Res 2002- 64 Approving Variance @ 1423 Knollwood LnCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 02-64 A RESOLUTION APPROVING A VARIANCE TO ALLOW TWO GARAGES FOR A NEW HOUSE AT 1423 KNOLLWOOD LANE WHEREAS, Mr. Keith Heaver, on behalf of Sherwin and Diana Sieden, future residents of 1423 Knollwood Lane (legal description) has applied for a Variance to allow Two Garages for a New House as proposed in Planning Case #02-39; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on October 22, 2002; and WHEREAS, The Planning Commission voted 4-0 to recommend that the Council approve the Variance as proposed in Planning Case #02-39. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Variance to allow Two Garages for a New House for 1423 Knollwood Lane as proposed in Planning Case #02-39 is hereby approved, with the following circumstances as a hardship to justify the variance: 1. The height restrictions imposed on the house by the City's conditions for approval of this subdivision. 2. The 40' drainage and utility easement. BE IT FURTHER RESOLVED that the granting of this Variance to allow Two Garages for a New House for 1423 Knollwood Lane as proposed in Planning Case #02-39 does not permit any future modification of the house into two separate living units. BE IT FURTHER RESOLVED that the house at 1423 Knollwood Lane shall not be modified into two or more separate living quarters. BE IT FURTHER RESOLVED that the Variance to allow Two Garages for a New House for 1423 Knollwood Lane as proposed in Planning Case #02-39 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
