RESOLUTION 04- 04
A RESOLUTION MAKING THE DETERMINATION THAT THE PROPOSED
"WELLNESS CENTER" FOR 2520 PILOT KNOB ROAD
IS A PERMITTED USE WITHIN THE "I" ZONE.
WHEREAS, Mr. Scott Moe of United Properties has requested a Zoning Ordinance
Interpretation for a "Wellness Center" at 2520 Pilot Knob Road; and
WHEREAS, The City Council discussed this request at their regular meeting on
December 16, 2003; and
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that the Council hereby makes the determ ination that the proposed
"Wellness Center" for 2520 Pilot Knob Road as Mr. Moe presented to the Council that evening
is a permitted use within the "I" zone.
BE IT FURTHER RESOLVED that this determination was made on very narrow
grounds and is based on the following findings made by the City Council:
I. The Wellness Center as presented is really an educational facility which will be used to
teach about caring for individuals with diabetes; and
2. The Wellness Center is close to being a facility for "Scientific research, investigation,
testing, and experimentation" or a "Trade school" which are permitted uses in the "I"
Zone under the City's Zoning Ordinance; and
3. The Wellness Center is not a facility that wil l be used for providing medical care and
assistance to the public or individuals that come to the facility; and
4. This use is compatible consistent with the requirements of the "I" Zone.
BE IT FURTHER RESOLVED that the Council also hereby authorizes the Code
Enforcement Officer to issue any necessary building perm its for any interior work within the
building necessary to accommodate this use, contingent upon conformance with any other
applicable codes. Any exterior changes such as lighting, signage, parking, etc. will need separate
Council approval.
BE IT FURTHER RESOLVED that the Zoning Ordinance Interpretation for an
"Wellness Center" for 2520 Pilot Knob Road would not have an adverse impact on the health,
safety, and general welfare of the citizens of the community and the surrounding land, and would
not be adverse to the general purpose and intent of the Zoning Ordinance.
