RESOLUTION 03-43
A RESOLUTION APPROVING
A CONDITIONAL USE PERMIT AND WETLANDS PERMIT
FOR A GARDEN SHED AND RETAINING WALL AT 1812 VALLEY CURVE
WHEREAS, John Gelderman has applied for a Conditional Use Permit and
Wetlands Pen -nit for a Garden Shed, Retaining Wall, and Wildlife Pond at 1812 Valley
Curve [legal description] as proposed in Planning Case #03-23; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on June 24, 20033; and
WHEREAS, The Planning Commission voted 6-0 (with one Commissioner
excused) to recommend that the Council approve the Conditional Use Permit and
Wetlands Permit as presented to the Planning Commission on the evening of June 24,
2003 and as shown in Planning Case #03-23 on the condition that Mr. Gelderman
eliminate the wildlife pond from his plans,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit and Wetlands Permit for a
Garden Shed and Retaining Wall for 1812 Valley Curve as proposed in Planning Case
#03-23 is hereby approved on the following conditions:
1. Mr. Gelderman shall submit to the City a new plan with the originally proposed
pond removed, and shall not build the pond.
2. The SWCD and City Engineering shall review and approve all plans.
3. The Council hereby makes a finding of No Loss or Exemption as the LGU and
authorizes the Public Works Director to sign the certificate of No Loss or
Exemption.
BE IT FURTHER RESOLVED that the Conditional Use Permit and Wetlands
Permit for a Garden Shed and Retaining Wall for 1812 Valley Curve as proposed in
Planning Case #03-23 would not have an adverse impact on the health, safety, and
general welfare of the citizens of the community and the surrounding land, and would not
be adverse to the general purpose and intent of the Zoning Ordinance.
