RESOLUTION 03-65
A RESOLUTION APPROVING A HEIGHT VARIANCE
FOR A NEW HOME AT 680 HIDDEN CREEK TRAIL
WHEREAS, Thomas Milim has applied for a Height Variance for a New Home
at 680 Hidden Creek Trail (Lot 4, Block 2, Hidden Creek Estates) as proposed in
Planning Case #03-39; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on July 22, 2003; and
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that the Coimcil hereby makes the following findings:
1. The lot at 680 Hidden Creek Trail has a dual zoning of R-1 and R-lA.
2. The R-1 height limitation is the more restrictive than the R-1 A height limitation,
and is therefore the height limitation that applies to this lot.
3. This dual zoning constitutes a hardship justifying the variance.
BE IT FURTHER RESOLVED that this height variance for a New Home for
680 Hidden Creek Trail as proposed in Planning Case #03-39 would not have an adverse
impact on the health, safety, and general welfare of the citizens of the community and the
surrounding land, and would not be adverse to the general purpose and intent of the
Zoning Ordinance.
