RESOLUTION 02-10
A RESOLUTION APPROVING A FIVE-FOOT REAR YARD SETBACK
VARIANCE FOR A HOME ADDITION FOR JOEL AND JULIA BENNETT OF
2295 APACHE STREET
WHEREAS, Joel and Julia Bennett of 2295 Apache Street have applied for a
Five -Foot Rear Yard Setback Variance for a Home Addition as proposed in Planning
Case #02-05; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on February 26, 2002; and
WHEREAS, The Planning Commission voted 4-0 (with three Commissioners
excused) to recommend that the Council approve the Five -Foot Rear Yard Setback
Variance for a Home Addition as proposed in Planning Case #02-05 be approved, due to
the small size of the lot and the City's previous practice of granting similar variances for
undersized lots in Friendly Hills.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Five -Foot Rear Yard Setback Variance for a Home
Addition for the Bennetts of 2295 Apache Street as proposed in Planning Case #02-05 is
hereby approved.
BE IT FURTHER RESOLVED that the Five -Foot Rear Yard Setback Variance
for a Home Addition for the Bennetts of 2295 Apache Street as proposed in Planning
Case #02-05 would not have an adverse impact on the health, safety, and general welfare
of the citizens of the community and the surrounding land, and would not be adverse to
the general purpose and intent of the Zoning Ordinance.
