AIRPORT RELATIONS COMMISSION MINUTES
May 19, 2008
The Mendota Heights Airport Relations Commission met at City Hall to drive together to
the MSP Air Traffic Control Tower (ATCT) for a 4:30 p.m. iour conducted by ATCT
Operations Manager Carl Rydeen and MAC Aviation Noise Manager Chad Leqve.
The following Commissioners were present: Liz Petschel, Chair; Robin Ehrlich, Vice
Chair; Bill Dunn and Ken Reed, Commissioners; and Sandra Krebsbach, Council
Member. Also present: Jim Danielson, City Administrator; Jake Sedlacek, Assistant to
the City Administrator; Ellsworth Stein, former ARC meinber; and Mary Heintz,
Recorder.

It was Commission consensus to table approval of the April 9, 2008, A.R.0 ineeting
minutes to the next regular ARC meeting.

MSP Air Traffic Control Tower Meetin� and Tour
The ARC met with Mssrs. Rydeen and Leqve and other tower representatives in the tower
meeting room before the tour. At the meeting, Mr. Rydeen displayed a speeded-up
simulation of actual flights departing and arriving at MSP that showed crossing traffic to
reach runway 17.
Mr. Rydeen cited factors that determine runway choice and said controllers do not
differentiate between 12L and 12R. Mr. Leqve noted that flight impact has been
decreased due to fleet mix (decreased DC9s and increased CRJs) and
lower-than-anticipated flights. Mr. Rydeen stated that MSP ATCT procedures are driven

by safety and efficiency/noise abatelnent.

Minutes of Meeting and Tour— May 19, 2008 —
Mendota Heights Airport Relations Couunission
Council Member Krebsbach asked when the R.NAV would be put into use. Mr. Rydeen
quoted September 24 but said only 65% of aircraft will be compatible at that time. He �
briefly described the system (which takes the place of heading navigation) and said it will ('
increase potential for aircraft to be more precise and efficient and provide a predictable
track. The goal is to work with Northwest in creating and publishing procedures for the
new system and then coordinate them between the tower and pilots. Mr. Rydeen said that
he would like to utilize the system for daytime as weli as initial nighttime use.
Council Member Krebsbach commented on inequitable use of the two 12s. Mr. Rydeen
reported that 12L night-time 2007 annualized flights were forecasted at 14.1 % and came
in at 19.5%. He reiterated that runway choice is determined according to efficiency and
safety and said the biggest issue is runway incursion. Discussed ensued.
Mr. Leqve, responding to a question about the possible Northwest Airlines-Delta merger,
stated that growth opporiunities are anticipated at MSP and Detroit for international
destinations and gates.
Mr. Rydeen addressed questions submitted in advance by ARC concerning out-of-
corridor excursions (does not believe it is pilot error), wheels down (seeks
standardization), RUS update, crossing the corridor update, runway selection (determined
by ground controller according to destination, adding that separation occurs on the
ground), radio recording of pilot-tower conversations (doesn't want the pilot to be a
controller or noise expert; if a problem or anomaly is identified, for instance, by Mendota
Heights and it can be fixed, he wili do something about it if he is able; and Chair Petschel (

commented that she is interested more in trends versus individual occurrences), and
conformance to FEIS. Responding to a question posed at the meeting, he reported that
MSP ATCT is fully staffed and many new employees coming in are very highly qualified
a$er completing their training at the North Dakota facility.
The group then took a tour of the control tour and radar room.

Apri19, 2008
The regular meeting of the Mendota Heights Airport Relations Commission was held on
Wednesday, April 9, 2008, at 7:00 p.m., in the Large Conference Room at City Hall, 1101
Victoria Curve, Mendota Heights, Minnesota.
The following Commissioners were present: Liz Petschel, Chair; Bill Dunn, Sally .
Lorberbaum, Ken Reed, and Dave Sloan, Commissioners.
Guests: Mike Heide and Mike Kosel, Rogers Lake Group.
Also present were: Jim Danielson, City Administrator; John Bergman, Apple Valley
Noise Ovezsight Coinrnittee Alternate; and Mary Heintz, Recorder.
Not Present: Robin Ehrlich, Vic Chair; Lyle Odland, Corrunissioner; Jake Sedlacek,
Assistant to Mr. Danielson.
Approval of Minutes

A lnotion was made by Commissioner Lorberbaum, seconded by Commissioner Dunn, to
approve the March 12, 2008, ARC meeting lninutes as amended. The minutes were
approved.
Unfinished and New Business
A. Presentation by Guy Heide and Mike Kosel, Rogers Lake Group
Mr. Guy Heide distributed a copy of the final draft report of the MAC Enviromnental
Assessment for the Runway 4-22 Extension. He said the Federal Aviation
Administration (FAA) reasoning for redirecting traffic at night over the Mendota Heights
corridor is because fewer residences are located there, which is untrue, and commented
that Eagan had pressured the Noise Oversight Committee (NOC) to work on the FAA to
do so.
Chair Petschel stated that the measure had passed by only one vote at that time and that
industry representatives and the Northwest Airlines representative had voted against it.

Mr. Heide reported that his wife has been unable ta sleep because of the airplane noise
overhead, even with cotton in her ears, and claims that it has damaged his and his wife's (�
health, their home bricks have shattered and windows have been damaged, and his and �
Mr. Kosel's ch.i.inneys "have been lost." He said he doesn't know what ARC can do but
wanted to bring the complaint to the Commission's attention.
He provided specifics of his ongoing investigation over the last five years concerning
irregularities, "false statements," and "fraud," which have included, but not been limited
to, his filing of 120 Freedoin of Information Acts with the FAA, 100 with MAC, and
various meetings with pertinent officials. Mr. Heide commented that Airport
improvement grants were sought to extend Runway 4-22 because Northwest had
threatened to reduce operations and move elsewhere if it didn't get an 11,000-foot
runway. He cited various discrepancies in the Environmental Assessment report's data
and xnaps, noted postdated amendments and missing accounting records, and said he
believes the FAA understated activity and mislead the public. Mr. Heide said he is at the
point where he wants to contact the Miller-Ciresi law firm to litigate the Airport's
"pattern of wrongdoing" that could reach in the hundreds of millions of dollars.
Mr. Mike Kosel commented that it appears Mendota Heights was left out of the data in
order to make the numbers fit and referenced discrepancies in maps, which began in
1992. He said some MAC Comrnissioners have violated their oaths of office in using the
1996 map 65 DNL Contour, which never existed. In addition, he said the Cornmissioners
are suppose to disclose their conflicts of interest and cited one, in particular, who was �
invested in Northwest, Jet Blue and Continental but never disclosed that information �
before voting, and said he believes something should be done about that.
Commissioner Reed said the discrepancy in numbers on the Enviroxunental Assessment
report may be math errors.
Chair Petschel stated that justification for extending the 4-22 Runway was because of
Northwest's insistence to lengthen it for Korean flights and that those flights were to go
over Bloomington (nine residential blocks were insulated). She added, however, that
those flights never went over Bloomington, but rather onto 12L, 12R and 30s, and so the
contouxs over Mendota Heights haven't reflected the flights that didn't go over
Bloomington. Mr. Kosel said the maps do not reflect Mendota Heights in the least, that
noise runways are dead center on the runways but that isn't the way planes take off from
the airport and instead leave 15 degrees off the ground.
Comm.issioner Reed commented that the situation may be a huge set of bizarre
coincidences. He said that he doesn't mean to diminish any wrongdoing believed to have
been done but that he worked for HNTB and knows that totals can be generated that are
bad. He added that he doesn't understand what motivation there would be for such
alleged wrongdoing.

Mr. Kosel said their group has done a tremendous amount of work and the 1992 maps are
; not representative of the area. He then reported on the tremendous volurne of flights he's
experienced overhead at home and the corresponding number of complaints he's had to
make because of it.
Chair Petschel assured Mssrs. Heide and Kosel that the ARC has fought aggressively to
ensure the City's fair share of nighttime flights and concurred that it has absorbed twice
as many as it should have. She reported that she'd been told that gates on the southeast
are closest to 12L, so that runway is preferred in order to save fuel.
Mr. Kosel invited Cornmissioner Reed to his home to review all of the documentation
that he and Mr. Heide have pulled together, about which 5% was shared at the evening's
meeting, and Conunissioner Reed agreed to do so. Commissioner Dunn offered to join
Commissioner Reed when the meeting occurs.
Chair Petschel reassured Mssrs. Heide and Kosel that the ARC's first goal is to address
nighttirne operations. She said they would be welcome to come back to ARC with their
PowerPoint presentation regarding their issues, which they reported that they have been
working on.
Mssrs. Heide and Kosel excused themselves from the meeting and, general discussion
ensued.
( ! Commissioner Reed described the public radio frequency real-time sensors that were
utilized at the Tampa International Airport, where he used to work, and suggested that
something similar be used at MSP. He stated that tracks, noise levels, and audio
transmissions are monitored and time stamped, even identifying who assigns aircraft to
particular runways, and quoted a cost of the $100,000 for such a system. Chair Petschel
said the suggestion could be made to Carl Rydeen during the ARC's May 19 Tower tour.
Commissioner Dunn commented that "the surest way to change behavior is to monitor
lt."
Chair Petschel said the Corninission also has to be prepared to address the issue of fuel
cost and that the Airport's choice will be the shortest trek to the runway. She did also
note, however, that less fuel would be required to go to 12R than to burn fuel to go to 17.
Commissioner Reed added that the difference between the cost to save fuel and spend
money to sound-insulate homes has to be balanced.
Comrnissioner Reed commented that not much progress seems to have been made by
Chad Leqve's group or NOC, in that he doesn't see numbers coming down. He said in
his same role at Tampa, as Mr. Leqve, improvement was charted every three months to
ensure numbers were inoving closer to goals. Chair Petschel said ARC needs to tallc with
Mr. Rydeen to develop a strategy regarding the Tower crossing the corridor over the
freeway at nonpeak times and that an accounting is needed as to how frequently that
� procedure is being used. Commissioner Reed said he would want the ineasure to go back
' to the source, controller, pilot andlor airline policy.

B. Review Airport Section of 2008 Comprehensive Plan
Chair Petschel stated that the Comprehensive Plan is revised every ten years, to address (
various City priorities, and that NIr. Danielson had pulled pieces relative to ARC for its
review of content and to ensure they are in synch with the Airport Plan of Action, goals
and objectives, and dovetail with the City and NOC.
Recommended Visions
• Under "Airport Plan," second para -�raph, remove first two sentences (which follow�:
"Since the opening of the "North-South runway, previous issues with the distribution
of air traffic have been reduced. A11 r�sidential areas in Mendota Heights were in
conformance with the original aviation guidelines and their previousprojections of air
noise and air traffic."
• Under "Airport Plan," report that the third para�raph is not true (which follows�: "The
Runway Use System at MSP relies heavily on "land compatibility" as a guiding
principle for departure determination, thereby increasing the volume of traffic and the
percentage of exclusive use of the southeast corridor, which was zoned
commercial/industrial in cooperation with regional and local planning agencies. This
increased traffic has impacted existing compatible residential neighborhoods in
Mendota Heights."
• Under "Goals and Policies," chan�e Goal 1 to read: "Monitor and control where
possible negative airport impacts in Mendota Heights."
• Under "Goals and Policies," change Goal 2 to read: "To support the equitable
distribution of flights within all communities located close to IVISP."
• Under "Goals and Policies," insert "�opulation in place of "area" to read: "To work
diligently with all noise issues and agencies to decrease aircraft noise in volume and
to decrease noise irnpacts to the population."
• Under "Goals and Policies " add Goal 4: "Add part 150 plan and subsequent noise
compatibility program."
• Under "Airport Noise Policies," chan�e Policy 6 to read: "Advocate to increase
general aviation use to other reliever airports."
• Under "Airport Noise Policies," add Polic_y 8 to read: "Inform the public/media
regarding MAC's progress in addressing noise issues and limitations of noise
compatibility program."
• Under "History of Noise Reduction Efforts," asked whether it is enforceable because
it's a written agreement between MAC and the CitY (follows�: "Agreement to a
contract with MA.0 prohibiting construction of a third parallel runway."
• Under "History of Noise Reduction Efforts," add Policy 6 to read: "Ongoing dialogue
with adjacent communities, legislators, NOC, FAA and MAC for the purpose of noise
attenuation."
• Under "History of Noise Reduction Efforts," revise third para�raph b a� "about
their participation" under that section to read: "The City has worked through the
various agencies on issues including: modification of aircraft landings and deparh�res, �-
supporting the installation of ANOMS, supporting the prohibition of Stage II aircraft, ��
and educating homeowners about their participation in the Part 150 program."

Should guiding principle of land use development is runway usage at MSP which utilizes
the parallel runway for capacity and therefore should plan noise compatible land uses in
line. With parallel runways and future land use should reflect continued firaffic on the
parallel runways.
Given time constraints, it was Commission consensus to complete the review of the
document at the June ARC meeting.
C. NOC Update
Chair Petschel reported that MAC deputy director Nigel T'i.��.ney has retired and will be
replaced by Denny I?r�bst and ICevin Hochn7a71 will replace UPS representative �'ete
I:�i�Ter�norc. Mr. Livermore was a member of the original Blue Ribbon Pane1 that put
MA.0 together and the only person on the carrier side that voted with the communities on
the sound insulation for 60/64, to his risk and displeasure of Kathle�n. Nelson.
Discussion had taken place regarding projected and actual noise contours, required as a
result of the lawsuit. Operations off 12L are higher than projected and use of 17 is below
-- forecast in acival numbers but up 10% over last year. The noise contoux over Mendota
j � Heights is larger than projected. ANOMS actual nurnbers are close to modeled nurnbers,
- so projections match the actual very closely with the exception of 12L. Runway use and
nighttilne operations are driving the current noise inap the most. Upgrade for ANOMS
software and sensors related to real-tirne flight tracking will cost $500,000. Worst
offenders for lowering landing gear is Fed Ex; UPS is on board and Tim Butalla, chief
pilot for Northwest, sits on the NOC and has been briefing pilots from Fed Ex and Delta,
hoping to see positive changes. The word is getting out about coinpliance and the next
thing to watch is to see if Apple Valley sees positive effects from the compliance.
Commissioner Reed commented that no one should expect contours to match very well,
as they are generated five years in advance, that the 2007 projection started in 2000. He
said the area most different between projection and actual is Bloomington because flights
aren't departing on 17 as much as they want them to and there should be a bigger
difference and Mendota Heights getting lnore equitable benefit. Commissioner Reed said
the numbers don't make sense because departure distributions are twice as much on 12L
as 12R but arrivals are nearly identical.
D. Tower Tour — May 19, 2008, ARC Meeting
The ARC meeting has been moved from May 14 to May 19, when the Tower tour is
scheduled. Those scheduled for the tour will meet at City Hall at 4 p.m. and drive
together to the 4:30 p.m. tour. Attendees should RSVP to Mr. Danielson via email, as the
( � Tower requests a complete list of na.ines in advance of the tour.

Commissioner Sloan reported that he wouldn't' be able to attend. Mr. Rydeen and
Mr. Leqve will meet with the Comrnission in a separate room after the tour. ��
Issues to be addressed (requested in advance by the Tower) include, but may not be
limited to:
• Northern excursions
e Nighttime operations
s Crossing corridor use
• Runway selection determination and who assigns the runway
s Radio recording system
s Conformance to EIS
• Reason as to why twice as many flights utilize 12L as 12R when a similar number of
gates are close to each one
s Reason as to why 12R getting relief from 17, instead of relief for Mendota Heights on
12L
Mr. Bergman suggested that NOC members be invited to join the tour, but it was ARC
consensus that the decision to invite them be left to Mr. Rydeen's discretion.
Chair Petschel recommended that Mr. Danielson inform the City of ARC's May meeting
date change, in the event members of the public might be planning to attend.
E. Reschedule October 15, 2008, ARC Meeting
It was Commission consensus that the October 15, 2008, ARC meeting be moved to
October 8, in that it conflicts with Yom Kippur.

Corrections on page 2
1 Council Member Krebsbach asked when the RNAV would be put into use. Mr. Rydeen
quoted September 24 but said only 65% of aircraft will be compatible at that time. He
briefly described the system (which takes the place of heading navigation) and said it will
increase potential for aircraft to be more precise and efficient and provide a predictable
track. The goal is to work with Northwest in creating and publishing procedures for the
new system and then coordinate them between the tower and pilots. Mr. Rydeen said that
he would like to utilize the system for daytime as well as initial nighttime use.
Council Member Krebsbach commented on inequitable use of the two 12s. Mr. Rydeen
reported that 12L night-time 2007 annualized flights were forecasted at 14.1 % and came
in at 19.5%. He reiterated that runway choice is determined according to efficiency and
safety and said the biggest issue is runway incuxsion. Discussion ensued.
Mr. Leqve, responding to a question about the possible Northwest Airlines-Delta merger,
stated that growth opportunities are anticipated at MSP and Detroit for international
destinations and gates.
Mr. Rydeen addressed questions submitted in advance by ARC concerning out-of-
corridor excursions (does not believe it is pilot error), wheels down (seeks
standardization), RUS update, crossing the corridor update, runway selection (determined
by ground controller according to destination, adding that separation occurs on the
ground), radio recording of pilot-tower conversations (doesn't wa.nt the pilot to be a
controller or noise expert; if a problem or anomaly is identified, for instance, by Mendota
Heights and it can be fixed, he will do something about it if he is able; and Chair Petschel
commented that she is interested more in trends versus individual occurrences), and
conformance to FEIS. Responding to a question posed at the meeting, he reported that
MSP ATCT is fully staffed and many new employees coming in are very highly qualified
after completing their training at the North Dakota facility.
The group then took a tour of the control tower and radar room.

The regular meeting of the Mendota Heights Airport Relations Commission was held on
Wednesday, Apri19, 2008, at 7:00 p.m., in the Large Conference Room at City Hall, 1101
Victoria Curve, Mendota Heights, Minnesota.
The following Commissioners were present: Liz Petschel, Chair; Bi11 Dunn, Sally
Lorberbaum, Ken Reed, and Dave Sloan, Commissioners.
Guests: Mike Heide and Mike Kosel, Rogers Lake Group.

Approval of Minutes
Chair Petschel requested a spelling correction to "Senator Metzen" on page one, second
paragraph under Review/Update Goals and Objectives.
A motion was made by Commissioner Lorberbaum, seconded by Commissioner Dunn, to
approve the March 12, 2008, ARC meeting minutes as amended. The minutes were
approved.
Un�nished and New Business
A. Presentation by Guy Heide and Milce Kosel, Rogers Lake Group
Mr. Guy Heide distributed a copy of the final draft report of the MAC Environmental
Assessment for the Runway 4-22 Extension. He said the Federal Aviation
Administration (FAA) reasoning for redirecting traffic at night over the Mendota Heights
corridor is because fewer residences are located there, which is untrue, and commented
that Eagan had pressured the Noise Oversight Committee (NOC) to work on the FA.A to
do so.
Chair Petschel stated that the measure had passed by only one vote at that time and that
industry representatives and the Northwest Airlines representative had voted against it.

supporting the installation of ANOMS, supporting the prohibition of Stage II aircraft,
and educating homeowners about their participation in the Part 150 program."
• Under "Impacts of Future Land Use Pla.lining," second sentence in second para�raph,
correct spelling to "townhome." Inform them it's not true. Guiding principle of land
use development is runway usage at MSP, which utilizes the parallel runway for
capacity, and should be in line with the noise compatible land uses. With parallel
runways and future land use, should reflect continued traffic on the parallel runways.
Given time constraints, it was Commission consensus to complete the review of the
document at the June ARC meeting.
C. NOC Update
Chair Petschel reported that MAC deputy director Nigel Finney has retired and will be
replaced by Denny Probst and Kevin Hochman will replace UPS representative Pete
Livermore. Mr. Livermore was a member of the original Blue Ribbon Panel that put
MAC together and the only person on the carrier side that voted with the communities on
the sound insulation for 60/64, to his risk and displeasure of Kathleen Nelson.
Discussion had taken place regarding proj ected and actual noise contours, required as a
result of the lawsuit. Operations off 12L are higher than projected and use of 17 is below
forecast in actual numbers but up 10% over last year. The noise contour over Mendota
Heights is larger than projected. ANOMS actual numbers are close to modeled numbers,
so projections match the actual very closely with the exception of 12L. Runway use and
nighttime operations are driving the current noise map the most. Upgrade for .ANOMS
software and sensors related to real-time flight tracking will cost $500,000. Worst
offenders for lowering landing gear is Fed Ex; UPS is on board and Tim Butalla, chief
pilot for Northwest, sits on the NOC and has been briefing pilots from Fed Ex and Delta,
hoping to see positive changes. The word is getting out about compliance and the next
thing to watch is to see if Apple Valley sees positive effects from the compliance.
Commissioner Reed commented that no one should expect contours to match very well,
as they are generated five years in advance, that the 2007 projection started in 2000. He
said the area most different between projection and actual is Bloomington because flights
aren't departing on 17 as much as they want them to and there should be a bigger
difference and Mendota Heights getting more equitable benefit. Commissioner Raed said
the numbers don't make sense because departure distributions are twice as much on 12L
as 12R but arrivals are nearly identical.

D. Tower Tour — May 19, 2008, ARC Meeting
�,' '� The ARC meeting has been moved from May 14 to May 19, when the Tower tour is
scheduled. Those scheduled for the tour will meet at City Hall at 4 p.m. and drive
together to the 4:30 p.m. tour. Attendees should RSVP to Mr. Danielson via email, as the
Tower requests a complete list of narnes in advance of the tour.
Commissioner Sloan reported that he wouldn't be able to attend. Mr. Rydeen and
Mr. Leqve will meet with the Cornmission in a separate room after the tour.
Issues to be addressed (requested in advance by the Tower) include, but may not be
limited to:
• Northern excursions
• Nighttime operations
• Crossing corridor use
• Runway selection determination and who assigns the runway
• Radio recording system
• Conformance to EIS
• Reason as to why twice as many flights utilize 12L as 12R when a similar number of
gates are close to each one
• Reason as to why 12R getting relief from 17, instead of relief for Mendota Heights on
12L
Mr. Bergman suggested that NOC members be invited to join the tour, but it was ARC
consensus that the decision to invite them be left to Mr. Rydeen's discretion.
Chair Petschel recommended that Mr. Danielson inform the City of ARC's May meeting
date change, in the event members of the public might be plamiing to attend.
E. Reschedule October 15, 2008, ARC Meeting
It was Commission consensus that the October 15, 2008, ARC meeting be moved to
October 8, in that it conflicts with Yom Kippur.

April 9, 2008
The regular meeting of the Mendota Heights Airport Relations Commission was held on
Wednesday, April 9, 2008, at 7:00 p.rn., in the Large Conference Room at City Hall, 1101
Victoria Curve, Mendota Heights, Minnesota.
The following Cornrnissioners were present: Liz Petschel, Chair; Bill Dunn, Sally
Lorberbaum, Ken Reed, and Dave Sloan, Commissioners.
Guests: Mike Heide and Mike Kosel, Rogers Lake Group.
Also present were: Jim Danielson, City Administrator; John Berg�nan, Apple Valley
Noise Oversight Committee Alternate; and Mary Heintz, Recorder.
Not Present: Robin Ehrlich, Vic Chair; Lyle Odland, Commissioner; Jake Sedlacek,
Assistant to Mr. Danielson.
Approval of Minutes

A motion was made by Commissioner Lorberbaum, seconded by Corrunissioner Dunn, to
approve the March 12, 2008, ARC meeting minutes as amended. The ininutes were
approved.
Unfinished and New Business
A. Presentation by Guy Heide and Mike Kosel, Rogers Lake Group
Mr. Guy Heide distributed a copy of the final draft report of the MAC Environmental
Assessment for the Runway 4-22 Extension. He said the Federal Aviation
Administration (FAA) reasoning for redirecting traffic at night over the Mendota Heights
corridor is because fewer residences are located there, which is untrue, and commented
that Eagan had pressured the Noise Oversight Committee (NOC) to work on the FAA to
do so.
Chair Petschel stated that the lneasure had passed by only one vote at that time and that
industry representatives and the Northwest Airlines representative had voted against it.

Mr. Heide reported that his wife has been unable to sleep because of the airplane noise
overhead, even with cotton in her ears, and claims that it has damaged his and his wife's �'
health, their home bricks have shattered and windows have been damaged, and his and t
Mr. Kosel's chimneys "have been lost." He said he doesn't know what ARC can do but
wanted to bring the complaint to the Commission's attention.
He provided specifics of his ongoing investigation over the last five years concerning
irregularities, "false statements," and "fraud," which have included, but not been lirnited
to, his filing of 120 Freedom of Information Acts with the FAA, 100 with MAC, and
various meetings with pertinent officials. Mr. Heide cominented that Airport
unprovement grants were sought to extend Runway 4-22 because Northwest had
threatened to reduce operations and move elsewhere if it didn't get an 11,000-foot
runway. He cited various discrepancies in the Environmental Assessment report's data
and rnaps, noted postdated amendments and missing accounting records, and said he
believes the FAA understated activity and mislead the public. Mr. Heide said he is at the
point where he wants to contact the Miller-Ciresi law firm to litigate the Airport's
"pattern of wrongdoing" that could reach in the hundreds of millions of dollars
Mr. Mike Kosel commented that it appears Mendota Heights was left out of the data in
order to make the numbers fit and referenced discrepancies in maps, which began in
1992. He said some MAC Cominissioners have violated their oaths of office in using the
1996 map 65 DNL Contour, which never existed. In addition, he said the Cornmissioners
are suppose to disclose their conflicts of interest and cited one, in particular, who was
invested in Northwest, Jet Blue and Continental but never disclosed that information ,- �
before voting, and said he believes something should be done about that. . �, '
Commissioner Reed said the discrepancy in numbers on the Environmental Assessment
report may be math errors.
Chair Petschel stated that justification for extending the 4-22 Runway was because of
Northwest's insistence to lengthen it for Korean flights and that those flights were to go
over Bloomington (nine residential blocks were insulated). She added, however, that
those flights never went over Bloomington, but rather onto 12L, 12R and 30s, and so the
contours over Mendota Heights haven't reflected the flights that didn't go over
Bloomington. Mr. Kosel said the maps do not reflect Mendota Heights in the least, that
noise runways are dead center on the runways but that isn't the way planes take off from
the airport and instead leave 15 degrees off tlie ground.
Coirunissioner Reed commented that the situation may be a huge set of bizarre
coincidences. He said that he doesn't mean to diminish any wrongdoing believed to have
� been done but that he worked for HNTB and knows that totals can be generated that are
bad. He added that he doesn't understand what motivation there would be for such
alleged wrongdoing.

Mr. Kosel said their group has done a tremendous amount of work and the 1992 maps are
not representative of the area. He then reported on the tremendous volurne of flights he's
experie�ced overhead at home and the corresponding number of complaints he's had to
\' make because of it.
Chair Petschel assured Mssrs. Heide and Kosel that the ARC has fought aggressively to
ensure the City's fair share of nighttirne flights and concurred that it has absorbed twice
as many as it should have. She reported that she'd been told that gates on the southeast
are closest to 12L, so that runway is preferred in order to save fuel.
Mr. Kosel invited Commissioner Reed to his hoine to review all of the documentation
that he and Mr. Heide have pulled together, about which 5% was shared at the evening's
meeting, and Commissioner Reed agreed to do so. Commissioner Dunn offered to join
Commissioner Reed when the meeting occurs.
Chair Petschel reassured Mssrs. Heide and Kosel that the ARC's first goal is to address
nighttiine operations. She said they would be welcome to come back to ARC with their
PowerPoint presentation regarding their issues, which they reported that they have been
working on.
Mssrs. Heide and Kosel excused themselves from the meeting and general discussion
ensued.
( , Commissioner Reed described the public radio frequency real-time sensors that were

) utilized at the Tampa International Airport, where he used to work, and suggested that
something similar be used at MSP. He stated that tracks, noise levels, and audio
transmissions are monitored and time stamped, even identifying who assigns aircraft to
particular runways, and quoted a cost of the $100,000 for such a system. Chair Petschel
said the suggestion could be made to Carl Rydeen during the ARC's May 19 Tower tour.
Commissioner Dunn commented that "the surest way to change behavior is to monitor
it."
Chair Petschel said the Commission also has to be prepared to address the issue of fuel
cost and that the Airport's choice will be the shortest trek to the runway. She did also
note, however, that less fuel would be required to go to 12R than to burn fuel to go to 17.
Commissioner Reed added that the difference between the cost to save fuel and spend
money to sound-insulate homes has to be balanced.
Commissioner Reed commented that not much progress seems to have been made by
Chad Leqve's group or NOC, in that he doesn't see numbers corning down. He said in
his same role at Tampa, as Mr. Leqve, improvement was charted every three months to
ensure nuinbers were moving closer to goals. Chair Petschel said ARC needs to talk with
Mr. Rydeen to develop a strategy regarding the Tower crossing the corridor over the
freeway at nonpeak times and that an accounting is needed as to how frequently that
procedure is being used. Commissioner Reed said he would want the measure to go back

B. Review Airport Section of 2008 Comprehensive Plan
Chair Petschel stated that the Comprehensive Plan is revised every ten years, to address i�
various City priorities, and that Mr. Danielson had pulled pieces relative to ARC for its `
review of content and to ensure they are in synch with the Airport Plan of Action, goals
and obj ectives, and dovetai� with the City and NOC.
Recommended Visions
o Under "Airport Plan," second paragraph, remove first two sentences (which follow�:
"Since the opening of the "North-South runway, previous issues with the distribution
of air traffic have been reduced. All residential areas in Mendota Heights were in
conformance with the original aviation guidelines and their previous projections of air
noise and air traffic."
• Under "Airport Plan," report that the third parag_raph is not true (which follows): "The
Runway Use System at MSP relies heavily on "land compatibility" as a guiding
principle for departure determination, thereby increasing the volum.e of traffic and the
perc�ntage of exclusive use of the southeast corridor, which was zoned
commerciaUindustrial in cooperation with regional and local plaruling agencies. This
increased traffic has impacted existing compatible residential neighborhoods in
Mendota Heights."
• Under "Goals and Policies," chan�e Goal 1 to read: "Monitor and control where
possible negative airport impacts in Mendota Heights."
e Under "Goals and Policies; ' change Goal 2 to read: "To support the equitable �
distribution of flights within all comtnunities located close to MSP." �.

diligently with all noise issues and agencies to decrease aircraft noise in volume and
to decrease noise impacts to the population."

Should guiding principle of land use development is runway usage at MSP which utilizes
the parallel runway for capacity and therefore should plan noise compatible land uses in
line. With parallel runways and future land use should reflect continued traffic on the
parallel runways.
Given time constraints, it was Corrunission consensus to complete the review of the
document at the June ARC meeting.
C. NOC Update
Chair Petschel reported that MAC deputy director Nigel Fii�.ney has retired and will be
replaced by Denny Probst and ICevin Hochnzan will replace UPS representative Pete
Li�rei•in�re. Mr. Livermore was a member of the original Blue Ribbon Panel that put
MAC together and the only person on the carrier side that voted with the communities on
the sound insulation for 60/64, to his risk and displeasure of ICathleen Nelson.
Discussion had taken place regarding projected and actual noise contours, required as a
result of the lawsuit. Operations off 12L are higher than projected and use of 17 is below
forecast in actual numbers but up 10% over last year. The noise contour over Mendota
( Heights is larger than projected. ANOMS actual numbers are close to modeled nuxnbers,
, 1 so projections match the actual very closely with the exception of 12L. Runway use and
nighttime operations are driving the current noise map the inost. Upgrade for ANOMS
software and sensors related to real-time flight tracking will cost $500,000. Worst
offenders for lowering landing gear is Fed Ex; UPS is on board and Tim Butalla, chief
pilot for Northwest, sits on the NOC and has been briefing pilots from Fed Ex and Delta,
hoping to see positive changes. The word is getting out about compliance and the next
thing to watch is to see if Apple Valley sees positive effects from the compliance.
Commissioner Reed commented that no one should expect contours to match very well,
as they are generated five years in advance, that the 2007 projection started in 2000. He
said the area inost different between projection and actual is Bloomington because flights
aren't departing on 17 as inuch as they want them to and there should be a bigger
difference and Mendota Heights getting more equitable benefit. Commissioner Reed said
the numbers don't make sense because departure distributions are twice as much on 12L
as 12R but arrivals are nearly identical.
D. Tower Tour — May 19, 2008, ARC Meeting
The ARC meeting has been moved from May 14 to May 19, when the Tower tour is
scheduled. Those scheduled for the tour will meet at City Hall at 4 p.m. and drive
together to the 4:30 p.m. tour. Attendees should RSVP to Mr. Danielson via ennail, as the
( Tower requests a complete list of names in advance of the tour.

Commissioner Sioan reported that he wouldn't' be able to attend. Mr. Rydeen and
Mr. Leqve will meet with the Conunission in a separate room a$er the tour.
Issues to be addressed (requested in advance by the Tower) include, but may not be

• Crossing corridor use
• Runway selection determination and who assigns the runway
• Radio recording system

Mr. Bergman suggested that NOC members be invited to join the tour, but it was ARC
consensus that the decision to invite them be left to Mr. Rydeen's discretion.
Chair Petschel recommended that Mr. Danielson inform the City of ARC's May meeting
date change, in the event members of the public might be plamiillg to attend.

The Mendota Heights Airport Relations Commission met at City Hall to drive together to
the MSP Air Traffic Control Tower (ATCT) for a 4:30 p.m. tour conducted by ATCT
Operations Manager Carl Rydeen and MAC Aviation Noise Manager Chad Leqve.
The following Commissioners were present: Liz Petschel, Chair; Robin Ehrlich, Vice
Chair; Bill Dunn and Ken Reed, Cominissioners; and Sandra Krebsbach, Council
Member. Also present: Jim Danielson, City Administrator; Jake Sedlacek, Assistant to

MSP Air Traffic Control Tower Meetin� and Tour
The A.RC met with Mssrs. Rydeen and Leqve and other tower representatives in the tower
meeting room before the tour. At the meeting, Mr. Rydeen displayed a speeded-up
simulation of actual flights departing and arriving at MSP that showed crossing traffic to
reach runway 17.
Mr. Rydeen cited factors that deternune runway choice and said controllers do not
differentiate between 12L and 12R. Mr. Leqve noted that flight impact has been
decreased due to fleet inix (decreased DC9s and increased CRJs) and
lower-than-anticipated flights. Mr. Rydeen stated that MSP ATCT procedures are driven
by safety and efficiency/noise abatement.

Council Member Krebsbach asked when the RNAV would be put into use. Mr. Rydeen
quoted September 24 but said only 65% of aircraft will be compatible at that time. He (
briefly described the system (which takes the place of heading navigation) and said it will {
increase potential for aircraft fo be more precise and efficient and provide a predictable
track. The goal is to work with Northwest in creating and publishing procedures for the
new system and then coordinate them between the tower and pilots. Mr. Rydeen said that
he would like to utilize the system for daytime as well as initial nighttime use.
Council Member Krebsbach commented on inequitable use of the two 12s. Mr. Rydeen
reported that 12L night-time 2007 annualized flights were forecasted at 14.1 % and came
in at 19.5%. He reiterated that runway choice is determined according to efficiency and
safety and said the biggest issue is runway incursion. Discussed ensued.
Mr. Leqve, responding to a question about the possible Northwest Airlines-Delta merger,
stated that growth opportunities are anticipated at MSP and Detroit for international
destinations and gates.
Mr. Rydeen addressed questions sulslnitted in advance by ARC concerning out-of-
corridor excursions (does not believe it is pilot error), wheels down (seeks
standardization), RUS update, crossing the corridor update, runway selection (determined
by ground controller according to destination, adding that separation occurs on the
ground), radio recording of pilot-tower conversations (doesn't want the pilot to be a
controller or noise expert; if a problem or anomaly is identified, for instance, by Mendota
Heights and it can be fixed, he will do something about it if he is able; and Chair Petschel %�
commented that she is interested more in trends versus individual occurrences), and �
conformance to FEIS. Responding to a question posed at the meeting, he reported that
MSP ATCT is fully staffed and many new employees coming in are very highly qualified
after completing their training at the North Dakota facility.
The group then took a tour of the control tour and radar room.

The Minneapolis/St. Paul International Airport (MSP) Noise Oversight Committee {NOC) is a twelve
member Coxnmittee comprised af six airport user representatives and six community representatives that
makes airport noise related recornmendations to the Meh�opolitan Airparts Commission (MAC).
At the May 21, 200$ NOC meeting, MAC staff briefed the Committee on the progress being made with
Area Navigation (RNAV) procedure implementation at MSP in the case of the Eagan/Mendota Heights
Departure Corridor and the 21S-degree departure track off Runway 17. It is clear that progress in this
( ) regard would not be possible without your willingness to collaborate on strategies for addressing noise
( � concerns around MSP.
Pursuant to the Committee's direction at the May 21S` meeting, as the Co-Chairs of the I�TOC, we would
like to express our sincere gratitude, on behalf of the Committee, for your efforts to date to implement
RNAV procedures during the nighttime hours at MSP to help reduce noise impacts. Moreover, we want
to voice the NOC's strong support of the �ederal A�iation Adminisiration {FAA) and Northwest Airlines
entering into a Letter of Agreement (LOA) to begin the implementation af RNAV procedures for the
Crossing-in-the-Corridor point for depariures aff of 12L and 12R, as well as an RNAV departure
procedure for the 215-degree track off Runway 17 for use by properly equipped Northwest Airlines
aircraft during the nighttime hours when available.
Once again, thank you for your continued contributions to this effort. This initiative will provide excellent
data for analysis and, hopefully, a legitimate starting point for the cansideration of this technology for
wider application in the future at MSP.

The California state Senate recently passed, by nearly unanimous vote, a bill
strongly pushed by the Aircraft Owners and Pilots Association (AOPA) that
sirengthens the state's airport land use laws.
S.B. 1118 requires all counties in the state with at least one public use airpart to
have an airport land use commission (ALUC). Nine counties, including Marin, San
Bernardino, and Santa Cruz counties, are affected by the bill, which was passed by
the state Senate on May 1 and is now under consideration by the state Assembly.
The California Legislature originally required all counties in the state to set up
ALUCs to plan for the areas around airports with scheduled service. The Legisla-
ture later extended that mandate to require ALUCs to plan for all public use
airports.
However, in 1993, to save money, the Legislature repealed the mandate for
counties to have ALUCs. The following year, it reinstated the mandate but
allowed local officials to avoid forming an ALUC if they found there were no
noise, public safety, or land use issues facing affected airports. The result was
that several counties stopped using a county-wide body to plan for land use

To ease airspace congestion in the New York area and keep ticket prices down,
the Department of Transportation May 16 proposed slot auctions at John F.
Kennedy and Newark International airports and a cap on tra�c at Newark.
The controversial proposal, based on DOT's assertion that it owns airline slots,
was strongly opposed by the Air Transport Association and the Port Authority of
New York and New Jersey, which have vowed to fight it.
DOT's proposal was published as a Notice of Proposed Rulemaking (NPRM) in
the May 21 Federal Register. DOT is accepting public comments on the NPRM
until July 21. The NPRM is avaiiable online at http://edocket.access.gpo.�ov/2008/

Under DOT's proposal, all airlines operating at Newark and JFK wouid be given
up to 20 slots a day for the 10-year life of the rule. The proposal offers two options
for JFK which would affect between 91 and 179 slots out of the 1,245 total siots at
the airport.
Under the first, 10 percent of the airline's slots above the 20-slot baseline would
be made available via an auction. The airlines could bid on their own slots. The
revenue from those auctions would then be invested in congestion and capacity
improvements in theNew York region.

around public use airports.
S.B.1118 repeals the authority for a county to exempt itself
from the requirement to set up an airport ]and use commis-
sion. It also specifies that a two-thirds vote by a county
board of supervisors is required to overturn an ALUC
decision. That provision was aimed at Marin County, which
only requires a majority vote to override an ALUC decision.
The legislation is intended to restore the Legislature's
desire that local o�cials and aviation experts meet in a
countywide setting to balance competing interests. Because
most counties have kept their ALUCs operating, the bill will
not afFect them. But nine counties will have to change how
land use pianning and regulation occurs around their public
use airports. Also, some cities will lose the direct control
over land use around airports that they currently enjoy.
ALUCs are comprised of seven members representing
cities, counties, aviation experts, and the general public.
They must adopt "airport compatibility land use plans"
(ACLUPs) for areas around public use airports. ALUCs can
determine whether city and county general plans and
particular land use decisions are consistent with those
ACLUPS. A city council or county board of supervisors can
overrule an ALUC's consistency determination on a two-
thirds vote. However, if the ciry or county overrules the
ALUC, state law stipulates that the airport operator is
immune from liability for property damages or personal
injury from the city or county's decision.
AOPAApplauds Bill
AOPA applauded the legislation and said, had it been
passed earlier, it could have made it much easier and less
expens'rve to protect Watsonville Municipal Airport from
residential encroachment.
In March, the Wastonville Pilots Association and a
neighborhood advocacy group called Friends of Buena
Vista won a lawsuit that will prevent the City of VJatsonville
from building homes north of the airport. The ruling also
overturned resolutions passed by ihe city in 2005 eliminat-
ing one runway safety zone and limiting another.
"The Watsonville case perfectly illustrates why
California's airport lanfl use laws need to be reinforced" said
Greg Pecoraro, AOPA vice president of regional affairs.
"Had an airport commission been in place, it would have
helped to ensure the city's decision complies with the
state's a�iation handbook guidelines. That's why we've
been supporting this legislation for the last two years."

Under the second option for JFK, the airlines would
auction 10 percent of siots above the 20-slot baseline and
keep ali the proceeds.
DOT also is proposing to auction 10 percent of slots at
Newark above the baseline annually for the first five years
of the rule. As a resuit, only 96 slots out of the total 1,219
slots at the airport would be auctioned over the 10-year
lifespan of the rule. �

DOT is proposing to cap flights at Newark at 83 per hour at
least until the end of October 2009.
Transportation Secretary Mary E. Peters said that airlines
operating at JFK and Newark "would receive a 10-year
interest in some of the world's most valuable aviation assets,
free of charge, free of question and free of hassle." She said
that DOT is proposing to auction slots because economists
estimate that caps at airports without competition can
increase fares for passengers between 11 to 15 percent over
similar flights at other airports. Economists estimate that fares
drop by over 30 percent when new airlines enter a market.
"Simply put, competition drives down fares," Peters said.
ATA called the slot auction proposai "i1l-conceived and
unlawful." "Instead of focusing on modernizing and expand-
ing the airspace infrastructure as the tra�eling and shipping
public expects, the governments seeks to curb that demand
by making it more costly to fly. We must work to expand, not
limit, capacity. This experimentwill penalizethe public."
Sen. Charles Schumer (D-NY) called the slot auction
"nothing short of insanity ... Auctions have never been tried
and were hatched by a handful of ivory tower types in the
administration. It shows that this administration puts
ideology above the safety and economic well-being of the
American flier."
At the heart of the issue is the question of who owns the
airline slots that DOT seeks to auction ofF. DOT General
Counsel D.J. Gribbin asserts that slots are intangible Federal
Aviation Administration property granted to airports and
that the airlines have no legal property interest in them or
authority over them.
However, Douglas Lavin, the International Air Transport
Association's regional vice president for North America,
contends that there is no legal authority for DOT's assertion
that airline slots are the properly of the govemment. Slots u•e
the property rights of the airlines, he said, and attempts to
take away that property will require due process and just
compensation.

On May 16, a U.S. District Court judge issued a preliminary
injunction barring the City of Santa Monica, CA, from
enforcing an unprecedented ordinance banning high-speed
Category C and D business jets, such as the Gulfstream N,
from operating at Santa Monica Airport for safety reasons.
The order by Judge George H. Wu compels the city to
comply with an Interim Cease and Desist Order issued by the
Federal Aviation Administration on May 12.
However, on May 23, the City of Santa Monica asked the
U.S. Court of Appeals for the Ninth Circuit for a stay pending
its appeal of the judge's preliminary injunction order.
Unless that stay is granted, the FAA order will be in effect
during the pendency of the agency's administrative proceed-
ings on the validity of the ordinance or during any proceed-

ings before a federal appeals court if the city chooses to
challenge the FAA's Cease and Desist Order.
The Santa Monica ordinance bans Category C and D
business jets – that have faster landing speeds than the
airport was designed for – from operating. The city fears that
faster jets will overrun the runways and crash into homes
that are located only 300 feet from runway ends.
FAA asserts that the design category of an airport cannot
be used to limit operations at an airport. The agency offered
to install a 70-knot Emergency Material Arresting System at
Santa Monica Airport that wouid stop approximately 97
percent of operations at the airport and 90 percent of
Category C and D aircraft. However, the city turned that
offer down. FAA also asserts that the city's ban will do
irreparable harm by disrupting 9,000 operations a year at the
airport.
Santa Monica officials urged the judge to take public
safety into account and not to issue the preliminary injunc-
tion.

On May 22, the Boeing Company released its 2008
Environment Report which details the company's perfor-
mance, strategy, and actions to reduce its environmentai
footprint and to develop environmentally progressive
products and services.
Over the last 40 years, airplane emissions of carbon dioxide
have been reduced by approximately 70 percent and the
noise footprints have been reduced by approximately 90
percent, according to the report. Boeing said it targets
improved fuel e�ciency of each new generation of commer-
cial airplanes by 15 percent compared to the planes they
replace.
Most of the report focuses on reductions of aircraft
emissions but noise is addressed.
"The 787 Dreamliner uses a number of new techniques –
most importantly, acoustically treated engine inlets and high
bypass ratio along with other special treatments for the
engines – to ensure that all sound of 85 dB (about the levei
of loud traffic heard from the side of the road) never leaves
the airpoi�t boundaries. In fact, the noise footprint of the 78'7
is 60 percent smaller than those of today's similarly sized
airplanes," the Boeing report states.

Work Begins on BBJ 3
In related news, Boeing announced May 10 that it has
begun work on the first Boeing Business Jet 3(BBJ 3), a
new, larger business jet based on the company's Next-
Generation 737-900 ER (extended range) airplanes which
entered commercial service and was certified by the FAA in
Apri12007.

The BBJ 3 was launched in October 2006 and will enter
service in 2009 with an unidentified customer. The same
CFM56-� engines that are used on Next-Generation 737
commercial aircraftwill powerthe BBJ 3.
Ali BBJs are equipped with Aviation Partners Boeing
Blended Winglets, which reduce community noise by 0.5 to
2.1 EPNdB on takeoffwith a slight improvement on ap-
proach, according to Boeing. The winglets also reduce fuel
burn 5.8 percent on a 5,800 nautical mile trip, increase the
plane's range up to 270 nautical miles, and reduce engine
maintenance costs.

FAA Acting Administrator Robert Sturgell announced
May 20 that Vicki Cox has been appointed as Senior Vice
President ofNextGen and Operations Planning.
Cox previously served as a vice president in the FAA's Air
Traffic Organization. She will lead the effort to transform the
nation's airspace system by using 21�` century technologies
– known as NextGen — to meet changing aviation demands.
Some of these modernization activities has already begun
and include deployment of satellite-based technology,
airspace redesign, and runway safety improvements.
"Given the aviation community's increasing need for faster
modernization or our airtra�c control system, we must
implementNextGen at a quicker pace," said Sturgell. "The
FAA is putting an emphasis on near- and mid-term imple-
mentation, while the Joint Planning and Development Office
(JPDO) continues its focus on long-term research and
development, and cross-agency cooperation."
FAA said that Cox's new position will incorporate the
7PD0 in addition to providing increased focus on the
modernization of the nation's air traffic control system
through the NextGen plan. JPDO help coordinate the efforts
of several federal departments and agencies, including the
Departments of Transportation, Defense, Commerce, and
Homeland Security, as well as the National Aeronautics and
Space Administration (NASA).

Naples Airport appears to be the first in the country to plan to use state-of-the-
art ADSB technology – the backbone of the NextGen satellite-based air traffic
system that is just beginning to be installed – to improve the accuracy of flight
tracking in a Part 150 Airport Noise Compatibility Program study.
The advantage of using ADSB at Naples is that the flight tracking data will be
more accurate than radar data, explained Ted Baldwin of Harris Miller Miller &
Hanson Inc., the acoustical consulting firm that is conducting the noise study.
Like rnax�y general aviation airports, Naples has no flight tracking capability and
is 40 miles away from the nearest radar facility. Because radar data degrade over
distance, the data would be less accurate at the 40-mile range than nearer the radar
equipment.
The combination of portable noise monitors and ADSB technology will give
Naples data that are the equivalent of what a permanent rioise monitoring system
would provide.
It is hoped that within a few months an ADSB antenna will be constructed at
Naples Airport so the system can be put in use. Aircraft must be equipped with

Business-sponsored legislation working its way through the Louisiana Legisla-
ture would move control of Louis Armstrong International Airport from the City of
New Orleans to a state agency which concerns officials of local jurisdictions
around the airport.
The airport is owned by the City ofNew Orleans (Orleans Parish) but is primarily
located in the City of Kenner, which is in neighboring Jefferson Parish. A small
portion of the airport's longest runway is located in St. Charles Parish.
Officials of St. Charles Parish fear that the legislation sets the stage fox construc-
tion of a new runway in their jurisdiction because it creates a new entity to run the
airport — the Southeast Regional Airport Authority — which would ha�e power
to expropriate private property to expand the airport. The City of New Orleans
cannot acquire land to expand the airport because it is located outside the city's
boundaries.
On May 19, the St. Charles Parish Council passed a resolution urging its legisla-
tive delegation to block House Bill 1272, which would create a regional airport
authority whose boundaries would incorporate JefFerson, Orleans, and St. Charles
parishes.

ADSB technology in order to be picked up by the antenna,
and the Federal Aviation Administration is not requiring all
aircraft to be ADSB-equipped until 2020 – so not all planes
will be tracked with the new technology.
But DayJet Corporation's fleet of Eclipse 500 very light jets
(VLJs) will be and that is important for the noise study
because the VLJs are a new kind of air service at Napies.
In January, DayJet – an air taxi service expanding in the
southeast — announced that Naples Airport will be part of
its "DayPort" service network. DayJet corporate members
fly "per-seat, on-demand" to and from more than �45 regional
destinations across Alabarna, Florida, Georgia, Mississippi,
and South Carolzna.
All af DayJet's air service will start and end at one of
seven DayPorts, including the one at Naples.
Naples' Part 150 study got underway in February and is
not expected to be submitted to the FAA for approval until
mid 2010.
ADSB Technology
ADSB is an acronym for Automatic Dependent Surveil-
lance Broadcast. It is new technology that allows pilots in
the air and air traffic controllers on the ground to "see" air
tra�c with far greater precision than radar provides. Aircraft
equipped with ADSB broadcast their precise position in
space along with other data (such as airspeed, altitude, and
whether they are turning or climbing or descending} via data
links. ADSB receivers that are installed in other aircraft or
integrated into air traffic facilities receive the data and
provide real-time traffic depictions both in the air and on the
ground. ADSB relies on the sateilite-based global position-
ing systern (GPS} to determine an aircraft's precise position
in space.
Unlike conventional radar systems, ADSB works on the
ground and at low altitudes so that it can be used to monitor
traffic on airport runways and taxiways. It also works in
mountainous areas where radar coverage is limited and it
does not seriously degrade with distance or atmospheric
conditions.
Last August, the FAA awarded a contract worth up to
$1.8 billion to ITT Corporation of WhitePlains, NY, to
construct the ADSB system (19 ANR 1 l 9). Under the
contract, ITT will build ground stations for the system,
which will be brought online across the country, starting in
the East Coast, portions of the Midwest, Alaska, and the
Gulfof Mexico. Nationwide coverage is expected by 2013.
ITT has begun installing the system in Florida, although
Naples Airport's ADSB antenna is not part of that contract.
Boca Raton Airport is in the process of getting an ITT-
installed ADSB antenna and also is a DayPort of DayJet air
taxis.
Paul McDermott, assistant airport manager, said that Boca
has a non-precision approach but the ADSB antenna will
allow a precision approach and provide all-weather capacity.
It also will allow curved approaches.

City ofNew Orleans $500 million in bond money in exchange
for control over the airport. The bond money would be used
by New Orleans to redevelop the city.
The legislation would establish a nine-member governing
board for the regional airport authority. Members would be
appointed by the governor from lists submitted by St.
Charles Parish, Jefferson Parish, and the City of Kenner (who
would each have one member); two members would represent
the City of New Orleans and four members would be at-large.
An amendment to the bill reduced the number of inembers
that Jefferson Parish would have from two to one and gave
the City of Kenner one member.
The New Orleans Aviation Board, which governs the
airport now, is also comprised of nine members but only two
represent communities near the airport (Kenner and St.
Charles Parish).
St. Charles Parish Councilman Larry Cochran said he was
concerned that the regional airport authority would build a
new runway in St. Charles Parish. He said he did not want
residents in his district to have more aircraft noise over their
heads.
The Parish may ha�e sarne legai leverage over expansion of
the airport. It has zoned the area that will most likely be
targeted for airport expansion for airport use. However, any
project done in that airport use zone requires Parish approval
of a special use permit.

A new study from The Netherlands identifies non-acoustic
measures that airports are using to mitigate annoyance in
surrounding communities.
The study, "Noise Annoyance Mitigation at Airports by
Non-Acoustic Measures Inventory and Initial Analysis,"
was discussed in a recent Wyle Noise Bulletin and is

The study by Ruud Vader, a communication researcher,
was commissioned by Luchtrerkeersleiding Nederland, the air
traffic control service for The Netherlands.
The study describes how and why non-acoustic factors
play an important role in determining the level of annoyance
that people experience from aircraft noise, Wyle explained in
its Bulietin. The study identifies 50 "Non-Acoustic Noise
Annoyance Mitigation Measures" (NANAMM's) that are
categorized into eight main types: community programs,
consultation, compensation, financial, information, insula-
tion, land use, and property.
The Dutch study is the most comprehensive examination of
NANAMNIs to date. Wyle said the study "found that
NANAMMs can range as broad as any measure or activity

that involves the relationship between airports and the
surrounding communities. Many NANAMMs are simple and
obvious while others are innovative and special. Such
measures include Stansted's properly value guarantee,
O'Hare's Land Use Grant, Anchorage's scheme of enlisting
volunteers to assist in disaster exercises, several airport's
environmental compensation projects, and the micro-climate
projects at Schiphol Airport. [The study] also found that the
Australia Aviation Noise Guidance materials may be hetpfui
in designing more effective communication between airports
and residents."

The U.S. Supreme Court May 12 i�uled against a church
seeking to block the City of Chicago from relocating a
cemetery to expand O'Hare Infernational Airport on the
ground that it violates First Amendment freedom of religion
protections.
The High Court declined to hear a case filed by St. John's
United Church of Christ in Bensenville, IL, where the City of
Chicago has condemned the church cemetery and ordered
graves to be relocated in order to clear a path for a new
runway that is part ofthe massive $15 billion expansion plan
for 0'Hare.
The Supreme Court ruling lets stand a decision by the U.S.
Court of Appeais for the Seventh Circuit allowing Chicago to
acquire and demolish the St. Johannes Cemeteay.
Rosemarie Andolino, executive director for the O'Hare
Modernization Program, said she was "extremely pleased"
with the High Court's ruling. "We will continue to move
forward with acquisition of the cemetery and will be contact-
ing next of kin in order to begin the relocation process."
St. John's United Church of Christ, which owns the
cemetery, as well as the suburbs of Elk G►•ove Village and
Bensenville, IL, still have a case challenging the expansion
pending in the U.S. Court of Appeals for the District of
Golumbia where they feel they have a better chance of
winning. That case challenges the finance scheme for the
O'Hare expansion plan and asserts that the Federal Aviation
Administration should not have approved federal grants to
finance the project.
Another case is pending in the DuPage County court that
chall�nges Chicago's authority to take the property needed
to expand O'Hare.
This November, Chicago is set to open the first new
runway in the airport's modernization program, which will
reconfigure the runways from an intersecting design to a
parallel configuration, with eight runways instead of the
current seven.
The city hopes to open a second new runway in 2011 but
the litigation over the cemetery rnay delay that schedule.

ON GEARE�D TURBOFAN ENGINE
Initiai data from recently-completed acoustic ground tests
show that Pratt & Whitney's new Geared Turbofan demon-
strator engine "is right on target" to meet significant noise
reduction goals, Bob Saia, Pratt & Whitney's vice president,
Next Generation Product Family, announced May 28 at the
2008 BerlinAir Show.
Pratt & Whitney expects its new engine to be 50 percent
quieter than today's jet engines and 20 dB quieter than
International Civil Aviation Organization (ICAO) Stage 4
aircraft noise certification standards.
"The ground test noise data wiil be compiled with flight
test measurements taken later this year to validate the
Geared Turbofan engine's noise signature. The significantly
lower noise of the Geared Turbofan engine is a key benefit to
airlines andoperators, giving them increased flexibility for
landing and takeoff at airports with heavy noise regula-
tions," Saia said.
The ground acoustic testing used an array of 32 individual
microphones around the engina test stand and 16 sound
pressure transducers inside the engine to get accurate data
for noise modeling.
Pratt & Whitney said its new engine "is expected to set
new standards in environmental performance and operating
value for the next generation of commercial aircraft." The
Geared Turbofan engine has a state-of-the-art gear system
that allows the engine's fan to operate at a different speed
than the low-pressure compressor and turbine. This results
in greater fuel efficiency and a slower fan speed for reduced
noise.
The Geared Turbofan demonstrator engine recently
completed Phase II ground tests and has been cleared for
flight testing on Pratt & Wl�itney's 747SP flying test bed this
summer. The Phase II ground tests began in April at the
company's advanced test facility in West Palm Beach, FL,
and focused on engine performance and ground acoustics
with the new engine's flight capable nacelle system.
Performance Targets Met or Exceeded
"The ground test program has been a complete success
and the Geared Turbofan engine has met or exceeded all
performance targets," Saia said. "This demonstrator engine
has confirmed the laboratory results of our Fan Drive Gear
System demonstrating excellent efficiency and operational
characteristics. The double-digit reductions in fuei burn,
engine noise, environmental emissions, and operating costs
we've targeted make the Geared Turbofan engine the best
solution forthe next generation of commercial aircraft."
Last year, Pratt & Whifiey's Geared Turbofan engine was
selected as the exclusivs power source for the new
Mitsubishi Regional Jet and the proposed Bombardier
CSeries. Both aircraft are expected to enter service in 2013.,

AirportNoiseMitigation Symposium Set
The 8'� Annual Airport Noise Mitigation Symposium will be held on Oct. 12-
14 in San Antonio, Texas.
Formerly known as the Sound Insulation Symposium, the conference is
presented by the symposium planning committee and the American Associa-
tion of Airport Executives. The conference brings together key players —
FAA, airports, community groups, consultants, and manufacturers of sound
insulation products — to share their collective experience.

On May 29, the FAA announced its approval of airport noise exposure

Michaei Jeck has been hired by the Metropolitan Washington Airports
Commission (MWAA) as an understudy to Neal Phillips, Manager of Noise
Abatement for MWA.A, who is preparing for retirement after long service with
MWAA but says he will not retire in the next five years.
MWAA is the proprietor of Washington Reagan Nationat Airport and
Dulles International Airport.
Jeck comes to MWAA from Philadelphia lnternationai Airpoi�t where he
served as Airport Noise Abatement Program Manager for Philadelphia
International Airport and Philadelphia Northeast Airport.
Jeck's replacement in Philadelia is Jon Collette who comes from St. Peters-
burg-Clearwater International Airport where he served as Supervisor ofNoise
Affairs.
Collette said that in his new position at Philadelphia, he wili be involved with
a Part I50 airport noise compatibility study update, a capacity enhancement
project, residential sound insulation program, and the FAA's NY/NJ/PHL
airspace redesign project.
