Res 2002- 35 Approving ROW, Drainage & Utility Easement VacationsCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 02-35 APPROVING STREET RIGHT-OF-WAY AND DRAINAGE AND UTILITY EASEMENT VACATIONS WHEREAS, the City of Mendota Heights is the current record owner of street right-of-way and utility easements as described as follows; STREET VACATIONS: That part of Freeway Road lying south of Lots 4, 5 and 6, Block 5, as dedicated in the plat of Jefferson Heights, Dakota County, Minnesota, and as created by statutory user and Document No. 210559 That certain roadway lying between Lot 13, Block 2, and Lot 1, Block 3, as dedicated in the plat of Mortensen's Addition, Dakota County, Minnesota and as created by statutory user and Document No. 152926 That certain easement for construction and maintenance for cuts, fills, and slopes in favor of the Village of Mendota Heights, a municipal corporation, as granted in an instrument dated October 25, 2971, filed December 8, 1971, as Document No. 392226 That certain easement for construction and maintenance for cuts, fills, and slopes in favor of the Village of Mendota Heights, a municipal corporation, as grated in an instrument dated August 31, 1971, filed September 7, 1971, as Document No. 388446 That certain street easement in favor of the Village of Mendota Heights, a municipal corporation, as granted in an instrument dated August 31, 1971, filed September 7, 1971, as Document No. 388447 DRAINAGE AND UTILITY EASEMENTS: All drainage and utility easements as dedicated over Lot 2, Block 1, on the plat of Birch Addition as amended by Certificate of Completion of Proceedings for a Vacation of Utility and Drainage Easement dated December 27, 1999, filed December 28, 1999, as Document 1662783 All drainage and utility easements as dedicated on the plat of Einess Addition and WHEREAS, a notice.,of hearing has been duly published and posted more than two weeks before the date scheduled for the hearing on said vacation, all in accordance with the applicable Minnesota Statues; and WHEREAS, a public hearing was held on said vacation on July 9, 2002 at 7:30 o'clock P.M or as soon as possible thereafter, at the City Hall of the City of Mendota Heights; and WHEREAS, the City Council then proceeded to hear all persons interested in said vacation and all persons were afforded an opportunity to present their views and objections to the grant of said petition. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the vacation of the right-of-way described above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detrimental to the health, safety and welfare of the community. 2. That the above described street right-of-way and utility vacation be and the same is hereby vacated. 3. That the City Clerk be and is hereby authorized and directed to prepare and present to the proper Dakota County officials a notice of completion of these vacation proceedings, all in accordance with the applicable Minnesota Statutes.
