RESOLUTION NO. 02-28
RESOLUTION GRANTING EXTENSION OF EXCLUSIVE NEGOTIATION PERIOD
WITH RMF AS THE DEVELOPER FOR THE MENDOTA HEIGHTS TOWN CENTER
DEVELOPMENT
WHEREAS, the City is proceeding with the development of a mixed-use development (the
"Development"), know as the Mendota Heights Town Center, Municipal Development District No 1,
located at Highway 110 and Dodd Road (the "Development District");
WHEREAS, Ross M. Fefercorn, having his principal offices at 7625 Metro Boulevard, Suite 145, Edina,
MN 55439 (herein after "RMF") has special expertise in developments of the type proposed for the
Development District;
WHEREAS, RMF has proposed that the city designate an entity controlled by RMF as the developer to
undertake the Development, with the exception of the senior housing to be developed by the Dakota
County Community Development Agency (the "CDA"), and enter into a period of exclusive negotiation
with RMF regarding a Redevelopment Contract (the "Agreement") to undertake the Development; and
WHEREAS, pursuant to Resolution 01-67, the City granted RMF exclusive negotiation rights through
June 1, 2002; and
WHEREAS, the City staff and RMF have been making progress in negotiating the terms of the
Agreement; and
WHEREAS, the City and RMF desire to extend the exclusive negotiation rights period from June 1, 2002
through July 31,2002.
NOW THEREFORE BE IT RESOLVED The exclusive negotiation rights period to RMF for the
purpose of negotiating the Agreement to undertake the Development is hereby extended from June 1, 2002
through July 4, 2002.
