Res 2002- 73 Approving Variance @ 790 Wentworth AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 02-73 A RESOLUTION APPROVING A FIVE-FOOT FRONT YARD SETBACK VARIANCE FOR AN OPEN COVERED ENTRYWAY AT 790 WENTWORTH AVENUE WHEREAS, Russell T. R. Rider of 790 Wentworth Avenue (Auditors Subdivision #3 east 1 acre of W 2 acres of L-36 ex pt of SW quarter of Sec. 24 Twn 28 Range 23 lying W of Wentworth Meadows E of W 118.37 ft N of Evergreen Knolls V Add & S of N 280 ft) has applied for a five-foot front yard setback variance for an open covered entryway as proposed in Planning Case #02-48; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on November 26, 2002; and WHEREAS, The Planning Commission voted 6-0 to recommend that the Council approve the five-foot front yard setback variance as proposed in Planning Case #02-48. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a five-foot front yard setback variance for an open covered entryway for 790 Wentworth Avenue as proposed in Planning Case #02-48 is hereby approved based on the hardship that Mr. Rider needs reasonable use of his property, and that the addition will improve both safety and aesthetics. BE IT FURTHER RESOLVED that as a condition of this variance approval, the open covered entryway shall not be enclosed. BE IT FURTHER RESOLVED that the five-foot front yard setback variance for an open covered entryway for 790 Wentworth Avenue as proposed in Planning Case #02- 48 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
