Res 2002- 63 Approving Variance @ 2566 Whitfield DrCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 02-63 A RESOLUTION APPROVING AN EIGHT -FOOT SIDE YARD SETBACK VARIANCE FOR A GARAGE ADDITION AT 2566 WHITFIELD DRIVE WHEREAS, Thomas R. Marks of 2566 Whitfield Drive (Lot 16, Block 2, Kensington PUD 2nd Addition) has applied for a Eight -Foot Side Yard Setback Variance for a Garage Addition as proposed in Planning Case #02-38; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on October 22, 2002; and WHEREAS, The Planning Commission voted 4-1 to recommend that the Council approve the Eight -Foot Side Yard Setback Variance as proposed in Planning Case #02-38, and WHEREAS, the applicant represented to the Planning Commission and the City Council at their respective meetings that he has no intention of altering the existing curb cut configuration as part of this addition. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that an Eight -Foot Side Yard Setback Variance for a Garage Addition - for 2566 Whitfield Drive as proposed in Planning Case #02-38 is hereby approved, with the following circumstances as a hardship to justify the variance: 1. The unusual shape of the lot. 2. The restrictive neighborhood covenants prohibiting accessory structures. 3. The additionally wide setback because of the street on the side yard. BE IT FURTHER RESOLVED that the Eight -Foot Side Yard Setback Variance for a Garage Addition for 2566 Whitfield Drive as proposed in Planning Case #02-38 does not allow the applicant to alter the existing curb cut configuration. BE IT FURTHER RESOLVED that the Eight -Foot Side Yard Setback Variance for a Garage Addition for 2566 Whitfield Drive as proposed in Planning Case #02-38 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
