WHEREAS, Ronald R. Kammueller of 1250 Dodd Road (Lot 6, Block 12,
Somerset View Addition) has applied for a Three -Foot Side Yard Setback Variance for a
Garage Addition as proposed in Planning Case #02-40; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on October 22, 2002; and
WHEREAS, The Planning Commission voted 5-0 to recommend that the Council
approve the Three -Foot Side Yard Setback Variance as proposed in Planning Case #02-
40.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Three -Foot Side Yard Setback Variance for a Garage
Addition for 1250 Dodd Road as proposed in Planning Case #02-40 is hereby approved,
with the following circumstances as a hardship to justify the variance:
1. The fact that the lot is a through -lot.
2. The narrowness of the existing garage.
BE IT FURTHER RESOLVED that the Three -Foot Side Yard Setback
Variance for a Garage Addition for 1250 Dodd Road as proposed in Planning Case #02-
40 would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
