RESOLUTION NO. 03-26
RESOLUTION REQUESTING A VARIANCE FROM DAKOTA COUNTY TO ALLOW
SEVEN DRIVEWAYS ONTO COUNTY ROAD 45 (SOUTH VICTORIA ROAD) WITH 50
FEET OF RIGHT-OF-WAY FOR THE PROPOSED BUROW POND SUBDIVISION
WHEREAS, Dakota County Plat Commission voted and stipulated only one access for the
subject property onto County Road 45 (South Victoria Road) and,
WHEREAS, the City of Mendota Heights has approved the Preliminary Plat for the subject
property consisting of seven lots with individual driveways entering onto County Road 45 (South
Victoria Road) and,
WHEREAS, County Road 45 (South Victoria Road) was designed over 50 years ago and does
not comply with current Dakota County Standards, currently having lots with predominantly individual
driveways in both directions of the subject property and,
WHEREAS, County Road 45 (South Victoria Road) is more like a city street than arterial
(' ) collector county road, having been slated to be given to the city under the Dakota County turnback
program for several years and,
WHEREAS, County Road 45 (South Victoria Road) lies in both the City of Mendota Heights
and the City of Lilydale and,
WHEREAS, the project is designed to have the least impact to the Wetlands, Trees, and
Watershed using key elements as per the Dakota County SWCD "Low Impact Development"
guidelines and,
WHEREAS, police records indicate no accidents at any driveway locations over the last three
years on County Road 45 (South Victoria Road) and,
WHEREAS, the City of Mendota Heights is nearly fully developed and does not anticipate the
traffic volumes on County Road 45 (South Victoria Road) in the area of the subject property to
increase significantly as projected by the county and,
WHEREAS, the subject property is the only remaining large parcel left to be developed along
County Road 45 (South Victoria Road) and has currently 50 feet of right of way in both directions of
the subject property and,
WHEREAS, the City of Mendota Heights finds that the proposed Preliminary Plat of Burow
Pond is consistent with the current developed conditions.
NOW THEREFORE BE IT RESOLVED, that the City of Mendota Heights requests a
variance for the Burow Pond Subdivision to have seven driveways onto County Road 45 (South
Victoria Road) with 50 feet of right-of-way.
