Res 2002- 45 Approving Variance @ 2131 Aztec LnCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 02-45 A RESOLUTION APPROVING A 2 -FOOT SIDE -YARD SETBACK VARIANCE FOR A HOME ADDITION AT 2131 AZTEC LANE WHEREAS, Chris R. Matykiewicz of 2131 Aztec Lane has applied for a 2.5 Foot Side - Yard Setback Variance for a Home Addition as proposed in Planning Case 402-29; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on July 23, 2002; and WHEREAS, The Planning Commission voted 5-0 (with two Commissioners excused) to recommend that the Council approve the 2 -Foot Side -Yard Setback Variance as proposed in Planning Case #02-29 on the following conditions: 1. The existing garage may be removed and rebuilt. 2. The garage shall have one side service door as discussed between Council and the applicant on August 6, 2002 3. The garage shall have one side window as discussed between Council and the applicant on August 6, 2002 4. The kitchen shall have at least one side window as discussed between Council and the applicant on August 6, 2002 5. The garage portion of the addition may be 8 feet from the side lot line, but the kitchen portion of the addition must be 9 feet from the side lot line. In other words, the kitchen must be "stepped back" at least one foot from the garage. 6. There shall be no outside storage between the addition and the lot line. 7. The exterior materials for the addition shall be consistent with the existing house when the addition is finished. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 2.5 Foot Side -Yard Setback Variance for a Home Addition for 2131 Aztec Lane as proposed in Planning Case #02-29 is hereby approved. BE IT FURTHER RESOLVED that the 2.5 Foot Side -Yard Setback Variance for a Home Addition for 2131 Aztec Lane as proposed in Planning Case #02-29 under the above condition would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
