Res 2003- 20 Approving Final Plat/Plan for PUD @ St ThomasCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 03-20 A RESOLUTION APPROVING A FINAL PLAT AND FINAL DEVELOPMENT PLAN FOR A PLANNED UNIT DEVELOPMENT FOR A HOCKEY ARENA AT SAINT THOMAS ACADEMY WHEREAS, RSP Architects, on behalf of Saint Thomas Academy [legal description] had applied for a Preliminary Plat, Wetlands Permit and Preliminary Development Plan for a Planned Unit Development for a Hockey Arena as proposed in Planning Case #02-41; and WHEREAS, The City Council of the City of Mendota Heights, at their regular meeting on November 5, 2002, voted 5-0 to approve an application for Preliminary Plat, a Wetlands Permit and a Conditional Use Permit for a Planned Unit Development for a Hockey Arena for Saint Thomas Academy (949 Mendota Heights Road) as shown in Planning Case #02-41 under numerous conditions. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Final Plat and Final Development Plan for a Planned Unit Development for a Hockey Arena for Saint Thomas Academy as presented to the Council on April 15, 2003 is hereby approved on the following condition: 1. The City and the Developer shall execute a Developer's Agreement addressing issues such as hours of lighting, park dedication, sanitary sewer, watermain installation, MnDOT approval, and any other Council concerns. BE IT FURTHER RESOLVED that the Code Enforcement Officer is hereby authorized to issue any and all necessary building permits upon fulfillment of all conditions in this Resolution of Approval, in accordance with all City ordinances and State building code. BE IT FURTHER RESOLVED that the Final Plat and Final Development Plan for a Planned Unit Development for a Hockey Arena for Saint Thomas Academy as presented to the Council on April 15, 2003 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
