Res 2003- 71 Denying Prel Plat and Variance @ 1850 Arvin DrCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 03-71 A RESOLUTION DENYING A PRELIMINARY PLAT AND VARIANCE TO CREATE ONE ADDITIONAL LOT AT 1850 ARVIN DRIVE WHEREAS, Robert Fink has applied for a Preliminary Plat and Variance to Create One Additional Lot at 1850 Alvin Drive (Lot 10 Block 3 Ridgewood Park and Part of Wachtler Avenue Accruing Thereto) as proposed in Planning Case #03-26; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on June 24, 2003. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Preliminary Plat and Variance to Create One Additional Lot at 1850 Alvin Drive as proposed in Planning Case #03-26 is hereby denied. BE IT FURTHER RESOLVED, that in support of the above denial, the Council hereby makes the following findings of fact: 1. The proposed new lot does not have 100 feet of frontage on a platted public right- of-way as required by the City of Mendota Heights Zoning Ordinance and the applicant has sought a variance from this requirement; and 2. The applicant has not demonstrated a sufficient hardship to justify the variance. BE IT FURTHER RESOLVED that the Preliminary Plat and Variance to Create One Additional Lot at 1850 Arvin Drive as proposed in Planning Case #03-26 would have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
