Res 2003-102 Denying Variance @ 1062 Wagon Wheel TrlCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 03-102 A RESOLUTION DENYING AN APPLICATION FOR A SUBDIVISION AND A VARIANCE FOR TWO ADDITIONAL LOTS AT 1062 WAGON WHEEL TRAIL WHEREAS, Timothy Gillespie has applied for a Subdivision and Variance for Two Additional Lots at 1062 Wagon Wheel Trail [Lot 4, Except Westerly 250 Feet, Lot 25, Except Parcel 226 on MnDOT RW Plat No. 19-37, All in Caroline's Lake View, Dakota County, MN] as proposed in Planning Case #03-50; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 23, 2003; and WHEREAS, The Planning Commission voted 6-0 (with one Commissioner excused) to recommend that the Council deny the Subdivision and Variance for Two Additional Lots as presented to the Planning Commission on the evening of September 23, 2003 and as shown in Planning Case #03-50. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Subdivision and Variance for Two Additional Lots for 1062 Wagon Wheel Trail as proposed in Planning Case #03-50 is hereby denied based on the following considerations: 1. This variance is not necessary in order to put the property to reasonable use. The applicant would be able to put the parcel to a reasonable use if the lots were further reduced or redesigned to provide adequate street frontage. 2. There is no unique circumstance pertaining to the property not caused by the owner justifying the variance. 3. The variance requested will alter the essential character of the neighborhood by creating a lot with less than adequate street frontage. BE IT FURTHER RESOLVED that the Subdivision and Variance for Two Additional Lots for 1062 Wagon Wheel Trail as proposed in Planning Case #03-50 would have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would be adverse to the general purpose and intent of the Zoning Ordinance.
