RESOLUTION 03-09
A RESOLUTION APPROVING A
6.5 -FOOT SIDE YARD SETBACK VARIANCE FOR A HOME ADDITION AND
CONDITIONAL USE PERMIT FOR A DETACHED GARAGE
AT 1293 DELAWARE AVENUE
WHEREAS, John V. Goebel of 1293 Delaware Avenue (Somerset Heights 31 E
180.04 ft. of Somerset Heights) has applied for a 6.5 -foot side yard setback variance for a
home addition and conditional use permit for a detached garage as proposed in Planning
Case #03-02; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on January 28, 2003; and
WHEREAS, The Planning Commission voted 7-0 to recommend that the Co-Lu-icil
approve the variance and CUP as proposed in Planning Case #03-02.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a 6.5 -foot side yard setback variance for a home addition
and conditional use permit for a detached garage for 1293 Delaware Avenue as proposed
in Planning Case #03-02 is hereby approved.
BE IT FURTHER RESOLVED that the 6.5 -foot side yard setback variance for
a home addition and conditional use permit for a detached garage for 1293 Delaware
Avenue as proposed in Planning Case #03-02 would not have an adverse impact on the
health, safety, and general welfare of the citizens of the community and the surrounding
land, and would not be adverse to the general purpose and intent of the Zoning
Ordinance.
