RESOLUTION 02-37
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
TO REPLACE A DETACHED GARAGE WITH A NEW DETACHED GARAGE
AT 2376 LEMAY LAKE ROAD
WHEREAS, John R. Heyn of 2376 Lemay Lake Road has applied for a
Conditional Use Permit and Variance to replace his detached garage with a new detached
garage as proposed in Planning Case #02-22; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on June 25, 2002; and
WHEREAS, The Planning Commission voted 5-0 (with one Commissioner
excused) to recommend that the Council approve the Conditional Use Permit but deny the
Variance as proposed in Planning Case #02-22.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit to Replace the Detached Garage
with a new Detached Garage for 2376 Lemay Lake Road as proposed in Planning Case
#02-22 is hereby approved on the following conditions:
1. That the new detached garage be no greater than 750 square feet in size.
2. That the existing attached garage no longer be used as a garage, but only as a
workshop.
3. That all other outdoor storage be eliminated on the property.
BE IT FURTHER RESOLVED that the Conditional Use Permit to replace the
detached garage with a new detached garage for 2376 Lemay Lake Road as proposed in
Planning Case #02-22 would not have an adverse impact on the health, safety, and
general welfare of the citizens of the community and the surrounding land, and would not
be adverse to the general purpose and intent of the Zoning Ordinance.
