Res 2014- 19 ROW Lic CUP 2385 Pilot Knob Rd Southview DesignCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2014-19 RESOLUTION APPROVING A RIGHT-OF-WAY LICENSE AGREEMENT AND CONDITIONAL USE PERMIT FOR OUTDOOR STORAGE AND DISPLAY OF MATERIALS AND EQUIPMENT, AN ACCESSORY STRUCTURE, AND FENCE EXCEEDING SIX FEET WHEREAS, Southview Partners I, LLC is requesting to utilize the existing Perron Road right-of-way to construct a private driveway in order to access the proposed development by entering into an approved right-of-way license agreement with the City of Mendota Heights; and WHEREAS, Southview Design, Inc. has applied for a conditional use permit for outdoor storage and display of materials and equipment, an accessory structure, and fence exceeding six feet at 2385 Pilot Knob Road (SECTION 33 TWN 28 RANGE 23, PT OF SE 1/4 OF NE 1/4 LYING SE OF TH#13 & S OF RR EX PARCEL 46B ON MNDOT RIW PLAT 19-94, LOT 33, BLOCK 28 & 23; PID # 27-03300-040-10) as proposed in Planning Case 2014-09; and WHEREAS, the Mendota Heights Planning Commission held a public hearing on this matter at their regular meeting April 22, 2014. NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the right-of-way license agreement for the utilization of the Perron Road right-of-way is hereby approved and City Staff is authorized to execute the agreement; BE IT FURTHER RESOLVED by the Mendota Heights City Council that the conditional use permit as proposed in Planning Case 2014-09 is hereby approved with the following conditions: 1. A performance bond, with security satisfactory to the City, is supplied by the applicant for the proposed screening and landscaping improvements. 2. The applicant shall provide additional information regarding any potential visibility of rooftop mechanical units to ensure compliance with the Code prior to the issuance of a building permit. 3. A final lighting plan shall be submitted and approved prior to installation. 4. Final building elevations for the accessory structure and storage bins shall be submitted with the final plans as part of the building permit application and approved to ensure compliance with the Code requirements. 5. A final sign package shall be submitted for review prior to issuance of a sign permit. 6. Circulation and water service on the property shall meet the requirements of the City's Fire Chief for access and fire protection. 7. The applicant shall dedicate 10 -foot drainage and utility easements adjacent to all property boundary lines and over stormwater treatment facilities to be recorded by document with Dakota County. 8. Geotechnical report and final stormwater model calculations shall be submitted and approved by the City prior to the issuance of Building Permit(s). 9. Final plans submitted for building permit shall include structural design details of the retaining wall and fence. 10. All soil disturbance, development, and construction activities shall comply with the City's stormwater ordinances and Land Disturbance Guidance Document.
