms of global slope
stability. The global stability analysis consists of plotting a cross-sectional view of the slope and
input the soil parameters of the site, such as unit weight and internal friction angle of the soil. The
results of the analysis would indicate a Factor of Safety (FOS) of the slope which typically range
between 0.9 and 2.0. Values greater than 1 indicate a stable slope, however most designs require a
FOS between 1.3 to 1.5. Current practices do not account for (or factor in) vegetation in the
evaluation of slope stability.
We understand grading activates did not occur on the slope at the time of the clear cutting. We
further understand the recent construction of the home was completed in conjunction with the
required setbacks and zoning requirements for the city of Mendota Heights. In addition, the survey
performed for the property did not include the topography of the buff. For these reasons, a global
stability analysis was not requested or performed.
Summary
Surface vegetation does not factor into the overall global stability analysis of the slope, therefore the
clear cutting activates appear not to have effect the stability of the slope. Based on our observations,
the clear cut area appears to have re -growth of vegetation and we did not observe evidence of
erosion of the slope. In our opinion, vegetation and root structure does help reduce surface erosion.
General

elevations referenced or described above should be considered approximate.

DESCRIPTION OF THE REQUEST
The applicant is seeking approval for an after -the -fact conditional use permit to clear cut vegetation within the
Mississippi River Corridor Critical Area. Title 12-3-9(F) of the City Code allows vegetation removal in the
Critical Area Overlay District, in compliance with a number of conditions.
BACKGROUND
The applicant received a Critical Area Permit on October 1, 2013 to demolish the existing structures and construct
a new single-family dwelling on the subject parcel. On July 1, 2014, Staff was made aware of a significant
clearcutting activity within the bluff area, which was not included in the landscape plan as part of the approved
application, and investigated the complaint. The property owners were notified of the violation by letter the
following day and contacted Staff promptly to determine the appropriate course of action.
ANALYSIS
The purpose and intent of the City's Critical Area Overlay District is to:
"---prevent and mitigate irreversible damage to this unique state, local, regional and national resource to promote
orderly development of the residential, commercial, industrial, recreational and public areas, to preserve and
enhance its values to the public and protect and preserve the system as an essential element in the city's
transportation, sewer and water and recreational systems--- "[Title 12-3-2]
The applicant's letter indicates their intention to trim additional oak trees on the property this fall. The extent of
the proposed trimming is unknown at this time and is not included as part of this after -the -fact permit review
process. Any additional trimming or cutting may require an additional conditional use permit to be approved
through another public planning process.
The Bluff Tree Preservation Plan indicates that all fallen vegetation will remain on-site to provide coverage and
shade, prevent erosion, and retain moisture to encourage new growth. As shown in Exhibit 2, there has been
significant re -growth in the impacted area since the clearcutting activity took place in late June.

According to the Hillside Vegetation Restoration Plan, the impacted area will be re-evaluated on September 1,
2014 to ensure adequate re -growth is progressing. If determined to be inadequate by Staff and/or the licensed
landscape architect, the plan includes a re -vegetation plan to be implemented as soon as possible.
Title 12-3-9(F)(2) of the City Code contains the following conditional use permit provisions for clearcutting within
the Critical Area:
1. The applicant shall demonstrate that there are no feasible or prudent alternatives to cutting trees on the site.

As indicated in the applicant's letter, the reason for the clearcutting activity was to enhance the view of the river
from the house. Due to the after -the -fact nature of the application, and the undocumented height of the vegetation
that was removed, it is unclear if other feasible or prudent alternatives were available to accomplish their intended
action.
2. Clearcutting shall not be used where soil, slope or other watershed conditions are fragile and subject to
injury.
There were several significant landslide events in close proximity to the subject property due to the amount of
rain earlier this summer. While the rainfall amounts may have been abnormal, the bluffline bordering the subject
property is steep and should have been left alone until later this year to ensure appropriate soil stability and comply
with the timeline provision in #5 below. However, Staff has no data to analyze the existing conditions of the soils
and slope on the subject property. According to the Bluff Tree Preservation Plan, all stumps were left intact to
encourage re -growth and no soil or earthwork will take place in the impacted area to prevent erosion or damage
to existing root systems.
3. Clearcutting shall be conducted only where clear cut blocks, patches or strips are, in all cases, shaped and
blended with the natural terrain.
As shown on the Bluff Tree Preservation Plan, and observed by Staff, the impacted area appears to have been
cleared in the past by previous property owners. It has a noticeably different vegetation pattern than surrounding
areas along the bluff, which include mature Oak, Basswood, Maple, Hackberry, and Ash trees.
4. The size of clear cut blocks, patches or strips shall be kept at the minimum necessary.
As noted, it appears the clearcutting activity was conducted within the previously -cut, impacted area. No
additional mature vegetation was removed which would have increased the extent of the impacted area.
5. Where feasible, all clear cuts shall be conducted between September 15 and May 15. If natural regeneration
will not result in adequate vegetable cover, areas in which clearcutting is conducted shall be replanted to
prevent erosion and to maintain the aesthetic quality of the area where feasible; replanting shall be performed
in the same spring or the following spring.
According to the contractor, the clearcutting could not take place before May 15 because the site was under
construction and inaccessible; nor could it be accomplished after September 15 because the new landscaping

would not allow for the necessary safety line tie -offs and access. Due to the after -the -fact nature of the permit,
Staff was not able to appropriately analyze the contractor's justification and therefore has no comments. The re-
growth will be inspected on September 1, 2014. If necessary, replanting will be required in accordance with the
Hillside Vegetation Restoration Plan.
City Code Violation
Once notified of the Code violation for clearcutting without an approved permit, the property owner was
responsive to Staffs direction and apologetic for the situation. However, Title 12-1L-11 of the City Code
authorizes the City to issue citations for violations of or refusal to comply with the provisions of the Code.
Furthermore, violation of the Code is a misdemeanor, and upon conviction thereof, may be punished by a fine of
no more than one thousand dollars ($1,000.00) or imprisonment for a term not to exceed ninety (90) days, or both
[Title 1-4-1(A)]. At this time no citation has been issued. If the Planning Commission feels a fine is necessary
in this case, it can be included as an additional condition for consideration by the City Council.
STAFF RECOMMENDATION
Staff recommends approval of the after -the -fact conditional use permit with the following conditions:
1. The applicant supplies a report from a licensed landscape architect on the status of the vegetation
re -growth in the impacted area as soon as possible after September 1, 2014. If determined to be
inadequate, the Hillside Vegetation Restoration Plan will be implemented immediately.
2. Any additional trimming or cutting, which is determined to require additional permitting, will be included
in a separate Critical Area Permit application for consideration.
ACTION REQUESTED
1. Recommend approval of the after -the -fact conditional permit request, with conditions.

This letter is to provide additional background regarding the Conditional Use Permit
Application attached. We purchased the property at 645 Sibley Memorial Highway in
May of 2013. After obtaining the necessary permit from the City, we commenced
construction in November of 2013.
We have always planned to trim the trees on the bluff to improve the view and we noted
when we purchased the property that a large section in the middle of the bluff had been
cleared by the prior owner of older growth trees. Unfortunately, the extraordinarily wet
weather delayed the trimming until June of this year. [The trimming of any oaks was
delayed until this coming fall to protect the health of those trees.]
To do the trimming we hired St Croix Tree Service, a company we have used periodically
over the last 20 years and a firm we understood has done extensive tree service work in
the area. In early June we met with an estimator from the firm who espoused knowledge
about the rules governing trimming in the bluff zone. We advised him that we only
wanted trimming necessary to enhance the view from the house. The trimming was
delayed until late June due to both weather and crew availability.
Our expectation at every stage of this process was that the bluff would only be trimmed
for view and in compliance with the bluff regulations so that no permit would be
required. We were very surprised that there was any issue with the trimming and are
anxious to address any issues caused by the work that was done by St Croix. The
application includes an action plan that we will diligently follow.
We would like to note that in both the planning and building process, we have been very
sensitive to the bluff zone. For example, we removed and did not attempt to use or
remodel a garage and concrete pad area which were both located inside the protected
bluff zone. Given our new construction and house position, we have an extremely strong
interest in ensuring the integrity of the bluff.

RE: Tree take down performed at 645 Sibley Memorial Hwy
The following is the inventory of trees that were taken down at the customer's direction for view on June 26,
2014:
-two 3" dia hackberry
-one 4" dia green ash
-three 3" dia American elms
-one 4" dia American elm
-one 8" dia basswood stump sprout (off a larger basswood that we left)
-fifteen 3-4" dia boxelders
-app. thirty five clumps of boxelder resprouts (each clump had 6-12 stems)
There were other trees removed on the property at this visit, but not within the area in question.
Guy Carlson contacted the city last fall (Sometime around September) and asked what the rules were for working
along the river. He explained to the woman (regrettably did not record her name) on the phone that we were
primarily looking at re -cutting boxelder regeneration with a few additions, similar to what had been done on this
property in the past for view maintenance. We would leave the stumps as they had been left in the past, to hold
the soil and to allow them to re -sprout. She said there should not be an issue since similar work had been done in
the past, and most of the cutting was of boxelder regeneration.
The work was not completed between September 15th, 2013 and May 15th, 2014 because the site was under
construction and blocked until after May 15. The cutting could not wait until September 15th, 2014 due to the
need to drive a truck to the back yard to allow for safety line tie -offs for the crews working on the hillside, and the
new landscaping would not allow for this.
The tree species that were cut typically resprout aggressively, and the health of the root systems should support
new growth well.
