RESOLUTION 03-66
A RESOLUTION DENYING A LOT SPLIT
AT 1316 VICTORY AVENUE
WHEREAS, Melvin Koppen has applied for a Lot Split at 1316 Victory Avenue
(Lot I Block 2 Furlong Addition) as proposed in Planning Case #03-35; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on July 22, 2003
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Lot Split for 1316 Victory Avenue as proposed in
Planning Case #03-35 is hereby denied.
BE IT FURTHER RESOLVED, that in support of the above denial, the Council
hereby makes the following findings of fact:
1. The proposed new lot has at least 100 feet of frontage on a platted public right-of-
way (Victory Avenue). As a condition of any approval of this request, the City
would require that the right-of-way of Victory Avenue be improved for its full
length. The applicant did not include this improvement as part of the plan
submitted for review by the City; and
2. Although the applicant has indicated that they will provide a cross -easement for
access of a private driveway to access the new lot through the existing lot, this
was also not part of the plan submitted for review by the City. Any such
arrangement would require a variance and was not part of the plan submitted for
review by the City, nor has the applicant provided any grading plans, site plans, or
legal wording for such an easement, and therefore the Council is unable to
approve the proposed plan.
BE IT FURTHER RESOLVED that the Lot Split for 1316 Victory Avenue as
proposed in Planning Case #03-35 as proposed would have an adverse impact on the
health, safety, and general welfare of the citizens of the community and the surrounding
land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
