Res 2002- 23 Approving Subdivision, Variance @ 1744 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 01-23 A RESOLUTION APPROVING WHEREAS, Inheritable World LLC has applied for a Subdivision, Variance, and Wetlands Permit to Create 19 Lots at 1744 Dodd Road as proposed in Planning Case #01- 39; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on April 23, 2002; and WHEREAS, The Planning Commission voted 3-1 (with three Commissioners excused) to recommend that the Council approve the subdivision, variance, and wetlands permit as proposed in Planning Case #01-39 under certain conditions. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Subdivision, Variance, and Wetlands Permit to Create 19 Lots for 1744 Dodd Road as proposed in Planning Case #01-39 under the above conditions is hereby approved on the following conditions: Written proof that all easement issues are resolved with the three neighbors who share the private drive. 2. Access to Dodd Road is subject to MnDOT approval. 3. All rights-of-way and street sections are subject to review and approval by the City Engineer. 4. An ingress/egress easement is provided over Lot 5, Block 1 for the Moeller and Field properties. 5. The preliminary plat is revised such that Lot 5, Block 1 has a width of 80 feet. 6. The preliminary plat is revised to illustrate a 50 -foot front yard setback for lots or portions of lots within the R -IA District. 7. Modified landscape plans are accepted as submitted. 8. Abandorunent of the existing septic system and well on Lot 5, Block 1 must conform to MPCA rules and approval of Dakota County. 9. All grading, drainage, utilities, and easements are subject to review and approval of the City Engineer. The preliminary plat must be revised to provide easements at the perimeter of each lot and over wetlands, watercourses, ponding areas, and utilities outside of the public right-of-way. 10. The developer pays a park dedication fee of $43,500. 11. Submission of evidence that all other agency permits have been issued. 12. Submission of a wetlands replacement permit request. 13. Execution of a Developers Agreement between the City and the Developer. Said Developers Agreement shall include the provision to the City of a warranty of workmanship from the developer on the designs for the stormwater ponds, surface water and hydrology plans. BE IT FURTHER RESOLVED that the Subdivision, Variance, and Wetlands Permit to Create 19 Lots for 1744 Dodd Road as proposed in Planning Case #01-39 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
