Res 2002- 74 Denying Variance @ 837 Park Place DrCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 02-74 A RESOLUTION DENYING AN OPACITY VARIANCE FOR A FENCE AT 837 PARK PLACE DRIVE WHEREAS, David G. Drake, owner of 837 Park Place Drive (Lot 5, Block 1, Park Place) has applied for an opacity variance for fence as proposed in Planning Case #02-47; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on November 26, 2002; and WHEREAS, The Planning Commission voted 5-0 to recommend that the Council deny the opacity variance as proposed in Planning Case #02-47. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that an opacity variance for a Fence for 837 Park Place Drive as proposed in Planning Case #02-47 is hereby denied. BE IT FURTHER RESOLVED that the opacity variance for a Fence for 837 Park Place Drive as proposed in Planning Case #02-47 would have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
