RESOLUTION 02-43
A RESOLUTION
APPROVING A SPECIAL USE PERMIT
FOR A FOUR FOOT HIGH FENCE
AT ROYAL REDEEMER LUTHERAN CHURCH
WHEREAS, Mary R. Moore of Royal Redeemer Lutheran Church, 1960
Lexington Avenue South, has applied for a One -Foot Height Variance for a Fence as
proposed in Planning Case #02-26; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on July 23, 2002; and
WHEREAS, The Planning Commission voted 5-0 (with two Commissioners
excused) to recommend that the Council approve the One -Foot Height Variance as
proposed in Plaiming Case #02-26.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Special Use Permit for a Four Foot High Fence for Royal
Redeemer Lutheran Church as proposed in Planning Case #02-26 is hereby approved
under the following condition:
1. This Special Use Permit shall terminate if the day care use on the property ceases.
BE IT FURTHER RESOLVED that having determined that a Special Use
Permit is the more appropriate approval for this fence, the variance application for this
same fence is hereby denied.
BE IT FURTHER RESOLVED that the Special Use Permit for a Four Foot
High Fence for Royal Redeemer Lutheran Church as proposed in Planning Case #02-26
under the above condition would not have an adverse impact on the health, safety, and
general welfare of the citizens of the community and the surrounding land, and would not
be adverse to the general purpose and intent of the Zoning Ordinance.
