RESOLUTION 02-38
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR A MARTIAL ARTS ACADEMY IN THE B-1 ZONE
AT 780 SOUTH PLAZA DRIVE
WHEREAS, Greg R. Bolton of 780 South Plaza Drive has applied for a Zoning
Ordinance Amendment and Conditional Use Permit For a Martial Arts Academy in the
B-1 Zone at 780 South Plaza Drive as proposed in Planning Case #02-23; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on June 25, 2002; and
WHEREAS, The Planning Commission voted 5-0 (with one Commissioner
excused) to recommend that the Council find that the B-1 zone already allows Martial
Arts Schools as a Conditional Use under "private academies", and that the Council
approve a Conditional Use Permit For a Martial Arts Academy in the B-1 Zone as
proposed in Planning Case #02-23.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit For a Martial Arts Academy in
the B-1 Zone for 780 South Plaza Drive as proposed in Planning Case #02-23 is hereby
approved on the following condition:
1. The applicant shall provide landscaping, lighting, and signage plans for
Council review.
BE IT FURTHER RESOLVED that the Conditional Use Permit For a Martial
Arts Academy in the B-1 Zone for 780 South Plaza Drive as proposed in Planning Case
#02-23 would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
