RESOLUTION 02-29
A RESOLUTION APPROVING
A THREE-FOOT SIDE YARD SETBACK VARIANCE
FOR A SECOND STORY FOR THE ATTACHED GARAGE
AT 1480 CHERRY HILL ROAD
WHEREAS, Paul R. Najarian of 1480 Cherry Hill Road has applied for a Three -
Foot Side Yard Setback Variance for a Second Story for his Attached Garage as proposed
in Planning Case #02-20; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on May 28, 2002; and
WHEREAS, The Planning Commission voted 6-0 (with one Commissioner
excused) to recommend that the Council approve the Three -Foot Side Yard Setback
Variance as proposed in Planning Case #02-20.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Three -Foot Side Yard Setback Variance for a Second
Story for the Attached Garage for 1480 Cherry Hill Road as proposed in Planning Case
#02-20 is hereby approved.
BE IT FURTHER RESOLVED that the Three -Foot Side Yard Setback
Variance for a Second Story for the Attached Garage for 1480 Cherry Hill Road as
proposed in Planning Case #02-20 would not have an adverse impact on the health,
safety, and general welfare of the citizens of the community and the surrounding land,
and would not be adverse to the general purpose and intent of the Zoning Ordinance.
