Res 2002- 19 Approving Plan/Plat for PUD for Town CenterCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 01-19 A RESOLUTION APPROVING A PRELIMINARY DEVELOPMENT PLAN FOR A PLANNED UNIT DEVELOPMENT, A PRELIMINARY PLAT, AND A WETLANDS PERMIT FOR THE TOWN CENTER REDEVELOPMENT PROJECT WHEREAS, Ms. Carolyn Kral] of Landform on behalf of the City of Mendota Heights has applied for a Preliminary Development Plan for a Planned Unit Development, a Preliminary Plat, and a Wetlands Permit for the Town Center redevelopment project as proposed in Planning Case #02-11; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 26,2002; and WHEREAS, The Planning Commission voted 5-1 (with one Commissioner excused) to recommend that the Council approve the Preliminary Development Plan for a Planned Unit Development, a Preliminary Plat, and a Wetlands Permit for the Town Center redevelopment project as proposed in Planning Case #02-11 be approved under certain conditions. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Preliminary Development Plan for a Planned Unit Development, a Preliminary Plat, and a Wetlands Permit for the Town Center redevelopment project as proposed in Planning Case #02-11 is hereby approved under the following conditions: Parking and Transportation: a. At least one parking space per 200 gross square feet of retail space and one parking space per 250 gross square feet of office space must be provided, subject to the recommendations of the City's traffic engineer regarding shared parking. Both on and off-street parking spaces may be counted. b. Plans need to be revised to provide an entrance from Road A to the underground parking for the north townhouse building fronting on North Freeway Road. C. The applicant will continue to work with MuDOT to create a westbound exist from Highway 110 into the development. d. If a bus shelter is desired, plans must be revised to include this with appropriate grading and pedestrian access. e. Loading must be prohibited on Road A and the frontage road. f. Landscaping and traffic control must be revised as necessary for adequate traffic visibility near street and driveway intersections. Layout, Labeling, and Open Space: g. The six townhornes listed as "HOffices" in the submitted text must be labeled on the site plan. h. The area on the preliminary plat labeled as Outlet A must be relabeled as public right-of-way. i. A trail must be located between the two eastern townhomes to connect the sidewalk along North Freeway Road to the trail behind the townhomes. j. The bank and parking lot southwest of the Vet Clinic must be set back further from the northeast property line and landscaping must be added to this area. k. The Park Commission should comment on the acceptability of the proposed open space and recreation facilities. 1. The site plan should be adjusted to reflect the PUD'S setback standards. Landscaping: III. The spruce trees along the southeast side of the Vet Clinic must be preserved and protected with tree protection fence consistent with the way other trees to be saved on the site will be protected. n. At the west end of the frontage road, landscaping must be added to the median and area northeast of the South Pond. o. The landscape plan must be revised to include some additional trees on the north and south sides of the frontage road. Management: p. A plan that distinguishes between common landscapuig installed and maintained by the developer and landscaping on individual sites that is the responsibility of the individual tenants must be submitted. q. Documents must be developed to determine responsibilities for maintenance of the various elements and spaces, and how covenants and other promises of the PUD process will be kept and enforced. r. A method for communicating private association ownership and operational responsibilities to new and future residents of the project must be developed. PUD Final Development Plan: S. Building lighting plans are required at the Final Development Plan stage. t. Signs are subject to review and approval as part of the Design Guidelines and comprehensive sign plan at the Final Development Plan stage. Other Planner's Recommendations: U. All trash must be stored within the buildings. V. Grading, drainage, erosion control, utilities, soils, and street issues are subject to City Engineer review and approval. Planning Commission Conditions: W. All recommendations of the City Fire Chief are implemented, including the widening of the drive aisles. X. Setbacks are corrected along Dodd Road and other streets within Town Center. Y- The applicant clarify the plans for the entrance from Road A to the underground parking in the north townhouse building and meet the standard for the whole project of 415 parking stalls. Z. The applicant eliminate all "compact car" parking space designations. aa. Parking shall be designated for the West Neighborhood. bb. The lighting poles shall be less than 25 feet tall as specified. cc. The applicant shall identify who is to maintain the landscaping. dd. The landscape plans shall include information on the boulevard trees to the north and south sides of the frontage road. ee. Snow Removal shall be clearly specified in the plan. Additional Conditions: ff. The Developer and the City shall negotiate and execute a Development Agreement. BE IT FURTHER RESOLVED that the proposed project is consistent with the intent and direction of the City's PUD Ordinance and Land Use Plan, and that the project will be beneficial to the community at large. BE IT FURTHER RESOLVED that the Preliminary Development Plan for a Planned Unit Development, a Preliminary Plat, and a Wetlands Pen -nit for the Town Center redevelopment project as proposed in Planning Case #02-11 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
