Res 2003- 37 Approving CUP @ 1405 Sibley Memorial HwyCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 03-37 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND CRITICAL AREA PERMIT FOR A CHURCH ADDITION AT 1405 SIBLEY MEMORIAL HIGHWAY WHEREAS, BWBR Architects has applied for a Conditional Use Permit, Critical Area Permit,. and Variance for a Church Addition at 1405 Sibley Memorial Highway [legal description] as proposed in Planning Case #03-25; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on May 27, 2003; and WHEREAS, The Planning Commission voted 5-0 (with two Commissioners excused) to recommend that the Council approve the Conditional Use Permit and Critical Area Permit as presented to the Planning Commission on the evening of May 27, 2003 and as shown in Planning Case #03-25, and WHEREAS, The Planning Commission, as part of the aforementioned motion, also made a finding that no height variance was necessary for the application as presented i to the Planning Commission on the evening of May 27, 2003 and as shown in Planning Case #03-25; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit and Critical Area Permit for a Church Addition for 1405 Sibley Memorial Highway as proposed in Planning Case #03- 25 is hereby approved on the following conditions: 1. Parking stalls must be at least 20 feet long, and drive aisles adjacent to parking stalls must be at least 20 feet wide. 2. Proposed lighting for parking lots shall have no direct source of light visible from the public right-of-way or adjacent land in the "R" District. 3. Grading, utility, and erosion control plans are subject to City Engineer review and approval. 4. Some of the trees indicated to be saved on the tree preservation plan are within the grading limits. For these trees to survive, care will have to be taken to minimize the removal or addition of soil within the root zone. 5. The normal Conditional Use Permit time limit of six months shall be extended for this Conditional Use Permit for a full year from the date of approval. 6. The normal one-year time limit for building permits shall be extended to two years for this application. BE IT FURTHER RESOLVED that in accordance with the Planning Commission's recommendation, the Council also makes a finding that no height variance is necessary for the application as presented to the City Council on the evening of June 3, 2003 and as shown in Planning Case #03-25; RE IT FURTHER RESOLVED that the Conditional Use Permit and Critical Area Permit for a Church Addition for 1405 Sibley Memorial Highway as proposed in Planning Case #03-25 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
