Res 2003- 23 Authorizing Elimination of Local Board of ReviewCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 03-23 RESOLUTION AUTHORIZING THE ELIMINATION OF THE LOCAL BOARD OF REVIEW WHEREAS, the Mendota Heights City Council has been required by Chapter 274 of Minnesota Statutes to establish a local Board of Review; and WHEREAS, the local Board of Review of the City of Mendota Heights meets annually to review the property assessments as established by the Dakota County assessor for all properties within said city; and WHEREAS Minnesota Statute 383D.73 allows governing bodies or town boards of any home rule charter or statutory city in Dakota County to transfer the duties of the city Board of Review or Board of Equalization under Minnesota Statute, Chapter 274, to the county Board of Equalization; and WHEREAS, the County Assessor's office conducts several open book meetings in March and April of each year at locations and times more convenient to residents than the local Board of Review meeting; and WHEREAS, the county Board of Equalization is authorized to meet during the months of April, May and June, thereby giving residents an increased opportunity to schedule time to appear at hearings; and WHEREAS, the City Council has reviewed the current local Board of Review process and has determined that the process can be inconvenient for taxpayers, may provide inefficient service to the public, and could be improved by transferring the review process to the county Board of Equalization; and NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Mendota Heights hereby authorizes the transfer of duties from the local Board of Review to the county Board of Equalization, effective January 1, 2004; BE IT FURTHER RESOLVED that the City Council reserves the right to reconsider the transfer of duties after two years and revert back to the local Board of Review process if it is determined that the transfer to the county proves to be inefficient or an inconvenience to local taxpayers. BE IT FURTHER RESOLVED that, barring rescission of the transfer of duties as the result of Council review in 2005, the transfer will become permanent in 2006.
