Res 2014- 15 CUP 2334 Swan Drivefor recording CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2014-15 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A FENCE GREATER THAN THIRTY-SIX INCHES WITHIN THIRTY FEET OF A PUBLIC RIGHT-OF-WAY AT 2334 SWAN DRIVE WHEREAS, Lee Violet and Joe Rueckert have applied for a conditional use permit for a fence greater than thirty-six inches in height within the 30 -foot setback at 2334 Swan Drive (PID 27-64550-00-110; Lot 11, Rogers Lake Shore Addition) as proposed in Planning Case 2014-07; and WHEREAS, the Planning Commission held a public hearing on this matter at their regular meeting March 25, 2014. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use permit as outlined in Planning Case 2014-07 is hereby approved with the following findings of fact: 1. The proposed project will not negatively impact traffic visibility at the Swan Drive/Bluebill Drive intersection. 2. The proposed fence -type and height are consistent with Code requirements. 3. The fence is compatible with the established character of the neighborhood and will not negatively impact any surrounding properties. Adopted by the City Council of the City of Mendota Heights this first day of April, 2014.
